PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 636] ubZ fnYyh] c`gLifrokj] flrEcj 13] 2018@Hkknz 22] 1940 No. 636] NEW DELHI, THURSDAY, SEPTEMBER 13, 2018/BHADRA 22, 1940 सड़कसड़कसड़कसड़क प�रवहनप�रवहनप�रवहनप�रवहन औरऔरऔरऔर राजमाग�राजमाग�राजमाग�राजमाग� म ंालयम ंालयम ंालयम ंालय अिधसचूनाअिधसचूनाअिधसचूनाअिधसचूना नई �द� ली, 13 िसत बर, 2018 सासासासा....काकाकाका....िनिनिनिन.... 870870870870((((अअअअ).—के��ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए मोटर यान अिधिनयम, 1988 (1988 का 59) क� धारा 212 क� उपधारा (1) क� अपे�ानुसार, भारत सरकार के सड़क प�रवहन और राजमाग� मं ालय क� अिधसूचना सं"यांक सा.का.िन. 528(अ) तारीख 6 जून, 2018 $ारा भारत के राजप , असाधारण, भाग II, खंड 3, उपखंड (i) म% &कािशत *कए गए थे, उन सभी -ि.य/ से, िजनके उनसे &भािवत होने क� सभंावना थी, उस तारीख स,े िजसको उ. अिधसूचना से यु. राजप क� &ितयां जनता को उपल1ध करा दी गई थी, तीस *दन क� अविध के अवसान से पूव� आ�ेप और सुझाव आमंि त *कए गए थे ; और उ. राजप अिधसूचना क� &ितयां जनता को 6 जून, 2018 को उपल1ध करा दी गई थी ; और उ. &ा5प िनयम/ क� बाबत जनता से कोई आ�ेप/ और सुझाव/ पर क% �ीय सरकार $ारा िवचार कर िलया गया ह ै; अतः, अब के��ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) क� धारा 110 $ारा &द9 शि.य/ का &योग करते ;ए, के��ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन<िलिखत िनयम बनाती ह,ै अथा�त् :- 1.1.1.1. संि��संि��संि��संि�� नामनामनामनाम और ार�भऔर ार�भऔर ार�भऔर ार�भ---- (1(1(1(1) इन िनयम/ का संि�? नाम के��ीय मोटर यान (@यारहवां संशोधन) िनयम, 2018 ह ै। (2) ये राजप म% उनके &काशन क� तारीख को &वृ9 ह/गे। 2. के��ीय मोटर यान िनयम, 1989 (िजसे इसम% इसके पDात् उ. िनयम कहा गया ह)ै के िनयम 92 के उपिनयम (3) के Eथान पर िन<िलिखत उपिनयम रखा जाएगा, अथा�त् :- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(3) जब कोई भाग, संघटक या संयोजन अंतरा�Hीय मानक इन िनयम/ म% अिधसूिचत मानक के Eथान पर अथा�त् ईईसी या ईसीई या जापानी क� अनुपालना करता ह,ै ऐसे भाग, संघटक या संयोजन क� अनुपालना को *कसी &ािधकृत अिभकरण या &Kयाियत &माणन अिभकरण $ारा जारी सुसंगत मानक के अनुपालन &माणप के िलए िनयम 124 और िनयम 126 के &योजन के िलए Eथािपत समझा जाएगा ।”। 3. उ. िनयम/ के िनयम 126 के दसूरे परंतुक के Eथान पर िन<िलिखत रखा जाएगा, अथा�त् :-- “परंतु यह और *क यान िविनमा�ता, जो अनु&यु. पूण�तया िनPमत इकाईय/ (सीबीयू) या पूण�तया नॉSड डाउन इकाईय/ (सीकेडी), जो दांए हाथ के िEटयUरग िनयं ण यान ह,ै का &Kय�त: या अपने &ािधकृत &ितिनिध के माVयम से यथािEथित, एम 1 या एल &वग� के यानो क� 2500 इकाईय/ का और अ�य &वगY के यान/ क� 500 इकाईय/ का आयात करता ह,ै जो अंतरा�Hीय मानक अथा�त् ईईसी या ईसीई या जापानी मानक/ का अनुपालन करते हZ, ऐसे यान/ क� अनुपालना को *कसी &ािधकृत अिभकरण या &Kयाियत &माणन अिभकरण $ारा जारी ससंुगत मानक अनुपालन &माणप $ारा िनयम 47 के अधीन िव]य और रिजE^ीकरण के िलए Eथािपत *कया गया समझा जाएगा : परंतु यह भी *क दांए हाथ के िEटयUरग िनयं ण वाले अनु&यु. यान/ के िलए, जो अंतरा�Hीय मानक, अथा�त् ईईसी या ईसीई या जापानी मानक के हZ, िजनका भारत म% पूण�तया िनPमत इकाईय/ (सीबीयू) के 5प म% वैयि.क उपयोग, &दश�न, परी�ण, अनुसंधान या वै_ािनक कायY के िलए आयात *कया जाता ह,ै ऐसे यान/ क� अनुपालना को *कसी &ािधकृत अिभकरण या &Kयाियत &माणन अिभकरण $ारा जारी सुसंगत मानक अनुपालना &माणप $ारा िनयम 47 के अधीन रिजE^ीकरण के िलए Eथािपत समझा जाएगा : परंतु यह भी *क संिनमा�ण उपEकर यान (सीईवी) का िEटयUरग िनयं ण *कसी भी एक तरफ हो सकेगा : परंतु यह भी *क ऑटोमो�टव उbोग मानक (एआईएस), *कEम अनुमोदन &*]या 115/116, भारतीय मानक (आईएस) और मानक�करण मानक अंतरा�Hीय संगठन (आईएसओ) िजनको क% �ीय मोटर यान िनयम, 1989 के अधीन अिधसूिचत *कया गया ह,ै के शुिeप , संशोधन या पुनरी�ण पुनरी�ण से िनपटने के िलए &शासिनक &*]या एआईएस-000 : 2013 के अनु5प होगी ।”। [[[[फा.... सं. . . . आरटी----11011011011036////82828282/20/20/20/2017----एमवीएल]]]] अभय दामले, , , , संयु. सिचव �टgपणः— मलू िनयम भारत के राजप , असाधारण, भाग II खंड 3, उपखंड (i) म% अिधसूचना सं. सा.का.िन. 590(अ), तारीख 2 जून, 1989 $ारा &कािशत *कए गए थे और अंितम संशोधन सा.का.िन. सं. 749 (अ), तारीख 7 अगEत, 2018 $ारा *कया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 13th September, 2018 G.S.R. 870(E).— Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R. 528 (E), dated the 6th June, 2018, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date of which copies of the Gazette containing the said notification were made available to the public;

And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. (1) Short title and commencement.- These rules may be called as the Central Motor Vehicles (Eleventh Amendment) Rules, 2018.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules), in rule 92, for subrule (3), the following sub-rule shall be substituted, namely. – "(3) Whenever a part, component, or assembly is compliant with the international standard namely, EEC or ECE or Japanese, in lieu of the standard notified in the rules, the compliance of such part, component or assembly shall be deemed to be established for the purpose of rules 124 and 126, by a certificate of compliance for the relevant standard issued by an authorised agency or accredited certifying agency.”.
3. In the said rules, in rule 126, for the second proviso, the following shall be substituted, namely: - “Provided further that in respect of vehicle manufacturer, importing into India unused completely built units (CBU) or completely knocked down units (CKD) of right-hand steering control vehicles, directly or through their authorised representative, up to 2500 units of M1 or L category of vehicles, as the case may be, and up to 500 units of other categories of vehicles annually, compliant with the international standard, namely EEC or ECE or Japanese, the compliance of such vehicles shall be deemed to be established for sale and registration under rule 47, by a certificate of compliance for the relevant standard issued by an authorized agency or accredited certifying agency:
Provided also that in respect of unused right-hand steering control vehicles compliant with the international standard namely, EEC or ECE or Japanese, imported into India as completely built units (CBU), for the purpose of personal use, demonstration, testing, research or scientific work, the compliance of such vehicles shall be deemed to be established for registration under rule 47, by a certificate of compliance for the relevant standard issued by an authorised agency or accredited certifying agency:
Provided also that the construction equipment vehicles (CEV) may have steering control on either of the side:
Provided also that the administrative procedure to deal with corrigendum, amendments or revisions to Automotive Industry Standards (AIS), Type Approval Procedures 115/116, Indian Standards (IS) and International Organisation for Standardisation (ISO) standards, which are notified under the Central Motor Vehicles Rules, 1989 shall be in accordance with AIS-000: 2013.”.

Note.-The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i),vide notification number G.S.R. 590(E), dated the 2 nd June, 1989 and lastly amended vide notification number G.S.R. 749(E) dated the 7th August, 2018.
