PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल्ली, 7 जून, 2021 सा.का.जन. 394(अ).—केन्द रीय मयटर यान जनयम, 1989 का और संियधन करने के जलए प्रारूप जनयम, मयटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथा अपेजित, भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना द्वारा भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में अजधसूचना सं. सा.का.जन. 57(अ), तारीख 29 जनवरी, 2021 द्वारा प्रकाजित दकए गए थ,े जजसमें उन सभी व् यज तयस से जजनके उनसे प्रभाजवत हयन ेकी संभावना है, उस तारीख से जजसकय उ त अजधसूचना में अंत्व् ट राजपत्र की प्रजतयां जनता कय उपलब् ध करा दी गई थं, तीस ददन की अवजध की समाज त के पूवग ्िेप और साझाव ्मंजत्रत दकए गए थ े;
और उ त राजपत्र की प्रजतयां जजसमें उ त अजधसूचना प्रकाजित की गई थी, जनता कय 29 जनवरी, 2021 कय उपलब् ध करा दी गई थी ;
और उ त प्रारूप जनयमस के संंंध में जनता से प्रा त ्िेपस और साझावस पर केन्द रीय सरकार द्वारा जवचार कर जलया गया ह ै;
अत:, अं, केन्द रीय सरकार, मयटर यान अजधजनयम, 1988 (1988 का 59) की धारा 27 द्वारा प्रदत् त िज तयस का प्रययग करते हुए, केन्द रीय मयटर यान जनयम, 1989 का और संियधन करने के जलए जनम् नजलजखत जनयम ंनाती ह,ै अथागत्:-
1. सजंि त नाम और प्रारंभ:- (1) इन जनयमस का संजि त नाम केन्द रीय मयटर यान (रहयारहवां संियधन) जनयम, 2021 ह ै।

2. केन्द रीय मयटर यान जनयम 1989 (जजसे इसमें इसके पश् चात् उ त जनयम कहा गया ह)ै के जनयम 11 के उपजनयम (1) में खंड (घ) के पश् चात्, जनम् नजलजखत खंड अंत:स्ट् थाजपत दकया जाएगा, अथागत्:- “च. ईंधन दि चालन तकनीक का ज्ञान और समझ हयना;” ।
3. उ त जनयमस में, जनयम 14 में, खंड (ड.) के पश् चात् जनम् नजलजखत खंड अंत:स्ट् थाजपत दकया जाएगा, अथागत:्- “च. जनयम 31ड. के अनासार प्ररूप 5ख में प्रत् यायन चालक प्रजििण केन्द र से प्रमाण पत्र, यदद कयई ह।ै ”।
4. उ त जनयमस में, जनयम 15 में, उपजनयम (2) के पश् चात् जनम् नजलजखत परंताक अंत:स्ट् थाजपत दकया जाएगा, अथागत:्- “परंता प्ररूप 5ख में प्रमाण पत्र धारक कय चालन परीिण की अपेिा से छूट दी जाएगी” ।
5. उ त जनयमस में जनयम 31क के पश् चात,् जनम् नजलजखत जनयम अंत:स्ट् थाजपत दकए जाएगं,े अथागत्:- “31ख. प्रत् यायन प्रा त चालक प्रजििण केन्द र- (1) कयई व् यज त केन्द रीय मयटर यान जनयम, 1989 के जनयम 126 में जनर्दद् ट दकसी परीिण एजेंसी की जसााररि पर केन्द रीय सरकार द्वारा अजधसूजचत दकसी प्राजधकृत एजेंसी या राज् य पररवहन प्राजधकरण द्वारा प्रदत् त प्ररूप 11क में दकसी प्रत् यायन के जंना मयटर यान चालन के जलए अनादेि दनेे हतेा कयई प्रत् यायन प्रा त चालक प्रजििण केन्द र स्ट् थाजपत नहं करेगा या उसका रखरखाव नहं करेगा ।
(2) उपजनयम (1) के अधीन दकसी प्रत् यायन प्रदान करने या नवीकरण के जलए प्ररूप 12क या प्ररूप 13क में, यथाजस्ट् थजत उस राज् य के राज् य पररवहन प्राजधकरण कय दकया जाएगा और जनयम 32 में जवजनर्दद् ट समाजचत ाीस संलरह न की जाएगी ।
(3) पदाजभजहत प्राजधकारी, इस जनयम के अधीन कयई प्रत् यायन प्रदान करने या नवीकरण के जलए दकसी ्वेदन पर जवचार करत ेसमय, जनम् नजलजखत जवययस कय ्यान में रखेगा, अथागत्:- ।. ्वेदक या उसके अधीन कायग करने वाले कमगचाररवंृद अच् छे नैजतक चररत्र वाले हऔ और चालन अनादेि दनेे के जलए अ्हत हऔ ;
।।. ्वेदक, जनम् नजलजखत न्द यूनतम अवसंरचना और अन्द य अपिेाएं रखता ह,ै अथागत:्- (क) वह पररसर जहां केन्द र कय चलाने का प्रस्ट्ताव ह,ै या तय ्वेदक के स्ट् वाजमत् व में ह ैया उसके द्वारा प्े पर जलया गया ह ैया उसके नाम में भाडे़ पर जलया गया ह,ै जजसका जनम् नजलजखत िेत्राल और चालन अनादिे प्रदान करने के जलए प्रययग दकए जान ेवाले यानस के जलए पयाग त पा्कग िेत्र के अजतरर्त, पयाग त अवसंरचना भी ह ै:-
(i) दापजहया, जतपजहया और हल् के मयटर यान के जलए चालक प्रजििण प्रदान करने के जलए प्रत् यायन हतेा न्द यनूतम एक एकड़;
(ii) दापजहया, जतपजहया और हल् के मयटर यान, म् यम और भारी यात्री/माल यान या रेलर ्दद के जलए चालक प्रजििण प्रदान करन ेके जलए प्रत् यायन हतेा न्द यनूतम दय एकड़;
(ख) यातायात जनयमस और जवजनयमस, चालन प्रदियाओं, यान तंत्र, जन संपकग और प्राथजमक जचदकत् सा पर ययरी किाएँ या पाठ ्ययजजत करने के जलए कं यूटर और मल् टीमीजडया प्रयजे टर जैसे जििण सहायक साम्ी या्त दय किा कि;
(ग) यानस (हल् के मयटर यान और भारी मयटर यान) के दयनस वगक के जलए साइम् यूलेटर;
(घ) ब्राड औंड कने टीजवटी ;
(ड.) पा्कग, पश्च चालन, ढलानस पर चालन ्दद कौिल हतेा प्र प्रजििणा्थयस के जलए अभ् यास करान े हतेा चालन रैक जजसमें टेढ़ा-मेढ़ा ,चढ़ावदार,8-्कार,जवपरीत समानांतर पा्कग, पश्च S-परीिण रैक भी ह ै;
(च) दापजहया यानस के मामलस कय छयड़कर , दयहरे जनयंत्रण के साथ प्रत् येक वगग का कम स ेकम एक यान ;
(छ) प्रदिगन के साथ कायगिाला;
(ज) ंायय मैररक उपजस्ट् थजत प्रणाली, ययरह य प्रजििक, ई-भागतान, वास्ट् तजवक समय मूल् यांकन, ऑनलाइन मूल् यांकन प्रदिया और प्रत् येक रेणेणी में पयाग त कमगचाररवंृद संसाधन (जििण कमगचाररवंृद, ्ई टी का्मक, सााई कमगचाररवंृद ्दद) हयने चाजहए;
[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (झ) भवन या पररसर प्रचजलत मानदंडस के अनासार हयने चाजहए;
(ञ) प्रजििणा्थयस और प्रजििकस के जलए प्रजििण यानस का जवजधमान्द य ंीमा ;
(ट) कयई अन्द य, जय अपेजित हय;
।।।. ्वेदक या अनादिे देन े के जलए उसके द्वारा जनययजजत दकसी कमगचाररवंृद सदस्ट् य के पास जनम् नजलजखत अहगताएं हस, अथागत्:- (क) दकसी मान्द यता प्रा त ंयडग या संस्ट् थान से न्द यनूतम ंारहवं पास की िैिजणक ययरह यता;
(ख) केन्द रीय या राज् य सरकार द्वारा स्ट् थाजपत दकसी संस्ट् थान या राज् य सरकार के तकनीकी जििा ंयडग द्वारा मान्द यता प्रा त दकसी संस्ट् थान से मयटर यांजत्रकी में कयसग में प्रवीणता परीिा प्रमाण पत्र या याजन्दत्रकी इंजीजनयरी में कयई उच् चतर ययरह यता के अजतरर्त पांच वयग का चालन अनाभव;
(ग) अजधजनयम की अनासूची और उसकी धारा 118 के अधीन ंनाए गए जवजनयमस में जवजनर्ददष्ट यातायात संकेतस का गहन ज्ञान;
(घ) यानस के जवजभन्द न घटकस, पाजक के कायक कय प्रद्ित करन ेऔर समझाने की िमता ;
(ड.) जसम् यूलेटर और चालन के जवजभन्द न तरीकस के उपययग कय प्रद्ित करने की िमता ;
(च) अं् ेजी या उस िेत्र जजसमें केन्द र या संस्ट् थान अवजस्ट् थत ह,ै की िेत्रीय भाया का पयाग त ज्ञान;
परंता कयई व् यज त जजसने इन जनयमस के लागू हयने से ठीक पूवग न्द यूनतम पांच वयग की अवजध के जलए प्रजििक के रूप में सेवा की हय, कय इस खंड की अपिेाओं से छूट दी जाती ह ै;
4. पदाजभजहत पदाजधकारी उपजनयम (2) के अधीन कयई ्वेदन प्रा त हयने पर और उसका यह समाधान हय जान े के पश् चात् दक ्वेदक ने उपजनयम (3) की अपेिाओं का पालन दकया है, ऐसे ्वेदन की प्राज त से साठ ददन की अवजध के भीतर प्ररूप 11क में प्रत् यायन प्रदान या नवीकृत कर सकेगा ।
5. प्रत् यायन के जलए कयई ्वेदन पदाजभजहत पदाजधकारी द्वारा तं तक अस्ट् वीकृत नहं दकया जाएगा जं तक दक ्वेदक कय सानवाई का अवसर नहं दे ददया जाता ह ैऔर ऐसे इन्द कार करने के कारण जलजखत में प्रत् यायन प्रदान करने वाल े प्राजधकारी द्वारा संसूजचत न कर ददए गए हस;
स्ट् प् टीकरण:- इस जनयम के प्रययजनस के जलए “पदाजभजहत पदाजधकारी” से ऐसा अजधकारी अजभप्रेत ह ैजय राज् य पररवहन प्राजधकारी की पंज त से नीचे का न हय या केन्द रीय सरकार द्वारा अजधसूजचत प्राजधकृत एजेंसी का पदाजभजहत कमगचारी ह;ै 31ग. प्रत् यायन और उसके नवीकरण की अवजध – प्ररूप 11क में प्रदान दकया गया कयई प्रत् यायन पांच वयग की अवजध के जलए प्रवृत् त रहगेा और प्ररूप 13क में, उसकी समाज त की तारीख से कम से कम साठ ददन पूवग, ्वेदन पर उस पदाजभजहत प्रजधकारी द्वारा जजसने प्रत् यायन प्रदान दकया ह,ै नवीकरण के जलए ददया जा सकेगा:
परंता उ त प्रत् यायन की जवजधमान्द यता, जवजहत मानदडंस कय पूरा करन े के अधीन रहते हुए जय पदाजभजहत पदाजधकारी या दकसी अन्द य प्राजधकारी जय राज् य सरकार द्वारा वा्यक ्धार पर इसके प्रययजन के जलए जवजहत की जाए, सत् याजपत की जाएगी। 31घ. प्रत् यायन की दसूरी प्रजत जारी करना – (1) यदद जनयम 31ख के उपजनयम (4) के अधीन प्रदान दकया गया प्रत् यायन दकसी भी समय खय जाता ह ैया न् ट हय जाता ह,ै तय प्रत् यायन का धारक उस पदाजभजहत पदाजधकारी कय तारंत संसूजचत करेगा जजसन ेप्रत् यायन प्रदान दकया ह ैऔर उ त प्राजधकारी कय दसूरी प्रजत के जलए जलजखत में ्वेदन करेगा;
(2) पदाजभजहत पदाजधकारी, जनयम 32 में जवजनर्दद् ट समाजचत ाीस के साथ दकसी ्वेदन की प्राज त पर “दसूरी प्रजत” स्ट् प् ट रूप से जचन्द हांदकत करते हुए प्रत् यायन की दसूरी प्रजत जारी करेगा;
(3) यदद प्रत् यायन की दसूरी प्रजत जारी करने के पश् चात,् मूल प्रजत प्रा त हय जाती ह,ै तय वही उस पदाजभजहत प्राजधकारी कय जजसने इसे जारी दकया था, तारंत अभ् य्पत दकया जाएगा ;
31ड. प्रत् यायन धारक द्वारा पालन की जान ेवाली साधारण ित – जनयम 31ख के अधीन प्रत् यायन प्रदान दकया गया कयई धारक, -
(i) प्ररूप 14 में इले रयजनक रजजस्ट् टर और दकसी वयग के दौरान भतती दकए गए जव्ा्थयस के नामस की वणागनासार सूची रखेगा;

(ii) जनयम 31 ञ में जवजनर्दद् ट पा्यकिम के अनासार प्रजििण पा्यकिम का संचालन करेगा;
(iii) प्ररूप 5ख में पा्यकिम पूरा करन ेवाले प्रत् यके जव्ाथती कय प्रमाण पत्र जारी करेगा;
(iv) प्रत् यायन जारी करन ेवाले प्राजधकृत प्राजधकारी कय इस अ् याय के प्रययजनस के जलए समय-समय पर मांगी गई सूचना प्रस्ट् तात करेगा;
(v) प्रत् यायन जारी करन े वाल े प्राजधकारी के पूवग जलजखत अनामयदन के जंना प्रत् यायन में उजल् लजखत पररसर कय स्ट् थानांतररत नहं करेगा;
(vi) प्रजििण प्रदान करने वाल ेप्रययग में लाए जान ेवाल ेसभी मयटर यानस पर नाम, केन्द र का पूरा नाम और टेलीायन संख् या सास्ट् प् ट रूप से मयटे अिरस में प्रद्ित करेगा;
(vii) प्ररूप 15 में, प्रत् यके प्रजििणाथती द्वारा प्रत् येक ददन चालन पर जंताए घंटस की संख् या द्ित करत े हुए अलग से ररकाडग ंनाए रखेगा;
(viii) अपने कायागलय में प्रमाख स्ट् थान पर जनम् नजलजखत का प्रदिगन करेगा- (क) पदाजभजहत प्रजधकारी द्वारा केन्द र कय जारी दकए गए प्रत् यायन की मूल प्रजत, और (ख) केन्द र द्वारा जनययजजत प्रजििकस के नाम, पते और मयंाइल संख् या;
(ix) केन्द र से प्रजििण प्रा त करन ेके जलए ्वेदन करन ेवाला कयई व् यज त दकसी भी रीजत में रामामक कायग नहं करेगा जजससे, इन जनयमस के अनासार से जभन्द न, ऐसे व् यज त कय कयई प्रत् यायन प्रा त करन ेहतेा उसकी ययरह यता के रूप में या इस अ् याय के उपंंधस की पररवंचना हतेा दकसी व् यज त कय दकसी कायग कय करने या करन ेका लयप करने की मौनानामजत नहं देगा। 31च. प्रत् यायन चालक प्रजििण केन्द रस की लेखा परीिा –
(1) पदाजभजहत पदाजधकारी, जनयजमत लेखा परीिा के मा् यम से केन्द र के कायक और उनके द्वारा जनयमस की अनापालना की जनगरानी करेगा । लेखा परीिा का कायग प्राजधकृत प्राजधकारी द्वारा इस जनजमत् त प्राजधकृत दकसी अजधकारी द्वारा दकया जा सकेगा ।
(2) केन्द र ंारंंार हयन ेवाली लेखा परीिाओं के अ् यधीन हयगा । पहली लेखा परीिा केन्द र के संचालन के प्रारंभ हयने के तीन मास के भीतर और तत् पश् चात ्प्रत् यके वयग में एक ंार ्ययजजत की जाएगी ।
(3) केन्द र कय पा्यकिम संपूणग करने की तारीख से जपछले पांच वयग के जलए प्रजििण हतेा उपलब् ध कराए गए दस्ट् तावेजस का रखरखाव करना अपेजित हयगा । ऐसी लेखा परीिाओं की लागत केन्द र द्वारा वहन की जाएगी ।
(4) अनासूजचत लेखा परीिाओं के अलावा, प्राजधकृत प्राजधकारी द्वारा केन्द र में ्कजस्ट् मक जनरीिण भी दकया जाएगा । कायागलय समय के दौरान दकसी भी समय जनरीिण के समन्द वय और इसे सिम ंनान े हतेा केन्द र का प्रंंधन उत् तरदायी हयगा ।
(5) केन्द र, लेखा परीिा के प्रययजन के जलए जनम् नजलजखत दस्ट् तावेजस का रखरखाव करेगा,-
(i) इलै राजनक उपजस्ट् थजत रजजस्ट् टर;
(ii) केन्द र कय चलान ेका प्रत् यायन पत्र;
(iii) भूजम प्ा या स्ट् वाजमत् व दस्ट् तावेज;
(iv) प्रजििकस और प्रजििणा्थयस की पात्रता ययरह यता जस्ध करने संंंधी दस्ट् तावेज;
(v) प्रजििण यान स्ट् वामी दस्ट् तावेज;
(vi) प्रजििण प्रदान करन ेसंंंधी दस्ट् तावेज। 31छ. प्रत् यायन रद य या जनरस्ट् त करन ेकी पदाजभजहत प्राजधकारी की िज त – (1) यदद पदाजभजहत पदाजधकारी, जजसने प्रत् यायन प्रदान दकया ह,ै का यह समाधान हय जाता ह ैतय प्रत् यायन धारक कय सानवाई का अवसर देन ेके पश् चात,् यदद वह – (क) जनयम 31ख के उपजनयम (3) में जवजनर्दद् ट अपेिाओं का अनापालन करने में जवाल रहता ह ै;या (ख) ऐसे यानस का जजनके द्वारा अनादेि ददए जान ेहऔ, का अच् छा रखरखाव करने में जवाल रहता है;
(ग) प्रजििण प्रदान करन ेमें जनयम 31ञ में जवजनर्दद् ट पा्यकिम का पालन करने में जवाल रहता ह;ै या [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 (घ) जनयम 31ड. के दकसी अन्द य उपंंध का उल् लंघन करता ह ैतय वह ऐसे कारणस कय लेखं्ध करते हुए, जनम् नजलजखत ्देि कर सकेगा,-
(i) दकसी जवजनर्दद् ट अवजध के जलए प्रत् यायन जनलंजंत करना; या
(ii) प्रत् यायन जनरस्ट् त करना ।
(2) जहां प्रत् यायन उपजनयम (1) के अधीन जनलंजंत या जनरस्ट् त दकया जाता ह,ै प्रत् यायन प्रमाण पत्र उसके धारक द्वारा पदाजभजहत पदाजधकारी कय अभ् य्पत दकया जाएगा। 31ज. अपील – जनयम 31ख के उपजनयम (5), जनयम 31ग या जनयम 31छ के अधीन पदाजभजहत प्राजधकारी द्वारा दकए गए दकसी ्देि से व् यजथत कयई व् यज त ऐसे ्देि की प्राज त की तारीख से तीस ददन के भीतर, यथाजस्ट् जत, यदद प्रत् यायन के जलए ्वेदन राज् य पररवहन प्राजधकरण कय दकया जाता ह,ै सजचव (पररवहन) या उस राज् य के पररवहन ्या त जजसमें केन्द र अवजस्ट् थत ह,ैकय और केन्द रीय सरकार द्वारा अजधसूजचत प्राजधकृत एजेंसी कय प्रत् यायन ्वेदन करने की दिा में केन्द रीय सरकार कय, अपील कर सकेगा । 31ठ. अपील की प्रदिया- जनयम 31ज के अधीन कयई अपील, पदाजभजहत प्राजधकारी के ्देि के ्िपेस के ्धार उजल् लजखत करते हुए, ज्ञापन प्ररूप में दय प्रजतयस में की जाएगी और जनयम 32 में जवजनर्दद् ट समाजचत ाीस तथा उस ्देि जजसके जवरु्ध अपील की जानी ह,ैकी सत् याजपत प्रजतजलजप संलरह न की जाएगी ।
(2) अपीलीय प्राजधकारी पिकारस कय सानवाई का अवसर ददए जाने के पश् चात् और ऐसी और जांच करने के पश् चात,् यदद कयई ह,ै जय यह ठीक समझे, ऐसी अपील प्राज त की तारीख से पऔतालीस ददन की अवजध के भीतर समाजचत ्देि पाररत कर सकेगा । 31ञ. प्रत् यायन चालन प्रजििण केन्द रस द्वारा मयटर यान चालन में प्रजििण देन ेके जलए पा्यकिम- (1) मयटर यान चालन में प्रजििण दनेे के जलए जनम् नजलजखत पा्यकिम हयगा – (क) हल् के मयटर यान चालन ;
पा्यकिम के प्रारंभ की तारीख से सभी खंडस में पा्यकिम की अवजध चार स ताह में 29 घंटे ह ै। इन्द हें दय भागस, ययरी और प्रैज टकल, में जवभाजजत करना ह:ै- ययरी-8 घंटे ययरी जवयय घंटे चालन ययरी; 1 यातायात जििा; 2 मूल यान तंत्र ययरी प्रदिगन; 1 जनसंपकग और प्राथजमक उपचार; 1 सड़क जि् टाचार और व् यवहार सड़क रेज; 1 दाघगटनाओं और मामलस के अ् ययन के कारण; 1 चालन ईंधन दिता; 1 प्रैज टकल- 21 घंटे जवयय घंटे मूल प चालन अभ् यास(चालन रेंज में) ; 2 कािल चालन अभ् यास (चालन रेज में) ; 2 ्ामीण और राज् यमागग सड़क चालन अभ् यास; 2 िहर की सड़कस में चालन अभ् यास (घन ेऔर लेन यातायात में) ; 4 चढ़ावदार और ढ़लान चालन ; 2 ररवसग, पा्कग; 2 जसम् यूलेटर प्रजििण (प्रारंभ, वयाग, कयहरा, रात ्दद) ; 4 चालन ईंधन दिता; 1 ययरी परीिण और मलू् यांकन; 2 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
1. चालन ययरी-1 1 अपना यान जनयंत्रण जाने ऑटयमयंाइल ईंजन और उनके कायग करने का सरल पररचय;
2 पैर जनयंत्रण पैर जनयंत्रण, ए सीलेटर, लच-जडपर (वतगमान मॉडल में नहं ह)ै ;
हाथ जनयंत्रण जस्ट् टयंरग व् हील, हऔड बै्रक, हानग, लाइट, वाइपर, इजरह निन जस्ट् वच, स्ट् टाटगर, जडपर और इंजडकेटरसग;

(2) उपयाग्त पा्यकिमस के अजतरर्त, केन्दर जविेय प्रकार की ड्राइववग ्वश्यकताओं जैसे खतरनाक और जयजखमवाले समानस, ाायर रकस, एं ांलेंस, िॉार ड्राइवर, जडलीवरी वेन, जवस्ट्ायटक और वस्ट्प्रकलर रकस, ााकग जलफ््स ंस, प्रजििण कायगिालाओं कय ल ेजा रह ेयानस में जविेयज्ञता देन ेवाले पा्यकिमस और कायगिमस कय प्रदान करने का जवकल्प भी [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 13 चान सकती ह ै। इन प्रचालनस के जलए अजतरर्त प्रजििण की ्वश्यकता हयती ह ैजय इन पा्यकिमस के मा्यम से संंयजधत की जा सकती ह ै।
(3) उपरय्त पा्यकिम राष्ट्रीय कौिल जवकास जनगम (एन एस डी सी) और मानकीकरण, परीिण और गाणवत्ता प्रमाणन (एस टी यू सी) के मागगदिगन और ्वश्यकताओं के अनासार हयना चाजहए ।
(4) प्रजििाओं की उपजस्ट्थजत की जनगरानी कड़ाई और ंाययमैररक प्रणाली द्वारा अजभजलजखत हयनी चाजहए, जहॉं प्रजििण पश्चात ्पात्रता के जलय ेमानदडं पचासी प्रजतित हयगा । इस मानदडं कय परूा नहं करन ेवाल ेकय अंजतम मलू्यांकन से अवश्य ही जवव्जत कर ददया जाना चाजहए और ड्राइववग प्रजैटस में उपजस्ट्थजत की कमी या असालता के जलए प्रजििण अवजध ्वश्यकतानासार ंढ़ाई जा सकती ह ै।
(5) ययरी साथ ही साथ प्रैजटकल का अंजतम मलू्यांकन उत्तीणग करन ेका न्दयनूतम मानदंड साठ प्रजतित ह ैऔर प्रजििाओं जजन्दहसने संस्ट्थान द्वारा ्ययजजत ड्राइववग परायरमेंस परीिा उत्तीणग की ह ैकय मयटरयान जनरीिण के पास एल एम वी / एचएम वी ड्राइववग लाइसेंस पृष्ांकन के जलए भेजा जाएगा ।
(6) सभी ययरी पपेरस और मयटरयान जनरीिक के द्वारा ली परीिा पास हयने के पश्चात,् प्रजििाओं के ्वश्यक जववरण के साथ उत्तीणग प्रमाणपत्र की एक प्रजत भी संंंजधत ्र टी र कय भेजी जाएगी ।

57 (E), dated the 29 th January, 2021 in the Gazette of India, Extraordinary, Part-II, section 3, sub-section (i) inviting objections and suggestions from all persons likely to be affected before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public;
Whereas, copies of the said Official Gazette in which the said notification were made available to the public on the 29 th January, 2021;

Now, therefore, in exercise of the powers conferred by section 27 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short Title and commencement. - (1) These rules may be called the Central Motor Vehicles (Eleventh Amendment) Rules, 2021.
(2) They shall come into force with effect from 01st day of July, 2021.
2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred to as the said rules), in rule 11, in subrule (1), after clause (d), the following clause shall be inserted, namely: - ―(e) knowledge and understanding of fuel efficient driving technique;‖.
3. In the said rules, in rule 14, after clause (e), the following clause shall be inserted, namely: - ―(f) Certificate from accredited driver training Center in Form 5B as per rule 31E, if any.‖.
4. In the said rules, in rule 15, after sub-rule (2), the following proviso shall be inserted, namely: - ―Provided that the holder of certificate in Form 5B shall be exempted from requirement of driving test‖.
5. In the said rules, after rule 31A, the following rules shall be inserted, namely: - “31B. Accredited Driver Training Centers. — (1) No person shall establish or maintain an accredited driver training center for imparting instructions for driving motor vehicles without an accreditation in Form 11 A granted by the State Transport Authority or any authorised agency notified by the Central Government on recommendation of any testing agency referred in rule 126 of the Central Motor Vehicle Rules, 1989;
(2) An application for the grant or renewal of an accreditation under sub-rule (1) shall be made in Form 12 A or Form 13 A, as the case may be, to the State Transport Authority of the State in which the center is situated and shall be accompanied by appropriate fee as specified in rule 32.
(3) The designated authority shall, while considering an application for the grant or renewal of an accreditation under this rule, have regard to the following matters, namely: — I. the applicant and the staff working under him are of good moral character and are qualified to give driving instructions;
II. the applicant maintains the following minimum infrastructure and other requirements, namely: —
(a) the premises where the center is proposed to be conducted is either owned by the applicant or is taken on lease by him or is hired in his name, spread over: -
(i) Minimum One acre – for accreditation for imparting driver training for two wheelers, three wheelers and Light Motor vehicle;
(ii) Minimum Two acres for accreditation for imparting driver training for two wheelers, three wheelers, Light Motor vehicles, Medium and Heavy Passenger /Goods vehicles or Trailers etc.
and it has adequate infrastructure besides adequate parking area for the vehicles meant to be used for imparting instructions in driving;
(b) Two class-rooms with teaching aids like computers and Multimedia Projector for holding theory classes or lessons on Traffic Rules and Regulations, Driving Procedures, Vehicle Mechanism, Public Relations and First Aid;
(c) Simulator(s) for both the classes of vehicles (Light Motor Vehicle and Heavy Motor Vehicle);
(d) Broadband connectivity;

(e) Driving tracks including Serpentine, Up-gradient, 8 shaped, Reverse parallel Parking, Reverse S Test Tracks to provide practice to the trainees for maneuvering, parking, reverse driving, driving on slopes, etc.;
(f) Minimum one vehicle of each class of vehicles with dual control except in case of two wheelers;
(g) Workshop along with exhibits;
(h) Should have biometric attendance system, qualified instructors, e-payment, real time evaluation, online evaluation process and adequate staff resources in each category (Teaching staff, IT personnel, cleaning staff etc.);
(i) Building or premises should be as per prevailing norms;
(j) Valid Insurance of the training vehicles for trainees and trainers;
(k) Any other, as may be required;
III. The applicant or any member of the staff employed by him for imparting instructions possesses the following qualifications, namely: —
(a) a minimum educational qualification to be passed in the 12th standard with a recognised Board or Institution;
(b) a driving experience of not less than five years in addition to a Proficiency Test Certificate in a course in motor mechanics or any other higher qualification in mechanical engineering from an institution established by the Central or a State Government or from an institution recognised by the Board of Technical Education of a State Government;
(c) thorough knowledge of traffic signs specified in the Schedule to the Act and the regulations made under section 118;
(d) ability to demonstrate and to explain the functions of different components and parts of the vehicles;
(e) ability to demonstrate usage of simulators and different modes of driving;
(f) adequate knowledge of English or the regional language of the region in which the center or establishment is situated:
Provided that any person who has served as an instructor for a period of not less than five years immediately before the commencement of these rules, is exempted from the requirements of this subclause.
(4) The designated authority may, on receipt of an application under sub-rule (2) and after satisfying that the applicant has complied with the requirements of sub-rule (3), grant or renew an accreditation in Form 11A within a period of sixty days from receipt of such an application.
(5) No application for accreditation shall be refused by the designated authority unless the applicant is given an opportunity of being heard and reasons for such refusal are communicated in writing by the licensing authority.
Explanation.— For the purposes of this rule "designated authority" means an officer not below the rank of the State Transport Authority or designated official of authorised agency notified by the Central Government.
31C. Duration of an accreditation and renewal thereof. — An accreditation granted in Form 11 A shall be in force for a period of five years and may be renewed on an application in Form 13 A made to the designated authority which granted the accreditation, not less than sixty days before the date of its expiry:
Provided that the validity of the said accreditation shall be subject to fulfilling the criteria as prescribed, which shall be certified by the designated authority or any other authority as, may be prescribed for the purpose by the State Government on an annual basis.

31D. Issue of duplicate accreditation. — (1) If at any time an accreditation granted under sub-rule (4) of rule 31B is lost or destroyed, the holder of the accreditation shall forthwith intimate the loss to the designated authority which granted the accreditation and shall apply in writing to the said authority, for a duplicate;
(2) On receipt of an application along with the appropriate fee as specified in rule 32, the designated authority shall issue a duplicate accreditation clearly marked "Duplicate";
(3) If after the issue of a duplicate accreditation, the original is found, the same shall be surrendered forthwith to the designated authority by which it was issued.
31E. General conditions to be observed by the holder of an accreditation. — The holder of an accreditation granted under rule 31B shall, —
(i) maintain an electronic register in Form 14 and an alphabetical list of the names of the students admitted during the year;
(ii) conduct the training course according to the syllabus specified in rule 31J;
(iii) issue to every student who has completed the course a certificate in Form 5B;
(iv) submit to the designated authority which granted the accreditation such information as may be called for by it from time to time for the purposes of this Chapter;
(v) not shift the center from the premises mentioned in the accreditation without the prior approval in writing of the designated authority, which granted the accreditation;
(vi) exhibit in a conspicuous manner on all the motor vehicles used for imparting instructions the name, full address of the center and the telephone number, in bold letters;
(vii) maintain a record separately for each trainee showing the number of driving hours spent every day, in Form 15;
(viii) display at a prominent place in its office the following: — a. the accreditation in original issued to the center by the designated authority, and b. the names, addresses and mobile numbers of instructors employed by the center;
(ix) not act in a manner calculated to mislead any person making an application to receive istructions from the center as to his ability to procure an accreditation for such person other than in accordance with these rules or to connive with any person in acts of commission or omission with a view to circumventing the provisions of this Chapter.
31F. Audit of Accredited Driver Training centers. — (1) The designated authority shall monitor the operation of the center and compliance to these rules through regular audits also that The audits may be conducted by an officer authorised in this behalf by the designated authority.
(2) The center shall be subjected to recurring Audits where The first audit will be conducted within three months from the starting of operations of the center and thereafter once every year.
(3) The center needs to maintain the documentation of training provided for last five years from the date of completion of course. The cost of such audits will be borne by the center.
(4) Apart from scheduled Audits, the center might also be subjected to surprise Audits by the designated authority. Management of the center shall be responsible for enabling and coordinating inspection at any point of time during office hours.
(5) The center shall maintain the following documents ready for audit purpose:
i. Electronic Attendance register;
ii. Accreditation to run the center;
iii. Land lease or ownership paper;

v. Training Vehicles Ownership papers;
vi. Training delivery documents.
31G. Power of the designated authority to suspend or revoke accreditation. — (1) If the designated authority which granted the accreditation is satisfied, after giving the holder of the accreditation an opportunity of being heard, that he has— a. failed to comply with the requirements specified in sub-rule (3) of rule 31B; or b. failed to maintain the vehicles, in which instructions are being imparted, in good condition;
c. failed to adhere to the syllabus specified in rule 31J in imparting instruction; or d. violated any other provision of rule 31E, it may, for reasons to be recorded in writing, make an order, — i. suspending the accreditation for a specified period; or ii. revoking the accreditation.
(2) Where the accreditation is suspended or revoked under sub-rule (1), the accreditation certificate shall be surrendered to the designated authority by the holder thereof.
31H. Appeal.—Any person aggrieved, by any order of the designated authority made under sub-rule (5) of rule 31B, rule 31C or rule 31G may, within thirty days of the date of receipt of such order, appeal to Secretary (Transport) or Transport Commissioner of the State in which the center is situated if the application for accreditation is made to State Transport Authority and in case of application of accreditation made to authorised agency notified by the Central Government, to the Central Government, as the case may be.
31I. Procedure for appeal. — (1) An appeal under rule 31H shall be preferred in duplicate in the form of a memorandum, setting forth the grounds of objections to the order of the designated authority and shall be accompanied by a certified copy of the order appealed against and appropriate fee as specified in rule 32.
(2) The appellate authority, after giving an opportunity to the parties to be heard and after such further enquiry, if any, as it may deem necessary, pass appropriate orders within a period of forty-five days from the date of receipt of such an appeal.
31J. Syllabus for imparting instructions in driving of motor vehicles by accredited Driving Training Centers. — (1) The syllabus for imparting instructions in driving of motor vehicles shall be as follows: — A. Light Motor Vehicle Driving The duration of the course in all segments is 29 hours in the span of maximum 4 weeks from the date of commencement of the course. These are to be divided into 2 segments, Theory and Practical.

(iii) Traffic Rules and Regulations;
(iv) Emergency handling techniques;
(v) Maintenance & fuel conservation;
(vi) Pollution and environment;
(vii) Case studies on accidents to analyze the cause of accident, who was at fault and how it could have been averted.
A practical skill test and theoretical behavioural analysis test to be conducted for such drivers to understand and analyze their improvement areas and give special focus on those areas during the course of training. Simulators may be used to train & assess such drivers in particular.
(2) Apart from above mentioned courses, the center may also choose to provide courses and programs specializing in particular type of driving requirements like Vehicles carrying Dangerous or Hazardous goods, Fire Trucks, Ambulance, Chauffeur Driver, Delivery Van, Explosive and Sprinkler Trucks, Forklifts, Center Bus, Training Workshops. Whereas these operations require additional training requirement which can be addressed through these courses.
(3) The above courses should be in accordance with the National Skill Development Corporation (NSDC) and Standardization, Testing and Quality Certification (STQC) guidance and requirements.
(4) The attendance of the trainees should be strictly monitored and recorded through biometric system where the criterion for eligibility post training shall be eighty-five percent. Anyone not completing this criterion must be debarred from final evaluation and for shortage of attendance or failure in Driving Practice the training period may be extended as per requirement.
(5) The minimum criteria to pass the final evaluation of theory as well as practical is sixty percent and the trainees who passed the Driving Performance Test conducted by the Institute will be sent to Motor Vehicle Inspector for LMV/ HMV Driving License Endorsement.
(6) After passing in all Theory Papers and Motor Vehicle Inspector's Test, the Proficiency Test Certificate will be issued to the trainees and thereafter A copy of the passing certificate along with the necessary details of the trainees will also be sent to the concerned RTO for issuance of driving license.‖.
