Ard u'herea-s. after reconsideration of the matter in lighl of rhe findings of rhe investigarion conducted by cBl, it had been decided that a review of the registration of the above-mentioned products granted under section 9(3) cf the lnsecticides Act. 1968 (hereinaftcr referred to as the Act) may be carried out by the Registration Committee (hereinafter refened to as RC) and its recommendation on the .issue of cancellation or continuation of registration conveyed to Department of Agriculture & Cooperation (hereinaf,er relerred to as DAC):

furd u,,hereas. RC, in its 3106 meeting held on 30.06.2010 decided to constilute a committee to undertalie a fresh review of the products in question of DAS and the said Cornrnitt-ee considered the matter and submitted its report 10 RC:

De-NociI crop protection Ltd., presently knourn as DAS, a subsidiary of M/s. Dow chemicals company, USA for the products (i) Acetamiprid Technical (Pride) (ii) Acetamiprid 2u/o Sp Formulation and (iii) Chlorpyriphos l0% Granules @ursban I 0G) as these were obtained by the registrant by adopting unethical practic€s, and also decided that the registration of Chlorpyriphos 50plo + Cyperrnethrin 5% EC (NurelleNurelle- D/Nurelle D-505) issued to the registrant u/s 9(3) b€ withdrawn/cancelled because of uethical practices adopted by the registrant and safety ftigher toxicity) of the fomrulation as well as due to availability of altematives, and firther decided that subsequent 9(4) registarions issued for Chlorpyriphos 5V/o + CyPrmethrin 5% EC shall also be withdrawn/cancelled;

And whereas having considered recommendations of RC and the material available on record" a notice was issued to DAS (formerly known as lv{/s De-Nocil crop protection Ltd) on

25.05.2011 to show cause within I 5 days of receipt of the notice why the certi{icates of Registration issued to the company u/s 9(3) of the lnsecticides Ac! 196g, for the above mentioDed products should not be cancelled by the cental Govemment in exercise of po-*ers n/s 27(2) of the Insecticides Act, 1968;

And whereas, DAS sought additional 3 weeks' time to consult their attorney whereupon extension of time upto 30.06.201 I for frling the reply was given;

And u'hereas, M/s Dua Associates representing DAS, in a letter dated 27.06.2011 asked for additional documents and also filed a preliminary reply dated 30.06-2011 to the show cause notice;

And u'hereas additional documents w-ere provided to DAS r.ide letter of even number dated I L07.201I and a hearing w.as fixed on I0.08.201 1;

And whereas, Dua Associates representing DAS. in a letter dated 01.08.201 I s-,aled that only copies of a part of the documents had been supplied and while making additional submissions also asked for specific documents to be supplied ro them;

And u-hereas in the hearing held on 10.08.201l, preliminary submissions were made by the attomey Ms. Romola Kamani and Dr. Suresh Ramachandran, country Manager and Shri fllimanav Gaur on behalf of DAS and Dr. s.K. K]rurana on behalf of clB&RC and plea for supply of additronal documents of D.A,S rvas noted;

And whereas on behalf of DAS fotlowing substantive submissions were made vide letters 30.06.201 1,01.08.2011 and 24.08.2011 and in hearings held on 10.08.201 I and on

30.08.201 l:

(i)Thataspersection2ToftheAc!underwhichnoticedated25.05.20llwasissued, the only basis for cancellation of registration.of an insecticide is if use of the insecticide-istikelyloiwolyesuchrisktohwnanbeingsoranimalsaslorenderil earydient or necessary to lalre immediale action " Clause (2) of section 27' which is a corollaryofclause(l),providesrhatifasaresultofitso'Uim,ifivestigation,oronthe basisofa,report,rcceivelfromtheStateGovemmearld,afierconsultalionu,ith theRegistrationCommioee'theCentralGovernmentis'satisfied'thatuseofsaid insecticide, viz., the insecticide u,hich has been prohibited for sale/distribution/use under clause (1) for the time being, is or is not likely to cause any such risk [as menlioned in clause (l)] then the central Govemmetrt may pass such order (including an order refusing to register the insecticide, or cancelling the certificate ofregistration thereof (if grantetl) as it deems fit in the circumstances of a case The basic minimum requirementssetforthinsection2Thzvenotbeenfollowed.Therewasneitheran 'investigation' undertaken by the Centrai Governm'ent nor was there any 'consultation' with Regisration Committee [as contemplated in section 27(2)] None of rhe factors mentioned for invocation of the extraordinary power of section 27(2t exist in the instant case.

(ii) That extraneous rationale mentioned in the notice is alleged illegal gratilication/extension of pecuniary advantage for expeditilrg product registrations which is the subject matter of ongoing judicial action' This aspect is not a permissiblebasisforRegistrationCommittee'sconsiderationwhosejurisdiction under the Act is limited oJy lo ,regisler insecticides sJler scrutinizing their formulae and verifiing claims made by the importer or manufacturer' as lhe case mo1 be' as regards their effcacy and safety to human beings and oimals "

(iii)TlutDAChasresortedtosuccessivereviewsofregistrationsdespitetherebeingno statutory or other provision for doing so' The Registration Commiuee examined and review. erl the suDDorting materials ior the said products on two occasions' viz" in ?8D" 4 {7u-{ l8 THE GAZETTE OF INDIA ; EXTRAORDINARY lP.Aru II-sEi. i(ii[ 2007 and in 2011 without asking DAS to participate in such reviews ' ln 227i meetiDg of RC held on 27.M.2m7 '.The Committee concluded that no inJbrmolion with reference to safety and efiicacy of this product were overlooksd at the fime of grant of registration and the qplications were conplete as per guidelines of the RC in vogue., This shows that any alleged palments have no connection to the 'safetv and efficacy' of lhese products.

(ir) That an expert committee was then appointed by RC for re-review which was chaired by the same oflicials who participated in and concluded the first review. Dr. T.P.

Rajendran. Assistant Director General @P). ICAR and Dr. S.K. Khuran4 SpecialiS Gradej who were appointed as members of the expert committee constituted in June 2010 were also part of the review committee constituted in June 2007. The report of the expert comnrittee (of 2010) was replete with conjectures and surmises and it did not have a lot of necessary materiaVinforrnation in relalion to the issue. Nonetheless, rhe expert. committee did not find any technical deficiency in the said products or regi stration thereof.

(v) That in its 3156 meeting. RC upheld a.rd affirmed that there u,as nothing untoward or even illegal as regards the registration of the said products. Despite DAC seeking a .detailed note clarifoing technical aspects of the recommendations' from RC. none uas prepared by RC. In its 3l8d meeting held on 27.04.2011. F-C noted that the decision for withdra*al/cancellation of Acelamapirid Technical and its formulation \\.as not taken ,due to anl,adterse technical ospccls o,f these products'. 1l vt'as furthcr noted that rhe RC u.as s,zli.-r79e d on the elJicacy o.f target pests as u ell as on thc sq/el,' tc human beings and animols of Acelamiprid Technical and its Jbrmulation. there is no justification to completel)t elimirate the products from lhe country" It was also noted that these products are u'idely used in cotton crop of the country and 'no cdverse impact o.f these products has been reporled an agricullure .from any olher country, u,here lhey are regisrered. ' In case of Chtorpyrifos 10% G also, RC (as noted in its 318s meeting) is 'satisfied v,ith its bio eJficacy to turget pests and also noted that there is no adverse impact of this formulation in agriculture'. These statements undermine proposed action as RC did not view these Products as involving 'risk to humon beings or animols'. As to registration of Chlorp;riphos 50% + cypermethrin 5% EC formulation, neither the said notice nor the minutes of various meetings offer any scientific studies or gfounds. The conclusion of expert committee and RC that combination of ctrlorpriphos and Clpermethrin is more hazardous than individual components is not valid as it is based on numerical values of LDso in rats and mice even though data shorvs that LDso values are well uithin the Worlci Heaith orga:rization's classification of Ctass II for hazard polential. As per data rt-hile the acute LD5s values for the combination pnxluct are numerically less than the 1 I I qrq II-E!-c 3(ii)] qr{d i5l IIGItH : 3IIlgFul l9 individuat partners it does not represent a hazard potential more than the individual partners, Consequentiy, RC has vioiateci section 27(2) b1' proposing cancellalton even after finding the products safe and efficacious. Neither the Central Govemment nor RC is permitted to canceUwithdraw registratiom of the aid products as sought by the said notice. The Central Govemment has invoked the extiaordinary provisions of section 27 in the past only in those circumstances uhen an insecticide posed risk to human beings/animals.

(vi) That allegations of unethical practices and investigation by cBI have been in the knowledge of RC and the Central Government since 2007 and pending adjudication before the Courr ofrhe Special Judge. Ambala. It was in light ofiuch allegations lhar in June 2007, RC .critically evaluated' the informatior/data of said products and concluded that the granl ofregistrations was proper and no information with reference to safety and efficacy of said products was overlooked at the time of grant of registrations. Affer 3 1,ears, a show cause notice rvas issued for blacklisting DAS lor alleged '..inethica! practices for obtaining registlaiioll' oi said products in u'ake of unprecedented publicitl and propaganda pursuant to judgment delircred on

07.06.2010 by the Court of the Chief .ludicial I\4agistrate. Bhopal, in a pending criminal trial in Bhopal Gas Leak case eYen though there is neither any corporate connection nor an1' other connecljon benYeen DAS and anl' aspect of the Bhopal Cas l.,eak case. The Central Govemmenl blacklisted DAS for a period of {ive years Vtde order dated 16.09.2010. Despite taking such unduly harsh measure, the ceniral Gorcrnment no\Y proposes to Vex D.AS again rvhich amounts to double jeopardy and severe r ictimization.

(vii) Thar ir is apprehended that the centrat Government had made up ils mind to canccl registrarions of the products around or at the same time of issuing the blacklisling order:

(viii) That it appears as a judicial process for inquiry and trial into the alleged acts of irnpropcr pa.'-ments has already' been set inlo molion. the notice amounts to intcrlerence with the judicial process and is not $'arranted u'hile thc crinlinal case remains pending before thc Courl;

(ix) Thal use of trade mark/brand names ofthe products mentioned in the notice, instead of their technical/chemical names is improper as these are regislered trademarks ol' DAS under the Trademarks Act. I999 and thus afford an entirel).' differenl proteclion under the extant inlellectual property la\\'sl

(x) That. therefore. the notice desen'es to be recalled/revoked"i.r'ithdrau'n, n T}IE GAZETTL OF INDIA: EXTRAORDINARY fP.ART ll -SE.. 3(ii)l And whereas, the replies filed on behalf of DAS and submissions made in the hearings have been coosidered by the competent authority in DAC with following observations pointwise:

(D Insecticides are toxic suhtanc€s and require to be regulated with a view to prcvent risk to human and animal health and matten connected therewith under the Insecticide Act and the Rules ft'amed thereunder. Registration is a critical process in regulation of insecticides as this process is responsible for scrutiny to ensure that the insecticide is safe and efficacious. It is central to the scheme of the Act. Nothing must be allowed to corrpromise the integrity of registration prccess. In the instant case, investigation by CBI has brought out that bribe was paid to a key offrcial ofRC to expedite registration ofspecific products of DAS (then De-Nocil). The issue raised by DAS is whether the basic requirements necessary to take action under section 27, i.e., 'invesligation', 'consullation with RC' nd 'satisfoction' with regard to risk of the products in question to human and animal health have actually been followed, The facts are that after publication of media reports regardlng payment of bribe for expediting regisration of products, a preliminary inquiry was ordered by the Central Government and on the basis of findings of that inquiry, CBI was asked to conduct further inquir,v for action under Prevention of Comrption Act if required. The inquiry conducted by CBI brougbt out details of bribery and to whom and how it was paid. Bribe was paid to the then Plant Protection Adviser IPPA) rvho has been charge-sheeted by CBI. PPA not only heads the Directorate of Plant Protection, Quarantine & Storage (DPPQ&S) but is also a key member of RC. CBT has also reported that the accounts of lr4/s De-Nocil (now DAS) u'ere manipulated shouing bribe amourt as incidental expenses uith the approval of the then lv'lanaging Director of t^he company. On the basis of this izvesrrgarion, RC u'as asked by DAC to canl' out a fresh review of products for registmtion of which the bribe *as paid. RC got the products revier,r'ed and recommended cancellation/withdraual of registration all four products - in case of three products adoption of unethical practices by the company *as cited as the reason by RC and in case of fourth product adoption of unethical practices as wcll as of violation of a guideline of registralion were cited as reasons. The int'estigotion by CBI utd consultation u,ilh RC have brought out that unethical practice adopted by the company by bribing a key official of RC compromised integnty of the process of registration. The question is whether such bribery atrected assessment of safety of company's products. Maintaining integriryof registration process is critical to ensure proper assessment of safety and efficacy cf insecticides so registered. under the .Act. It is obviorrs that bribery for ;nJflumging the process of registration compromises integnty of the process. (iii) of safety and efficacy of the product has been properly done. This is a serious matter because any deficiency in assessment of safety and efficacy of insecticides can have adverse implications for human and animal health and also on effective protection of crops from pests. Given this position, it is clear that compromising integrity .of registration process by bribing also compromises assessmeDt of safety and efficacy of insecticides subjected to such process. The argument that the safety of the products was not affected is not tenable because a situation wherein integnty of registration process is compromised has the potential of compromising safety of the product as well. Even if the safety is not actually compromised, rhe porential for comprornising safety is created. This is neither mere conjecture nor a rcmote possibility: In the instant case, fresh rcview by RC has bmught out that an important guideline conceming toxicity of combination products (i.e. product having more than one active ingredient) was not adhered to without any justification on record and' therefore, RC has recommended cancellation of registration of this product (Chlorpyriphos 50% + cypermethrin 5o/o EC) inter alra because of higher toxicit-v of the formulation. If the integnty of the registration process hcluding assessment of safety of insecticide has to be mainfained, an act of bribery of member of RC in connection with registration has to be viewed as an attack on integrity of the process and has to be dealt with effectively. If this was not done, faith of stalieholders including the public in sanctity of the process would falter; further, it would invite further such attacks. The cenral Govemment would, therefore. be failing in its duty to uphold the integrit-v of registration process and consequently the safety of products subjected to registration process, if it did not accept the rccommendation of RC to cancel registration oi products for r*'hich unethical practic€ of bribery was resorted to on behalf of tbe company.

To enable RC to fulfrl its mandate under the Act, it is imperative that the integrity of registration process is maintained and any act of compromising the process dealt with effectively. As illegal gratification/extension of pecmiary advantage compromises registration process, including assessment of safety of the product brought out in subparagraph (i) above, it cannot be held as an exhaneous consideration' Review of insecticides, including multiple revieus of the same insecticide' is well withinthecomp€tenceoftheRegistrationCommitteeandtheCentralGovemment [sectiong(3C)'sectionllandlT(2)].Severalinsecticideshavebeenreviewed;some of them have been reviewed several times' ln a number of cases' based on such rel,ierr,s,certificatesofregistrationhaveheencancelledortheirconditionsvaried' The power of review of registration is a logical corollary to power of grant of registtation. otherwise it would not be possible to var-v or cancel lhe registration once granted in spite of new information that mighr come to lighl' Rerieu of registration ?9te 6t)tt-6 i

2. THE CAZETTE OF INDIA : EXTRAORDINARY IPaRT n-SDc. 3(iil of pesticides is a common practice adopted by the pesticide regisering authorities the world over.

(iv) Facts on record show that the first review was carried out in 2007 by a committee headed by Dr. B.S. Phoga! the then Joint Director (Weed Science), Shd V.

Bhatnagar, the then Deputy Director (Chemistry) and Shri L. Ananth, the then Section Officer. The review carried out in 2010 was by an expert commifiEe headed by Dr. T.P. Rajendran, Assistant Director General (PP), ICAR and having Dr. S.K.

Khurana Specialist Grade-I, Dr. (I\,Irs.) Sarita Bhalla, Joint Director (Toxicology), Shri A.K. Bandopadhyay4 Deputy Director @ntomology) and Ms. Kamlesh Miglani, .Assistant Director (Chemisry) as members. This expert committee inter alia concluded th^l "taith regard to Nurelle D formulatio4 there is a serious apprehension about the loricity of the mixture of Chlorpyriphos and Cypermethrin is higher than that of the indiidual pesticides. "

(v) Ir is true that RC recommended cancellation of certificate of registration obtained by M/s De-Nocil (now DAS) jn respect of the products Aceramiprid Technical, Acetamiprid 20% SP formulation and CbJolpyriphos l0% Granules because of adoption of unethical practices by the registrant and not because it found these products unsafe. lt is for this reason that RC did not recommend cancellation of registrations granted to othet companies under section 9(4) for the same products.

The case for cancellation of certificate of registration f<rr these products is based on adoption of unethical practices by the registrant which compromised assessment of safetv of the products and thereby created a likelihood of risk to humans and animals u'hich cannot be ignored f<rr reasons enumerated in sub-parapxaph (i) of this parapraph.

ln case of Chlorp-vriphos 50?ir + Clpermetlrin 5% EC formulation RC decided in its 3 l5s meeting held on 22.02.2011 that the registration lle "v'irhdrau cancelled because of unethical praclices adopled by the regislranl and safey' of thc J'ormulalion as well as due to ovailability af ulternatives. " Toxicity of the active ingredient in an insecticide is measured in terms of LDso value r*hich denotes the (lethal) dose which kills half of the tested population. LDso is a general indicator ofa substance's acute toxicity and is usually expressed as the mass of substance administered per unit mass of test subject, such as grams of substance per kilogram of body mass. Stating it tltis way allows the relative toxicity of different substances to be compared. and norrnalizes for the variation in rhe size of the animals exposed. Lower the LDso value, higher is the toxicity. Rule 19 ofthe Insecticides Rules, 1971, lays down the following classifi cation of insecticides:

1 I t 1 I qrq - .-s!-s 3(iD] qRiI iFI II!trlEt : SI{ITqRsl 23 Classification ofthe insecricides As per toxicology data submitted by M/s De-Nocil, acute oral toxicity (rat) of Cypermetbrin is 1,562.62 mg&g, that of Chtorpyriphos is 224.567 mg/kg and for chlorpyriphos + cypemethrin it is 159.48 mg/kg. It is obvious that cypermelhrin is less toxic than chlorpyriphos. It could be expected that toxicity of their combination would lie somewhere in-between (i.e., between 1,562.62 mglkg and 224 567 mgkd' Hou,ever, their combination gives a toxicity (159.a8 mg/kg) which is higher than toxicity of either component. This is because synergism in chemicals in each active ingredient occurs sometimes when they are combined giving rise to a combination which is more toxic than either of its constituent ingredienrs. RC's guideline on data requirements for combinalion products,states that " Evidence in support that the combinqtion is not more huardous than individual insecticides should be submitted-' ln the agenda note for registration of this producr it was clearly stated that "In fiet qf aboye data submission on various toxiciry paramelers ds per the guidelines ol the Regisrration commiltee it is erident lhat the combinotion product i-t more loxic than the individuol components, i.e-, Chlorpy'iphos 500 and Cypermethrin 50 EC in case ofacuteoraltoxiciryRatandacuteoralfuxicityMice.Asperguidelinesofthe Registration Committee for the registration of combination product' the evidence is reiuired in suPport that lhe combination is not more huardous than individual insecticides." Despite this input, RC approved registration of the product in its l69s meeting held on 17 .07 .1997 without specifying rcasons for ignoring the guidelines set byitselfanditisonlyafterthefreshreviewfollowinginvestigationbyCBlthis omissionwasbroughttolighrandRCrecommendedwithdrawaVcancellationof certifi cale of regisfation.

This contention of DAS was refut€d on behalf of Secretariat of CIB&RC for not being in conformity with the classification of pesticides in the Insecticides Rules. As per classification in the Rules, Cyperrretbrin is moderately toxic (bright blue) while Chlorpldphos is higlly toxic @right yellow) Their combination is in highly toxic range ftright yellow) with higher toxicity than that of Chlorplriphos. This is a situation which was not permitted by RC's guidelines. Thercfore, RC's recommendations made in its 3146, 3156 and 3l8e meetings for withdrawaVcancellation of certificate of registration issued under section 9(3) for Ch.lorpyriphos 50% + Cypermethrin 5% EC formulation to DAS alongwith withdrawaVcancellation of 9(4) registrations on grounds of safety (higher toxicity) are based on rational and valid criteria It is for this reason that it is not possible to accept the conlention of Crop Care Federation of India made in their representation dated 14.04.201 1 that 9(4) registration of Chlorpyriphos 50% + Cl,permethrin 5% EC should be continued for having been widely accepted by Indian farmers for broad-spectrum control of insect pesf.s in field crops, declared safe for manufacture, storage, distribution and use and placed in the same classification as that of solo formulations. Also, there is no need for hearing compariies holding registrations of the product Chlorpytiphos 50% + Cypermethrin 5% EC under section 9(4) as rhey are not registrant under section 9(3) u'herein safety aspects are exanrined.

('t,i) Re'r'elations during the course of CBI's investigation necessitated another revieu'of registrarions granted for the company's products earlier. Fiesh review brought out that grant of registration 10 the company's products by RC earlier and subsequent revieu, in 2007 ignored an important guideline relating to data requirements for registration of combination products. These events have no conneclion with crirninal trial in Bhopal Gas Leak case. For act of bribery, prosecution under criminal law does not preclude proccedings for liabilities ofcivil nature under relevant laws. Thus it wor:ld be erroneous to conclude tlat proceedings under the Prevention of Comrption Act and those under the Insecticides Act constitute double jeopardy which precludes only subsequent criminal proceedings. Double jeopardy does not preclude ordinary civil or administrative proceedings agains a p€rson who already has been prosecuted for the same act or omission. There is no commonality in blacklisting of DAS and proceedings under the lnsecticides Act either. In blacklising, the Central Govemment has simply exercised its administrative and legal nght as a procurer of pesticides to not procure Producls of DAS in conformity with guidelines of DGS&D. Proceedings uoder the Insecticides Act are for proper regulation of insecticides as per the scheme ofthat law which includes measures for prevention of risk to human beings and animals.

(vii) No ground for apprehension of predetennined action on part of the Government should exis as action under section 27(2) lns been taken up based on recommendations of RC after due consideration of the matter.

(viiD Procredings under criminal law do not preclude proc€edings under the lnsecticides Act which has different aims and objecs.

(ix) In the label and the leaflet which arc part of the certificate of registrariol b'rand names of the products in question are also mentioned. When the company has proposed and accepted association of chemical name with brand name in the certificate of registration, it is disingenuous 10 argue at this stage that the notice should not have reflected any such association.

(x) Having considered the matter in its entLety, it would not me€t the ends of juSice if the serious damage caused to the integrity of the process of registration and thereby impairing the capacity of tbe regulalor (i e., the Registration Committee) to dispassionately and objectively assess ttre safety aspect of tbe products is allowed to go by uithout action rmder 27(2) ofthe Act.

And now, therefore, having considered the recommendations of the Registration Committee made in its 31+6, 3l5s antl 318h meetings, the submissions dated 30.06.201 l,

01.08.201 I and 24.08.2011 as also submissions made in rhe hearings held on 10.08.201 1 and

30.08.201 I on behalf of IWs Dow Agro Sciences and the submissions made on behalf of RC, it is hereby ordered that the Certificates of Regisration for Acetamiprid Technical, Acelamiprid 20% SP Formulalion, ChlorpFiphos 107o Granules Formulation and Chlorpyriphos 50% + Cypermethrin 5% EC Formulation under section 9(3) the Insecticides Act, 1968 in the name of tnlls oe-Nocit crop Protection Ltd (now M/s Dow Agro Sciences) are hereby cancelled- lt is also hereby ordered that all Certificates of Registration under section 9(4) for Chlorpyriphos 50% + Cy,permethrin 5% EC Formulation are cancelled. A period of two years is allowed for disposingofexistingstocksbyrespectivecompanies.TheRegistrationCommitteeandState Governments shalt ensure implementation of this order' [F.
