PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय ऄजधसचूना नइ ददल्ली, 7 जून, 2021 सा.का.जन. 393(ऄ).—केन्द्रीय मोटर यान ऄजधजनयम, 1989 (1988 का 59) की धारा 212 की ईपधारा (1) की ऄपेक्षानुसार केन्द्रीय मोटर यान जनयम, 1989 का और संिोधन करन े के जलए, भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की ऄजधसूचना सा.का.जन. संखयांक 144 (ऄ) तारीख 2 माचग, 2021 द्वारा ईन सभी व्यजियों से, जजनके ईनस ेप्रभाजवत होने की संभावना थी, प्रारूप जनयम भारत के राजपत्र, ऄसाधारण, भाग 2, खंड 3, ईपखंड (i) में प्रकाजित दकए गए थ,े ईस तारीख से जजसको ईि ऄजधसूचना से युि राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थी, तीस ददन की ऄवजध के ऄवसान से पूवग अक्षेप और सुझाव अमंजत्रत दकए गए थ े;
और राजपत्र की प्रजतयां जजसमें ईि ऄजधसूचना प्रकाजित की गइ थी, जनता को 2 माचग, 2021 को ईपलब्ध करा दी गइ थीं ;
और ईि प्रारूप जनयमों की बाबत जनता से प्राप्त अक्षेपों और सुझावों पर कें रीय सरकार द्वारा सम्यकतः जवचार दकया गया ह ै;

1. (1) आन जनयमों का संजक्षप्त नाम केन्द्रीय मोटर यान (बारहवा संिोधन) जनयम, 2021 ह ै।
(2) य ेजनयम राजपत्र में ईनके प्रकािन की तारीख को प्रवृत्त होंगे।
2. केन्द्रीय मोटर यान जनयम, 1989 (जजसे आसमें आसके पश्चात् ईि जनयम कहा गया ह)ै के जनयम 126ग के पश्चात ् जनम्नजलजखत जनयम ऄंतःस्ट्थाजपत दकया जाएगा, ऄथागत् :- “126घ. राजपत्र में प्रकािन की तारीख से ऄठ्ठारह मास के पश्चात ् जनयम 126 में जनर्ददष्ट समय-समय पर यथासंिोजधत परीक्षण ऄजभकरण एअइएस-017-भाग6:2020 संपणूग यान सुरक्षा ईत्पादन की पुजष्ट (डब्ल्यूवीएससीओपी) परीक्षणों का संचालन ईसमें ऄजधकजथत प्रदिया के ऄनुसार ईि तारीख को और ईसके पश्चात ् जवजनर्ममत या अयाजतत यानों पर जजन्द्हें जवजनमागता के संयंत्र या अयातक के पररसर से जलया जाएगा तादक यह सत्यापन दकया जा सके दक क्या ये यान ईन जनयमों के ऄनुरूप हैं जजनके ऄधीन ईनका जनयम 126 के ऄधीन दकस्ट्मानुमोदन दकया गया ह ै:
परंत ुआस जनयम में ऄंतर्मवष्ट कोइ बात कें रीय सरकार द्वारा जनयम 126 के ऄनुसार दकस्ट्म ऄनुमोदन ऄपके्षा य या ईत्पादन ऄपेक्षा य की पुजष्ट से छूट प्राप्त यानों को लाग ूनहीं होगी ।”;
3. ईि जनयमों के जनयम 126क में, “जांच भी संचाजलत करेगा” िब्दों के स्ट्थान पर, “टेल पाआप ईत्सजगन जांच भी संचाजलत करेगा” िब्द रखे जाएंगे । [फा. सं. अरटी-11036/18/2021-एमवीएल] ऄजमत वरदान, संयुि सजचव रटप्पणः मूल जनयम भारत के राजपत्र, ऄसाधारण, भाग 2, खंड 3, ईपखंड (i) में ऄजधसूचना सं. सा.का.जन. 590(ऄ), तारीख 2 जून, 1989 द्वारा प्रकाजित दकए गए थ ेऔर ऄंजतम संिोधन सा.का.जन. सं, 343(ऄ), तारीख 25.05.2021 द्वारा दकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 7th June, 2021 G.S.R. 393(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways, number G.S.R 144(E), dated the 2nd March, 2021, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification was published were made available to the public;
And, whereas, the copies of the said Official Gazette in which the said notification was published were made available to the public on the 2 nd March, 2021;
And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: —
1. Short title and commencement.—(1) These rules may be called as the Central Motor Vehicles (Twelfth Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), after rule 126C, the following rule shall be inserted, namely: - “126D. After Eighteen months from the date of publication of this notification in the Official Gazette, the testing agencies referred to in rule 126, shall conduct Whole Vehicle Safety Conformity of Production (WVSCoP) tests as specified in AIS-017-Part 6:2020, as amended from time to time, in accordance with the procedures laid down therein, on vehicles, manufactured or imported on and after the said date drawn from the manufacturer’s plant(s) or the importer’s premise(s), to verify whether these vehicles conform to the rules to which they have been type approved under rule 126:
Provided that nothing in this rule shall apply to the vehicles exempted by the Central Government from type approval requirements as per rule 126 or conformity of production requirements.”;
3. In the said rules, in rule 126A, for the words, “also conduct tests”, the words, “also conduct tailpipe emission tests” shall be substituted.
