औि उ त प्रारूप धनयमस की बाबत जनता से कोई ्िेप औि सावाव प्रा त नहं ुए हैं;
अत:, अब, केन्द द्रीय सिकाि, मोटि यान अधिधनयम, 1988 (1988 का 59) की िािा 110 की उपिािा (1) द्वािा प्रित् त शध तयस का प्रयोर् कित ेुए केन्द द्रीय मोटि यान धनयम, 1989 का औि संशोिन किन ेके धलए धनम् नधलधखत धनयम बनाती ह,ै अथागत:्--
1. (1) इन धनयमस का संधि त नाम कें द्रीय मोटि यान (सोलहवां संशोिन) धनयम, 2017 ह ै
(2) इन धनयमस में यथाउपबंधित के धसवाय, य ेिाजपत्र में उनके प्रकाशन की तािीख को या छह मास की अवधि की समाध त के प चात् प्रव्त् त हसर् े
2. कें द्रीय मोटि यान धनयम, 1989 में,-
(i) धनयम 96र् में, ‘‘्ईएस 12207:1999’’ अििस औि अंकस के स् थान पि, ''्ईएस 12207:2014'' अिि औि अंक िखे जाएरं्;े
(ii) धनयम 98ख के उपधनयम (2) में, ‘‘्ईएस 11859:1986’’ अििस औि अंकस के स् थान पि, ‘‘्ईएस 11859:2004’’ अिि औि अंक िखे जाएरं्;े 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(iv) पा वग शी्ग 115च. ‘‘ईंिन खपन मानिडं’’ के स् थान पि धनम् नधलधखत पा वग शी्ग िखा जाएर्ा औि यह 5 अ तूबि, 2016 से प्रव्त् त ु् समवा जाएर्ा अथागत्:-- ‘‘115छ. ईंिन खपन मानिडं’’ [फा. सं. ्िटी-11028/01/2017-एमवीएल] अभय िामल,े संया त सधचव स् प् टीकािक ञापन भाित के िाजपत्र, असािािण, भार् II, खंड 3, उप-खंड (i), तािीख 5 अ तूबि, 2016 में अधिसूचना सं. सा.का.धन. 954(अ), तािीख 4 अ तूबि, 2016 द्वािा प्रकाधशत केन्द द्रीय मोटि यान (16वां संशोिन) धनयम, 2016 द्वािा केन्द द्रीय मोटि यान धनयम, 1989 का संशोिन किते समय पा वग शी्ग ''धनयम 115छ. ईंिन खपत मानिंड'' के स् थान पि अनविानता से उसे ''धनयम 115च. ईंिन खपत मानिडं'' के रूप में उधल् लधखत दकया र्या था 5 अ तूबि, 2016 से धनयम 2 के खंड (iv) में धनयम 115छ. के प्रवतगन की तािीख का उल् लेख किने से दकसी व् यध त के धहत पि कोई प्रधतकूल प्रभाव नहं पड़ता ह ै रट पण : मूल धनयम भाित के िाजपत्र, असािािण, भार् II, खंड 3, उप-खंड (i) में अधिसूचना सं. सा.का.धन. 590(अ), तािीख 2 जून, 1989 द्वािा प्रकाधशत दकए र्ए थे औि अधिसूचना सं. सा.का.धन. 1433(अ), तािीख
20.11.2017 द्वािा अंधतम संशोिन दकया र्या MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 27th November, 2017 G.S.R. 1461(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 1113(E), dated the 29th August, 2017 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) inviting objections and suggestions from affected persons before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public;
Whereas, copies of the said Gazette notification were made available to the public on the 29 th August, 2017;
And whereas, no objections and suggestions have been received from the public in respect of the said draft rules.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: —
1. (1) These rules may be called the Central Motor Vehicles (Sixteenth Amendment) Rules, 2017.
(2) Save as otherwise provided in this rules, they shall come into force on and after the expiry of six months from the date of their publication in the Official Gazette.
2. In the Central Motor Vehicle Rules 1989,—
(i) in rule 96 C, for the letters and figures “IS 12207:1999”, the letters and figures “IS 12207:2014” shall be substituted;
(ii) in rule 98-B, in sub-rule (2), for the letters and figures “IS 11859:1986”, the letters and figures “IS 11859:2004” shall be substituted;

(iii) in rule 112, in the fourth proviso, for the letters, figures and word “IS 12239 (Part 1) -1988”, the letters, figures and word “IS 12239 (Part 1):1996” shall be substituted;
(iv) for the marginal heading “115F. “Fuel consumption standard”, the following marginal heading shall be substituted and shall be deemed to have been substituted with effect from the 5 th October, 2016, namely:— “115G. Fuel consumption standard”.

Explanatory Memorandum While amending the Central Motor Vehicle Rules, 1989 vide the Central Motor Vehicles (16 th Amendment) Rules, 2016, published in the Gazette of India, Explanatory, Part II, Section 3, Sub-section (i), dated the 5 th October, 2016, vide notification number G.S. R 954(E), dated the 4 th October, 2016, instead of marginal heading “Rule 115G. Fuel Consumption Standard” it was inadvertently mentioned as “Rule 115F. Fuel Consumption Standard”. Mentioning the date of operation of rule 115G in clause (iv) of rule 2 with effect from the 5 th October, 2016, does not bring adverse effect to the interest of any person.
Note : The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) vide notification number G.S.R. 590(E), dated the 2 nd June, 1989 and lastly amended vide notification number G.S.R. 1433(E), dated 20.11.2017.
