उक् त रािपत्र की प्रजतयां िनसाधारण कय तारीख 13 अगस्ट् त, 2020 कय उपल् ध करा िी गई थं;
और उक् त प्रारूप जनयमस के संबंध में िनसाधारण से प्रा त दकए गए आिपेस और सुझावस पर केन्दरीय सरकार द्वारा जवचार कर जलया गया ह ै;
अत:, अब, कें रीय सरकार, मयार यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित् त िजक् तयस का प्रययग करते हुए केन्द रीय मयार यान जनयम, 1989 का और संियधन करने के जलए जनम् नजलजखत जनयम बनाती ह,ै अथागत:्-
1. सजंि त नाम और प्रारंभ.-- (1) इन जनयमस का संजि त नाम केन्द रीय मयार यान (सयलहवां संियधन) जनयम, 2020 ह ै।

2. केन्द रीय मयार यान जनयम, 1989 में,-
(1) जनयम (2) के उप-जनयम (गकख) के स्ट् थान पर, जनम्नजलजखत कय रखा िाएगा, अथागत:्-- ‘(गकख) “संजनमागण उपस्ट् कर यान” से रबड़ की ाायर वाली (न्दयूमेराक ाायर सजहत) स्ट् वय ंप्रणयदित मिीन, रबड़ पडै वाला या रबड़ अथवा स्ट्ाील ड्रम वाला पजहएिार माउंाेड काम् पैक् ार, पजहएिार हाईड्रयजलक उत् खनक, पजहएिार लयडर, बेकहय लयडर, स्ट् कीड-स्ट् ाीयर लयडर, डम् पर, मयार ग्रडेर, मयबाइल के्रन, रबड रैक वाली डयिर और पेवसग अथवा रबर पैड या व् हील वाली पेवसग, फयकग जलफ्ा रक, स्ट् वयं लिान कंक्रीा जमक्सर या स्ट् व-प्रणयदित बूम पम् प, स्ट् व-प्रणयदित या कं्रकीा पम् प या अथग मूववंग या भूजम, चट्टान, अन्दय सामजग्रयस के खनन, लिान, पररवहन, जड्रवलगं, फैलान,े िमा करन ेया खाई बनाने, रािमागग से िरू खनन, औद्ययजगक उपक्रम, वसंचाई और सामान्दय जनमागण कायग करन ेके जलए मूल रूप से पररकजल् पत, लेदकन रािमागग की िमताओं के साथ "ऑन या ऑफ" या "ऑन और ऑफ" रूप में उपांतररत और जवजनर्मगत कयई अन्दय जनमागण उपस्ट् कर यान या उसका संययिन अजभप्रेत ह।ै इस खडं के प्रययिन के जलए स्ट्पष्टीकरण:-- एक संजनमागण उपस्ट् कर यान या अथग मूववंग यान एक गैर-पररवहन यान हयगा, जिसका सड़क पर चालन, मुख य ऑफ-रािमागग दक्रया-कलापस के आनुषंजगक ह ैऔर पचास दक.मी. प्रजतघंाा से अनजधक गजत पर एक संजि त अवजध के जलए ह,ै लेदकन ऐसे यान में अन्द य पूणगतया ऑफ-रािमागग जनमागण उपस्ट् कर यान िाजमल नहं हयता ह,ै िय सड़क नेावकग से जभन्द न दकन्द ही संलग् न पररसरस, कारखान ेया खान में उपययग के जलए पररकजल् पत तथा अंगीकृत दकया गया ह ैऔर लयक सड़क पर अपनी िजि से यात्रा करने के जलए सुसजित नहं ह,ै उिाहरण के जलए जस्ट् लप फामग पेवसग, कंक्रीा पेवसग, कयल् ड जमवलंग मिीन, कयल् ड ररसाईकलर मिीन और क्रॉलसग या मेाल रैक के साथ कयई भी संजनमागण उपस्ट् कर यान अथवा अथग मूवसग, उिाहरण के जलए पजहयस वाले उत् खनक या पैरस वाले उत् खनक, कें रीय मयार यान जनयमस के िेत्र में आन ेवाले नहं माने िाते हैं, क् यसदक उन्दहें लयक सड़कस पर चालन की अनुमजत नहं ह;ै’
(2) जनयम 96-क के उप जनयम (7) में परंतुक के पश् चात् जनम् नजलजखत परंतुक अंत:स्ट् थाजपत दकया िाएगा अथागत:्-- "परंत ु यह और दक 1 अप्रलै, 2021 कय और उसके पश् चात ् जवजनर्मगत जनमागण उपस्ट् कर यान में समय समय पर यथा-संियजधत एआईएस: 143-2017 में जनधागररत अनुपालन अपेिाए रखने वाली बे्रककंग प्रणाली का उपबंध दकया िाएगा ।";
(3) जनयम 98-क में— (क) उप-जनयम (2) में जनम् नजलजखत परंतुक अंत:स्ट् थाजपत दकया िाएगा, अथागत:्-- “परंत ु1 अप्रलै, 2021 कय और उसके पश् चात् जवजनर्मगत जनमागण उपस्ट् कर यान सभी चालन पररजस्ट्थजतयस में यान का कुिल और प्रभावी जनयंत्रण सुजनजित करन ेके जलए पयागप्त रूप से पररकजल् पत दकए िाएंग,े तादक यान समय- समय पर यथा संियजधत आईएस/आईएसओ: 7457: 1997 में जवजनर्िगष्ट परीिण प्रदक्रया के अनुरूप 24 मीार िायरे के भीतर मयड़ने में सिम हय, तथाजप स्ट्व-प्रणयदित ाेंडम ड्रम और एकल ड्रम वाइबे्रारी कॉम्पेक्ार के मामल े में, मयड़ का िायरा और मयड़ सकगल अपेिाओं कय क्रमिः आईएस:5500 - भाग 1 और भाग 2 के अनुसार मापा िाएगा ।”;
(ख) उप जनयम (3) में जनम् नजलजखत परंतुक अंत:स्ट् थाजपत दकया िाएगा, अथागत:्-- "परंत ु1 अप्रलै, 2021 कय और उसके पश् चात ्जवजनर्मगत जनमागण उपस्ट् कर यान समय-समय पर यथा संियजधत एआईएस: 144-2018 में यथा जनधागररत स्ट्ाीयररंग प्रयास की आवश्यकता का अनुपालन करेगा, तथाजप, यदि आपातकालीन स्ट्ाीयररंग प्रणाली प्रिान की िाती ह,ै तय समय-समय पर यथा संियजधत एआईएस: 144-2018 में यथा जवजनर्िगष् ा आपातकालीन स्ट्ाीयररंग प्रणाली के जलए अजतररि अनपुालन अपेिाओं की भी अनुपालना की िाएगी।”
(4) जनयम 120 के उप-जनयम (5) के पश् चात,् जनम्नजलजखत उप-जनयम अतं:स्ट् थाजपत दकया िाएगा अथागत:्-- “(6) जनमागण उपस्ट् कर यानस के मामले में, जस्ट्थर परीिण जस्ट्थजतयस के अधीन ऑपरेार के कान पर उत्सिगन ध्वजन िबाव का स्ट्तर आईएस/आईएसओ: 6394:2008 के अनुसार हयगा, गजतिील परीिण जस्ट् थजतयस के अधीन ऑपरेार के कान की जस्ट्थजत आईएस/आईएसओ:6396:2008 के अनुसार हयगी और जस्ट्थर परीिण की जस्ट्थजत में ध्वजन िजि का स्ट्तर आईएस/आईएसओ:6393:2008 के अनुसार हयगा, गजतिील परीिण की जस्ट्थजत में ध्वजन िजि का स्ट्तर नीचे िी गई सारणी-1 और सारणी-2 में जवजनर्िगष्ट सीमाओं का अनुपालन करते हुए समय-समय पर [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 यथा संियजधत आईएस/आईएसओ:6395:2008 के अनुसार हयगा, 1 अप्रैल, 2021 कय और उसके पश् चात ् जवजनर्मगत यान चरण-1 के अधीन जवजनर्िगष्ट सीमाओं के अनुपालन में हयगा/हसगे तथा 1 अप्रलै, 2024 कय और उसके पश् चात् जवजनर्मगत यान चरण-2 के अधीन जवजनर्िगष्ट सीमाओं के अनुपालन में हयगा/ हसगे । (सारणी-1: जस्ट्थर और गजतिील जस्ट्थजतयस में ऑपरेार के कान पर ध् वजन की सीमा मिीन का प्रकार ऑपरेार की जस्ट्थजत पर उत् सिगन ध् वजन िबाव स्ट् तर डीबी(ए) (केजबन से सुसजित जनमागण उपस्ट् कर यान के जलए) चरण–I 1 अप्रलै, 2021 से प्रभावी मानक ( आईएस/आईएसओ 6394 के अनुसार) चरण-II 1 अप्रैल, 2024 से प्रभावी मानक (आईएस/आईएसओ 6396 के अनुसार) संजनमागण उपस्ट् कर यान 90 85 सारणी-2: जस्ट्थर और गजतिील जस्ट्थजतयस में ध् वजन परीिण द्वारा पास के जलए ध् वजन की सीमा मिीन का प्रकार इंिन की सकल िजि पी, केड् ल् य ू उत् सिगक ध् वजन िजि स्ट् तर सीमा डीबी(ए) चरण–I 1 अप्रलै, 2021 से प्रभावी मानक (आईएस/आईएसओ 6393 के अनुसार) चरण-II 1 अप्रलै, 2024 से प्रभावी मानक (आईएस/आईएसओ 6395 के अनुसार) कॉम् पेक् िन मिीन (वाइबे्ररांग रयलर) पी≤8 110 107 8≤पी≤70 111 108 70≤पी≤560 91+11 लॉग पी 88+11 लॉग पी पजहएिार लयडर, पजहएिार डयिर, बैकहय लयडर, जस्ट्कड स्ट्ाीयर लयडर, डंपर, मयार ग्रडेर, रबड़ रैक वाल े डयिसग, रबर रैक या रबड़ पैड वाल े पेवसग अथवा पजहएिार पेवसग, फयकग जलफ्ा रक, कॉम् पेवक्ांग रयलसग (नॉन-वाइबे्ररांग रयलसग), या सीएमवीआर के िेत्र में आन ेवाला कयई अन्दय संजनमागण उपस्ट् कर पी≤55 110 107 55<पी≤560 91+11 लॉग पी 88+11 लॉग पी पजहएिार हाइड्रयजलक उत्खनक पी≤15 98 95 15<पी≤560 85+11 लॉग पी 82+11 लॉग पी मयबाइल के्रन, स्ट्व-लिान कंक्रीा जमक्सर पी≤560 93+11 लॉग पी 90+11 लॉग पी रा पण : अनुमेय ध्वजन िजि स्ट्तर कय जनकातम पूणग संखया (कम संख या के उपययग के जलए 0.5 से कम, उच्चतर संखया के जलए 0.5 से अजधक या उसके समतुल् य) माना िाएगा। इंिन की सकल िजि पी कय ाीएपी 115/116/एआईएस 137 के अनुसार अवधाररत दकया िाएगा। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(5) जनयम 124-ख के पश् चात्, जनम्नजलजखत जनयम अंत:स्ट् थाजपत दकया िाएगा अथागत-् "124-ग. सजंनमागण उपस्ट् कर यानस (सीईवी) के घाकस के सरुिा मानक.-- जनमागण उपस्ट् कर यान, एआईएस-160 के उपबंधस के अनुपालन में हसग:े परंत ु1 अप्रैल, 2021 कय और उसके पश् चात् जवजनर्मगत संजनमागण उपस्ट् कर यानस के जलए एआईएस-160 के िेत्र के अनुसार एआईएस-160 का भाग 1 लागू हयगा:
परंतु यह और दक 1 अप्रलै, 2024 कय और उसके पश् चात् जवजनर्मगत संजनमागण उपस्ट् कर यानस के जलए एआईएस-160 के िेत्र के अनुसार एआईएस-160 का भाग 2 लाग ूहयगा। [फा. सं. आराी-11036/77/2020-एमवीएल] जप्रयांक भारती, संयुक् त सजचव रा पण: मूल जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में अजधसूचना संख या सा.का.जन. 590(अ), तारीख 2 िून, 1989 द्वारा प्रकाजित दकए गए थे और अंजतम बार अजधसूचना संख या सा.का.जन. 661(अ), तारीख 22 अक् तूबर, 2020 संियजधत दकए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi the 27th October 2020 G.S.R. 673(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 502 (E), dated the 13 th August,2020, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date of which copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 13 th August, 2020;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short title and commencement.-(1) These rules may be called the Central Motor Vehicles (Sixteenth Amendment) Rules, 2020.
(2) They shall come into force on the date of their publication in Official Gazette.
2. In the Central Motor Vehicles Rules, 1989,-
(1) in rule 2, for sub-rule (cab), the following sub-rule shall be substituted, namely:- ‘(cab) “construction equipment vehicle” means a self-propelled machine with rubber tyred (including pneumatic tyred), rubber padded or rubber or steel drum wheel mounted compactor, wheeled hydraulic excavator, wheel loader, backhoe loader, skid-steer loader, dumper, motor grader, mobile crane, dozer and pavers with rubber track or rubber pads or wheeled pavers, fork lift truck, self-loading concrete mixer or self-propelled boom pumps, self-propelled or concrete pumps or any other construction equipment vehicle or combination thereof primarily designed to perform earth moving, excavation, loading, transportation, drilling, spreading, compacting or trenching of earth, rock, other materials, off-highway operations in mining, industrial [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 undertaking, irrigation and general construction but modified and manufactured with "on or off" or "on and off" highway capabilities.
Explanation for the purpose of this clause.—a construction equipment vehicle or earth moving vehicle shall be a non-transport vehicle the driving on the road of which is incidental to the main off-highway function and for a short duration at a speed not exceeding fifty kilometres per hour, but such vehicle does not include other purely off-highway construction equipment vehicle designed and adopted for use in any enclosed premises, factory or mine other than road network, not equipped to travel on public roads on their own power for example slip form pavers, concrete pavers, cold milling machines, cold recycler machines and any construction equipment vehicle or earth moving vehicle with crawlers or metal track, for example, tracked excavator or excavator with legs are not considered to be falling under the scope of Central Motor Vehicles Rules, as they are not permitted to run on public roads;’
(2) in rule 96A, in sub-rule (7), after the proviso following proviso shall be inserted, namely:- “Provided further that construction equipment vehicle manufactured on and after the 1 st day of April, 2021 shall be provided with the braking system having performance requirements stipulated in AIS:143-2017 as amended from time to time.”;
(3) in rule 98A-
(a) in sub-rule (2), the following proviso shall be inserted, namely:- “Provided that construction equipment vehicle manufactured on and after the 1 st day of April 2021, shall be adequately designed to ensure efficient and effective control of the vehicle under all driving conditions so that the vehicle is able to steer within a turning circle diameter of 24 meters, conforming to the test procedure specified in IS/ISO: 7457:1997 as amended from time to time, however in case of self-propelled tandem drum and single drum vibratory compactors, the turning circle radius and turning circle requirements shall be measured as per IS:5500 - Part 1 and Part 2, respectively.”;
(b) in sub-rule (3), the following proviso shall be inserted, namely:- “Provided that construction equipment vehicle manufactured on and after the 1 st day of April 2021, shall comply the steering effort requirement as stipulated in AIS: 144-2018as amended from time to time, however in case if emergency steering system is provided, the additional compliance requirements for emergency steering system as specified in AIS:144-2018 as amended from time to time, shall also be complied with.”;
(4) in rule 120, after sub-rule (5), the following sub-rule shall be inserted, namely:- “(6) In the case of construction equipment vehicles the emission sound pressure level at the Operator’s ear position under static test conditions shall be in accordance with IS/ISO:6394:2008,Operator’s ear position under Dynamic test conditions shall be in accordance with IS/ISO:6396:2008 and sound power level at stationary test condition shall be in accordance with IS/ISO:6393:2008, sound power level at Dynamic test condition shall be in accordance with IS/ISO:6395:2008 as amended from time to time, complying to the limits specified in Table -1 and Table -2 below and vehicle(s) manufactured on and after the 1 st April 2021, shall comply to limits specified under phase-I and vehicle(s) manufactured on and after the 1 st April 2024, shall comply to limits specified under phase-II- Table -1: Noise limits for Operator Ear Level at Static and Dynamic Conditions Type of Machine Emission sound pressure level limit at operator’s position, dB(A) (For Construction Equipment Vehicle fitted with cabin) Phase – I norms effective from the 1st day of April, 2021 ( As per IS/ ISO 6394) Phase-II norms effective from the 1 st day of April, 2024( As per IS/ ISO 6396) Construction Equipment Vehicle 90 85 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Table -2: Noise limits for Pass by Noise test at Static and Dynamic Conditions Type of machine Engine gross power P, kW Emissive sound power level limit dB(A) Phase – I norms effective from the 1st day of April, 2021 (As per IS/ ISO 6393) Phase-II norms effective from the 1 st day of April, 2024 ( As per IS/ ISO 6395) Compaction machines (vibrating rollers) P≤8 110 107 8≤P≤70 111 108 70≤P≤560 91+11 log P 88+11 log P Wheeled loader, wheeled dozer, Backhoe loader, Skid Steer Loader, Dumpers, Motor Grader ,Dozers with Rubber wheels, pavers with rubber track or rubber pads or wheeled pavers, fork Lift truck, compaction Rollers (nonvibrating Rollers), or any other construction equipment falling under the scope of CMVR P≤55 110 107 55<P≤560 91+11 log P 88+11 log P Wheeled hydraulic excavator P≤15 98 95 15<P≤560 85+11 log P 82+11 log P Mobile crane, self-loading concrete mixer P≤560 93+11 log P 90+11 log P Note: The permissible sound power level shall be rounded to the nearest whole number (less than 0.5 use lower number; greater than or equal to 0.5 use higher number). (5) after rule 124B, the following rule shall be inserted, namely:- “124-C.Safety Standards of components for Construction Equipment Vehicles (CEV).- Construction equipment vehicles, shall comply with the provisions of AIS-160:
Provided that Part 1 of AIS-160, shall be applicable for construction equipment vehicles, as per scope of AIS-160, manufactured on and after the 1 st April, 2021:
Provided further that Part 2 of AIS-160, shall be applicable for construction equipment vehicles, as per scope of AIS-160, manufactured on and after the 1 st April, 2024.”.
