(1) इन िनयमC का संि&P त नाम क �ीय मोटर यान (स)हवाँ संशोधन) िनयम, 2017 ह ै। (2) ये राजप) म उनके �काशन क तारीख को �वृS त हCग े। 2. क �ीय मोटर यान िनयम, 1989 िनयम 25 म ,- (क) भारत सरकार, सड़क प1रवहन और राजमाग5 मं)ालय सं9या सा.का.िन. 291(अ), तारीख 24 अ�ैल, 2014 क अिधसूचना के तहत यथा अJतः+थािपत उप-िनयम (7) म , “(7) एम I �वग5 के मोटर यान” के +थान पर िनLिलिखत रखा जाएगा और 24 अ�ैल, 2014 से �वृK रखे जाने के िलए समझा माना जाएगा, अथा5त् :- “(8) एम1 �वग5 के मोटर यान”;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) इस �कार संशोिधत उप-िनयम 8 के पVात् िनLिलिखत उप-िनयम अJतः+थािपत �कया जाएगा, अथा5त् :- “(9) 1 जुलाई, 2019 को और पVात् िविनXमत एम1 �वग5 के मोटरयान, अित1र= सुर&ा िविशYताएं और समय-समय संशोिधत एआईएस-2017 म अनुबZ इसक अपे&ाएं पालन करेगा ।”। [फा. सं. आर.टी 11028/16/2016-एमवीएल] अभय दामल,े संयु= सिचव �प�ीकारक �ापन�प�ीकारक �ापन�प�ीकारक �ापन�प�ीकारक �ापन अिधसूचना सं9या सा.का.िन. 99(अ), तारीख 19 फरवरी, 2014 <ारा भारत के राजप), असाधारण, भाग II, खंड 3, उप-खंड (i), तारीख 19 फरवरी, 2014 म �कािशत मोटरयान (पहला संशोधन) िनयम, 2014 <ारा केJ�ीय मोटरयान िनयम, 1989 का िनयम 125 का उप-िनयम (7) अJतः+थािपत �कया गया था । तथािप, भारत के राजप), असाधारण, भाग II, खंड 3, उप-खंड (i), तारीख 24 अ�ैल, 2014 म �कािशत केJ�ीय मोटरयान (5वां संशोधन) िनयम, 2014 <ारा अिधसूचना सं9या 291(अ), तारीख 24 अ�ैल, 2014 <ारा, िनयम 125 के उप-िनयम (7) के �प म अनावधनतापूव5क अJतः+थािपत �कया गया था । यह �मािणत �कया जाता ह ै �क 24 अ�ैल, 2014 से िनयम 125 के उप-िनयम (8) के �वत5न क तारीख का उ�लेख करने से �कसी Bि= के िहत पर �ितकूल �भाव नहA पड़ता ह।ै �ट�पण �ट�पण �ट�पण �ट�पण :::: मूल अिधसूचना सं9या सा.का.िन. 590(अ), तारीख 2 जून, 1989 <ारा भारत के राजप), भाग II, खंड 3, उप-खंड (i) म �कािशत �कए गए थे और अिधसूचना सं9या सा.का.िन. 1461(अ), तारीख 27 नवंबर, 2017 <ारा अंितम बार संशोिधत �कया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 7th December, 2017 G.S.R. 1483(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 1118(E), dated the 29th August, 2017 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) inviting objections and suggestions from affected persons before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public;
Whereas, copies of the said Gazette notification were made available to the public on the 29th August, 2017;
And whereas, no objections and suggestions received from the public in respect of the said draft rules.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: —
1. (1) These rules may be called the Central Motor Vehicles (Seventeenth Amendment) Rules, 2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989, in rule 125,-
(a) in sub-rule (7), as inserted vide notification of the Government of India, Ministry of Road Transport and Highways number G.S.R.291(E), dated the 24 th April, 2014, for “(7) Motor vehicles of category M1”, the following shall be substituted and shall be deemed to have been substituted with effect from the 24 th April, 2014 namely:- “(8) Motor vehicles of category M1”;

(b) after sub-rule 8 as so amended, the following sub-rule shall be inserted, namely:- “(9) Motor vehicles of category M1, manufactured on and after the 1 st day of July, 2019, shall comply with the additional safety features and its requirements stipulated in AIS-145 -2017, as amended from time to time.”.

Explanatory Memorandum Sub-rule (7) of rule 125 of the Central Motor Vehicle Rules, 1989 was inserted vide the Motor vehicles (1 st Amendment) Rules, 2014 published in the Gazette of India, Extraordinary, Part-II, Section 3, sub-section (i), dated the 19 th February, 2014, vide notification number G.S.R.99(E), dated the 19 th February,2014.
However, vide the Central Motor Vehicles (5 th Amendment) Rules, 2014, published in the Gazette of India, Extraordinary, Part-II, Section 3, sub-section (i), dated the 24 th April, 2014, vide notification number G.S.R.
291(E) dated the 24 th April, 2014, sub-rule (8) of rule 125 had been inadvertently inserted as sub-rule (7) of rule 125. It is certified that mentioning the date of operation of the sub-rule (8) of rule 125 with effect from the 24 th April, 2014 does not bring adverse effect to the interest of any person.
Note : The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), vide notification number G.S.R. 590(E), dated the 2nd June, 1989 and lastly amended vide notification number G.S.R. 1461(E), dated 27.11.2017.
