PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 912] ubZ fnYyh] c``gLifrokj] fnlEcj 20] 2018@vxzgk;.k 29] 1940 No. 912] NEW DELHI, THURSDAY, DECEMBER 20, 2018/AGRAHAYANA 29, 1940 सड़क प�रवहन और राजमाग� म�ंालयसड़क प�रवहन और राजमाग� म�ंालयसड़क प�रवहन और राजमाग� म�ंालयसड़क प�रवहन और राजमाग� म�ंालय अिधसचूनाअिधसचूनाअिधसचूनाअिधसचूना नई �द�ली, 20 �दस बर, 2018 सा.का.िन. सा.का.िन. सा.का.िन. सा.का.िन. 1225122512251225(अ).(अ).(अ).(अ).—क �ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िनयम� का �ा�प मोटर यान अिधिनयम, 1988 (1988 का 59) क धारा 212 क उपधारा (1) क अपे#ानुसार, भारत के राजप(, असाधारण, भाग II, खंड 3, उपखंड (i) म भारत सरकार के सड़क प*रवहन और राजमाग. मं(ालय क अिधसूचना सं1 या सा.का.िन. 872 (अ), तारीख 13 िसत बर, 2018 क अिधसूचना 2ारा उस तारीख से, िजसको उ4 त अिधसूचना को �कािशत करने वाले राजप( क �ितयां जनता को उपल5 ध करा दी गई थ7, स ेतीस �दन क अविध स ेपूव. उनसे �भािवत होने वाले 8 यि9य� के आ#ेप और सुझाव आमंि(त करते <ए �कािशत क गई थी; और उ4 त राजप( अिधसूचना क �ितया ंजनता को 13 िसत बर, 2018 को उपल5 ध करा दी ग= थ7; और उ4 त �ा�प िनयम� क बाबत जनता से �ा> त आ#ेप� और सझुाव� पर क �ीय सरकार 2ारा स यक ?प से िवचार कर िलया गया ह;ै अत: अब क �ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) क धारा 110 2ारा �दA त शि4 तय� का �योग करते <ए, क �ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन निलिखत िनयम बनाती ह,ै अथा.त् :- 1. संि#> त नाम और �ारंभ – (1) इन िनयम� का संि#> त नाम क �ीय मोटर यान (अठारहवा ँसंशोधन) िनयम, 2018 ह ै। (2) ये राजप( म उनके �काशन क तारीख को �वृA त ह�गे । 2. क �ीय मोटर यान िनयम, 1989 म (इसे इसम इसके पI चात् उ4 त िनयम कहा गया ह)ै म िनयम 2 के खंड (झ) के M थान पर िन निलिखत खंड रखा जाएगा, अथा.त् :- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ‘(i) ‘Nेणी एल ।’ से अिभ�ेत ह,ै मोटर साइ�कल या ह� के दो पिहया वाले संचािलत वाहन िजसक अिधकतम गित 70 �कलोमीटर �ितघंटा से अनिधक ह ैऔर इंजन #मता 50 सीसी से अनिधक ह,ै य�द उQ मीय इंजन या मोटर #मता से सिR जत ह ैतो 40 �कलोवाट से अनिधक हो, य�द उसके साथ इलि4 Sक मोटर लगाया ह ै।’ 3. उ4 त िनयम� म , िनयम 110 म दसूरे परंतुक के पI चात् िन निलिखत परंतुक अंत:M थािपत �कया जाएगा, अथा.त् :- ‘परंतु यह और �क 1 अ4 तूबर, 2019 को और उसके पI चात् तीन पिहय� के हडेलTप म लगाए गए �फलाम ट लTप (ब� ब) को समय-समय पर सुधार �कया जाएगा, जब तक �क भारतीय मानक 5 यूरो (बीआईएस) के िविनदVश� के तA M थानी भारतीय मानक ब् यूरो अिधिनयम, 2016 (2016 का 11) के अधीन अिधसिूचत न कर �दया जाए ।’। 4. उ4 त िनयम� म , िनयम 117 म , उप-िनयम (1) म दसूरे परंतुक के पI चात् िन निलिखत परंतुक अंत:M थािपत �कया जाएगा, अथा.त् :- ‘परंतु यह और �क ऐसे वाहन को िजसक िडजाइन क गई गित तीस �कलोमीटर �ित घंटा से अनिधक ह,ै उप-िनयम (1) के #े( से छूट-�ा> त होगी । 5. उ4 त िनयम� म , िनयम 125 म , उप-िनयम (9) के पI चात् िन निलिखत उप-िनयम अंत:M थािपत �कया जाएगा, अथा.त् :- ‘(10) 1 अ�ैल, 2020 को और उसके पI चात् िविनYमत Nेणी एम 2, Nेणी एम 3 तथा Nेणी एन (अध.-Sेलर� के िलए पुलर Sै4 टर सिहत Sै4 टर�, Sेलर� और माडयूलर हाइZोिलक Sेलर� को छोड़कर) के वाहन, तदनु�पी बीआईएस िविनदVशन� को भारतीय मानक 5 यूरो अिधिनयम, 2016 (2016 का 11) के तहत अिधसूिचत �कए जाने तक समय समय पर यथासंशोिधत एआईएस-145:2017 क अपे#ा[ के अनु�प वाहन *रवस. पा\कग अलट. िसM टम से सुसिR जत ह�गे; (11) तीन पिहया वाहन� के अिधभोगी के िलए सरु#ा उपबंध: 1 अ�ैल, 2020 को और उसके पI चात् तीन पिहया वाहन� के अिधभोगी के िलए सरु#ा उपबंध समय-समय पर �कए गए सुधार के अनुसार एआईएस – 134:2016 म िविन^दQ ट उपबंध� के अनु�प होगा जब तक �क भारतीय मानक 5 यूरो (बीआईएस) के िविनदVश� के तA M थानी भारतीय मानक 5 यूरो अिधिनयम, 2016 (2016 का 11) के अधीन अिधसिूचत न कर �दया जाए ।’’। [फा.सं. आरटी – 11028/03/2017-एमवीएल] ि�याकं भारती, संयु4 त सिचव �ट� प�ट� प�ट� प�ट� पण:ण:ण:ण: मूल िनयम भारत के राजप(, असाधारण, भाग II, खंड 3, उपखंड (i) म अिधसूचना स.ं सा.का.िन. 590 (अ), तारीख 2 जून, 1989 2ारा �कािशत �कए गए थे और अंत म अिधसूचना सं. सा.का.िन. 1192(अ) तारीख 11 �दस बर, 2018 2ारा संशोिधत �कए गए थे । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 20th December, 2018 G.S.R. 1225(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R.
872(E), dated the 13thSeptember, 2018, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section
(i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 thirty days from the date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 13 th day of September, 2018;
And whereas, the objections and suggestions received from the public in respect of the said draft ruleshave been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: -
1. Short title and commencement. -(1) These rules may be called as the Central Motor Vehicles (Eighteenth Amendment) Rules, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereafter referred as the said rules), in rule 2, for clause (i), the following clause shall be substituted, namely: - ‘(i) “Category L1” means a motor cycle or a light two wheeled powered vehicle with maximum speed not exceeding 70 kilometer per hour and engine capacity not exceeding 50cc if fitted with a thermic engine or motor power not exceeding 4.0 kilowatts if fitted with electric motor.’.
3. In the said rules, in rule 110, after the second proviso, the following proviso shall be inserted, namely: - “Provided also that, on and after the1 st day of October, 2019, the filament lamp (bulb) fitted in headlamp of three wheelers shall be as per AIS-134:2016, as amended from time to time, till the corresponding Bureau of Indian Standards (BIS) specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”.
4. In the said rules, in rule 117, in sub-rule (1), after the second proviso, the following proviso shall be inserted, namely: - “Provided also that a vehicle of which, designed speed does not exceed thirty kilometers per hour shall be exempted from the purview of sub-rule (1).”.
5. In the said rules, in rule 125, after sub-rule (9), the following sub-rules shall be inserted, namely: - “(10) Vehicles of Category M2, Category M3 and Category N (except tractors including puller tractor for semitrailers, trailers and modular hydraulic trailers), manufactured on and after the 1 st April, 2020, shall be fitted with the vehicle reverse parking alert system complying with the requirements of AIS-145:2017, as amended from time to time, till the corresponding Bureau of Indian Standards (BIS) specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016);
(11) Safety provisions for occupant of three wheeled vehicles:On and after the 1 st day of April, 2020, the safety provisions for occupant of three wheeled vehicles shall conform to provisions specified in AIS- 134:2016, as amended from time to time till the corresponding Bureau of Indian Standards (BIS) specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”.
