PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल् ली, 26 अगस्ट् त, 2021 सा.का.जन. 596(अ).—कें द्रीय मोटरयान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथा-अपेजित केन्द द्रीय मोटर जनयम, 1989 का और संिोधन करन े के जलए प्रारूप जनयम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना सं. सा.का.जन. 287(अ), तारीख 23 अप्रलै, 2021 द्वारा उन सभी व् यज तयस से जजनकी उससे प्रभाजवत होने की संभावना ह,ै ऐसी तारीख से जजसकस उ त अजधसूचना से यक त राजपत्र की प्रजतयां जनसाधारण को उपल् ध करवाई गई थं, तीस ददवस की अवजध की समाज त से पूवग ्िेप और सकझाव ्मंजत्रत करत ेए ए प्रकाजित दकए गए थ े;
उ त राजपत्र अजधसूचना की प्रजतयां जजसमें उ त अजधसूचना प्रकाजित की गई थी, जनसाधारण को 26 अप्रलै, 2021 को उपल् ध करवाई गई थं;
उ त प्राुपप जनयमस के संबंध में जनसाधारण से प्रा त ्िेपस और सकझावस पर कें द्रीय सरकार द्वारा स् यक् रूप से जवचार दकया गया ह;ै अत:, केन्द द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 41, धारा 50 और धारा 110 द्वारा प्रदत् त िज तयस का प्रयोग करते ए ए केन्द द्रीय मोटर यान जनयम, 1989 का और संिोधन करन ेके जलए जन् नजलजखत जनयम बनाती ह,ै अथागत् :--
1. सजंि त नाम और प्रारंभ.— (1) इन जनयमस का संजि त नाम कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 ह।ै

2. कें द्रीय मोटरयान जनयम, 1989 (जजसे इसमें इसके पश् चात् उ त जनयम कहा गया ह)ै में, जनयम 2 के खंड (यघ) के स्ट् थान पर जन् नजलजखत खंड रखा जाएगा, अथागत् :- ‘(यघ) “जविेष प्रयोजन यान (एसपीवी)” से माल या याजत्रयस के पररवहन की जवजनर्ददष् ट पररवहन अपेिां को पूरा करने के जलए जवजनर्ममत या पररवर्मतत मोटर यान अजभप्रेत ह ै।'
3. उ त जनयमस के जनयम 112, में उपजनयम (4) के पश् चात् जन् नजलजखत उपजनयम अंत:स्ट् थाजपत दकए जाएंग,े अथागत् :-- “(5) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके छह मास पश् चात् , ए्ईएस-163 में यथा वर्मणत जविेष प्रयोजन यान अथागत मोबाईल कैं टीन, समय-समय पर यथा संिोजधत ए्ईएस-163:2020 में जनयत अपेिां के अनकपालन में हसगे ।
(6) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके छह मास पश् चात् , प्रथम प्रजतदक्रया दो पजहया यान-अज न, समय-समय पर यथा-संिोजधत ए्ईएस-167:2020 में जनयत अपिेां के अनकपालन में हसगे।
(7) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके एक वषग पश् चात् , इंसकलेटेड यान, समय-समय पर यथा-संिोजधत ए्ईएस- 164:2020 में जनयत अपेिां के अनकपालन में हसगे।
(8) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके छह मास पश् चात् , साथग मोटर गाड़ी, समय-समय पर यथा-संिोजधत ए्ईएस-124:2014 में जनयत अपेिां के अनकपालन में हसगे।”।
4. उ त जनयमस के जनयम 125-छ में, उपजनयम (2) के पश् चात् जन् नजलजखत उपजनयम अतं:स्ट् थाजपत दकए जाएंग,े अथागत् :-- “(3) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके छह मास पश् चात् , भारतीय मानक ् यूरो अजधजनयम, 2016 (2016 का 11) के अधीन तत् स्ट् थानी बी्ईएस जवजनद ि अजधसूजचत दकए जाने तक, साथग मोटर गाड़ी के रूप में उपांतररत मोटर यान, समय-समय पर यथा-संिोजधत ए्ईएस- 124:2014 में जनयत अपेिां के अनकपालन में हसगे।
(4) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके छह मास पश् चात् , भारतीय मानक ् यूरो अजधजनयम, 2016 (2016 का 11) के अधीन तत् स्ट् थानी बी्ईएस जवजनद ि अजधसूजचत दकए जाने तक, मलू उपस्ट् कर जवजनमागतां द्वारा जवजनर्ममत ए्ईएस-163 में यथा वर्मणत जविषे प्रयोजन यान अथागत मोबाईल कैं टीन, समय-समय पर यथा-संिोजधत ए्ईएस-163 में जनयत अपेिां के अनकपालन में हसगे।
(5) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके छह मास पश् चात् , मलू उपस्ट् कर जवजनमागतां द्वारा जवजनर्ममत प्रथम प्रजतदक्रया दो पजहया यान-अज न, समय-समय पर यथा-संिोजधत ए्ईएस-167 में जनयत अपेिां के अनकपालन में हसगे।
(6) कें द्रीय मोटरयान (अाारहवा संिोधन) जनयम 2021 के प्रारंभ की तारीख को और उसके छह मास पश् चात् , भारतीय मानक ् यूरो अजधजनयम, 2016 (2016 का 11) के अधीन तत् स्ट् थानी बी्ईएस जवजनद ि अजधसूजचत दकए जाने तक, मलू उपस्ट् कर जवजनमागतां द्वारा जवजनर्ममत इंसकलेटेड यान, समय-समय पर यथा-संिोजधत ए्ईएस-164 में जनयत अपेिां के अनकपालन में हसगे।”
5. उ त जनयमस के प्ररूप 22च में “[जनयम 47ख(3), 112(3), 112(4),126 देंखे]” ि् दस, अंको, अिर और कोष् ाकस के स्ट् थान पर “[जनयम 47ख(3), 112(3), 112(4), 112(5), 112(6), 112(7), 112(8),126 देंखे]” ि् द, अंक, अिर और कोष् ाक रखे जाएंगें। [फा. सं. ्रटी–11036/69/2021–एमवीएल] अजमत वरादान, संयक त सजचव रट पण: मलू जनयम, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में अजधसूचना सं. सा.का.जन. 590(अ), तारीख 2 जून, 1989 द्वारा प्रकाजित दकए गए थे और अजधसूचना सं. 575(अ), तारीख 11 अगस्ट्त, 2021 अंजतम संिोधन दकया गया । [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 26th August, 2021 G.S.R. 596(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 287(E), dated the 23rd April, 2021, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And, whereas, copies of the said Official Gazette in which the said notification was published were made available to the public on the 26 th April, 2021;
And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sections 41, 50 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short title and commencement. -(1) These rules may be called the Central Motor Vehicles (Eighteenth Amendment) Rules, 2021.
(2) Save as otherwise provided in the rules they shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred to as the said rules), for clause (zd) of rule 2, the following clause shall be substituted, namely:- ―(zd) ―Special Purpose Vehicle (SPV)‖ means a motor vehicle so constructed or altered to serve as a specific transportation requirement of goods or passenger transport.‖
3. In the said rules, in rule 112, after sub-rule (4), the following sub-rules shall be inserted, namely:- ―(5) On and after six months from the date of commencement of the Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, Special Purpose Vehicles, viz, Mobile Canteen, as described in AIS 163, shall comply with the requirements stated in AIS-163:2020, as amended from time to time.
(6) On and after six months from the date of commencement of Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, Two Wheeled First Responder – Fire, shall comply with the requirements stated in AIS 167:2020, as amended from time to time.
(7) On and after one year from the date of commencement of Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, Insulated vehicles, shall comply with the requirements stated in AIS-164:2021, as amended from time to time.
(8) On and after six months from the date of commencement of Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, Motor Caravans, shall comply with the requirements stated in AIS-124:2014, as amended from time to time.‖.
4. In the said rules, in rule 125-G, after sub-rule (2), the following sub-rules shall be inserted, namely:- ―(3) On and after six months from the date of commencement of Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, motor vehicles modified as Motor Caravans shall comply with AIS 124:2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act 2016 (11 of 2016).
(4) On and after six months from the date of commencement of Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, Special Purpose Vehicle, viz. Mobile Canteen, as defined in AIS 163, manufactured by Original Equipment Manufacturers, shall comply with the requirements of AIS 163, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act 2016 (11 of 2016).

(5) On and after six months from the date of commencement of Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, Two Wheeled First Responder – Fire, manufactured by Original Equipment Manufacturer, shall comply with the requirements of AIS 167, as amended from time to time.
(6) On and after one year from the date of commencement of Central Motor Vehicles (Eighteenth Amendment) Rules, 2021, Insulated Vehicle manufactured by Original Equipment Manufacturer, shall comply with the requirements of AIS 164, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act 2016 ( 11 of 2016).‖.
5. In the said rules, in Form 22 F, for the words, figures and brackets, ―[(See rules 47B (3),112(3), 112(4), 126)]‖, the words, figures and brackets, ―[(See rules 47B (3),112(3), 112(4), 112(5), 112(6), 112(7), 112(8), 126)]‖, shall be substituted.
