PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 894] ubZ fnYyh] c`gLifrokj] fnlEcj 29] 2016@ikS"k 8] 1938 No. 894] NEW DELHI, THURSDAY, DECEMBER 29, 2016/PAUSA 8, 1938 सड़क पᳯरवहन और राजमागᭅ मंᮢ ालय अिधसूचना नई ᳰद᭨ली, 29 ᳰदस᭥ बर, 2016 सा.का.िन. 1183(अ).—के᭠ ᮤ ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए ᮧाᱨप िनयम िजसे भारत सरकार के सड़क पᳯरवहन और राजमागᭅ मंᮢालय कᳱ अिधसचूना सं. सा.का.िन. 744(अ) तारीख 28 जुलाई, 2016 ᳇ारा मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 212 कᳱ उप-धारा (1) कᳱ अपेᭃानुसार उन सभी ᭪ यि तयᲂ से िजनके उससे ᮧभािवत होन ेकᳱ संभावना थᱭ, ᮧाᱨप िनयमᲂ से यु त उ त अिधसूचना कᳱ ᮧितयां जनता को उपल᭣ ध करा दी गई थᱭ, तीस ᳰदन कᳱ अविध के समाि᭡ त से पहले आᭃेप और सुझाव आमंिᮢत करते ᱟए ᮧकािशत ᳰकए गए थे; और उ त राजपᮢ अिधसूचना कᳱ ᮧितयां तारीख 28 जुलाई, 2016 को जनता को उपल᭣ध करा दी गई थᱭ ; और उᲦ ᮧाᱨप िनयमᲂ कᳱ बाबत जनता से कोई आᭃेप और सुझाव ᮧा᳙ नहᱭ ᱟए ह;ᱹ अतः, अब, कᱶ ᮤीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 110 कᳱ उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, कᱶ ᮤीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन᳜िलिखत िनयम बनाती ह,ै अथाᭅत् :-
1. (1) इन िनयमᲂ का संिᭃ᳙ नाम कᱶ ᮤीय मोटर यान (22वाँ संशोधन) िनयम, 2016 ह ै।
(2) ये राजपᮢ मᱶ उनके ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे ।
2. के᭠ᮤीय मोटर यान िनयम, 1989 मᱶ,—
(i) िनयम 9 मᱶ, उपिनयम (2) मᱶ “िनयम 32 कᳱ सारणी कᳱ ᮓम सं या 8 मᱶ यथािन᳸द᭬ ट” श᭣ दᲂ, अᭃरᲂ और अंकᲂ के ᭭ थान पर “िनयम 32 कᳱ सारणी मᱶ यथािन᳸द᭬ ट” श᭣ द और अंक रखे जाएंगे;
(ii) िनयम 14 के उपिनयम (1) मᱶ खंड (ख) के ᭭ थान पर िन᭥ निलिखत खंड रखा जाएगा, अथाᭅत् :— “(ख) यथाि᭭ थित, परीᭃण या प᭫ चातवतᱮ परीᭃण िनयम 32 मᱶ ᮧ᭜ येक वगᭅ को चलाने के िलए और अनु᭄ि᭡ त जारी करने के िलए यथािविन᳸द᭬ ट समुिचत फᳱस;”; 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(iii) िनयम 32 के ᭭ थान पर िन᭥ निलिखत िनयम रखा जाएगा, अथाᭅत् :- “32. फᳱस:- वह फᳱस जो इस अ᭟ याय के उपबंधᲂ के अधीन ᮧभाᳯरत कᳱ जाएगी, नीचे सारणी मᱶ िविन᳸द᭬ ट कᳱ जाएगी: परंतु रा᭔ य परीᭃण संचालन के िलए उपयोग ᳰकए गए ᭭ वचलन और ᮧौ᳒ोिगकᳱ कᳱ अितᳯर त लागत को पूरा करने के िलए या मू᭨ यवᳶधत सेवाए ंउपल᭣ ध कराने के िलए अितᳯर त रकम का उ᳅हण कर सकᱶ गे । सारणी ᮓम सं या ᮧयोजन रकम िनयम धारा

1. ᮧ᭜ येक वगᭅ के यान के िलए ᮧᱨप 3 मᱶ नौिसिखया चालन अनु᭄ि᭡ त जारी करने के संबंध मᱶ एक सौ पचास ᱧपये 10 8
2. यथाि᭭ थित, नौिसिखया िशᭃाथᱮ अनु᭄ि᭡ त परीᭃण फᳱस या परीᭃण कᳱ पुनरावृि᭜ त फᳱस पचास ᱧपये 27 (थ)
3. चलाने कᳱ ᭃमता के िलए, यथाि᭭ थित, परीᭃण या परीᭃण कᳱ पुनरावृि᭜ त के िलए (ᮧ᭜ येक वगᭅ के यान को) तीन सौ ᱧपये 14(1) (ख) 9
4. चालन अनु᭄ि᭡ त जारी करने के िलए दो सौ ᱧपये 14(1) (ख) 9
5. अंतररा᭬ ᮝीय चालन अनु᭄ा-पᮢ जारी करने के िलए एक हजार ᱧपये 14(2) (ख) 9
6. चालन अनु᭄ि᭡ त मᱶ यानᲂ के अ᭠ य वगᭅ को जोड़ने के िलए पाँच सौ ᱧपये 17(2) (घ) 11
7. पᳯरसंकटमय मालᲂ के संवहन के यान के पृ᭬ ठांकन या ᮧािधकरण के नवीकरण के िलए एक सौ ᱧपय े 9 27 (थ)
8. चालन अनु᭄ि᭡ त के नवीकरण के िलए दो सौ ᱧपये 18(1)(क) 15
9. ऐसी चालन अनु᭄ि᭡ त के नवीकरण के िलए िजसके िलए आवेदन अनुᮕह अविध के प᭫ चात् ᳰकया गया है तीन सौ ᱧपये । ᳯट᭡ पण: ᮧ᭜ येक वषᭅ या उसके भाग के िलए िजसकᳱ गणना अनᮕुह अविध कᳱ समाि᭡ त कᳱ तारीख से कᳱ जाएगी एक हजार ᱧपये कᳱ दर से अितᳯर त फᳱस 15
10. चालन मᱶ अनुदेश ᮧदान करने वाले ᭭ कूल या ᮧित᭭ थापन को अनु᭄ि᭡ त जारी करने या उसका नवीकरण करने के िलए दस हजार ᱧपये 24 (2) 12
11. चालन मᱶ अनुदेश ᮧदान करने वाले ᭭ कूल या ᮧित᭭ थापन को अनुिलिप अनु᭄ि᭡ त जारी करने या उसका नवीकरण करने के िलए पांच हजार ᱧपये 26 (2) 12 ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
12. िनयम 29 मᱶ िन᳸द᭬ ट अन᭄ुि᭡ त ᮧािधकारी के आदेश के िवᱧ ᳰकसी अपील के िलए पाँच सौ ᱧपये 30(1) 17
13. चालन अनु᭄ि᭡ त मᱶ अिभिलिखत ᳰक᭠ हᱭ अ᭠ य िविशि᭬ टयᲂ अथाᭅत् पता, आᳰद मᱶ पᳯरवतᭅन के ᳰकसी आवेदन के िलए दो सौ ᱧपये 27(थ) ᳯट᭡ पण–1: जब भी ᮧाᱨप 7 ᭭ माटᭅ काडᭅ ᳰकस् म मᱶ चालन अनु᭄ि᭡ त जारी कᳱ जाती ह ैतो दो सौ ᱧपये कᳱ अितᳯर त फᳱस उ᳄गृहीत कᳱ जाएगी ।
2. ऊपर सारणी मᱶ ᮓम सं या 1, 2 और 3 मᱶ िविन᳸द᭬ ट फᳱस, यथाि᭭ थित, नौिसिखया िशᭃाथᱮ अनु᭄ि᭡ त या चालन अनु᭄ि᭡ त जारी करन े के िलए या ᳰकसी अ᭠ य वगᭅ के यान के पृ᭬ ठांकन के िलए आवेदन ᮧ᭭ तुत करने के समय सामूिहक ᱧप से संद᭜ त कᳱ जाएगी ।”;
(iv) िनयम 81 के ᭭ थान पर िन᭥ निलिखत रखा जाएगा, अथाᭅत् :- “81. फᳱस:- वह फᳱस जो इस अ᭟ याय के उपबंध के अधीन ᮧभाᳯरत कᳱ जाएगी, नीचे सारणी मᱶ िविन᳸द᭬ ट कᳱ जाएगी: परंतु रा᭔ य परीᭃण संचालन के िलए उपयोग ᳰकए गए ᭭ वचलन और ᮧौ᳒ोिगकᳱ कᳱ अितᳯर त लागत को पूरा करने के िलए या मू᭨ यवᳶधत सेवाए ंउपल᭣ ध कराने के िलए अितᳯर त रकम का उ᳅हण कर सकᱶ गे । सारणी ᮓम सं या ᮧयोजन रकम िनयम धारा

5. रिज᭭ ᮝीकरण ᮧमाणपᮢ कᳱ अनुकृित जारी करना ᮓमसं या 4 के सामने वᳶणत फᳱस का आधा 53(2)
6. ᭭ वािम᭜ व का अंतरण ᮓमसं या 4 के सामने वᳶणत फᳱस का आधा । िनराᭃेप ᮧमाणपᮢ ᮧ᭭ तुत करने मᱶ िवलंब कᳱ दशा मᱶ ᮧ᭜ येक मास या उसके भाग के िलए मोटरसाइᳰकल कᳱ दशा मᱶ तीन सौ ᱧपये और अन् य यानᲂ के िलए ᮧ᭜ येक मास या उसके भाग के िवलंब के िलए पाँच सौ ᱧपये कᳱ अितᳯर त फᳱस उ᳅हीत कᳱ जाएगी । 55(2)(iii), 55(3), 56(2)(क) और 57(1)(क)
7. िनवास मᱶ पᳯरवतᭅन ᮓमसं या 4 के सामने वᳶणत फᳱस का आधा िनवास मᱶ पᳯरवतᭅन के िलए िनराᭃेप ᮧमाणपᮢ ᮧ᭭ तुत करने मᱶ िवलंब कᳱ दशा मᱶ ᮧ᭜ येक मास या उसके भाग के िलए मोटरसाइᳰकल कᳱ दशा मᱶ तीन सौ ᱧपये और अ᭠ य यानᲂ के िलए ᮧ᭜ येक मास या उसके भाग के िवलंब के िलए पाँच सौ ᱧपये कᳱ अितᳯर त फᳱस उ᳅हीत कᳱ जाएगी । 59
8. रिज᭭ ᮝीकरण ᮧमाणपᮢ मᱶ पᳯरवतᭅनᲂ का अिभलेखन ᮓमसं या 4 के सामने वᳶणत फᳱस का आधा
9. अवᮓय/पᲵा/आड़मान करार का पृ᭬ ठांकन – (क) मोटरसाइᳰकल (ख) ितपिहया/चौपिहया/ह᭨ के मोटर- यान (ग) म᭟ यम या भारी यान ᳯट᭡ पण–पᲵा, आᳰद को र करने के िलए या उसके प᭫ चात् नया रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी करने के िलए कोई पृथक फᳱस उ᳅हीत नहᱭ कᳱ जाएगी पाँच सौ ᱧपये एक हजार पाँच सौ ᱧपये तीन हजार ᱧपये 60
10. ᳰफटनैस ᮧमाणपᮢ अनुद᭜ त करने या उसका नवीकरण करने के िलए ᳰकसी यान के परीᭃण का संचालन (क) मोटरसाइᳰकल (ख) ितपिहया या ह᭨ के मोटरयान या चौपिहया साइᳰकल ह᭭ तचािलत : दो सौ ᱧपये ᭭ वचािलत : चार सौ ᱧपये ह᭭ तचािलत: चार सौ ᱧपये ᭭ वचािलत : छह सौ ᱧपये 62(2) 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ग) म᭟ यम या भारी मोटर यान ह᭭ तचािलत: छह सौ ᱧपये ᭭ वचािलत : एक हजार ᱧपये
11. मोटरयानᲂ कᳱ ᳰफटनैस के िलए ᮧमाणपᮢ अनुद᭜ त करना या उसका नवीकरण करना दो सौ ᱧपये । ᳯट᭡ पण: ᳰफटनैस ᮧमाणपᮢ कᳱ समाि᭡ त के प᭫ चात् िवलंब के ᮧ᭜ येक ᳰदन के िलए पचास ᱧपये कᳱ अितᳯर त फᳱस 62(2)
12. ᮧािधकार पᮢ अनुद᭜ त करना या नवीकरण करना पंᮤह हजार ᱧपये 63(2)(क)
13. ᮧािधकार पᮢ कᳱ अनुकृित जारी करना सात हजार पाँच सौ ᱧपये 66(2)

15. पूवᲃ त ᮓमसं या 1 से 14 के अधीन न आने वाली ᮧिवि᭬ टयᲂ के िलए ᳰकसी आवेदन के संबंध मᱶ दो सौ ᱧपये 64(त) ᳯट᭡ पण 1: शंकाᲐ को दरू करने के िलए यह ᭭ प᭬ ट ᳰकया जाता ह ैᳰक म᭟ यम याᮢी मोटरयान, भारी मालयान, आयाितत मोटरयान या कोई अ᭠ य यान िजनका पूवᲃ त सारणी के ᮓम सं या 4 के सामने वणᭅन नहᱭ ᳰकया गया ह,ै के अंतगᭅत पᳯरवहन और गैर पᳯरवहन यान दोनᲂ ह ᱹ। ᳯट᭡ पण 2 : जब भी ᳰकसी ᭭ माटᭅ काडᭅ ᳰक᭭ म के ᱨप मᱶ रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी ᳰकया जाता ह ैतो िसवाय अवᮓय या पᲵा या आड़मान करार के र होने के प᭫ चात् नए रिज᭭ ᮝीकरण कᳱ दशा मᱶ दो सौ ᱧपये कᳱ अितᳯर त फᳱस ᮧभाᳯरत कᳱ जाएगी ”। [सं. आर टी-11017/12/2013-एम वी एल] अभय दामले, संयु त सिचव ᳯट᭡पण : मूल िनयम भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उप-खंड (i) मᱶ सा.का.िन. सं. 590(अ), तारीख 2 जून, 1989 ᳇ारा ᮧकािशत ᳰकए गए थे और अंितम संशोधन सा.का.िन. सं. 1096 (अ), तारीख 28 नव᭥ बर, 2016 ᳇ारा ᳰकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 29th December, 2016 G.S.R. 1183(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required by sub-section (1) of Section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 744(E), dated the 28th July, 2016, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the said notification containing the draft rules were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 28th July, 2016; And whereas, no objections and suggestions were received from the public in respect of the said draft rules. Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:
1. (1) These rules may be called the Central Motor Vehicles (Twenty-second Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989,-
(i) in rule 9, in sub-rule (2), for the words, letters and figures “as is referred to in Sl.No.8 of the Table to rule 32”, the words and figures “as specified in the Table in rule 32” shall be substituted; ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7
(ii) in rule 14, in sub-rule (1), for clause (b), the following clause shall be substituted, namely:- “(b) appropriate fee as specified in rule 32, for the test, or the subsequent test, as the case may be, of competence to drive for each class and for issue of licence;”;
(iii) for rule 32, the following rule shall be substituted, namely:- “32. Fees.—The fees which shall be charged under the provisions of this Chapter shall be as specified in the table below:
Provided that the States may levy additional amounts to cover the cost of automation and technology utilised for conducting the testing or providing value added services. TABLE Sl. No. Purpose Amount Rule Section

13. Any application for change in address or any other particulars recorded in the driving licence e.g. address etc. Two hundred rupees 27(q) Note. 1. Where a Smartcard Type driving licence is issued in Form 7, an additional fee of two hundred rupees shall be levied.
2. (iv) for rule 81, the following rule shall be substituted, namely:- “81. Fees.-The fees which shall be charged under the provisions of this Chapter shall be as specified in the Table below:

Note 2: In case of delay in applying for renewal of certificate of registration, an additional fee of three hundred rupees for delay of every month or part thereof in respect of motor cycles and five hundred rupees for delay of every month or part thereof in respect of other classes of nontransport vehicles shall be levied.
5. Issue of duplicate certificate of registration Half of the fee mentioned against Serial No.4 53(2)

Note: In case of delay in submitting ‘No Objection Certificate’ for change of residence, an additional fee of rupees three hundred for delay of each month or part thereof in case of motor cycles and five hundred rupees for each month of delay or part thereof for other vehicles shall be levied. 59

(ii) Automated: Four hundred rupees
(b) Three wheeled or light motor vehicle or quadricycle
(i) Manual : Four hundred rupees
(ii) Automated: Six hundred rupees
(c) Medium or heavy motor vehicle
(i) Manual: Six hundred rupees
(ii) Automated: One thousand rupees
11. Grant or renewal of certificate of fitness for motor vehicle Two hundred rupees.
Note: Additional fee of fifty rupees for each day of delay after expiry of certificate of fitness shall be levied. 62(2)
12. Grant or renewal of letter of authority Fifteen thousand rupees 63(2)(a)
13. Issue of duplicate letter of authority Seven thousand and five hundred rupees 66(2)

Note 2: Where the certificate of registration issued is in the form of any Smart Card Type, an additional fee of rupees two hundred shall be charged except in the case of issue of fresh certificate of registration after cancellation of hire purchase or lease or hypothecation agreement.”.
