PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल् ली, 4 अक्टूबर, 2021 सा.का.जन. 714(अ).— कें द्रीय मोटरयान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथाअपेजित केन्द द्रीय मोटर जनयम, 1989 का और संिोधन करने के जलए प्रारूप जनयम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना संख् या सा.का.जन. 191 (अ), तारीख 15 माचग, 2021 द्वारा उन सभी व् यजक् तयस से जजनकी उससे प्रभाजवत होन े की संभावना ह,ै ऐसी जतजथ से जजसकस उक् त अजधसूचना से यकक् त राजपत्र की प्रजतयां जनसाधारण को उपल् ध करवाई गई थं, तीस ददवस की अवजध की समाज त से पूवग ्िेप और सकझाव ्मंजत्रत करते ए ए प्रकाजित दकए गए थे; उक् त राजपत्र अजधसूचना की प्रजतयां जनसाधारण को 15 माचग, 2021 को उपल् ध करवाई गई थं; उक् त प्राुपप जनयमस के संबंध में जनसाधारण से प्रा त ्िेपस और सकझावस पर कें द्रीय सरकार द्वारा स् यक् रूप से जवचार दकया गया ह;ै अत:, केन्द द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 64 द्वारा प्रदत् त िजक् तयस का प्रयोग करते ए ए केन्द द्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए जन् नजलजखत जनयम बनाती ह,ै अथागत् :--
1. सजंि त नाम और प्रारंभ.— (1) इन जनयमस का संजि त नाम कें द्रीय मोटरयान (23वां संिोधन) जनयम 2021 ह।ै स.ं 572] नई ददल्ली, सोमवार, अक् तबूर 4, 2021/्ज वन 12, 1943 No. 572] NEW DELHI, MONDAY, OCTOBER 4, 2021/ASVINA 12, 1943 सी.जी.-डी.एल.-अ.-04102021-230145 CG-DL-E-04102021-230145 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

2. कें द्रीय मोटरयान जनयम, 1989 (जजसे इसमें इसके प चात् उक् त जनयम कहा गया ह)ै के जनयम 47 के उपजनयम
(1) में, खंड (ड) के प चात् जन् नजलजखत खंड अंत:स्ट् थाजपत दकया जाएगा, अथागत ्:- “(ढ़) जनिेप प्रमाणपत्र, यदद उपल् ध हो; स्ट् पष् टीकरण.- इन जनयमस के प्रयोजनस के जलए, “जनिेप प्रमाणपत्र” का वही अथग होगा जो उसका मोटर यान (यान स्ट् रैपिंग कपग की सकजवधा का रजजस्ट् रीकरण और कृत् य) जनयम, 2021 के जनयम 3 के उपजनयम (1) के खंड (ग) में ह।ै”।
3. उक् त जनयमस के जनयम 81 में,--
(i) परंतकक के प चात् जन् नजलजखत परंतकक अंत:स्ट् थाजपत दकया जाएगा, अथागत ्:- “परंतक यह और दक यदद यान ‘जनिेप प्रमाणपत्र’ के प्रस्ट् तकतीकरण पर रजजस्ट् रीकृत दकया जाता ह,ै रजजस्ट् रीकरण प्रमाणपत्र जारी करन ेके जलए फीस नहं वसूली जाएगी।”;
(ii) सारणी में,-- (क) रम संख् यांक (4) और उससे संबंजधत प्रजवजष् टयस के स्ट् थान पर जन् नजलजखत रखा जाएगा, अथागत :-- र .सं. प्रयोजन रकम जनयम धारा

(1) तीन हजार ुपपये
(2) छह हजार ुपपये रट पण1: यदद रजजस्ट् रीकरण प्रमाण पत्र एक स्ट्माटग काडग टाइप है, जो प्रपत्र 23क में जारी दकया गया या नवीनीकृत ह,ै तो दो सौ ुपपये का अजतररक्त िकल्क उद्गृजहत दकया जाएगा। रट पण 2: रजजस्ट् रीकरण प्रमाण पत्र के नवीनीकरण के जलए ्वेदन करने में देरी के मामले में, मोटर साइदकल के संबंध में या उसके जहस्ट्से में देरी के जलए प्रत् येक माह तीन सौ ुपपये और पररवहन वाहनस की अन्दय रेेणणी या उसके जहस्ट्से के मामले में देरी के जलए प्रत् येक महीने पांच सौ ुपपये अजतररक्त िकल्क उद्गृजहत दकया जाएगा।’’; ख) रम संख् या (10) और उससे संबंजधत प्रजवजियस के प चात,् जनम्नजलजखत अंत:स्ट् थाजपत दकया जाएगा, अथागत् : - “10क. 15 वर्ग से अजधक पकराने मोटर वाहनस के जलए उपयकक् तता प्रमाणपत्र प्रदान करने और नवीनीकरण के जलए दकसी वाहन का परीिण करना। 62(2) (क) मोटर साइकल
(i) हस्ट् तचाजलत : चार सौ ुपपये
(ii) स्ट् वचाजलत : पांच सौ ुपपये (ख) तीन पजहयस वाले या हल् के मोटर यान या क् वाड्रीसाइकल
(i) हस्ट् तचाजलत : ्ठ सौ ुपपये
(ii) स्ट् वचाजलत: एक हजार ुपपये (ग) मध् यम माल / यात्री मोटर यान (i) हस्ट् तचाजलत: ्ठ सौ ुपपये
(ii)स्ट् वचाजलत: एक हजार तीन सौ ुपपये (घ) भारी माल/ यात्री मोटर यान (i) हस्ट् तचाजलत: एक हजार ुपपये
(ii) स्ट् वचाजलत: एक हजार पांच सौ ुपपय।े’’; (ग) रम संख् या (11) और उससे संबंजधत प्रजवजियस के प चात,् जनम्नजलजखत अंत:स्ट् थाजपत दकया जाएगा, अथागत् :- “11क. 15 वर्ग से अजधक पकराने मोटर वाहनस (पररवहन) के जलए उपयकक् तता प्रमाणपत्र प्रदान करना या नवीनीकरण 62(2) (क) मोटर साइकल एक हजार ुपपये (ख) तीन पजहयस वाले या क् वाड्रीसाइकल तीन हजार पांच सौ ुपपये (ग) हल् के मोटर यान सात हजार पांच सौ ुपपये (घ) मध् यम माल या यात्री मोटर यान दस हजार ुपपये (ड.) भारी माल या यात्री मोटर यान बारह हजार पांच सौ ुपपये रट पण :उपयकक् तता प्रमाण पत्र की अवजध समा त होने के बाद देरी के प्रत्येक ददन के जलए पचास ुपपये का अजतररक्त फीस वसूली जाएगी।’’। [सं. ्रटी-23013/2/2021-टी] अजमत वरदान, संयकक् त सजचव रट पण: मूल जनयम भारत के राजपत्र, असाधारण, भाग-II, खंड 3, उप-खंड (i) में अजधसूचना संख्या सा.का.जन. 590 (अ), 2 जून, 1989 द्वारा प्रकाजित दकए गए थे और अंजतम बार संिोधन अजधसूचना संख् या सा.का.जन 676 (अ), जतजथ 29 जसतंबर, 2021 द्वारा दकया गया था । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 4th October, 2021 G.S.R. 714(E).—Whereas certain draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 191 (E), dated the 15th March, 2021, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And, whereas, copies of the said Gazette notification were made available to the public on the 15th March, 2021; And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of powers conferred by section 64 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- RULES
1. Short title and commencement. –(1) These rules may be called the Central Motor Vehicles (Twenty Third Amendment) Rules, 2021.
(2) They shall come into force with effect from the 1st day of April, 2022.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 47, in sub-rule
(1), after clause (m), the following clause shall be inserted, namely: - ―(n) Certificate of Deposit, if available;
Explanation.- For the purposes of these rules, the expression "Certificate of Deposit" shall have the same meaning as assigned to it in clause (c) of sub-rule (1) of rule 3 of the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021.".
3. In the said rules, in rule 81, -
(i) after the proviso, the following proviso shall be inserted, namely: - ―Provided further that, in case the vehicle is registered on submission of ‗Certificate of Deposit‘, the fee for issue of certificate of registration shall not be levied.‖;
(ii) in the TABLE,-

(2) Six thousand rupees Note 1: Additional fee of two hundred rupees shall be levied if the certificate of registration is a smart card type issued or renewed in Form 23A.
Note 2: In case of delay in applying for renewal of certificate of registration, an additional fee of three hundred rupees for delay of every month or part thereof in respect of motor cycles and five hundred rupees for delay of every month or part thereof in respect of other classes of non-transport vehicles shall be levied.‖;
(b) after serial number (10) and the entries relating thereto, the following shall be inserted, namely: - ―10A. Conducting test of a vehicle for grant and renewal of certificate of fitness for motor vehicles older than 15 years: 62(2)
(a) Motorcycle
(i) Manual: Four hundred rupees
(ii)Automated: Five hundred rupees
(b) Three wheeled or light motor vehicle or quadricycle
(i) Manual: Eight hundred rupees
(ii) Automated: One thousand rupees
(c)Medium goods or passenger motor vehicle
(i) Manual: Eight hundred rupees
(ii)Automated: One thousand three hundred rupees
(d) Heavy goods or passenger motor vehicle
(i) Manual: One thousand rupees
(ii) Automated: One thousand five hundred rupees.‖;
(c) after serial number (11) and the entries relating thereto, the following shall be inserted, namely: - ―11A. Grant or renewal of certificate of fitness for motor vehicles (transport) older than 15 years: 62(2)
