1. लघ ुशीषᭅ एव ंᮧारंभ-(1) इस आदेश को पौध संगरोध (भारत मᱶ आयात का िविनयमन) (छठा संशोधन) आदशे, 2016 कहा जाए।

(2) यह राजकᳱय राजपᮢ मᱶ ᮧकाशन कᳱ ितिथ से ᮧवृ᭜ त होगा।

2. पौध संगरोध (भारत मᱶ आयात का िवनयमन) आदशे, 2003 कᳱ अनुसूची–II मᱶ खंड 3 (1, 2, 4, 6, 9) से संबंिधत िव᳒मान ᮧिवि᭬ टयᲂ के ᭭ थान पर िन᭥ निलिखत ᮧिवि᭬ टयां रखी जाएंगी, अथाᭅत:- ‘3. पौधᲂ, पौध उ᭜ पादᲂ आᳰद का आयात

(1) ᳰकसी ᮧकार के पौधᲂ, पौध उ᭜ पादᲂ तथा अ᭠ य िविनयिमत व᭭ तुᲐ (इसके प᭫ चात ‘खेप’ के ᱨप मᱶ संदᳶभत) को इस आदशे के तहत िनधाᭅᳯरत पौध ᭭ व᭒ छता शतᲄ का अनुपालन ᳰकए िबना भारत मᱶ आयात नहᱭ ᳰकया जाएगा। यह आदशे बीजᲂ/अनाज, फली, िगᳯरयᲂ, फलᲂ, ब᭨ ब, क᭠ दᲂ,/म᭍ का, ᳯरजोमेस, कॉलᭅमेट, कᳳटग, सᳰकष, ᮕा᭢ट ,छोटे पौधᲂ, बड वुड, जड़ᲂ, ᱨट᭭ टॉक ,फूलᲂ, पराग, सूखी पौध सामᮕी, ᳯट᭥ बर, काठ, लᲶे , ᳯटशु क᭨ चर पौध, मृदा, भूिम, िचकनी, िमᲵी , बालू, पीट/काई, जीिवत कृिम, माईᮓोबाइल क᭨ चर, जैव- िनयंᮢण एंजे᭠ टᲂ, ᮝांसजेिनक पौधᲂ तथा आनुवांिशक ᱨप से संशोिधत अवयवᲂ आᳰद तक सीिमत न होकर इनके सिहत सभी पौधᲂ, पौध उ᭜ पादᲂ तथा अ᭠ य व᭭ तुᲐ के आयात को िविनयिमत करेगा।

(2) अनुसूची –IV मᱶ उि᭨ लिखत पौध ᮧजाितयᲂ अथवा ᳰक᭭ म के संबंध मᱶ पौधᱶ/पौध उ᭜ पादᲂ कᳱ ᳰकसी ᮰ेणी को उ᭍ त अनुसूची के कालम (4) मᱶ ᮧ᭜ येक के सामने उ᭨ लेिखत दशेᲂ से भारत मᱶ आयात ᳰकए जाने कᳱ अनुमित नहᱭ दी जाएगी। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II —SEC. 3(ii)]

(3) इस ख᭛ ड को समा᭡ त ᳰकया जाएगा।

(4) मोटे अनाजᲂ, दलहनᲂ, ितलहनᲂ और चारा बीजᲂ तथा फल पौध ᳰक᭭ सᲂ के बीज/᭭ टॉक सामᮕी कᳱ खेपᲂ के आयात भी अनुमित ᮧसार के िलए केवल कृिष, सहकाᳯरता एवं ᳰकसान क᭨ याण िवभाग (डीएसी ए᭛ ड एफ ड᭣ लू) कᳱ आयात-िनयाᭅत सिमित कᳱ िसफाᳯरशᲂ के आधार पर ही दी जाएगी, पौध संगरोध आदशे कᳱ अनुसूची –XII मᱶ यथा िविन᳸द᭬ ट उनकᳱ ᮝायल सामᮕी को छोड़कर।

(5) इस ख᭛ ड को समा᭡ त ᳰकया जाएगा।

(6) ख᭛ ड 4, 6 व 7 मᱶ यथा संदᳶभत िविनयिमक व᭭ तुᲐ कᳱ ᳰकसी खेप को अनुसूची X मᱶ यथा िविन᳸द᭬ ट ᮧािधकारी ᳇ारा जारी आयात परिमट ᮧ᭭ तुत ᳰकए िबना आयात कᳱ अनुमित नहᱭ दी जाएगी।

(9) जारी ᳰकए गए परिमट जारी करने कᳱ तारीख से 12 महीने कᳱ अविध तक मा᭠ य हᲂगे और खंड 3 (14) (i) के अनुसार ये बᱟल प᭜ तनᲂ मᱶ ᮧवेश करने और बᱟ-अंशीय लदानᲂ के िलए वैध हᲂगे बशतᱸ िनयाᭅत, आयातक व उ᳄म देश पूरी खेप के िलए वही हो। परिमट जारी करने वाला ᮧािधकारी के अनुरोध पर परिमट कᳱ वैधता कᳱ अविध को 500 ᱨ0 का शु᭨ क वसूलने के बाद और अिधक 12 महीने के िलए बढ़ा सकते हᱹ, बशतᱸ वैधता कᳱ अविध बढ़ाने वाले अनुरोध जारी करने वाले ᮧािधकारी को उिचत कारणᲂ सिहत परिमट समा᭡ त होने कᳱ तारीख से पहले ᳯरकाडᭅ करने हतेु िलिखत ᱨप से भेजा जाए। आयात परिमट जारी ᳰकए जाते समय यᳰद त᭝ य या ᳰकसी व᭭ तुपरक सूचना को िछपाया जाता ह ैतो परिमट िनर᭭ त या वािपस िलया जा सकता ह।ै

(11) इस खंड को हटाया जाएगा।

3. पौध संगरोध (भारत मᱶ आयात का िविनयमन) आदशे, 2003 के अ᭟ याय-II मᱶ ख᭛ ड 4 से संबंिधत मौजूदा ᮧिवि᭬ टयᲂ को िन᭥ नांᳰकत ᮧिवि᭬ टयᲂ के साथ अंत: ᮧित᭭ थािपत ᳰकया जायेगा, जो िन᭥ नानुसार है -: ‘4. मृदा, ᮕोइंग मीिडया आᳰद का आयात - मृदा, ᮕोइंग मीिडया (मृदा,पीट अथवा अ᭠ य जैिवक सामᮕी), रेत एवं पीट अथवा ᭭ फेगनम, काई, ऐसी ही अ᭠ य सामᮕी और प᭜ थरᲂ के आयात कᳱ अनुमित िन᭥ नाᳰंकत शतᲄ को छोड़कर नहᱭ दी जायेगी, जो िन᭥ नानुसार है :- i. अनुसंधान ᮧयोजन के िलए ᳰकसी भी ᱨप मᱶ रखी गई मृदा, रेत ऐसी ही अ᭠ य सामᮕी और औ᳒ोिगक एवं गैर कृिष ᮧयोजन के िलए प᭜ थर, ᮕोइंग मीिडया (मृदा,पीट अथवा अ᭠ य जैिवक सामᮕी ) पीट अथवा बागवानी ᮧयोजनᲂ के िलए ᭭ फेगनम, काई को िविन᳸द᭬ ट वायु अथवा पोत प᭜ तनᲂ अथवा सीमा शु᭨ क ᭭ टेशन के ᳇ारा अनुमित दी जा सकती ह।ै ‘’बशतᱸ ᳰक आयात परिमट अनुसधंान ᮧयोजन के िलए ᳰकसी भी ᱨप मᱶ मृदा, ᮕोइंग मीिडया (मृदा,पीट अथवा अ᭠ य जैिवक सामᮕी ), पीट अथवा बागवानी ᮧयोजनᲂ के िलए ᭭ फेगनम, काई के िलए आव᭫ यक हो’’ ii. उपयुᭅ᭍ त (i) मᱶ उि᭨ लिखत ᮧयोजन हतेु आवेदन अथवा ऑन लाईन आवेदन को पी᭍ यू ᮧपᮢ 06 मᱶ कम से कम 10 ᳰदन पहले अनुसूची- 10 मᱶ यथा सूचीकृत िनगᭅमन ᮧािधकारी को ᮧ᭭ तुत ᳰकया जायेगा। iii. 1000 ᱨ० का शु᭨ क आवेदन के साथ अदा ᳰकया जायेगा। इस शु᭨ क को ऑनलाईन अथवा िडमांड ᮟा᭢ट के ᱨप मᱶ ऐसा कायᭅᭃेᮢ रखने वाले सᭃम ᮧािधकारी के नामे डाला जायेगा। iv. सᭃम ᮧािधकारी आवेदन कᳱ सू᭯ म जांच करने के बाद और उसके ᮧयोजन से संतु᭬ ट होने पर िजसके िलए उसे आयात ᳰकया जा रहा है, पी᭍ यू पपᮢ-07 मᱶ एक िवशेष परिमट जारी करेगा। इस आयात परिमट को अनुसूची-VI के तहत िविनधाᭅᳯरत ऐसी पाबंᳰदयᲂ और शतᲄ के अ᭟ यधीन जारी ᳰकया जायेगा।

4. पौध संगरोध (भारत मᱶ आयात का िविनयमन) आदशे, 2003 के अ᭟ याय-2 मᱶ ख᭛ ड 7 से संबंिधत मौजूदा ᮧिवि᭬ टयᲂ को िन᭥ नाᳰंकत ᮧिवि᭬ टयᲂ के साथ ᮧित᭭ थािपत ᳰकया जायेगा, जो िन᭥ नानुसार है - ‘7. आलगे/जवै िनयंᮢ ण कारकᲂ सिहत जीिवत कᳱटᲂ और अ᭠ य आᮣोपोडस/नमेोटो᭙स/माइᮓोबले क᭨ चसᭅ का आयात )1 ( भारत मᱶ अनसुूची-X के तहत यथा िविन᳸द᭬ ट सᭃम ᮧािधकारी ᳇ारा ᳶनगिमत वैध आयात परिमट के िबना ᳰकसी भी आलगे/जैव िनयंᮢण कारकᲂ सिहत जीिवत कᳱटᲂ और अ᭠ य आᮣोपोडस/नेमोटो᭙स/माइᮓोबेल क᭨ चसᭅ के आयात कᳱ अनुमती नही दी जा सकती। )2 ( आलगे/जैव िनयंᮢण कारकᲂ सिहत जीिवत कᳱट पतंगᲂ और अ᭠ य आᮣोपोडस/िनमाटादसे/माइᮓोबेल क᭨ चसᭅ का आयात करने कᳱ अनुमित लेने के ᮧयोजनाथᭅ ᮧ᭜ येक आवेदन अथवा ऑनलाईन आवेदन लेखा अिधकारी, पौध संगरोध और भंडारण, फरीदाबाद - 121001 ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 के पᭃ मᱶ ᳶनगिमत बᱹक ᮟा᭢ट के ᱨप मᱶ पंजीकृत 1000 ᱨ० के श᭨ु क के साथ पौध संरᭃण सलाहाकार को कम स ेकम 30 ᳰदन पहले पी᭍ य ू ᮧपᮢ- 12 मᱶ ᳰकया जायेगा। )3 ( सᭃम ᮧािधकारी आयात के ᮧयोजन से संतु᭬ ट होने कᳱ ि᭭ थित मᱶ और इसके साथ लगाई गई ऐसी शतᲄ के अ᭟ यधीन तीन ᮧितयᲂ मᱶ पी᭍ यू ᮧपᮢ-13 मᱶ परिमट जारी करेगा। )4 ( आलगे/जैव िनयंᮢण कारकᲂ सिहत जीिवत कᳱटᲂ और अ᭠ य आᮣोपोडस/िनमाटादसे/माइᮓोबेल क᭨ चसᭅ से संबंिधत सभी ᮧेिषती माल कᳱ अनुमित खंड 3 )14( के तहत िविन᳸द᭬ ट ᮧिवि᭬ ट के िब᭠ दᲐु के मा᭟ यम से ही दी जायेगी। लाभकारी कᳱटᲂ के साथ िविन᳸द᭬ ट परजीिवयᲂ और परजीवᲂ पर आधाᳯरत ज᭠ तुᲐ से मु᭍ त तथा हाईपर परजीिवयᲂ से मु᭍ त जैव िनयंᮢण कारकᲂ के िलए कᳱ गई अितᳯर᭍ त घोषणाᲐ के साथ उस संबंिधत दशे मᱶ रा᭬ ᮝीय पौध संरᭃण संगठन ᳇ारा िनगᭅिमत ᮧमाण पᮢ के साथ दी जायेगी। )5 ( यह खंड कृिष से संब᭟ दता न रखने वाले आलगे/जैव िनयंᮢण कारको सिहत जीिवत कᳱटᲂ और अ᭠ य आᮣोपोडस/िनमाटादसे / माइᮓोबेल क᭨ चसᭅ के आयात पर लागू नहᱭ होगा।

5. पौध संगरोध (भारत मᱶ आयात का िविनयमन) आदशे, 2003 के अ᭟ याय-III मᱶ ख᭛ ड 10 से संबंिधत मौजूदा ᮧिवि᭬ टयᲂ को िन᭥ नाᳰंकत ᮧिवि᭬ टयᲂ के साथ अंत :᭭ थािपत ᳰकया जायेगा, जो िन᭥ नानुसार ह:ै- ‘10. पौध ᮧजाितयᲂ के आयात के िलए िवशेष शत-ᱸ )1 ( अ᭟ याय - 2 मᱶ उपयुᭅ᭍ त सूचीब᳍ सामा᭠ य शतᲄ के अलावा अनुसूची V, VI और VII मᱶ उि᭨ लिखत के बाद एतत् प᭫ चात पौध ᮧजाितयᲂ को आयात कᳱ अनुमित दी जायेगी बशतᱸ ऐसे ᮧितबंध और शतᱸ इस अ᭟ याय मᱶ िविन᳸द᭬ ट ह।ै )2 ( अनुसूची V, VI और VII मᱶ िविन᳸द᭬ ट पौध ᮧजाितयᲂ के साथ मलू दशे पर ᮧािधकृत ᮧािधकारी ᳇ारा जारी मूल पादप ᭭ व᭒ छता ᮧमाण पᮢ लगा होगा अथवा मूल दशे से पादप ᭭ व᭒ छता ᮧमाण पᮢ के साथ-साथ पुनᳶनयातक दशे ᳇ारा जारी पुनᳶनयात हतेु पादप ᭭ व᭒ छता ᮧमाण पᮢ, जैसी भी ि᭭ थित हो, लगा होगा तथा अितᳯर᭍ त घोषणा भी होगी ᳰक यह खेप इस आदशे कᳱ अनुसूची V और VI के तहत उि᭨ लिखत नाशीजीवᲂ से मु᭍ त ह ैअथवा ᳰक यथा िविन᳸द᭬ ट नाशीजीव दशे मᱶ अथवा मूल दशे मᱶ नहᱭ ह।ै )3 ( जहां कहᱭ लागू हो मृदा और/अथवा खरपतवार से मुि᭍ त और उपचार से संबंिधत िवशेष शतᱸ, यथा अनुसूची V और VI के तहत िविन᳸द᳥ हो, ऐसे पादप ᭭ व᭒ छता ᮧमाण पᮢ पृ᳥ांᳰकत ᳰकए जायेगᱶ। )4 ( खंड 3 )4( और 3(11) के तहत िनधाᭅᳯरत शतᲄ के अ᭟ यधीन पौधᲂ और पौध सामᮕी कᳱ खेप आयाितत कᳱ जायेगी।

6. पौध संगरोध (भारत मᱶ आयात का िविनयमन) आदशे, 2003 के मौजूदा पी᭍ यू ᮧपᮢ ,01 02, 03, 04 , 05, 10, 11 व 14 को िनर᭭ त ᳰकया जाएगा।

7. पौध संगरोध (भारत मᱶ आयत िविनयमन) आदशे, 2003 मे, िव᳒मान पी᭍ यू फामᭅ 06, 07, 12 एवं 13 तथा उनसे संबंिधत ᮧिवि᭬ टयां िन᭥ निलिखत ᮧिवि᭬ टयᲂ ᳇ारा ᮧित᭭ थािपत कᳱ जाएगी। पी᭍ यू फामᭅ 06 (संᮧतीक) भारत सरकार कृिष एवं ᳰकसान क᭨ याण मंᮢालय कृिष, सहकाᳯरता एवं ᳰकसान क᭨ याण िवभाग पादप संरᭃण, संगरोध एवं भंडारण,िनदशेालय एनएच-IV, फरीदाबाद (हᳯरयाणा-121001) मृदा/ᮕोᳲवग मीिडया/पीट या सैफा᭏ नम ओस आयात करने के िलए अनु᭄ापᮢ हतेु आवेदन सेवा मᱶ (ह᭭ ताᭃरᮧािधकारी) 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II —SEC. 3(ii)] मᱹ/हम एत᳇ारा नीचे ᳰदए गए ᭣ यौरे अनुसार मृदा/ᮕोइंग मीिडया/पीट या सैफ᭏ नम मोस आयात करने कᳱ अनुमित हतेु िव᭟वंसक कᳱट व नशीजीव अिधिनयम, 1914 (1914 का 2) के खंड 3 के उप-खंड (1) के तहत जारी ᳰकए गए पादप संरᭃण (भारत मᱶ आयात का िवनयमन) आदशे, 2003 के खंड 4 (ii) के ᮧावधानᲂ अनुसार, एक आवेदन करता ᱠ/ं करते ह:ᱹ

12. आयात का िविश᭬ ट उ᳎े᭫ य घोषणा : मᱹ / हम एत᳇ारा पादप संरᭃण सलाहकार ᳍ारा िविधवत ᮧािधकृत अिधकारी को परेषण के िनरीᭃण/ उपचार कᳱ ᳰदशा मे िनधाᭅᳯरत शु᭨ क अदा करने और उनके ᳇ारा जारी अनुदशेᲂ/ ᳰदशा िनदᱷशᲂ का अनुपालन करने के िलए वचनब᳍ ᱠ ं/ह।ᱹ ᳰदनांक ---------------- ᭭ थान ------------------ (आयातक या उसके ᮧािधकृत एजे᭠ ट के ह᭭ ताᭃर एवं नाम) पी ᭍ य ूफामᭅ 07 (संᮧतीक) भारत सरकार कृिष एवं ᳰकसान क᭨ याण मंᮢालय कृिष, सहकाᳯरता एवं ᳰकसान क᭨ याण िवभाग पादप संरᭃण, संगरोध एवं भंडारण,िनदशेालय एनएच-IV, फरीदाबाद (हᳯरयाणा-121001) मृदा/ᮕोइंग िमिडया/पीट या सैफा᭏ नम मोस के आयात हतेु अनु᭄ापᮢ अनु᭄ापᮢ सं. ------------------------------------ जारी करने कᳱ तारीख.................. तक वैध -------------------------------- िव᭟ वंसक कᳱट व नशीजीव अिधिनयम, 1914 (1914 का 2) के खंड 3 के उप-खंड (1) के तहत जारी ᳰकए गए पादप संरᭃण (भारत मᱶ आयात का िवनयमन) आदशे, 2003 के खंड 4 के ᮧावधानᲂ अनुसार, मᱹ एतद᳇ारा नीचे ᳰदए गए ᭣ यौरे अनुसार मृदा/ ᮕोइंग मीिडया/पीट या सैफा᭏ नम मोस का िन᭥ निलिखत परेषण का आयात करने कᳱ अनमित ᮧदान करता ᱠ ं:

1. आयातक का नाम एवं पता

2. िनयाᭅतक का नाम एवं पता

3. मूल दशे

4. ᮧवेश ᭭ थल

5. खेप का वणᭅन 6. माᮢा भार/आयतन 7. पैकेज सं᭎ या 8. पै᳴कग प᳍ित ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5

9. उ᭍ त अनुमित िनि᭥ निलिखत शतᲄ के अधीन ᮧदान कᳱ गई ह:ै

(1) आयाितत परेषण ᮧारंिभक मुल दशे के ᮧािधकृत अिधकारी ᳇ारा जारी ᳰकए गए एक अिधकाᳯरक पादप ᭭ व᭒ छता ᮧमाण पᮢ लगाया जाऐगा ᳰक (क) ---------------------------------------------------------------------------------------------------------------------(ख) ------------------- --------------------------------------------------------------------------------------------- (ग) ---------------------------------------------------------------------------------------------------------------------

(2) अनु᭄ा पᮢ ह᭭ तांतरणीय नहᱭ ह ैऔर जारी करने कᳱ तारीख से बारह माह कᳱ अविध के िलए वैध रहेगा और गुणा᭜ मक पोटᭅ पᱟंच के िलए वैध होगा तथा िनयाᭅतक, आयतम और संपूणᭅ परेषणके िलए उसी मूल दशे ᳇ारा उपल᭣ ध कराए गए बᱟ भाग ब᭠ ᮤ गाहᲂ के िलए वैध होगा। मुल दशे / पुन िनयाᭅत, जो भी मामला हो शारांस जारीपादप ᭭ व᭒ छता ᮧमाणपᮢ पर अनु᭄ापᮢ सं᭎ या दजᭅ कᳱ जाएगी

1. Short title and Commencement.- (1) This Order may be called the Plant Quarantine (Regulation of Import into India) (Sixth Amendment) Order, 2016.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. In Chapter II of Plant Quarantine (Regulation of Import into India) Order, 2003, the existing entries relating to clause 3 (1, 2, 4, 6, 9,) shall be replaced with the following entries, namely:- ‘3. Import of plants, plant products etc.

(1) No plants, plant products and other regulated articles (hereinafter referred to as ‘consignment’) shall be imported into India without complying the phytosanitary conditions stipulated under this Order. The order shall regulate import of all plants, plant products and other articles including but not limited to seeds/grains, pods, nuts, fruits, bulbs, tubers, corms/cormlets, rhizomes, suckers, cuttings, grafts, saplings, bud woods, roots, rootstock, flowers, pollens, dry plant materials, timber, wood, logs, tissue culture plants, soil, earth, clay, sand, peat/moss, live insects, microbial culture, biocontrol agents, transgenic plants and genetically modified organisms etc.,

(2) No categories of plants/plant products in respect of the plant species or variety mentioned in Schedule-IV shall be allowed to be imported into India from the countries mentioned against each in column (4) of the said Schedule.

(3) This Clause shall be omitted.

(4) Import of consignments of seeds of coarse cereals, pulses, oil seeds and fodder seeds and seeds/stock material of fruit plant species for propagation shall only be permitted based on the recommendations of EXIM Committee of Department of Agriculture, Cooperation & Farmers Welfare (DAC&FW), except the trial material of the same as specified in Schedule- XII of Plant Quarantine Order.

(5) This Clause shall be omitted.

(6) No consignment of regulated articles as referred under Clauses 4, 6 and 7 shall be allowed for import, unless accompanied with an import permit issued by the authority as specified under Schedule X.

(9) The import permit issued shall be valid for twelve months from the date of issue and valid for multiple port access and multiple part shipments in accordance with Clause 3(14) (i) provided the exporter, importer and country of origin are the same for the entire consignment. The issuing authority may, on request, extend the period of validity for a further period of twelve months after charging Rs. 500/- provided such request for extension of validity is made to the issuing authority before the expiry of the permit with adequate reasons to be recorded in writing. In case of suppression of the facts or any material information, issue of import permit is liable to be cancelled or withdrawn.

(11) This Clause shall be omitted

3. In Chapter II of Plant Quarantine (Regulation of Import into India) Order, 2003, the existing entries relating to clause 4 shall be replaced with the following entries, namely:- ‘4. Import of soil, growing media, etc. - No import of soil, growing media (with soil, peat or other organic materials), sand and peat or sphagnum moss, similar material and stone shall be permitted except under the following conditions, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 i. The consignments of soil in any form for research purpose; sand, similar material and stone for industrial and non-agriculture purpose; growing media (with soil, peat or other organic materials), peat or sphagnum moss for horticultural purposes, may be permitted through specified air or sea ports or land customs station. “Provided an import permit shall be required for consignment of soil in any form for research purpose; growing media (with soil, peat or other organic materials), peat or sphagnum moss for horticultural purposes” ii. The application or online application for the purpose referred to in (i) above shall be made to the Issuing Authority as listed in Schedule-X, at least 10 days in advance, in PQ Form 06. iii. A fee of Rs. 1000/- shall be payable along with the application. The fee shall be payable online or in the form of Demand Draft payable to the Competent Authority having jurisdiction. iv. The Competent Authority may, after scrutiny of the application, and if satisfied of the purpose, for which such consignment is being imported, issue special permit in PQ Form 07. The import permit shall be issued subject to such restrictions and conditions prescribed under Schedule-VI.’ 4 In Chapter II of Plant Quarantine (Regulation of Import into India) Order, 2003, the existing entries relating to clause 7 shall be replaced with the following entries, namely:- ‘7. Import of live insects and other arthropods/nematodes/microbial cultures including algae/bio-control agents -

(1) No consignment of live insects and other arthropods/nematodes/microbial cultures including algae/bio-control agents shall be permitted into India without valid import permit issued by competent authority as specified under Schedule-X.

(2) Every application or online application for permit to import live insects and other arthropods/nematodes/microbial cultures including algae/bio-control agents, shall be made in the PQ Form 12 at least thirty days in advance to Plant Protection Adviser along with a fee of Rs. 1000/- towards registration in the form of bank draft issued in favour of the Accounts Officer, Directorate of Plant Protection Quarantine and Storage, Faridabad-121001.

(3) The competent authority shall issue the permit in PQ Form 13 in triplicate, if satisfied of the purpose for which import is made and subject to such conditions imposed thereon.

(4) All the consignments of live insects and other arthropods/nematodes/microbial cultures including algae/bio-control agents shall be permitted only through points of entry specified under Clause 3(14). The consignment of beneficial insects shall be accompanied by a certificate issued by National Plant Protection Organisation at the country of origin with additional declarations for freedom from specified parasites and parasitoids and the bio-control agents free from hyper-parasites. The consignment of beneficial insects/bio-control agents shall be subjected to post-entry quarantine as may be prescribed by the Plant Protection Adviser.

(5) Nothing contained in the clause shall apply to import of live insects and other arthropods/nematodes/microbial cultures including algae/bio-control agents having no relevance in agriculture.’ 5 In Chapter III of Plant Quarantine (Regulation of Import into India) Order, 2003, the existing entries relating to clause 10 shall be replaced with the following entries, namely:- ‘10. Special conditions for import of plant species –

(1) In addition to the general conditions listed above in Chapter-II, the plant species herein after mentioned in Schedules-V, VI and VII shall be permitted to be imported subject to such restrictions and conditions specified in this Chapter.

(2) Every consignment of plant species herein specified in Schedules-V, VI and VII shall be accompanied by an original Phytosanitary Certificate issued by the authorized officer at country of origin or Phytosanitary Certificate for re-export issued by the country of re-export along with attested copy of Phytosanitary Certificate from country of origin, as the case may be, with the additional declarations being free from pests mentioned under Schedules-V and VI of this order or that the pests as specified do not occur in the country or state of origin.

(3) The special conditions relating to treatment and freedom from soil and/ or weed as specified under Schedules V and VI shall be endorsed on such Phytosanitary Certificate, wherever applicable.

(4) The consignment of plants and planting material shall be imported subject to the conditions stipulated under Clause 3(4) and 3(11).’ 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II —SEC. 3(ii)]

6. In Plant Quarantine (Regulation of Import into India) Order, 2003, the existing PQ Forms 01, 02, 03, 04, 05, 10, 11 and 14 shall be omitted.

7.
