439(ऄ), तारीख 28 जून, 2021 द्वारा प्रकाजित दकए गए थ,े ईन सभी प्रभाजवत व्यजियों से, ईस तारीख से, जजसको ईि ऄजधसूचना से युि राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, तीस ददन की ऄवजध की समाजि के पूवग अक्षपे और सुझाव अमंजत्रत दकए गए थे ;
और राजपत्र की प्रजतयां, जजसमें ईि ऄजधसूचना प्रकाजित की गइ थी, जनता को 28 जून, 2021 को ईपलब्ध करा दी गइ थीं ;
और ईि प्रारूप जनयमों के संबंध में जनता से प्राि अक्षेपों और सुझावों पर कें द्रीय सरकार द्वारा जवचार कर जलया गया ह ै;
ऄत:, ऄब कें द्रीय सरकार, मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत श िजियों का प्रयोग करते हुए, कें द्रीय मोटरयान जनयम, 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै ऄथागत ्:--
1. सजंक्षि नाम और प्रारंभ—(1) आन जनयमों का संजक्षि नाम कें द्रीय मोटर यान (पचीसवााँ संिोधन) जनयम, 2021 ह ै। स.ं 586] नइ ददल्ली, मगंलवार, ऄक् तबूर 12, 2021/ अज वन 20, 1943 No. 586] NEW DELHI, TUESDAY, OCTOBER 12, 2021/ ASVINA 20, 1943 सी.जी.-डी.एल.-अ.-12102021-230371 CG-DL-E-12102021-230371 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) य ेराजपत्र में आनके प्रकािन की तारीख से प्रवृत श होंग े।
2. कें द्रीय मोटर यान जनयम, 1989 (जजसे आसमें आसके पश्चात ्ईि् जनयम कहा गया ह)ै के जनयम 115 में,--
(i) ईप-जनयम (18) के खंड (i) में, सारणी 2 के पश्चात ्रटप्पणों में, - (क) क्रम संखयांक (21) और ईससे संबंजधत प्रजवजियों के स्ट्थान पर, जनम्नजलजखत मद रखी जाएगी, ऄथागत् :-- "(21) इ12 या इ15 या इ20 या इ85 या इ100 के आथेनॉल जमश्रण के स्ट्तर के जलए यान की ऄनुकूलता को यान जनमागता द्वारा पररभाजित दकया जाएगा और आसे स्ट्पि रूप से ददखाइ देने वाला जस्ट्टकर यान पर लगाकर प्रद्ित दकया जाएगा।";
(ख) क्रम संखयांक (21) के पश्चात्, जनम्नजलजखत ऄतंःस्ट्थाजपत दकया जाएगा, ऄथागत ्:-- "(22) जद्व-ईंधन यानों के जलए, रेफरेंस गैसोलीन ईंधन जवजनमागता द्वारा ऄनुमोदन के दौरान घोजित इ-5 या इ 12 या इ 15 के ऄनुसार होगा ।''
(ii) ईप-जनयम (19) के खंड (i) में, -
(1) सारणी 2 में, 'एकल ईंधन', 'जद्व ईंधन', 'फ्लेक्स ईंधन' से संबंजधत स्ट्तंभ में, "(इ5)'', कोष्ठकों, ऄक्षर और ऄंक के स्ट्थान पर, जहां कहीं वे अते हैं, "(इ5)/(इ10)'', कोष्ठक, ऄक्षर और ऄंक रखे जाएगं;े
(2) सारणी 2 के पश्चात,् रटप्पणों में – (क) क्रम संखयांक (4) में, 'मद (क)' के स्ट्थान पर, जनम्नजलजखत रखा जाएगा, ऄथागत ्:-- "जवजनमागता द्वारा यथाजवजनर्ददि रेफरेंस गैसोलीन ईंधन (इ5) या (इ10), क्रमिः ईपाबंध 4-X या ईपाबंध 4-XA में यथाजवजनर्ददि होगा ।'' (ख) क्रम संखयांक (15) के स्ट्थान पर, जनम्नजलजखत मद रखी जाएगी, ऄथागत ्:-- "(15) इ12 या इ15 या इ20 या इ85 या इ100 के आथेनॉल जमश्रण के स्ट्तर के जलए यान की ऄनुकूलता को यान जनमागता द्वारा पररभाजित दकया जाएगा और आसे स्ट्पि रूप से ददखाइ देन ेवाला जस्ट्टकर यान पर लगाकर प्रद्ित दकया जाएगा।";
(ग) क्रम संखयांक (15) के पश्चात,् जनम्नजलजखत ऄतंःस्ट्थाजपत दकया जाएगा, ऄथागत ्:-- "(16) जद्व-ईंधन यानों के जलए, रेफरेंस गैसोलीन ईंधन जवजनमागता द्वारा ऄनुमोदन के दौरान घोजित इ-5 या इ10 या इ 12 या इ 15 के ऄनुसार होगा ।''
(iii) ईप जनयम (20) में, -
(1) सारणी 2 में, 'जद्व ईंधन/फ्लेक्स ईंधन' से संबंजधत स्ट्तंभ में, "(इ5)'', कोष्ठकों, ऄक्षर और ऄंक के स्ट्थान पर, जहां कहीं वे अत ेहैं, "(इ5)/(इ10)'', कोष्ठक, ऄक्षर और ऄंक रखे जाएंग;े
(2) सारणी 2 के पश्चात,् रटप्पणों में – (क) क्रम संखयांक (4) में, 'मद (क)' के स्ट्थान पर, जनम्नजलजखत रखा जाएगा, ऄथागत ्:-- "(i) जवजनमागता द्वारा यथाजवजनर्ददि रेफरेंस गैसोलीन ईंधन (इ5) या (इ10), क्रमिः ईपाबंध 4-X या ईपाबंध 4- XA में यथाजवजनर्ददि होगा ।
(ii) रेफरेंस एथनोल ईंधन (इ85) ईपाबंध 4-थ के ऄनुसार होगा'';
[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 (ख) क्रम संखयांक (15) के पश्चात,् क्रम संखयांक 15 और ईससे संबंजधत प्रजवजियों के स्ट्थान पर जनम्नजलजखत रखा जाएगा, - "(16) इ12 या इ15 या इ20 या इ85 या इ100 के आथेनॉल जमश्रण के स्ट्तर के जलए यान की ऄनुकूलता को यान जनमागता द्वारा पररभाजित दकया जाएगा और आसे स्ट्पि रूप से ददखाइ देन ेवाला जस्ट्टकर यान पर लगाकर प्रद्ित दकया जाएगा।";
"(17) जद्व-ईंधन यानों के जलए, रेफरेंस गैसोलीन ईंधन जवजनमागता द्वारा ऄनुमोदन के दौरान घोजित इ-5 या इ10 या इ 12 या इ 15 के ऄनुसार होगा ।''
(iv) ईप-जनयम (22) में, -
(1) सारणी 2 में, 'एकल ईंधन', 'जद्व ईंधन', 'फ्लेक्स ईंधन' से संबंजधत स्ट्तंभ में, "(इ5)'', कोष्ठकों, ऄक्षर और ऄंक के स्ट्थान पर, जहां कहीं वे अते हैं, "(इ5)/(इ10)'', कोष्ठक, ऄक्षर और ऄंक रखे जाएगं;े
(2) सारणी 2 के पश्चात,् रटप्पणों में, – (क) क्रम संखयांक (7) में, 'मद (क)' के स्ट्थान पर, जनम्नजलजखत रखा जाएगा, ऄथागत ्:-- "(i) जवजनमागता द्वारा यथाजवजनर्ददि रेफरेंस गैसोलीन ईंधन (इ5) या (इ10), क्रमिः ईपाबंध 4-X या ईपाबंध 4- XA में यथाजवजनर्ददि होगा ।'' (ख) क्रम संखयांक (15) के स्ट्थान पर जनम्नजलजखत मद रखी जाएगी, - "15. इ12 या इ15 या इ20 या इ85 या इ100 के आथेनॉल जमश्रण के स्ट्तर के जलए यान की ऄनुकूलता को यान जनमागता द्वारा पररभाजित दकया जाएगा और आसे स्ट्पि रूप से ददखाइ देन ेवाला जस्ट्टकर यान पर लगाकर प्रद्ित दकया जाएगा;
(16) जद्व-ईंधन यानों के जलए, रेफरेंस गैसोलीन ईंधन जवजनमागता द्वारा ऄनुमोदन के दौरान घोजित इ-5 या इ10 या इ 12 या इ 15 के ऄनुसार होगा ।''
3. ईि जनयमों के जनयम 115-छ के ईपजनयम (2) में, "टैप-115/116'', िब्द, ऄंकों और जचन्ह के पश्चात्, "एअइएस137'', िब्द और ऄकं ऄंतःस्ट्थाजपत दकए जाएंग े।
4. ईि जनयमों के जनयम 115-ट के पश्चात ्जनम्नजलजखत जनयम ऄंतःस्ट्थाजपत दकया जाएगा, ऄथागत् :-- "115-ठ. इ-12 (12% आथनेॉल-गसैोलीन जमश्रण) और इ-15 (15% आथनेॉल-गसैोलीन जमश्रण) यानों के जलए बडे़ पमैान ेपर ईत्सजगन मानक।
(1) इ -12 और इ -15 के आथेनॉल गैसोलीन जमश्रणों से चलाने के जलए स्ट्पाकग आजििन आंजन वाले नए जन्मत गैसोलीन यानों के प्रकार को प्रचजलत गैसोलीन ईत्सजगन मानदडंों के ऄनसुार ऄनुमोददत दकया जाएगा। ”
(2) इ12 और इ15 के आथनेॉल जमश्रण के स्ट्तर के जलए यान की ऄनुकूलता को यान जनमागता द्वारा पररभाजित दकया जाएगा और आसे स्ट्पि रूप से ददखाइ देने वाला जस्ट्टकर यान पर लगाकर प्रद्ित दकया जाएगा।
(3) टाआप ऄनुमोदन परीक्षण के जलए परीक्षण ऄपेक्षाएं नीचे दी गइ सारणी के ऄनुसार होंगी:
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी 1 सीएमवीअर ऄनपुालन हते ु3,500 दकलोग्राम स ेकम या ईसके बराबर के सकल यान भार वाल ेचार पजहया यान के जलए परीक्षण ऄपके्षाए ं क्र.स.ं परीक्षण गसैोलीन आथनेॉल जमश्रण यान 1 गैसीय प्रदिूक (टाआप I परीक्षण) इ 12 या इ 15 ईंधन 2 जनजरक्रय और ईच्च जनजरक्रय ईत्सजगन (टाआप II परीक्षण) इ 12 या इ 15 ईंधन 3 क्रैं ककेस ईत्सजगन (टाआप III परीक्षण) केवल गैसोलीन ईंधन पर 4 बारपीकरणीय ईत्सजगन (टाआप IV परीक्षण) केवल गैसोलीन ईंधन पर 5 रटकाउपन (टाआप V परीक्षण) केवल गैसोलीन ईंधन पर 6 गजतमान जस्ट्थजत में ऄनुरूपता केवल गैसोलीन ईंधन पर 7 काबगन डाइऑक् साआड और ईंधन की खपत इ 12 या इ 15 ईंधन 8 ऑनबोडग जांच (ओबीडी I या II) जैसा लाग ूहो और आस्ट् तेमाल के दौरान प्रदिगन ऄनपुात जनगरानी (अइयूपीअरएम) इ 12 या इ 15 ईंधन 9 आंजन की िजि इ 12 या इ 15 ईंधन रटप्पण-
1. सीएमवीअर ऄनुपालन के जलए ईत्सजगन परीक्षण, जैसा लागू हो और समय-समय पर संिोजधत एअइएस 137 के ऄनुसार दकया जाएगा।
2. सीएमवीअर ऄनुपालन के जलए यान जवजनमागता जनयम 126 के ऄधीन जनर्ददि परीक्षण ऄजभकरणों को यान सौंपेंगे।
3. खराब होने वाले कारक यान प्रवगग के जलए यथा ऄजधसूजचत प्रचजलत ईत्सजगन मानदंडों के ऄनुसार होंगे।
4. जब तक बीअइएस द्वारा इ -12 और इ -15 के जलए गैसोलीन आथनेॉल ईंधन जमश्रण को ऄजधसूजचत नहीं दकया जाता ह,ै तब तक सीएमवीअर ऄनुपालन के प्रयोजनाथग अइएस 17586: 2021 के ऄनुसार इ -12 और इ -15 के जलए वाजणजययक गैसोलीन आथनेॉल ईंधन जमश्रण ईंधन का आस्ट् तेमाल दकया जाएगा।
5. गैसोलीन रेफरेंस ईंधन यान प्रवगग के जलए यथा ऄजधसूजचत होगा ।
6. खराब होने वाले कारक यान प्रवगग के जलए यथा ऄजधसूजचत प्रचजलत ईत्सजगन मानदंडों के ऄनुसार होंगे। सारणी 2 सीएमवीअर ऄनपुालन हते ुदो पजहया यानों या तीन पजहया यानों या क् वाड्रीसीसाआकल के जलए परीक्षण ऄपके्षाए ं क्र.स.ं परीक्षण गसैोलीन आथनेॉल जमश्रण यान 1 गैसीय प्रदिूक (टाआप I परीक्षण) इ 12 या इ 15 ईंधन 2 जनजरक्रय और ईच्च जनजरक्रय ईत्सजगन (टाआप II परीक्षण) इ 12 या इ 15 ईंधन 3 क्रैं ककेस ईत्सजगन (टाआप III परीक्षण) केवल गैसोलीन ईंधन पर 4 बारपीकरणीय ईत्सजगन (टाआप IV परीक्षण) केवल गैसोलीन ईंधन पर 5 रटकाउपन (टाआप V परीक्षण) केवल गैसोलीन ईंधन पर [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 6 काबगन डाइऑक् साआड और ईंधन की खपत इ 12 या इ 15 ईंधन 7 ऑनबोडग जांच (ओबीडी I या II ) और अइयूपीअरएम, जैसे लाग ूहो इ 12 या इ 15 ईंधन 8 आंजन की िजि इ 12 या इ 15 ईंधन रटप्पण-
1. सीएमवीअर ऄनुपालन के जलए ईत्सजगन परीक्षण, जैसा लागू हो और समय-समय पर संिोजधत एअइएस 137 के ऄनुसार दकया जाएगा।
2. सीएमवीअर ऄनपुालन के जलए यान जवजनमागता जनयम 126 के ऄधीन जनर्ददि परीक्षण ऄजभकरणों को यान सौंपेंगे।
3. खराब होन ेवाल ेकारक यान प्रवगग के जलए यथा ऄजधसूजचत प्रचजलत ईत्सजगन मानदंडों के ऄनुसार होंगे।
4. जब तक बीअइएस द्वारा इ -12 और इ -15 के जलए गैसोलीन आथनेॉल ईंधन जमश्रण को ऄजधसूजचत नहीं दकया जाता ह,ै तब तक सीएमवीअर ऄनुपालन के प्रयोजनाथग अइएस 17586: 2021 के ऄनुसार इ -12 और इ -15 के जलए वाजणजययक गैसोलीन आथनेॉल ईंधन जमश्रण ईंधन का आस्ट् तेमाल दकया जाएगा। गैसोलीन रेफरेंस ईंधन यान प्रवगग के जलए यथा ऄजधसूजचत होगा।
5. खराब होन ेवाल ेकारक यान प्रवगग के जलए यथा ऄजधसूजचत प्रचजलत ईत्सजगन मानदंडों के ऄनुसार होंगे।” [फा. सं. अरटी-11036/111/2021-एमवीएल] ऄजमत वरदान, संयुक् त सजचव नोट : मलू जनयम भारत के राजपत्र, ऄसाधारण, भाग II, खड 3, ईप खंड (i) में ऄजधसूचना संख या सा. का. 590(ऄ), तारीख 2 जून, 1989 द्वारा प्रकाजित दकए गए थ े और ईनका ऄंजतम संिोधन ऄजधसूचना संख या सा. का. जन.
720(ऄ.) तारीख 5 ऄिूबर, 2021 द्वारा दकया गया था । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 11th October, 2021 G.S.R 728E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988) vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 439(E) dated the 28 th June, 2021, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date of which copies of the Gazette containing the said notification were made available to the public;
AND whereas, copies of the said Gazette notification were made available to the public on the 28 th June, 2021;
AND whereas, the objections and suggestions received from the public in respect of the said draft rules were considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. (1) These rules may be called as Central Motor Vehicles (Twenty Fifth Amendment) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. In Central Motor Vehicle Rules, 1989 (herein after referred to as said rules), in rule 115,-
(i) in sub-rule (18), in clause (i), after „Table 2‟, in the „Notes‟,-
(a) for serial number (21) and the entries relating thereto, the following item shall be substituted, namely.- “(21) The compatibility of vehicle to level of ethanol blend of E12 or E15 or E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker”;
(b) after serial number (21), the following shall be inserted, namely:,- “(22) For the bi-Fuel vehicles, the Reference Gasoline fuel shall be as per E5 or E10 or E12 or E15 as declared by the manufacturer during approval.”
(ii) in sub-rule (19), in clause (i),-
(1) in „TABLE 2‟, in column relating to „Mono-Fuel‟, „Bi-Fuel‟, „Flex-Fuel‟, for the brackets, letter and figure “(E5)”, wherever they occur, the brackets, letters and figures “(E5)/(E10)” shall be substituted;
(2) after „TABLE 2‟, in the „Notes‟,
(a) in serial number (4), for „item (a)‟, the following shall be substituted, namely.- “The reference Gasoline fuels (E5) or (E10), as specified by the manufacturer, shall be as specified in Annexure IV-X or Annexure IV-XA, respectively.”;
(b) for serial number (15), the following shall be substituted, namely.- “(15) The compatibility of vehicle to level of ethanol blend of E12 or E15 or E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker”;
(c) after serial number (15), the following shall be inserted, namely:- “(16) For the bi-Fuel vehicles, the Reference Gasoline fuel shall be as per E5 or E10 or E12 or E15 as declared by the manufacturer during approval.‟‟.
(iii) in sub-rule (20),-
(1) in „TABLE 2‟, in column relating to Bi-Fuel/Flex-Fuel, for the brackets, letter and figure “(E5)”, wherever they occur, the brackets, letters and figures “(E5)/(E10)” shall be substituted;
(2) after „TABLE 2‟, in the „Notes‟,
(a) in serial number (4), for „item (a)‟, the following shall be substituted, namely.- “(i) The reference Gasoline fuels (E5) or (E10) ,as specified by the manufacturer, shall be as specified in Annexure IV-X or Annexure IV-XA, respectively.
(ii) The reference ethanol fuel (E85) shall be as per the Annexure IV-Q”;
(b) after serial number (15), for serial number 15 and entries relating thereto, the following shall be substituted,- “(16) The compatibility of vehicle to level of ethanol blend of E12 or E15 or E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker;
(17) For the bi-Fuel vehicles, the Reference Gasoline fuel shall be as E5 or E10 or E12 or E15 as declared by the manufacturer during approval.‟‟.
(iv) in sub-rule (22),-
(1) in the „TABLE 2‟, in column relating to „Mono-Fuel‟, „Bi-Fuel‟ and „Flex-Fuel‟ for the brackets, letter and figure “(E5)”, wherever they occur, the brackets, letters and figures “(E5)/(E10)” shall be substituted;
(2) after „TABLE 2‟, in the „Notes‟,-
(a) in serial number (7), for „item (a)‟, the following item shall be substituted, namely.- “The reference Gasoline fuels (E5) or (E10),as specified by the manufacturer, shall be as specified in Annexure IV-X or Annexure IV-XA, respectively.”
(b) for serial number (15), the following item shall be substituted, namely.- [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 “15. The compatibility of vehicle to level of ethanol blend of E12 or E15 or E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker;
(16) For the bi-Fuel vehicles, the Reference Gasoline fuel shall be as per E5 or E10 or E12 or E15 as declared by the manufacturer during approval.”.
3. In the said rule, in rule 115-G, in sub-rule 2, after the words, figures and punctuation, “TAP-115/116”, the words and figures, “ AIS 137” shall be inserted.
4. In the said rule, after rule 115-K, the following rule shall be inserted, namely:- “115-L. Mass emission standard for E12 (12 % Ethanol-Gasoline Blend) and E15 (15 % Ethanol-Gasoline Blend) vehicles.
(1) The newly manufactured gasoline vehicles fitted with spark ignition engine compatible to run on ethanol gasoline blends of E12 and E15 shall be type approved as per prevailing gasoline emission norms.”
(2) The compatibility of vehicle to level of ethanol blend of E12 and E15 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.
(3) Test requirements for Type Approval test shall be as per Table below:

(1) Emission tests for CMVR compliance, shall be carried out as per AIS 137 as applicable and as amended from time to time.
(2) Vehicles manufacturer shall submit the vehicle to the Test Agencies referred under rule 126, for CMVR compliance.
(3) Deterioration factors shall be as per prevailing emission norms, as notified for the vehicle category.
(4) Till the time reference gasoline ethanol fuel blend for E12 and E15 is notified by BIS, commercial gasoline ethanol fuel blend fuel for E12 and E15, as per IS 17586: 2021, shall be used for the purpose of CMVR compliance.
(5) Gasoline Reference Fuel shall be as notified for the vehicle category.
(6) Deterioration factors shall be as per prevailing emission norms, as notified for the vehicle category.
