PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और रािमागग मतं्रालय अजधसचूना नई दिल्ली, 11 फरवरी, 2020 सा.का.जन. 104(अ).— केन्द्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की भारत के रािपत्र असाधारण, भाग II, खंड (3), उपखंड (i) अजधसूचना सा.का.जन. 512(अ) तारीख 18 िुलाई 2019 द्वारा प्रारुप जनयम प्रकाजित दकए गए थ ेजिसम ेउन सभी व्यजियों से जिनके उनस ेप्रभाजवत होने की संभावना थी, उस तारीख से जिसको उि अजधसूचना में अतंर्वगष्ट रािपत्र की प्रजतयां िनता को उपलब्ध करा िी थी, तीस दिन की अवजध के अवसान के पूवग आक्षेप और सूझाव आमंजत्रत दकए गय ेथ;े और उि रािपत्र अजधसूचना की प्रजतयां िनता को 18 िुलाई 2019 को उपलब्ध करा िी गई थी;
और उि प्रारुप जनयमों के संबंध में िनता से प्राप्त आक्षेपों और सूझावों पर कें रीय सरकार द्वारा जवचार दकया गया ह;ै अतः अब कें रीय सरकार मोटर यान अजधजनयम,1988 (1988 का 59) की धारा 110 द्वारा प्रित िजियों का प्रयोग करते हुए केन्द्रीय मोटर यान जनयम 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागतः- स.ं 86] नई दिल्ली, मगंलवार, फरवरी 11, 2020/माघ 22, 1941 No. 86] NEW DELHI, TUESDAY, FEBRUARY 11, 2020/MAGHA 22, 1941 सी.जी.-डी.एल.-अ.-12022020-216087 CG-DL-E-12022020-216087 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
1. सजंक्षप्त नाम और प्रारंभ – (1) इन जनयमों का संजक्षप्त नाम केन्द्रीय मोटर यान (जद्वतीय संिोधन) जनयम, 2019 ह।ै
(2) ये जनयम रािपत्र में अपने प्रकािन की तारीख को प्रवृत होंग।े
2. केन्द्रीय मोटर यान जनयम, 1989 में ( जिसे इसमें इसके पश्चात उि जनयम कहा गया ह)ै, जनयम 50 में उपजनयम 1 में,- (क) खंड (i) में “डीआईएन 1745/ डीआईएन 1783 या आईएसओ 7591” िब्िों और आकड़ों के स्ट्थान पर समय- समय पर यथा-संिोजधत एआईएसः 159: 2019 (ऐसे समय तक बीआईएस जवजनर्िगष्ट भारतीय मानक वू्यरो अजधजनयम, 2016 (2016 का 11) अथवा आईएसओः 7591 के अधीन अजधसूजचत दकया गया ह)ै” जनम्नजलजखत िब्ि आकडे़ और कोष्ठक रखे िाएंग;े (ख) खंड (iii) “सात” िब्ि के स्ट्थान पर “िस” िब्ि रखा िाएगा ;
(ग) खंड (iv) में,
(i) “अनजु्ञजप्त प्लेट जवजनमागता का रजिस्ट्रीकृत प्राजधकारी/अनुमोदित डीलर” िब्िों के स्ट्थान पर “ रजिस्ट्रीकृत प्राजधकारी/वाहन जवजनमागता और उसके डीलर” जनम्नजलजखत िब्ि रखे िाएगे ;
(ii) “ जवजनर्मगत अनुज्ञजप्त प्लेट या उसके डीलर” िब्िों के स्ट्थान पर “रजिस्ट्रीकृत प्राजधकारी / वाहन के जवजनमागता और उसके डीलर” जनम्नजलजखत िब्ि रखे िाएगे ;
(घ) खंड (v) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा अथागतः- “(v) प्लेट को वाहन के रीयर पर अस्ट्थानानतरणीय/गरै –पुनःप्रयोग करने वाले स्नेप लॉक दफटटंग प्रणाली के साथ बंधन दकया िाएगा ;
नय े वाहन के जलए सभी उपयुगि जवजनिेि और जवजनर्िगष्ट रजिस्ट्रीकरण के साथ अनजु्ञजप्त प्लेट को रजिसरीकरण प्राजधकारी अथवा वाहन जवजनमागताओं और उनके डीलरों द्वारा िारी दकया िाएगा और जवद्यमान पुरान े रजिस्ट्रीकृत वाहन को जलए रजिसरीकरण प्राजधकारी अथवा वाहन जवजनमागताओं और उनके डीलरों अथवा अनुमोदित अनुज्ञजप्त प्लेट जवजनमागताओं या उनके डीलरों द्वारा िारी दकया िाएगा । जनयम 26 के अधीन केन्द्रीय सड़क अनुसंधान संस्ट्थान, नई दिल्ली अथवा दकसी प्राजधकृत अजभकरण को इस जनयम के उपबंधों के अनुसार सुरक्षा रजिस्ट्रीकरण का अनुमोिन दकया िाएगा ।” (ङ) खंड (VI) में,- (i ) “मध्यम वाजणजययक वाहनों, भारी वाजणजययक वाहनों और रेलर/संयोिनः 340×200 जमलीमीटर” िब्िों आंकड़ों और अक्षरों के स्ट्थान पर “मध्यम वाजणजययक वाहनों, भारी वाजणजययक वाहनों और रेलर/संयोिनः 340×200 जमलीमीटर/ 500×120 जमलीमीटर” जनम्नजलजखत िब्ि आंकडे़ और िब्ि रखे िाएगे ;
(ii) पांचवे परन्द्तुक के पश्चात जनम्नजलजखत परन्द्तुक अंतस्ट्थाजपत दकया िाएगा अथागत,- “परन्द्तु यह और दक जनमागण उपकरण वाहन के मामले में उपकरण आकार और स्ट्थान की उपलब्धा के आधार पर प्लेट का आकार 500×120 जमलीमटर या 340×200 जमलीमीटर या 200×100 जमलीमीटर या 285×45 जमलीमीटर होगा ।”
3. उि जनयम में , जनयम 50 में उप-जनयम (2) में खंड (घ) में उप-जनयम (अ) के पश्चात जनम्नजलजखत उप-जनयम रखा िाएगा, अथागतः- भाग II–खण् ड 3(i) भारत का रािपत्र : असाधारण 3 “(अ आ) दकराए पर कैब स्ट्कीम, 1989 के अधीन मोटर कैब या दकराए पर मोटर साईदकल स्ट्कीम 1997 के अधीन मोटर साईदकल (एल-1 और एल-2 प्रवगग िो पजहया), काले रंग की पषृ्ठ भूजम पर पीला रंग, तथाजप दकराए पर कैब स्ट्कीम 1989 के अधीन बैटरी प्रचाजलत या इलेक्ट्रॉजनकी पावर की मोटर अथवा दकराए पर मोटर साईदकल स्ट्कीम 1997 के अधीन मोटर साईदकल के मामले में, हरे पषृ्ठभूजम पर काले रंग में ; और”।
4. उि जनयम में, जनयम 50 में, उप-जनयम (3) में पहले परन्द्तुक के स्ट्थान पर जनम्नजलजखत परन्द्तुक रखा िाएगा अथागतः- “परन्द्तु यह दक रजिस्ट्रीकृत जचन्द्ह सामन ेएक पंजि में हो सकता ह,ै 200 जममी×100 जममी साइि की प्लेट के मामले में यह ििागने का कोई पयागप्त स्ट्थान नहीं दक रजिस्ट्रीकृत जचन्द्ह एक पंजि में हो, रजिस्ट्रीकरण जचन्द्ह िो पंजियों में प्रिर्िगत दकया िा सकता ह ै। ” ।
5. उि जनयम में जनमय 51 में,- (क) आरंजभक पैरा के पश्चात, जनम्नजलजखत िीर्ग अन्द्तःस्ट्थाजपत दकया िाएगा, अथागतः- “सारणी” ;
(ख) नीचे िीर्ग सारणी को इस प्रकार अन्द्तःस्ट्थाजपत दकया िाएगा, जिसके सामन ेक्रम संख्या से संबंजधत पंजि से सामन,े “से अन्द्यून आयाम ” प्रजवष्टी के स्ट्थान पर “से अन्द्यून आयाम (जममी में)” जनम्नजलजखत प्रजवष्टी रखी िाएगी ;
(ग) सारणी में, क्रम संख्या 11 और उससे संबंजधत प्रजवजष्टयों के पश्चात जनम्नजलजखत क्रम संख्या और प्रजवजष्टयां रखी िाएगी, अथागतः- “12 जनमागण उपकरण वाहन सामन ेऔर पीछे के अक्षर और अंक (क) प्लेट आकार 500×120 जममी. या 340×200 जममी.

37 (अ) तारीख 17 फरवरी, 2019 द्वारा दकया गया था । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 11th February, 2020 G.S.R. 104(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R. 512 (E), dated the 18 th day of July, 2019, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions from all persons likely to be affected 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] thereby before the expiry of the period of thirty days from the date of which copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 18 th July, 2019;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short title and commencement. -(1) These rules may be called as the Central Motor Vehicles (Second Amendment) Rules, 2019.
(2) These rules shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules); in rule 50, in sub-rule 1,-
(a) in clause (i), for the words and figurers “DIN 1745/DIN 1783 or ISO 7591” the following words, figures and brackets “AIS:159:2019 as amended from time to time (till such time BIS specification is notified under the Bureau of Indian Standard Act, 2016 (11 of 2016) or ISO:7591” shall be substituted;
(b) in clause (iii) for the word “seven” the word “ten” shall be substituted;
(c) in clause (iv),-
(i) for the words “registering authorities/approved dealers of the licence plates manufacturers”, the following words “registering authority/vehicle manufacturer and their dealers” shall be substituted;
(ii) for the words “licence plate manufactured or his dealers” the following words “registering authority/vehicles manufacturer and their dealers: shall be substituted;
(d) for clause (v), the following clause shall be substituted, namely: - “(v) the plate shall be fastened with non-removable / non- reusable snap lock fitting system on rear of the vehicle;
The license plates with all the above specifications and the specified registrations for a new vehicle shall be issued by the registering authority or vehicle manufacturers and their dealers and for existing old registered vehicle shall be issued by registering authority or vehicle manufacturers and their dealers or by the approved licence plate manufacturers or their dealers. The Central Road Research Institute, New Delhi or any agency authorised under rule 126 shall approve the security registration as per the provisions of this rule”
(e) in clause (vi),-
(i) for the words and figures and letters “For medium commercial vehicles, heavy commercial vehicles and Trailer/combination: 340 x 200 mm” the following words, figure and letters “For medium commercial vehicles, heavy commercial vehicles and Trailer/combination: 340x200 mm/500 x 120 mm” shall be substituted;
(ii) after the fifth proviso the following proviso shall be inserted namely, - “Provided also that in case of Construction Equipment Vehicles, the size of plate shall be 500x120 mm or 340x200 mm or 200x100mm or 285x45mm, depending on the equipment size and availability of space.”.
3. In the said rules, in rule 50, in sub-rule (2), in clause (d), after the sub-clause (A), following sub- clause shall be inserted, namely. - “(AB) in case of motor cab under rent a cab scheme, 1989 or motor cycle (L1 and L2 category two wheeler) under rent a motor cycle scheme 1997, in yellow colour on black background, however in case of battery operated or electrically powered motor cab under rent a cab scheme 1989 or motor cycle under rent a motor cycle scheme 1997, in black colour on green background; and”.

4. In the said rules, in rule 50, in sub-rule (3) for first proviso, the following proviso shall be substituted, namely. - “Provided that the registration mark in the front may be in one line, in case, in 200mm x 100mm size plate, there is no sufficient place to exhibit the registration mark in one line, the registration mark may be exhibited in two lines:”.
5. In the said rules, in rule 51, -
(a) after the opening paragraph, the following heading shall be inserted, namely: - “Table”;
(b) below the heading Table as so inserted, against the row relating to Serial number (S.No.), for the entry “Dimensions not less than” the following entry shall be substituted “Dimensions (in mm) not less than ;
(c) in the Table, after S.No.11 and entries relating thereto, the following S.No. and entries shall be inserted, namely: - “12 Construction Equipment Vehicles Front and rear letters and numerals.- a) With plate size 500x120 mm or 340x200 mm 65 10 10 b) With plate size 200x100 mm 35 7 5 c) With plate size 285x45 mm 30 5 5” [F. Note.- The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i),vide notification number G.S.R. 590(E), dated the 2 nd June, 1989 and lastly amended vide notification number G.S.R 37 (E) dated 17 th January, 2020.
