PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल् ली, 23 फ़रवरी, 2022 सा.का.जन. 153(अ).—केन्द रीय मयार यान जनयम, 1989 का और संियधन करन ेके जलए प्रारूप जनयम मयार यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथापेजित भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना संख् या सा.का.जन. 287(अ), तारीख 23 अप्रैल, 2021 द्वारा भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में प्रकाजित दकए गए थ,े जजसमें उन सभी व् यज तयस से जजनका उससे प्रभाजवत हयना संभाव् य है, उस तारीख से, जजसकय प्रारूप जनयमस में अंतर्ववष् ा राजपत्र की प्रजतयां जनता कय उपल् ध करा दी गई थी, तीस ददनस की अवजध के अवसान से पूवग आिपे और सुझाव आमंजत्रत दकए गए थ े;
और उ त राजपत्र अजधसूचना की प्रजतयां 26 अप्रलै, 2021 कय जनता कय उपल् ध करा दी गई थी;
और उ त प्रारूप जनयमस के संबंध में जनता से प्रा् त आिपेस और सुझावस पर केन्द रीय सरकार द्वारा स यक् रूप से जवचार कर जलया गया ह ै;
अत:, अब केन्द रीय सरकार, मयार यान अजधजनयम, 1988 (1988 का 59) की धारा 41, धारा 50 और धारा 110 द्वारा प्रदत् त िज तयस का प्रययग करत े एए, केन्द रीय मयार यान जनयम, 1989 का और संियधन करने के जलए जन नजलजखत जनयम बनाती ह,ै अथागत् :-
1. संजि् त नाम और प्रारंभ.- (1) इन जनयमस का संजि् त नाम केन्द रीय मयार यान (तीसरा संियधन) जनयम, 2022 ह ै।

2. केन्द रीय मयार यान जनयम, 1989 (जजसे इसमें इसके पश् चात् उ त जनयम कहा गया ह)ै में, जनयम 112 के उपजनयम (8) के पश् चात् जन नजलजखत उपजनयम अतं:स्ट् थाजपत दकया जाएगा, अथागत् :- “(9) केन्द रीय मयार यान (तीसरा संियधन) जनयम, 2022 के प्रारंभ की तारीख से छह माह के पश् चात् जविेप प्रययजन यान अथागत् कैि वैन भारतीय मानक ् यूरय अजधजनयम, 2016 (2016 का 11) के अधीन तत् स्ट् थानी बीआईएस जवजनदोिस कय अजधसूजचत दकए जाने तक समय-समय पर यथासंियजधत एआईएस-163:2020 में कजथत अपेिाओं का अनुपालन करेगी ।”।
3. उ त जनयम में जनयम 125छ में उपजनयम (6) के पश् चात् जन नजलजखत उपजनयम अंत:स्ट् थाजपत दकया जाएगा, अथागत् :- “(7) केन्द रीय मयार यान (तीसरा संियधन) जनयम, 2022 के प्रारंभ की तारीख से छह माह के पश् चात् मलू उपस्ट् कर जवजनमागताओं द्वारा जनर्वमत जविेप प्रययजन यान अथागत् कैि वैन भारतीय मानक ् यूरय अजधजनयम, 2016 (2016 का 11) के अधीन तत् स्ट् थानी बीआईएस जवजनदोिस कय अजधसूजचत दकए जाने तक समय-समय पर यथासंियजधत एआईएस- 163:2020 में कजथत अपिेाओं का अनपुालन करेगी ।”।
4. उ त जनयम में प्ररूप 22च में “[(जनयम 47ख (3), 112(3), 112(4), 112(5), 112(6), 112(7), 112(8), 126 देजखएं)]” ि् दस, अंकस और कयष् ठकस के स्ट् थान पर “[(जनयम 47ख (3), 112(3), 112(4), 112(5), 112(6), 112(7), 112(8), 112(9), 126 देजखएं)]” ि् द, अंक और कयष् ठक रखे जाएंग े। [फा. सं. आराी-11036/69/2021-एमवीएल] अजमत वरदान, संयु त सजचव रा् पण : मलू जनयम अजधसूचना संख् यांक सा.का.जन. 590(अ), तारीख 2 जून, 1989 द्वारा भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में प्रकाजित दकए गए थ ेऔर अंजतम बार अजधसूचना संख् यांक सा.का.जन. 126(अ) तारीख 15 फरवरी, 2022 द्वारा संियजधत दकए गए थे । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 23rd February, 2022 G.S.R. 153(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 287(E), dated the 23rd April, 2021, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And, whereas, copies of the said Official Gazette in which the said notification was published were made available to the public on the 26th April, 2021;
And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sections 41, 50 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short title and commencement.- (1) These rules may be called the Central Motor Vehicles (Third Amendment) Rules, 2022.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 112, after sub-rule (8), the following sub-rule shall be inserted, namely:- “(9) On and after six months from the date of commencement of the Central Motor Vehicles (Third Amendment) Rules, 2022, Special Purpose Vehicle, viz. Cash Vans shall comply with the requirements stated in AIS-163:2020, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016(11 of 2016).”.
3. In the said rules, in rule 125-G, after sub-rule (6), the following sub-rule shall be inserted, namely:- “(7) On and after six months from the date of commencement of the Central Motor Vehicles (Third Amendment) Rules, 2022, Special Purpose Vehicle, viz. Cash Vans, manufactured by Original Equipment Manufacturers, shall comply with the requirements of AIS-163, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”.
4. In the said rules, in Form 22 F, for the words, figures and brackets, “[(See rules 47B (3),112(3), 112(4), 112(5), 112(6), 112(7), 112(8),126)]”, the words, figures and brackets, “[(See rules 47B (3),112(3), 112(4), 112(5), 112(6), 112(7), 112(8), 112(9),126)]”, shall be substituted.
