No. PNGRB/CGD/Amendment/ 2015/2/SC.—In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, namely: -

1. Short title and commencement.

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Amendment Regulations, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008,-

(a) in regulation 2, in sub regulation (1),-

(i) for clause (f),the following clause shall be substituted, namely:- ‘(}) “compression charge for CNG" means a charge (excluding statutory taxes and levies) in Rs. / Kg for online compression of natural gas into compressed natural gas (hereinafter referred to as CNG) for subsequent dispensing to customers in a CNG station to be paid by an entity to the entity authorised to operate the CGD network;’ Gi) for clause (h),the following clause shall be substituted, namely:- ‘(h) "network tariff" means the weighted average unit rate of tariff (excluding statutory taxes and levies) in rupees per million British Thermal Units (Rs./ MMBTU) for all the categories of customers of natural gas in a CGD network to be paid by an entity to the entity authorised to operate the CGD network;’

(b) in regulation 5,in sub-regulation (6), for clause (f), the following clause shall be substituted, namel y:- “(f) the entity, on being declared as a successful bidder and not being a company registered under the Companies Act, 1956 or Companies Act, 2013, shall get itself registered as a company under the Companies Act, 2013 within six months from the date of such declaration:”

(c) in regulation 7, in sub-regulation (1),-

(i) for clause (a), the following clause shall be substituted, namel y:- “(a) lowness of the present value of the overall unit network tariff, to be paid by an entity to the entity authorised to operate the CGD network, for usage of the proposed CGD network by all categories of customers of natural gas (including supply of natural gas to online compressor for CNG) over the economic life of the CGD network project (twenty five years from the date of authorization). The entity is required to bid for the tariff charge for each year of the economic life of the project and the variation in unit network tariff between any two consecutive years should not be more than ten per cent. This shall have a weightage of seventy per cent.;” Gi) for clause (b), the following clause shall be substituted, namely:- “(b) lowness of the present value of the compression charge for CNG, to be paid by an entity to the entity authorised to operate the CGD network, for dispensing in the CNG stations in the proposed CGD Lar I—ars 4] YR AT USTIA : STATA network over the economic life of the project. The entity is required to bid for the compression charge for each year of the economic life of the project and the variation in compression charge for CNG between any two consecutive years should not be more than ten per cent. This shall have a weightage of thirty per cent.;”

(d) in regulation 8,-

(iii) for sub-regulation (1), the following sub-regulation shall be substituted, namel y:- “(1) The network tariff for transportation of natural gas in the CGD networks, shall be fixed as per the network tariff bid under clause (a) of sub-regulation (1) of regulation 7 and shall be recovered from an entity by the entity authorised to operate the CGD network for using the network as common carrier or contract carrier.”;

for sub-regulation (2), the following sub-regulation shall be substituted, namely:- “(2) The compression charge for CNG in the CGD networks, shall be fixed as per the compression charge for CNG bid under clause (b) of the sub-regulation (1) of regulation 7 and shall be recovered from an entity by the entity authorised to operate the CGD network for using the compression facility of the authorised entity.”;

for sub-regulation (3), the following sub-regulation shall be substituted, namely:- “(3) The authorised entity shall recover the network tariff and the compression charge for CNG separately from an entity accessing the CGD network through an invoice without any premium or discount on a non-discriminatory basis.”;

(e) in regulation 11,for sub-regulation (2), the following shall be substituted, namel y:- “(2) The volume of natural gas supply under the agreement referred to in sub- regulation (1) shall be equal to at least fifty per cent. of the volumes considered in the quoted network tariff bid for each year of the exclusivity period allowed for exemption from the purview of common carrier or contract carrier under the Petroleum and Natural Gas Regulatory Board (Exclusivity for City or Local Natural Gas Distribution Networks) Regulations, 2008.; ”

(f) in regulation 17,for sub-regulation (5), the following sub-regulation shall be substituted, namely: - “(5) The transportation tariff shall be as determined by the Board as per regulation under section 22 of the Petroleum and Natural Gas Regulatory Board Act, 2006. ”;

(g) in regulation 18,in sub-regulation (9), for clause (a), the following clause shall be substituted, namel y:- “(a) The transportation tariff shall be as determined by the Board as per regulation under section 22 of the Petroleum and Natural Gas Regulatory Board Act, 2006.”;

(h) in Part-I of Schedule C,-

(i)

(ii) for clause (3) D, the following shall be substituted, namel y:- “Is the entity a company registered under the Companies Act, 1956 or Companies Act, 2013?” ;

for clause (3) E, the following shall be substituted, namel y:- “Is the entity promoted by a company registered under the Companies Act, 1956 or Companies Act, 2013?” ;

(iii) for clause (3) F, the following shall be substituted, namely:- “The entity undertakes to become a company, in case it is not a company at the time of submission of this application-cum-bid, under the Companies Act, 2013 on being selected for grant of authorization.” ;

(i) Declaration (3) in Schedule C shall be deleted and Declaration (4) shall be renumbered as Declaration (3);

(j) in Schedule D,-

(i) for clause (9) , the following clause shall be substituted, namely:- “(9) The entity shall publish on its website the network tariff for transportation of natural gas as well as the compression charge for CNG in the CGD network in the authorized area which is also annexed to this schedule.” ;

(ii) for clause (13) , the following shall be substituted, namely:- THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEc. 4] “The entity shall comply with the applicable provisions under the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008, the Petroleum and Natural Gas Regulatory Board (Exclusivity for City or Local Natural Gas Distribution Networks) Regulations, 2008, relevant regulations for technical standards and specifications, including safety standards, any other regulations as may be applicable and the provisions of the Act.” ;

(iii) clause 15 shall be deleted.
