6.34 िव�ुत प/रपथ सरु+ा के H यौरे : बस बाडी कोड मB िविन~द4� ट अपे+ाZ के अनुपालन को [ थािपत करने वाले द[ तावेज संलw न करB । (हा/ंनहI) J वJ वJ वJ व----घोषणाघोषणाघोषणाघोषणा यह मािणत �कया जाता ह ै�क (क) उपरोm त यान क( बाडी/सरंचना हमारे @ारा बनाई गई ह ै और समय-समय पर यथासंशोिधत एआईएस :052 (आरईवी1) क( अपे+ाZ और मोटरयान अिधिनयम, 1988 के सभी उपबध# तथा उसके अधीन बनाए गए िनयम# का अनुपालन �कया गया ह ै। (ख) चेिसस, उसके समु� चय या अवयव# मB कोई हरेफेर नहI �कया गया ह।ै''। .................... बाडी बनाने वाल ेके ह[ ता+र बाडी बनाने वाल ेक( मु�ा।''। [सं. आरटी-11028/02/2013-एमवीएल] अभय दामले, संयुm त सिचव �टG प�टG प�टG प�टG पण :ण :ण :ण :---- मूल िनयम भारत के राजप5, असाधारण, भाग II, खंड 3, उपखंड (i) सा.का.िन. सं8 यांक 590(अ), तारीख 2 जून, 1989 @ारा कािशत �कए गए थे और अिंतम संशोधन सा.का.िन. सं8 यांक 243(अ) तारीख 20 अ ैल, 2018 @ारा �कया गया था । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 13th April, 2018 G.S.R. 368(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification number G.S.R 1377 (E), dated the 10 th day of November , 2017of the Government of India in the Ministry of Road Transport and Highways, in the Gazette of India, Extraordinary, Part II, Section (3), Subsection (i) inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public; And whereas, copies of the said Official Gazette notification were made available to the public on the 10 th day of November, 2017. And whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: -
1. Short title and commencement. - (1) These rules may be called as the Central Motor Vehicles (Fifth Amendment) Rules, 2018
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules), in rule 47, -
(i) in sub-rule (1), in clause (g), after the words, figures and letter “Form 22A from the body-builders”, the following words, figures and letters shall be inserted, namely: - “and, in case of self-certification of the bus body built on a drive away chassis by a bus body structure fabricator, certificate of compliance in Form 22B”;
(ii) after sub-rule (4), the following sub-rule shall be inserted, namely: “(5) On and from the commencement of this sub-rule, every bus body builder shall upload the bus body details against the relevant drive away chassis on the portal https://www.vahan.nic.in/makermodel.”.
3. In the principal rules, in rule 126, after the second proviso, the following proviso shall be inserted, namely:- “Provided also that a bus body builder may self-certify the bus body built on a drive away chassis certifying compliance to the requirements of the Code and Practice for Bus Body Design and Approval in accordance with AIS:052, (Rev.1) as amended from time to time], as per the procedure notified by the Central Government in the official Gazette;
Provided further that the bus body builder shall provide a unique identification number to the self-certificate in the format XXXX XXXXXXXXXX wherein the first four characters represent body builder identification code followed by four digits indicating the year of fabrication followed by six digits signifying the serial number in the particular year.”
4. In the principal rules, after Form 22A, the following Form shall be inserted, namely: - “FORM 22B [See rule 47(1)(g)]
PART-A Initial self-certificate of compliance of the bus body built on drive away chassis by the bus body builder to the provisions of the Code and Practice for Bus Body Design and Approval AIS:052, as amended from time to time
1. Name, address and telephone number of the bus body builder
2. Accreditation certificate details like number, date and validity
3. Details of chassis on which bus is built
3.1 Particulars of chassis manufacturer
