PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल्ली, 14 माचग, 2022 सा.का.जन. 200(अ).—कें द्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए कजतपय प्रारूप जनयम, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) की अपके्षानुसार, भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना संख यांक सा.का.जन. 886(अ), तारीख 28 ददसंबर, 2021 द्वारा प्रकाजित दकए गए थ,े जजसमें उन सभी व् यज तयस से, जजनके उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जजसको उ त अजधसूचना वाल ेराजपत्र की प्रजतयां जनता को उपल् ध करवा दी गई थी, तीस ददन की अवजध के भीतर आक्षपे और सुझाव मांग ेगए थ े;
और उ त अजधसूचना में अतं्व् ट राजपत्र की प्रजतयां जनता को 28 ददसंबर, 2021 को उपल् ध करा दी गई थी ;
और उ त प्रारूप जनयमस के संबंध में जनसाधारण से कोई आक्षपे और सुझाव प्रा् त नह ुएए थ;े अत:, कें द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत् त िज तयस का प्रयोग करते ुएए कें द्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए जनम् नजलजखत जनयम बनाती ह , अथागत ्:-
1. (1) इन जनयमस का संजक्षप्त नाम कें द्रीय मोटर यान (छठा संिोधन) जनयम, 2022 ह ।
(2) ये जनयम राजपत्र में इनके प्रकािन की तारीख को प्रवृत्त हसगे ।
2. कें द्रीय मोटर यान जनयम, 1989 (जजसे इसमें इसके पश्चात ्उक्त जनयम कहा गया ह ) के जनयम 93 में,-
(i) उप-जनयम (1)(क) के खंड (IX) की सारणी में “*ख चने वाले रेटर के साथ जवजिष्ट लम्बाई वाले यांजत्रक रेलर’’ ि्दस के स्ट्थान पर “*एन3 श्रेणी के रक/रेटर के साथ जवजिष्ट लम्बाई वाले यांजत्रक रेलर” ि्द रखे जाएंगे ;

(ii) उप-जनयम (2) के खंड (2) में, पहल ेस्ट्पष्टीकरण में, “(क) अन्यय यान के सबसे पीछे वाल ेजबन्द”ु िीर्ग के अधीन परंतुक में मद (ख) में, उपमद (ii), (iii) और (iv) के स्ट्थान पर जनम्नजलजखत उपमद रखी जाएगी, अथागत ्:- “(ii) केवल तीन धरुी और आगे की दो धुरी स्ट्टीयररग एसल ह , वाले यान के मामले में सबसे पीछे की धुरी (ओं) को "जनजश्चत" या "खीचने योग्य (जलफ्ट एसल) करन ेके बावजूद सबसे पीछे वाली धरुी का कें द्र बबद ु; या
(iii) केवल तीन धुरी, जजसमें आगे की दो धुरी स्ट्टीयररग एसल ह , वाले यान के मामले में सबसे पीछे की धरुी (ओं) को"जनजश्चत" या "खीचन ेयोग्य (जलफ्ट एसल) करन ेके बावजूद सबसे पीछे वाली धरुी का कें द्र बबद ु; या
(iv) चार या चार से अजधक धरुी वाल ेयान के मामल ेमें; सबसे पीछे की धुरी (ओं) को "जनजश्चत" या "खीचन ेयोग्य (जलफ्ट एसल) करन ेके बावजूद सबसे पीछे वाली धरुी का कें द्र बबद ुहो;’’ ।
3. उक्त जनयम के जनयम 125ञ के पश्चात् जनम्नजलजखत जनयम अंत:स्ट्थाजपत दकया जाएगा, अथागत्:- "125ट. सड़क रेन के जलए सरुक्षा आवश्यकताएँ.- रोड रेन के टाईप अनुमोदन और प्रमाणीकरण की प्रदिया, समय-समय पर संिोजधत एआईएस-113 के अनुसार होगी, जब तक दक भारतीय मानक ्यरूो अजधजनयम 2016 (2016 का 11)के अधीन संबंजधत बीआईएस जवजनदेिस को अजधसूजचत नह दकया जाता ह ।” [फा. सं. आरटी-11028/02/2021-एमवीएल] अजमत वरदान, संयुक्त सजचव रट् पण : मलू जनयम, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में अजधसूचना संखया सा.का.जन. 590 (अ), तारीख 2 जून, 1989 द्वारा प्रकाजित दकए गए थ ेऔर अजधसूचना संख या सा.का.जन. 164(अ), तारीख 25 फरवरी, 2022 द्वारा अंजतम बार संिोजधत दकए गए थ े। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 14th March, 2022 G.S.R. 200(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 886(E), dated the 28 th December, 2021, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the official Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 28 th December, 2021;
And whereas, no objections and suggestions were received from the public in respect of the said draft rules;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. (1) These rules may be called the Central Motor Vehicles (Sixth Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (here in after referred to as the said rules), in Rule 93,-
(i) in sub-rule (1) (A), in clause (IX), in the Table, for the words “*Mechanical trailer with exceptional length with a puller tractor” the words “*Mechanical trailer with exceptional length with N3 category truck or tractor” shall be substituted;

(ii) in sub-rule (2), in clause (2), in the first Explanation, under the heading “ (A) The rearmost point of the vehicle exclusive of- ”, in the proviso, in item (b), for sub-items (ii), (iii) and (iv), the following sub-items shall be substituted, namely:- “(ii) in the case of a vehicle having only three axles and the front axle is the only steering axle, the centre point of the rearmost axle, irrespective of rear axle(s) being "fixed" or "retractable" (lift axle); or
(iii) in the case of a vehicle having only three axles where two front axles are steering axles, the centre point of the rearmost axle, irrespective of rear axle(s) being "fixed" or "retractable" (lift axle);or
(iv) in the case of a vehicle having four or more than four axles; the centre point of the rearmost axle, irrespective of rear axle(s) being "fixed" or "retractable" (lift axle); or ”.
3. After rule 125J of the said rules, the following rule shall be inserted, namely:- “125K. Safety requirements for Road Train.- The procedure for type approval and certification of Road Train, shall be in accordance with AIS-113, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”.
