(iv) (क) इसम िविनmद1W ट गैसोलीन या सीएनजी या एलपीजी यान िनयम 115 के उपिनयम (2) के खंड (i) के उपबंध= के अनुपालन म ह=गे; (ख) इसम िविनmद1W ट डीजल यान िनयम 115 के उपिनयम (2) के खंड (ii) के अनुपालन म ह=गे; (v)उH पादन बारंबारता क� अनुGपता (सीओपी) और नमूना परी�ण (�hया एमओआरटीएच/सीएमवीआर/टीएपी-115/116 म यथाउपबंिधत होगी hम स.ं यान का (कार वाdष1क उH पादन/आयात सीओपी बारंबारता से तक 1 2 3 4 5 1. चौपिहया 250 (ित छह माह 10000 (ितवष1 वष1 म एक बार 2 चौपिहया 10000 (ितवष1 75000 (ित छह माह 6 माह म एक बार 3 चौपिहया 75000 (ित छह माह -- 3 माह म एक बार जहां छह माह म उH पादन मा2ा 250 (ितमाडल िजसके अंतग1त उसके वे,रयंट भी ह ैसे कम होती ह ैतो िनयम 126क म उपबंिधत उपबंध लागू ह=गे। (vi) (क) संपीिड़त (ाकृितक गैस मोड पर चािलत यान= के िलए िनयम 115ख के उपबंध लागू ह=गे । (ख) तरलीकृत पैYोिलयम गैस मोड पर चािलत यान= के िलए िनयम 115ग के उपबंध लागू ह=गे । (vii) सदभं1/वािणिf यक \धन के िलए िविनदश̀ : (क) संदभ1 \धन गैसोलीन वाले यान= के िलए उपाबp IV-ञ और डीजल \धन के साथ सुसिf जत यान= के िलए उपाबp IV-ट म यथािविनmद1W ट होगा और सपंीिड़त (ाकृितक गैस और तरलीकृत पैYोिलयम गैस के िलए संदभ1 \धन ; यवसाियक )प से उपलA ध \धन होगा ; (ख) वािणिf यक गैसोलीन और डीजल के िलए िविनदश̀ उपाबp IV-ढ और उपाबp IV-ण म यथािविनmद1W ट ह=गे; (ग) वाणिf यक संपीिड़त (ाकृितक गैस और तरलीकृत पैYोिलयम गैस के िलए िविनदश̀ समय-समय पर यथाअिधसूिचत ह=गे ; (viii) गैसोलीन से चािलत यान (णाली के िलए h] क केस संवातन को वातावरण म �कसी (कार क� h] क केस गैस= का उH सज1न अनुUात नहB �कया जाएगा । (ix) गैसोलीन चािलत यान= से उ�ािW पत उH सज1न 2.0 Vाम (ित परी�ण से अिधक नहB होगा। परी�ण (�hया एमओआरटीएच/सीएमवीआर/टीएपी-115/116 म यथािविनmद1W ट होगी । (x) संपीिड़त (f जवलन \जन क� दशा म \जन शि< त, \जन डाइनामोमीटर पर मापी जाएगी और मापी गई शि< त समय-समय पर यथासंशोिधत एमओआरटीएच/सीएमवीआर/टीएपी-115/116 के भाग 4 के अe याय 1 म िविनmद1W ट शि< त के अनुपालन म होगी । सकाराH मक (f वलन \जन क� दशा म , \जन शि< त आईएस 14599 : 1999 के उपबंध= के अनुसरण म \जन डाइनामोमीटर पर मापी जाएगी।''। ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 5. मूल िनयम= के िनयम 138 के उपिनयम (4) के खंड (क) के परंतुक के S थान पर िनJ निलिखत परंतुक रखा जाएगा, अथा1त् :- ‘’एल 7 एम 1 और एन 1 ^ेणी के यान= क� दशा म अS थाई उपयोग के िलए अित,र< त पिहए का (योग अनुUात �कया जाएगा और (योग के िलए तैयार अित,र< त पिहए के उपबंध आUापक नहB ह=गे य�द ऐसे यान= म मानक के अनुसार रन फलैट लगे ह= । [फा.सं. आरटी–11028/09/2013–एमवीएल] अभय दामले, संयु< त सिचव �ट1 प�ट1 प�ट1 प�ट1 पण:ण:ण:ण: मूल िनयम, भारत के राजप2, असाधारण, भाग 2, खंड 3, उपखंड (i) म अिधसूचना सं. का.आ. 590 (अ), तारीख 2 जून, 1989 �ारा (कािशत �कए गए थे और अंितम बार अिधसूचना स.ं 490(अ) तारीख 24 मई, 2018 �ारा संशोिधत �कए गए । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 1st June, 2018 G.S.R. 518(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988)vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R 1445 (E) dated the 24 th day of November, 2017, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date of which copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 24 th November, 2017 And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short title and commencement.- (1) These rules may be called as the Central Motor Vehicles (Eighth Amendment) Rules, 2018.
(2)These rules shall come into force from the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (herein after referred to as the principal rules), in rule 2, in clause (z),:-
(a) for sub-clause (iv), the following sub-clause shall be substituted, namely:- “(iv) Maximum permissible kerb weight for the purpose of classification shall not exceed 475 kg in case of passenger vehicle and 550 kg in case of goods vehicle;
(b) in the Explanation, for the words starting with “kerb weight” and ending with “hybrid vehicles”, the words and letter” “the weight shall not include,- 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(a) Mass of batteries in the case of electric or hybrid vehicles,
(b) Mass of gaseous fuel system including tanks for gaseous fuel storage in the case of mono-fuel, bi-fuel or multifuel vehicle” shall be substituted.
3. In rule 95 of the principal rules, for sub-rule (7), the following sub-rule shall be substituted, namely:- “(7) Temporary use spare wheel or tyre and Run Flat Tyre for vehicles of categories L7, M1 and N1, if they are different from the normal tyre used on the vehicle shall conform to AIS 110:2009, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).”.
4. In rule 115of the principal rules, after the sub rule (17), the following sub-rule shall be inserted namely:- “(17A)Mass emission standards:(Bharat Stage IV) for quadricycle (L7), shall be as under:- Table 1 [fitted with gasoline or compressed natural Gas (CNG) or Liquefied Petroleum Gas (LPG) engine] TA=COP norms EVAP (g/test) OBD CO(g/km) HC(g/km) NOX(g/km) Limit

(i) The test shall be on Chassis Dynamometer;
(ii) The test procedure and driving cycle shall be as per the MoRTH/CMVR/TAP-115/116. Modified ECE R 40 with maximum speed to 43 km per hour with cold start.
(a) Reference mass : kerb weight + 150 kg;
(b) Number of test cycles: Six (6), with weightage factors firstcycle: 30%; remaining: 70%0;
(c) Breakdown of cycle: ECE R40 cycle modified for the maximum speed of 43km/hr. Referred to in the MoRTH/CMVR/TAP-115/116;
(iii) A deterioration factor shall be applicable as per Table 1 above for durability.
(a) Provided that the vehicle manufacturer may opt for an ageing test of 80000 kms for evaluation deterioration factor, as provided in MoRTH/CMVR/TAP-115/116;
(iv) (a) Gasoline or CNG or LPG vehicles specified herein shall comply with the provisions of clause (i) of sub-rule (2) of rule 115;
(b)Diesel vehicles specified herein shall comply with clause (ii) of sub-rule (2) of rule 115;
(v) Conformity of Production (COP) frequency and sampling test procedure shall be as provided in the MoRTH/CMVR/TAP-115/116.

(vi) (a) For vehicles operating on compressed natural gas mode, the provisions of rule 115Bshall be applicable;
(b) For vehicles operating on liquefied petroleum gas mode, the provisions of rule 115Cshall be applicable;
(vii) Specification of Reference / Commercial Fuels:
(a) The reference fuel shall be as specified in Annexure IV-J for vehicles equipped with gasoline and Annexure IV-K for vehicles equipped with diesel engines and reference fuel for compressed natural gas and liquefied petroleum gas shall be as available commercially;
(b) The specification of commercial gasoline and diesel shall be as specified in Annexure IV-N and Annexure IV-O;
(c) Specification for commercial compressed natural gas and liquefied petroleum gas shall be as notified from time to time;

(viii) Crank case ventilation for gasoline driven vehicles system shall not permit the emission of any of the crank case gases into the atmosphere;
(ix) Evaporative emission shall not be more than 2.0g/test from Gasoline driven vehicles. The test procedure shall be as specified in the MoRTH/CMVR/TAP-115/116;
(x) In case of compression ignition engine,engine power shall be measured on engine dynamometer and the measured power shall conform to the power specified in Chapter 1 of Part IV of MoRTH/ CMVR/TAP115/116 as amended from time to time.
In case of positive ignition engine, engine power shall be measured on engine dynamometer in accordance with the provisions of IS 14599:1999.”.
5. In rule 138 of the principal rules in sub-rule (4), in clause (a), for the proviso, the following proviso shall be substituted, namely:- “Provided that in case of L7, M1 and N1 categories of vehicles, use of temporary use spare wheel shall be permitted and the provision of ready to use spare wheel shall not be mandatory, if such vehicles are fitted with run flat tyres as standard.”.
