1. 2. 3. 4. 5. 6. 7. 8. 1. अिधकतम गित नह> नह> नह> नह> हां वाहन को भार रिहत ि7 थित म� (पूरी तरह से चाज2 और पूण2 F वरक क( ि7 थित म�) सीधी या समतल सड़क पर चलाया जाएगा और जब वाहन अिधकतम गित पर होता ह ैतो अिधकतम गित क( गणना िनयत दरूी (अथा2त् 50 मीटर) तय करने म� लगने वाले समय के 8ारा क( जाएगी” 2. परावत2क हां नह> हां नह> नह> यह सुिनिV चत �कया जाना �क परावत2क और -रWलेि टव टेप का रंग िनयम 104 के अनु$प ह ै।” 3. उ< िनयम" के िनयम 104 म�, -- (क) उप-िनयम (1) म� श=द" “तीन पिहया वाहन" और” का लोप �कया जाएगा; (ख) उप-िनयम (1) के खंड (i), खंड (ii) और खंड (iii) म� श=द", अंक" और अ+र" “1 अ#ैल, 2009 को और इसके पOात् िविनZम2त,” का लोप �कया जाएगा; (ग) उप-िनयम (1) के खंड (iv) म� श=द", अंक" और अ+र" “1 अ<ूबर, 2009 को और इसके पOात् िविनZम2त,” का लोप �कया जाएगा; (घ) उप-िनयम (1) के िलए खंड (iv) के पOात् िनQिलिखत अंत:7थािपत �कया जाएगा, अथा2त् :- ''(v) ई--र शा और ई-काट2 सिहत तीन पिहया वाहन" म� वाहन क( संपूण2 चौड़ाई म� फैली सामने क( ओर सफेद परावत2क टेप और पीछे क( ओर लाल परावत2क टेप लगाई जाएगी तथा सामने और पीछे क( ओर लगाई गई टेप" क( चौड़ाई 20 िममी स ेकम नह> होगी और तदनु$पी बीआईएस िविनद_श" को भारतीय मानक =यूरो अिधिनयम, 2016 (2016 का 11) के अधीन अिधसूिचत �कए जाने तक एआईएस:090-2005 के उपाबंध 4, 5 और 6 क( अपे+ा के अनु$प होगी।”; 4. उ त िनयम" के िनयम 104घ म�, श=द", अंक" और अ+र" म� “1 अ#ैल, 2015 को और इसके पOात् िविनZम2त,” का लोप �कया जाएगा; 5. उ त िनयम" के िनयम 104घ म�, भारत सरकार के सड़क प-रवहन और राजमाग2 मं3ालय क( अिधसूचना सं. सा.का.िन. 212(अ), तारीख 20 माच2, 2015 8ारा अंत:7 थािपत “मॉडयूलर हाइbोिलक cेलर पर रेcो--रWलेि टव टेप या परावत2क और पीछे क( िचdनांकन J लटे को लगाया जाना” िनयम 10ड. के $प म� पुन:सं5 या�ंकत �कया जाएगा । [फा. सं. आरटी–11028/18/2017-एमवीएल] ि#याकं भारती, संयु त सिचव �ट� प�ट� प�ट� प�ट� पण :ण :ण :ण : मूल िनयम भारत के राजप3, असाधारण, भाग II, खंड 3 उप-खंड (i) म� अिधसूचना सं. सा.का.िन. 590(अ), तारीख 2 जून, 1989 8ारा #कािशत �कए गए थे और अिधसूचना सं. सा.का.िन. 681(अ) तारीख 23.09.2019 8ारा अंितम बार संशोिधत �कया गया था । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 23rd October, 2019 G.S.R. 807(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 548(E), dated the 1st August, 2019, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public;
Whereas, copies of the said Gazette notification were made available to the public on the 1 st August, 2019;
AND whereas, no objections and suggestions were received from the public in respect of the said draft rules;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short Title and commencement. -(1) These rules may be called the Central Motor Vehicles (Ninth Amendment) Rules, 2019.
(2) They shall come into force on 1st day of April, 2020.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as said rules), in rule 62, in sub-rule
(1), in the second proviso for the TABLE, the following TABLE shall be substituted, namely: - “TABLE Sl.

3. In the said rules, in rule 104,-
(a) in sub-rule (1), the words “three wheelers and” shall be omitted;
(b) in sub-rule (1), in clauses (i), (ii) and (iii), the words, figurers and letters “manufactured on and after 1 st day of April, 2009,” shall be omitted;

(c) in sub-rule (1), in clause (iv), the words, figurers and letters “manufactured on and after 1st day of October, 2009,” shall be omitted;
(d) for sub-rule (1) after clause (iv) the following clause shall be inserted, namely.- “(v) three wheeled vehicles including e-rickshaw and e-cart, shall be affixed at the front with a white reflective tape and at the rear with a red reflective tape running across the width of the body and the tapes affixed at the front and rear shall be not less than 20mm width and shall confirm to the requirement of Annexures 4, 5 and 6 of AIS:090-2005, till the corresponding BIS specification are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”;
(4) In the said rules, in rule 104D, the words, figurers and letters “manufactured on and after 1 st day of April, 2015,” shall be omitted.
(5) In the said rules, rule 104D relating to ‘Fitment of retro-reflective tapes or reflectors and rear marking plate on modular hydraulic trailer’ inserted vide notification of the Government of India, Ministry of Road Transport and Highways number, G.S.R. 212(E), dated the 20th March, 2015 shall be renumbered as rule 104E.
