उ त राजपᮢ अिधसूचना कᳱ ᮧितयां जनसाधारण को 23 अᮧैल, 2015 और 23 माचᭅ, 2016 को उपल᭣ ध करवाई गई थᱭ ;
उ त ᮧाᱧप िनयमᲂ के संबंध मᱶ जनसाधारण स ेᮧा᭡ त आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा िवचार ᳰकया गया ह ै;
अत:, के᭠ ᮤ ीय सरकार मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 110 कᳱ उपधारा (1) ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करते ᱟए के᭠ ᮤ ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन᭥ निलिखत िनयम बनाती ह,ै अथाᭅत्:-
(1) इन िनयमᲂ का संिᭃ᭡ त नाम कᱶ ᮤीय मोटरयान (नवां संशोधन) िनयम 2016 ह ै।
(2) ये राजपᮢ मᱶ इनके ᮧकाशन कᳱ तारीख को ᮧवृ᭜ त हᲂग े। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
2. कᱶ ᮤीय मोटरयान िनयम,1989, (िजसे इसमᱶ इसके प᭫ चात् उ त िनयम कहा गया ह)ै मᱶ, िनयम 2 मᱶ खंड (य) के प᭫ चात् िन᭥ निलिखत खंड अंत:᭭ थािपत ᳰकए जाएंग,े अथाᭅत् :-
2. कᱶ ᮤीय मोटर यान िनयम, 1989 (िजसे इसमᱶ इसके प᳟ात् उᲦ िनयम कहा गया ह)ै के िनयम 2 मᱶ, खंड (य़) के प᳟ात् िन᳜िलिखत खंड अंत:᭭ थािपत ᳰकए जाएगंे,अथाᭅत्:- ‘(यक) “मोटर कारवा”ं से िवशेष ᮧयोजन के िलए रहने का वास–सुिवधाए ंसि᭥मिलत करने कᳱ िलए िनᳶमत एम ᮰ेणी का यान अिभᮧेत ह ैिजसमᱶ कम स ेकम िन᳜िलिखत उप᭭कर अ᭠तᳶव᳥ होगᱶ ।
(i) सीटᱶ और टेबल ;
(ii) सोने कᳱ वास-सुिवधा जो सीटᲂ से संपᳯरवᳶतत कᳱ जा सकती ह ै;
(iii) खाना पकाने कᳱ सुिवधाए ं; और
(iv) भ᭛डारण सुिवधाएं, जो रहने के कᭃ के साथ दढ़ृता से जड़ुी हᲂगी :
परंतु टेबल सहज ᭭थाना᭠तरणीय होने के िलए पᳯरकि᭨पत हो सकेगी । (यख) "सड़क रोगी-वाहन" सड़क रोगी-वाहन िवशेष ᱧप से सिᲯत और ᮰म दᭃता कᳱ दिृ᳥ से पᳯरकि᭨पत यान ह ैजो बीमार या ᭃितᮕ᭭त ᳞िᲦयᲂ के पᳯरवहन या आपात उपचार के िलए और जब समुिचत ᱧप स े इसमᱶ कमᭅचाᳯरवृंद हो उसके अिभिहत दखेभाल ᭭तर के अनुᱨप पᳯरवहन के दौरान या जब वह खड़ा हो अ᭭पताल िचᳰक᭜सा दखेभाल ᮧदान करन ेके िलए सᭃम हो । (यग) "िव᳒ालय बस" स े िव᳒ालय जाने वाले बालकᲂ के िलए िवशेष ᱧप से पᳯरकि᭨ पत और िविनᳶमत ऐसा यान अिभᮧेत ह ैिजसमᱶ चालक को छोड़कर 13 याᮢी और अिधक के बैठने कᳱ ᭃमता हो;
(यघ) "िवशषे ᮧयोजन यान (एस पी वी)" से ᮰ेणी एल [केवल एआईएस-125(भाग 1)-2014 के अनुपालन मᱶ सड़क रोगी-वाहन कᳱ दशा मᱶ ], एन या टी का ऐसा यान अिभᮧेत ह ैजो, कृ᭜यᲂ िजसमᱶ िवशेष इंतजाम और/या उप᭭कर अपेिᭃत ह,ै का पालन करने के िलए िविन᳸द᳥ तकनीकᳱ िविश᳥ताए ंरखता हो ।’।
3. उᲦ िनयमᲂ के िनयम 108 मᱶ, 1 अᮧैल, 2018 को या उसके प᳟ात्, उप-िनयम (1) के परंतुक के, खंड (iv) के ᭭थान पर िन᳜िलिखत खंड रखा जाएगा, अथाᭅत ्:- "(iv) रोिगयᲂ के वहन हतेु उपयोग के िलए ᳰकसी रोगी-वाहन मᱶ ᳰफट ᳰकए गए बᱹगनी शीशे सिहत ᳲ᭣ लकर टाइप कᳱ लाल ब᭜ ती या एआईएस-125 (भाग-1)-2014 के उपाबंध -1 के अनुसरण मᱶ सड़क रोगी-वाहन पर लगे ᱟए चेतावनी दीप;" ।
4. उᲦ िनयमᲂ के, िनयम 108 मᱶ, उप-िनयम(6) के प᳟ात्, िन᳜िलिखत उप-िनयम अ᭠तः᭭थािपत ᳰकया जाएगा, अथाᭅत् :- “(7) भारतीय मानक ᭣यूरो अिधिनयम, 1986 (1986 का 63) के अधीन त᭜᭭थानी बी आई एस िविनदᱷश अिधसूिचत ᳰकए जाने तक, 1 अᮧैल 2018 को और उसके प᳟ात् सड़क रोगी-वाहन पर लगी ᱟई ऊपर कᳱ बिᱫयां (चेतावनी दीप) इसमᱶ िविन᳸द᳥ सभी ᮧकार के रोगी-वाहन के िलए, समय-समय पर यथा संशोिधत एआईएस:125 (भाग 1)-2014 के अनुसरण मᱶ होगी ।
5. उ त िनयमᲂ के िनयम 119 मᱶ, 1 अᮧैल, 2018 को और उसके प᭫ चात्, उपिनयम (3) मᱶ िन᭥ निलिखत पंरतुक अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत ्:- ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 परंतु सड़क रोगी वाहनᲂ के सायरनᲂ के िलए अपेᭃाएं, जब तक भारतीय मानक ᭣ यरूो अिधिनयम, 1986 (1986 का 63) के अधीन त᭜ ᭭ थानी बीआईएस िविनदᱷश अिधसूिचत नहᱭ ᳰकए जाते ह,ᱹ तब तक समय-समय पर यथासंशोिधत एआईएस:125 (भाग 1)-2014 के अनुसार हᲂगी ।”।
6. उᲦ िनयमᲂ, मᱶ, िनयम 125-ड. के प᳟ात्, िन᳜िलिखत िनयम अ᭠तः᭭थािपत ᳰकया जाएगा, अथाᭅत् :- "125च- एल और एम ᮰िेणयᲂ के यानᲂ के सड़क रोगी-वाहनᲂ का ᮧकार अनमुोदन । भारतीय मानक ᭣यूरो अिधिनयम, 1986 (1986 का 63) के अधीन त᭜᭭थानी भी बी.आई एस िविनदᱷश अिधसूिचत ᳰकए जान ेतक, 1 अᮧैल, 2018 को और उसके प᳟ात् िविनᳶमत एम और एस ᮰ेिणयᲂ के सड़क रोगी-वाहन, समय-समय पर यथा संशोिधत एआईएस:125(भाग 1) 2014 के अनुसरण मᱶ हᲂगे ।" 125-छ िवशेष ᮧयोजन यानᲂ के िलए ᮧकार अनुमोदन.- (1) भारतीय मानक ᭣यूरो अिधिनयम, 1986 (1986 का 63) के अधीन त᭜᭭थानी भी आई एस िविनदᱷश अिधसूिचत ᳰकए जाने तक, 1 अᮧैल, 2018 को और उसके प᭫ चात ्िवᳶनिमत मोटर कारवा ंसमय-समय पर यथा संशोिधत एआईएस-124 :2014 मᱶ किथत अपेᭃाᲐ के अनुपालन मᱶ हᲂगे ।
(2) भारतीय मानक ᭣यूरो अिधिनयम, 1986 (1986 का 63) के अधीन त᭜᭭थानी बीआईएस िविनदᱷश अिधसूिचत ᳰकए जाने तक उᲦ मानकᲂ के खंड 0.0 (ख) के अधीन यथा अनु᭄ात िव᳒मान यानᲂ पर बनाये गए मोटर कारवां भी समय-समय पर यथा संशोिधत एआईएस-124:2014 के अनुपालन मᱶ हᲂगे ।
7. उᲦ िनयमᲂ के, ᮧाᱧप 22-क मᱶ,-
(i) अंकᲂ और अᭃरᲂ "125ग" के ᭭थान पर अंक और अᭃर "125च, 125छ" अ᭠तः᭭थािपत ᳰकए जाएंगे ;
(ii) भाग-2 मᱶ, - (क) मद 4 और 5 के ᭭थान पर िनि᳜िलिखत मदᱶ रखी जाएंगी, अथाᭅत् :- "*4 बस बॉडी िनमाᭅणकताᭅ ᮧ᭜यायन ᮧमाणपᮢ संयांक........................ तारीख.......................
तारीख तक िविधमा᭠य होगा ।
5. अनुमोᳰदत परीᭃण अिभकरण ᳇ारा जारी यान बॉडी िनमाᭅण (बस सड़क रोगी-वाहन मोटर कारवा ं आᳰद) ᮧकार अनुमोदन ᮧमाणपᮢ संयांक....................तारीख ..........................।''। (ख) ᳯट᭡ पण के ᭭ थान पर, िन᭥ निलिखत ᳯट᭡ पण रखा जाएगा, अथाᭅत् :- “ᳯटप् पण:- भाग II , 1 अ तूबर, 2014 को या उसके प᭫ चात् िविनᳶमत बसᲂ के नए मॉडल को और 1 अ तूबर, 2016 को और उसके प᭫ चात् िविनᳶमत बसᲂ के िव᳒मान मॉडलᲂ को और ᮓमश: एआईएस 125 (भाग1):2014 और एआईएस 124(भाग1):2014 के लाग ूहोने कᳱ तारीख से िविनᳶमत सड़क रोगी- वाहनᲂ और मोटर कारवां कᳱ दशा मᱶ लागू होगा ” [सं. आरटी-11028/10/2013-एमवीएल] अभय दामले, संयुᲦ सिचव ᳯट᭡ पण : मूल िनयम भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (i) मᱶ अिधसूचना संयाकं सा.का.िन. 590(अ), तारीख 2 जून, 1989 ᳇ारा ᮧकािशत ᳰकए गए थ े और अिधसूचना संयांक सा.का.िन. 682 (अ) तारीख 12.07.2016 ᳇ारा उनका अि᭠तम संशोधन ᳰकया गया । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 8th September, 2016 G.S.R. 868(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988) vide notifications of Government of India in the Ministry of Road Transport and Highways number G.S.R.
316(E), dated the 23rd April,2015 and number G.S.R. 335(E), dated the 23rd March, 2016, in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of thirty days from the date on which copies of the Gazette containing the said notifications were made available to public;
Whereas, copies of the said Gazette notifications were made available to the public on the 23rd April, 2015 and the 23rd March, 2016;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. (1) These rules may be called the Central Motor Vehicles (Ninth Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989, (hereinafter referred to as the said rules) in rule 2, after clause (z), the following clauses shall be inserted, namely:- ‘(za) “Motor Caravan” means a special purpose category M vehicle constructed to include living accommodation which contains at least the following equipment:-
(i) seats and table;
(ii) sleeping accommodation which may be converted from the seats;
(iii) cooking facilities; and
(iv) storage facilities, which shall be rigidly fixed to the living compartment:
Provided that the table may be designed to be easily removable;
(zb) “Road Ambulance” means a specially equipped and ergonomically designed vehicle for transportation and/ or emergent treatment of sick or injured people and capable of providing out of hospital medical care during transit or when stationary, commensurate with its designated level of care when appropriately staffed;
(zc) “School Bus” means a vehicle with a seating capacity of thirteen passengers and above excluding driver designed and constructed specially for school going children;
(zd) “Special Purpose Vehicle (SPV)” means a vehicle of category L [only in case of Road Ambulance complying to AIS-125 (Part1)-2014], M, N or T having specific technical features in order to perform a function which requires special arrangements and / or equipment.’.
3. In rule 108 of the said rules, on and after the 1st April, 2018, in sub-rule (1), in the proviso, for clause (iv), following clause shall be substituted namely:- “(iv) the blinker type of red light with purple glass fitted to an ambulance van used for carrying patients or the warning lamps fitted on Road Ambulance in accordance with Annexure-1 of AIS- 125 (Part-1)-2014; ”.
4. In rule 108 of the said rules, after sub-rule (6), the following sub-rule shall be inserted, namely:- ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 “(7) On and after the 1st April, 2018, the top lights (warning lamps) fitted on Road Ambulances shall be in accordance with AIS:125 (Part1)– 2014, as amended from time to time, for all types of ambulances specified therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).”.
5. In rule 119 of the said rules, on and after 1st April, 2018, in sub-rule (3), following proviso shall be inserted, namely:- “Provided that requirements for sirens of Road Ambulances shall be in accordance with AIS:125 (Part 1)-2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 ( 63 of 1986).”.
6. In the said rules, after rule 125-E, the following rules shall be inserted, namely:- “125F- Type Approval of Road Ambulances of Vehicle categories L and M. - Road Ambulances of categories L and M manufactured on and after the 1st April, 2018, shall be in accordance with AIS: 125 (Part1)–2014 as amended from time to time, for all types of ambulances specified therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).
125-G Type Approval of Special Purpose Vehicles.- (1) The Motor Caravans manufactured on and after the 1st April, 2018, shall comply with the requirements stated in AIS-124:2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).
(2) The Motor Caravans built on the existing vehicles as permitted under the clause 0.0 (b) of the said standard shall also comply with AIS-124:2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).”.
7. In Form 22-A of the said rules,-
(i) after figures and letter “125C”, the figures and letters “125F, 125G”shall be inserted;
(ii) in PART-II,-
(a) For items 4 and 5, the following shall be substituted, namely:- “*4. Bus Body Builder Accreditation Certificate Number __________Date ________ valid up to date _____________.
5. Vehicle Body construction (Bus/Road Ambulance/ Motor Caravan /etc.) Type Approval Certificate Number _______________Date _________ issued by the approved Test Agency.”
(b) for the Note, the following Note shall be substituted, namely:- “Note:- Part II shall be applicable for new model of buses manufactured on or after the 1st October, 2014 and for the existing models of buses manufactured on and after 1st October, 2016 and in case of Road Ambulances and Motor Caravans manufactured from the date of applicability of AIS-125 ( Part 1): 2014 and AIS-124: 2014 respectively.”.
