PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1024] ubZ fnYyh] eaxyokj] vizSy 11] 2017@pS=k 21] 1939 No. 1024] NEW DELHI, TUESDAY, APRIL 11, 2017/ CHAITRA 21, 1939 िवज्ञान और ᮧौ᳒ोिगकी मंᮢ ालय (वजै्ञािनक और औ᳒ोिगक अनसुधंान िवभाग) अिधसचूना नई िदल्ली, 6 अᮧैल, 2017 का. आ.1153(अ ) शासी बोडर्, वैज्ञािनक और नवीकृत अनुसंधान अकादमी अिधिनयम, 2011 (2012 का 13) की धारा 28 की उप धारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए और वैज्ञािनक और नवीकृत अनुसंधान अकादमी पिरिनयम, 2012 को उन बातᲂ के िसवाय अिधकांत करते हुए, िजन्हᱶ ऐसे अिधᮓमण से पूवर् िकया गया ह ैया करने का लोप िकया गया ह,ै वैज्ञािनक और नवीकृत अनुसंधान अकादमी के िलए िन᳜िलिखत पिरिनयम बनाता ह,ै अथार्त:- सिंक्ष᳙ नाम और ᮧारंभ- (1) इन पिरिनयमᲂ का नाम वैज्ञािनक और नवीकृत अनुसंधान अकादमी पिरिनयम, 2017 ह।ै

(2) ये राजपᮢ मᱶ ᮧकाशन की तारीख को ᮧवृᱫ हᲂगे।

2. पिरभाषाएं:- इन पिरिनयमᲂ मᱶ, जब तक िक संदभर् से अन्यथा अपेिक्षत न हो, - (क) "अकादमी" से इस अिधिनयम की धारा 3 की उप-धारा (1) के अधीन स्थािपत वैज्ञािनक और नवीकृत अनुसंधान अकादमी अिभᮧेत ह,ै (ख) "अिधिनयम" से वैज्ञािनक और नवीकृत अनुसंधान अकादमी अिधिनयम, 2011 (2012 का 13) अिभᮧेत ह;ै (ग) "सहयुᲦ संकायाध्यक्ष" से अकादमी के सहयुᲦ संकायाध्यक्ष अिभᮧेत ह,ै (घ) "सहयुᲦ िनदशेक" से अिधिनयम की धारा 23 के अधीन िनयुᲦ अकादमी का सहयुᲦ िनदशेक अिभᮧेत ह,ै (ड़) "बोडर्" स े अिधिनयम की धारा 11 की उप-धारा (1) के अधीन गिठत वैज्ञािनक और नवीकृत अनुसंधान अकादमी का शासी बोडर् अिभᮧेत ह;ै (च) "अध्यक्ष" से अिधिनयम की धारा 12 के अधीन िनयुᲦ बोडर् का अध्यक्ष अिभᮧेत ह,ै 2413GI/2017 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (छ) "वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद" से सोसायटी रिजस्ᮝीकरण अिधिनयम, 1860 (1860 का 21) के अधीन 'वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद' के नाम से रिजस्ᮝीकृत सोसायटी अिभᮧेत ह;ै (ज) "संकायाध्यक्ष" से अकादमी के संकायाध्यक्ष अिभᮧेत ह,ै (झ) "िनदशेक" से अिधिनयम की धारा 22 के अधीन िनयुᲦ अकादमी का िनदशेक अिभᮧेत ह,ै (ट) "सम्पदा" से अकादमी की कोई भी या सभी संपिᱫ अिभᮧेत ह,ै जो अकादमी ᳇ारा चाह ेभुगतान के माध्यम स े या दान और अपकृित के रूप मᱶ स्वािमत्व ᮧा᳙ या अिजत हो और जो पूणर्त: उसकी हᲂ परंतु इसके अंतगर्त वैज्ञािनक और औ᳒ोिगक अनुसंधान ᮧयोगशाला का पिरसर, मकान या भवन या वैज्ञािनक और औ᳒ोिगक अनुसंधान का अकादमी ᳇ारा उपयोग मᱶ लाया गया कोई पिरसर, सिम्मिलत नहᱭ ह;ै (ठ) "अकादमी का संकाय" से अकादमी आचायर्, िवख्यात आचायर्, ᮧख्यात आचायर्, ᮧितभाशाली आचायर्, आचायर्, एिमिरट्स आचायर्, ज्ये᳧ आचायर्, सहयुᲦ आचायर्, सहायक आचायर्, अितिथ संकाय, सहायक संकाय और ऐसे अन्य ᳞िᲦ अिभᮧेत ह,ᱹ िजनको अकादमी मᱶ अकादमी ᳇ारा चलाई जा रही संस्थाᲐ मᱶ िशक्षा दनेे या अनुसंधान का संचालन करने के िलए िनयुᲦ िकया जाए और िजसके अंतगर्त िशक्षा दनेे या अनुसंधान का संचािलत करने के िलए समनुदेिशत, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनक भी ह ᱹ। (ड) "दान" से ऐसे अिभदाय, अनुदान, वसीयती िनक्षेप या अन्य, जंगम और स्थावर संपिᱫयां और धन जो िकसी दानदाता से अकादमी ᳇ारा ᮧा᳙ िकए जाते ह,ᱹ के बदले मᱶ वािणिज्यक मूल्य की कोई सेवा या संसाधन की वचनब᳍ता िकए बगैर, अकादमी ᳇ारा उसके उ᳎ेश्यᲂ के अनुरूप दानदाता ᳇ारा िदए गए दान को पदािविहत करने और नामकरण अवसर ᮧदान करने से िभ᳖, अिभᮧेत ह।ै (ढ) "िसनेट" से अिधिनयम की धारा 18 के अधीन गिठत अकादमी की िसनेट अिभᮧेत है;

(ण) "पिरिनयम" से तत्समय ᮧवृᱫ अकादमी के पिरिनयम अिभᮧेत ह,ै (त) "छाᮢ" से ऐसा ᳞िᲦ अिभᮧेत ह ै-

(i) िजसने अकादमी के िकसी िडᮕी या िडप्लोमा कायर्ᮓम मᱶ नामांकन कराया हो और ᳩातक की उपािध ᮧा᳙ नहᱭ की ह ैया अभ्यिथता वापस नहᱭ ली हो या संबंिधत िडᮕी या िडप्लोमा के िलए िकसी आवश्यकता को पूरा करने मᱶ िवफल न रहा ह,ै या अनुशासनात्मक कारर्वाई के पिरणामस्वरूप िनष्कािसत नहᱭ कर िदया गया ह;ै या

(ii) जो अकादमी मᱶ अध्ययन करने के िलए रिजस्ᮝीकृत ह ैपरंतु िकसी िडᮕी या िडप्लोमा कायर्ᮓम के िलए नहᱭ और िजसने अध्ययन की अविध को पूरा नहᱭ िकया ह ैया अभ्यिथता वापस नहᱭ ली ह,ै या अनुशासनात्मक कारर्वाई के एक पिरणाम के रूप मᱶ िनष्कािसत नहᱭ कर िदया गया ह;ै (थ) "उपाध्यक्ष” से शासी बोडर् के उपाध्यक्ष अिभᮧेत ह।ै

(2) ये उन शब्दᲂ और पदᲂ के, जो इसमᱶ ᮧयुᲦ ह ᱹऔर पिरभािषत नहᱭ ह ᱹ᳴कतु अिधिनयम मᱶ पिरभािषत ह,ᱹ वही अथर् हᲂगे जो अिधिनयम मᱶ ह।ᱹ

3. शासी बोडर् - (1) शासी बोडर् अकादमी का शीषर्स्थ ᮧािधकरण बनाएगा ।

(2) बोडर् की संरचना, अध्यक्ष की िनयुिᲦ और सदस्यᲂ के नामांकन का तरीका, सदस्यᲂ की पदाविध और बोडर् की शिᲦयां अिधिनयम की धरा 11, 12, 13, 14, 16 और 17 के उपबंधᲂ के अनुसार होगी ।

4. बोड़र् की बैठक - (1) बोडर् की बैठकᲂ की अध्यक्षता अध्यक्ष करेगा ।

(2) िविभ᳖ मु᳎ᲂ जैसे िवदेशी छाᮢᲂ का ᮧवेश, अकादमी के बौि᳍क संपदा अिधकारᲂ पर मागर्दशर्क िस᳍ांत और अध्यादशेᲂ तथा िविनयमᲂ के अनुसार अन्य मागर्दशर्क िस᳍ांत बनाना:

(3) बैठक मᱶ िनणर्य सवर्सम्मित से िलया जाएगा, परंतु आम सहमित नहᱭ बनने की दशा मᱶ मतदान प᳍ित को अपनाया जाएगा। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3

(4) बोडर् की बैठक एक साल मᱶ कम से कम एक बार होगी और अध्यक्ष िजतनी बार उिचत समझे बोडर् की असाधारण बैठक बुला सकता ह।ै

(5) बोड़र् का सिचव, बैठक की तारीख स ेकम से कम सात कायर्िदवस पूवर्, िवचार के िलए संबंध एजᱶडा के साथ बैठक की सूचना दगेा:

परंतु अध्यक्ष कारण लेखब᳍ करने के प᳟ात अड़तालीस घंटे का नोिटस दकेर असाधारण बैठक बुला सकता ह।ै

(6) सिचव बैठक की चचार् को कायर्वृᱫ के रूप मᱶ िरकॉडर् करेगा और अध्यक्ष ᳇ारा सम्यक रूप से कायर्वृᱫ को अनुमोदन के प᳟ात इन्हᱶ बोडर् के सदस्यᲂ के िलए ᮧचािलत करेगा और बोडर् की अगली बैठक मᱶ इस कायर्वृᱫ को अंितम रूप से अंगीकार िकया जाएगा।

(7) बोडर् की कुल सदस्य संख्या का एक ितहाई बोडर् की बैठकᲂ के िलए कोरम का गठन करेगा।

(8) बैठक के िलए भागीदारी या तो ᳞िᲦगत रूप से उपिस्थित ᳇ारा या इलेक्ᮝॉिनक संसूचना माध्यमᲂ ᳇ारा जैसे स्काइप, वीिडयो कॉन् ᱶᮨ िसग, टेलीकां ᱶᮨ िसग या िकसी अन्य माध्यम से हो सकती ह।ै

(9) यिद जब आदशे करने के िलए बैठक बुलाई जाने पर कोरम नहᱭ बनता ह,ै तब अध्यक्ष तीस िमनट के िलए बैठक स्थिगत करेगा और तत्प᳟ात कोरम बनाने वाले उपिस्थत सदस्यᲂ के साथ बैठक पुन: बुला सकेगा।

(10) यिद भाग लेने वाले पचास ᮧितशत से अिधक सदस्य, अध्यक्ष को छोड़कर, ᮧस्ताव के पक्ष मᱶ मतदान करते ह,ᱹ ᮧस्ताव को पािरत समझा जाएगा और वोटᲂ की समानता की िस्थित मᱶ, अध्यक्ष का िनणार्यक मत होगा।

(11) कोई भी कारबार, अकादमी की वािषक िरपोटर् और लेखा खातᲂ से संबंिधत मामलᲂ को छोड़कर, िजसका बोडर् के िलए संचालन करना आवश्यक हो सकता ह,ै को अपने सभी सदस्यᲂ के बीच ᮧचािलत िकया जाएगा और इस तरह से पिरचािलत और अनुमोिदत कोई भी संकल्प सदस्यᲂ के बहुमत से हस्ताक्षर िकए जाने पर उसी रूप मᱶ िᮓयाशील और बाध्यकारी होगा जैसे की यह संकल्प बोडर् की बैठक मᱶ पािरत िकया गया हो, परंतु बोडर् की कुल संख्या के कम से कम एक-ितहाई सदस्यᲂ ᳇ारा इस संकल्प पर अपने िवचार दजर् िकए गए हᲂ।

5. िसनेट- (1) अिधिनयम की धारा 18 मᱶ उपबंिधत िसनेट के सदस्यᲂ के साथ-साथ अकादमी के सभी सहयुᲦ संकायाध्यक्ष िसनेट के पदने सदस्य हᲂगे।

(2) सहायक िनदशेक (ᮧशासन और िवᱫ) या उसकी अनुपिस्थित मᱶ ज्ये᳧ ᮧबंधक (ᮧशासन) िसनेट के गैर सदस्य सिचव के रूप मᱶ कृत्य करेगा।

6. िसनेट की शिᲦयां और कृत्य - अिधिनयम मᱶ िविन᳸द᳥ कृत्यᲂ के अलावा िसनेट िन᳜िलिखत कृत्य कर सकेगी:- (क) अकादमी ᳇ारा ᮧस्थािपत पाᲹᮓम बनाना, समीक्षा और पुनरीक्षण करना;

(ख) अध्यादशेᲂ मᱶ िनधार्िरत ᮧिᮓयाᲐ के अधीन छाᮢᲂ के दािखले के िलए मागर् दशर्क िस᳍ांत तैयार करना;

(ग) अध्यादशेᲂ मᱶ िनधार्िरत ᮧिᮓयाᲐ के अधीन िशक्षा, िशक्षा और परीक्षा के मानकᲂ को बनाए रखना, छाᮢᲂ का मूल्यांकन करना और ऐसी परीक्षाᲐ के पिरणाम घोिषत करना;

(घ) अकादमी के शैक्षिणक और ᮧशासिनक मामलᲂ पर िसफािरशᱶ ᮧा᳙ करने के िलए िविभ᳖ सिमितयᲂ, जैसा यह उिचत समझे, की िनयुिᲦ करना;

(ड़) सिमितयᲂ की िसफािरशᲂ पर िवचार करने और अनुसमथर्न के िलए उन्हᱶ बोडर् के समक्ष ᮧस्तुत करना;

(च) अकादमी के काम की आविधक समीक्षा करना;

(छ) अकादमी की वािषक िरपोटर् और अन्य ᮧकाशन जो अकादमी के िᮓयाकलापᲂ के संबंध मᱶ जानकारी का ᮧसार करने के िलए सुसगंत हᲂ, तैयार करना;

(ज) अध्यादशेᲂ के अनुसार अकादमी की सम्पदा, कमर्चािरवंृद के िलए िनवास, छाᮢᲂ के िलए छाᮢावास के रूप मᱶ उपयोग करना और कमर्चािरवृंद के िनरीक्षण के िलए ᳞वस्थाएं करना;

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (झ) संकाय को ऐसे संकायᲂ, िशक्षण िवभागᲂ, संस् थानᲂ, िव᳒ालयᲂ, कᱶ ᮤᲂ एवं एककᲂ तथा अध् ययन एवं िशक्षण के अन् य उप-ᮧभागᲂ मᱶ संचािलत करना;

(ट) अकादमी के कायर्ᮓमᲂ और िᮓयाकलापᲂ के िवस्तार, िविवधीकरण और पुन: िस्थितयन के िलए बोडर् को िसफािरशᱶ ᮧस्तुत करना;

(ठ) बोडर् को, पदᲂ के सृजन और िव᳒मान पदᲂ के पुन:पदनाम ऐसे पदᲂ के िलए उपलिब्धयां िनयत करते हुए सुझावᲂ के साथ, िसफािरशᱶ करना;

(ड) अध्यादशे के उपबंधᲂ के अनुसार अध्येतावृिᱫयां, छाᮢवृिᱫयां, अध्ययन वृिᱫयां, पदक और पुरस्कार संिस्थत करना और ᮧदान करना;

(ढ) ᮧािधकरण के समुिचत अनुमोदन से अकादमी की सभी िनयुिᲦयᲂ, ऐसी िनयुिᲦयᲂ के िलए चयन सिमितयᲂ, पदधािरयᲂ के िलए आरंिभक वेतन और िनयुिᲦ के िलए िकए जाने वाले स्तर के ᮧस्ताव का िनणर्य करेगा;

(ण) िकसी भी अन्य शैक्षिणक मु᳎े का समाधान करना; और (थ) बोडर् ᳇ारा िनदᱷिशत ऐसे अन्य कृत्यᲂ का िनवर्हन करना;

7. िसनेट की बैठक.- (क) िसनेट एक वषर् मᱶ कम से कम तीन बार बैठक करेगी;

(ख) िसनेट अध्यक्ष अपने स्वयं की पहल पर या िसनेट सदस्यᲂ के कम से कम पᲬीस ᮧितशत ᳇ारा हस्ताक्षिरत माँग पर बैठक बुला सकेगा;

(ग) िसनेट का सिचव साधारण बैठक के िलए कम से कम पांच कायर् िदवस और मांग पर आयोिजत बैठक के िलए कम से कम तीन कायर् िदवसᲂ का अिᮕम नोिटस जारी करेगा;

(घ) िसनेट का अध्यक्ष िसनेट की बैठक की अध्यक्षता करेगा;

(ड़) जब िसनेट का अध्यक्ष अनुपिस्थत हो उस समय सहयुᲦ िनदशेक (शैिक्षक) बैठक की अध्यक्षता करेगा;

(च) िसनेट की बैठक के िलए कुल सदस्यᲂ का एक-ितहाई गणपूित का गठन करेगा;

(छ) भागीदारी, ᳞िᲦगत उपिस्थित ᳇ारा या इलेक्ᮝॉिनक संचार प᳍ित जैसे स्काइप, वीिडयो कॉन् ᱶᮨ िसग, टेलीकां ᱶᮨ िसग या संचार की िकसी अन्य प᳍ित के रूप मᱶ गणपूित का अवधारण करने हतुे िकया जा सकेगा;

(ज) यिद जब आदशे करने के िलए बैठक बुलाई जाने पर कोरम नहᱭ बनता ह,ै तब अध्यक्ष तीस िमनट के िलए बैठक स्थिगत करेगा और तत्प᳟ात कोरम बनाने वाले उपिस्थत सदस्यᲂ के साथ बैठक पुन: बुला सकेगा। (झ) िसनेट का सिचव िसनेट की बैठक का कायर्वृᱫ तैयार करेगा और िसनेट के अध्यक्ष के अनुमोदन के साथ इस कायर्वृᱫ को सभी सदस्यᲂ मᱶ ᮧचािलत करेगा;

(ट) बैठक मᱶ िलए गए अकादमी के संकाय से संबंिधत िनणर्य को तत्प᳟ात बोडर् के समक्ष अनुसमथर्न के िलए रखा जाएगा;

(ठ) बैठक मᱶ िनणर्य सवर्सम्मित से िलया जाएगा और यिद िकसी कायर्सूची पर आम सहमित नहᱭ बन पाती ह,ै तो इस मु᳎े पर सदस्यᲂ के पचास ᮧितशत से अिधक के बहुमत ᳇ारा िसनेट के अध्यक्ष को छोड़कर, िनणर्य हतुे मतदान प᳍ित अपनाई जा सकेगी;

(ड) यिद िकसी कायर्सूची पर मतदान प᳍ित अपनाई जाती ह,ै उस समय वोटᲂ की समानता की िस्थित मᱶ बैठक के अध्यक्ष का िनणार्यक मत होगा;

(ढ) कोई भी कारबार, अकादमी की वािषक िरपोटर् और लेखा खातᲂ से संबंिधत मामलᲂ को छोड़कर, िजसका बोडर् के िलए संचालन करना आवश्यक हो सकता ह,ै को अपने सभी सदस्यᲂ के बीच पिरचािलत िकया जाएगा और इस ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 तरह से पिरचािलत और अनुमोिदत कोई भी संकल्प सदस्यᲂ के बहुमत से हस्ताक्षर िकए जाने पर उसी रूप मᱶ िᮓयाशील और बाध्यकारी होगा जैसे की यह संकल्प बोडर् की बैठक मᱶ पािरत िकया गया हो, परंतु बोडर् की कुल संख्या के कम से कम एक-ितहाई सदस्यᲂ ᳇ारा इस संकल्प पर अपना समथर्न अिभिलिखत िकया गया हो। (ण) िसनेट का िनणर्य और बोडर् की िसफािरश, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद और अकादमी के बीच िकए गए समझौता ज्ञापन के अनुरूप हᲂगे।

8. कुलपित - (1) अध्यक्ष अकादमी का कुलपित होगा।

(2) अकादमी के दीक्षांत समारोह की अध्यक्षता कुलपित करेगा और अध्यक्ष की अनुपिस्थित मᱶ उपाध्यक्ष, कुलपित के रूप मᱶ कायर् करेगा।

9. िनदशेक (1) अिधिनयम की धारा 22 के उपबंधᲂ के अनुसार वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद का अध्यक्ष िनदशेक की िनयुिᲦ करेगा ।

(2) िनदशेक एक भारतीय नागिरक होगा और अकादमी का ᮧमुख शैक्षिणक और कायर्कारी अिधकारी होगा जो अकादमी के ᮧशासन और िशक्षा ᮧदान करने, अनसुंधान और अनुशासन बनाए रखने के िलए िजम्मेदार होगा ।

10. िनदेशक की पदाविध और पद से हटाया जाना-(1) िनदशेक की पदाविध िनयुिᲦ की तारीख से पांच वषर् की होगी:

परंतु वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद का सभापित, िनदेशक की पदाविध का, मूल्यांकन सिमित िजसमᱶ िनदशेक की िनयुिᲦ के िलए खोज-बीन सह चयन सिमित के कम से कम तीन सदस्य हᲂ, िजसके अंतगर्त अध्यक्ष और उपाध्यक्ष भी ह,ᱹ की िसफ़ािरश पर सᱫर वषर् की आयु तक िवस्तार कर सकेगा।

(2) अिधिनयम की धारा 35 की उपधारा (2) के उपबंधᲂ के अनुसार िनदशेक को उसके पद से हटाया जा सकेगा।

(3) ᮧितिनयुिᲦ, स्थानांतरण, िचिकत्सा या अन्य अवकाश, त्यागपᮢ या िकसी अन्य कारण से िनदशेक की अनुपिस्थित मᱶ, सबसे विर᳧ सहयुᲦ िनदशेक, िनदशेक की वापसी तक या िनयिमत आधार पर िनदशेक पद पर िनयुिᲦ होने तक िनदशेक के कतर्᳞ᲂ का िनवर्हन करेगा।

11. िनदशेक की शिᲦयां और कतर्᳞- (1) िनदशेक - (क) पिरिनयमᲂ या अध्यादशेᲂ ᳇ारा अकादमी के अन्य अिधकािरयᲂ के िलए ᮧत्यायोिजत िनणर्यᲂ को छोड़कर, अकादमी के बोडर् और िसनेट ᳇ारा िलए गए िनणर्यᲂ को कायार्िन्वत करेगा;

(ख) अनुमोिदत बजट मᱶ िनिधयᲂ की उपलब्धता के अध्यधीन, अध्यादशेᲂ मᱶ िविहत ᮧिᮓयाᲐ और समय-समय पर बोडर्, िसनेट और िवᱫ सिमित ᳇ारा िलए गए िनणर्यᲂ के अनुसार ᳞य उपगत करेगा;

(ग) िवᱫ सिमित ᳇ारा अनुमोिदत सीमा तक िनिधयᲂ का पुनिविनयोग करने की शिᲦ होगी;

(घ) िवᱫ सिमित की सहमित अध्यधीन और िसनेट तथा बोडर् के अनुसमथर्न के ᳇ारा ऋणᲂ, वसूली और अᮧितसंघगीय हािनयᲂ को, बोडर् ᳇ारा तय सीमा तक, को माफ करने की शिᲦ होगी;

(ड़) ᮧािधकरण के समुिचत अनुमोदन से अकादमी की सभी िनयुिᲦयᲂ, ऐसी िनयुिᲦयᲂ के िलए चयन सिमितयᲂ, पदधािरयᲂ के िलए आरंिभक वेतन और िनयुिᲦ के िलए िकए जाने वाले स्तर के ᮧस्ताव का िनणर्य करेगा;

(च) अकादमी मᱶ ᮧवेश के िलए पाᮢता मानदडं के िलए मानकᲂ या ᮧवेश के िलए मूल्यांकन को िनयत करने और ऐसे सभी ᮧवेशᲂ के अनुमोदन की शिᲦ होगी;

(छ) िवᱫ सिमित की िसफािरश और िसनेट ᳇ारा अनुमोदन के अधीन अकादमी की इमारतᲂ, हॉस्टल, गेस्ट हाउस और अन्य अवसंचना के िलए िकराया और फीस तय करेगा;

(ज) अकादमी की वािषक िरपोटर् और वािषक लेखा बोडर् के समक्ष ᮧस्तुत करेगा;

6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (झ) अकादमी मᱶ अस्थायी पदᲂ का सृजन करेगा और िसनेट की िसफािरश और बोडर् ᳇ारा अनुसमथर्न पर संिवदा के आधार पर उᲦ पदᲂ मᱶ उपयुᲦ ᳞ि᳥यᲂ की िनयुिᲦ करेगा;

(ट) िकसी भी शैक्षिणक कतर्᳞ और कृत्य िसनेट के अनुमोदन और बोडर् के अनुसमथर्न से को आउटसोसर् करने की शिᲦ होगी;

(ठ) अकादमी की ओर से सभी करारᲂ, अनुबंधᲂ और समझौता ज्ञापनᲂ पर हस्ताक्षर करेगा;

(ड) अकादमी के शैक्षिणक कमर्चािरवृन्द के सदस्यᲂ को अवकाश अनुदान ᮧदान करने और, यथा आवश्यक, तो अकादमी के कमर्चािरवृन्द को ᳞िᲦगत िवकास और ᮧिशक्षण हतुे भेजने की शिᲦ होगी;

(ढ) िविश᳥ क्षेᮢᲂ मᱶ अकादमी के जनादशे को आगे बढ़ाने और सलाह दनेे के िलए सिमितयᲂ, टास्क फोसर् और कायर् समूह का गठन करने की शिᲦ होगी;

(ण) बोडर् ᳇ारा समय समय पर पिरिनयम मᱶ िविन᳸द᳥ या अध्यादशे मᱶ उपबंध ᳇ारा या अिधसूचना ᳇ारा ऐसे अन्य कतर्᳞ᲂ का अनुपालन कर सकेगा।

(2) िनदशेक, अकादमी के अन्य उपयुᲦ अिधकािरयᲂ को अध्यक्ष के अनुमोदन से अपनी शिᲦयᲂ का ᮧत्यायोजन कर सकेगा;

12. िनदशेक के िलए ᮧितकर - चयन सिमित िनदेशक पद के िलए ᳞िᲦ की ᮰े᳧ता के अनुरूप ᮧितकर की िसफािरश कर सकेगी िजसमᱶ िनयत और कायर् आधािरत दोनᲂ पिरवतर्नीय संघटक हᲂगे और िजसका अनुसमथर्न बोडर् ᳇ारा िकया जाएगा।

13. सहयुᲦ िनदशेक - (1) अकादमी मᱶ पाँच सहयुᲦ िनदशेक हᲂगे, अथार्त सहयᲦु िनदेशक (शैक्षिणक), सहयुᲦ िनदशेक (ᮧशासन और िवᱫ), सहयुᲦ िनदशेक (छाᮢ संबंधी मामले), सहयुᲦ िनदशेक (संसाधन िवकास और नेटवकर् ) और सहयुᲦ िनदशेक (संस्थान संबंधी मामले और सूचना और संचार ᮧौ᳒ोिगकी अवसंरचना) ।

(2) बोडर्, ᮧशासिनक सुिवधा या अकादमी की शैक्षिणक दक्षता के ᮧयोजन के िलए, सहयुᲦ िनदशेक को कोई भी अन्य पदनाम समनदेुिशत कर सकेगी।

14. सहयुᲦ िनदेशकᲂ की िनयुिᲦ- (1) िनदशेक, अकादमी के आचायर् या वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनकᲂ, जो अकादमी की शैक्षिणक गितिविधयᲂ मᱶ लगे हुए हᲂ, मᱶ से अध्यक्ष के अनुमोदन से सहयुᲦ िनदशेक िनयुᲦ कर सकेगा।

(2) सहयुᲦ िनदशेकᲂ के चयन के िलए एक चयन सिमित का गठन िकया जाएगा िजसमᱶ िन᳜िलिखत शािमल हᲂग-े (I) बोडर् का उपाध्यक्ष - अध्यक्ष;

(Ii) िनदशेक - सदस्य;

(Iii) बोडर् के सदस्यᲂ मᱶ से उपाध्यक्ष (वाइस चेयरपसर्न) ᳇ारा नामिनदᱷिशत बोडर् का एक सदस्य - सदस्य;

(Iv) तीन िवशेषज्ञ, िजनमᱶ से कम से कम दो, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद से संबंिधत न हᲂ, को िनदशेक की िसफािरश पर उपाध्यक्ष (वाइस चेयरपसर्न) ᳇ारा नामिनदᱷिशत िकया जाएगा;

(3) चयन सिमित, सहयुᲦ िनदशेक के पद के िलए, बोडर् के सदस्यᲂ, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧयोगशालाᲐ के िनदशेक और वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के ᮧिति᳧त वैज्ञािनकᲂ मᱶ से अभ्यिथयᲂ को ढंूढेगी।

(4) खंड (1) के ᮧयोजन के िलए, चयन सिमित ऐसी ᮧिᮓयाᲐ का पालन करेगी, जैसा िक यह उिचत समझे।

(5) िनदशेक, सहयुᲦ िनदशेक की िनयुिᲦ के िलए चयन सिमित की िसफािरश, अध्यक्ष को उसके अनुमोदन के िलए ᮧस्तुत करेगा। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7

15. सहयुᲦ िनदशेकᲂ की पदाविध (1) आरंभ मᱶ सहयुᲦ िनदशेकᲂ की पदाविध िनयुिᲦ की तारीख से तीन वषर् या पांच वषर् की अविध के िलए होगी या पᱹसठ वषर् की आयु तक होगी, जैसा भी चयन सिमित की िसफािरश पर बोडर् ᳇ारा िनणर्य िलया जाए:

परंतु बोडर् कारण लेखब᳍ करते हुए, सहयुᲦ िनदेशकᲂ की पदाविध को उनके ᮧदशर्न के आधार पर आगे बढ़ा सकेगा।

16. सहयुᲦ िनदशेक का हटाया जाना- बोडर्, तीन महीने का नोिटस दकेर या तीन महीने के नोिटस के बदले मᱶ वेतन का भुगतान करने के प᳟ात एक सहयुᲦ िनदशेक को हटा सकेगा। परंतु बोड़र् ᳇ारा िकसी भी सहयुᲦ िनदशेक को कायार्लय से तब तक नहᱭ हटाया जाएगा जब तक िनदशेक ᳇ारा उसके िलए एक संकल्प के ᮧस्ताव पर िसनेट और बोड़र् के दो-ितहाई बहुमत से अनुमोिदत न कर िदया जाए।

17. सहयुᲦ िनदशेकᲂ के कतर्᳞ और शिᲦयाँ - सहयुᲦ िनदशेक, शैक्षिणक, ᮧशासिनक, िवᱫीय, संचालन और पदनाम के साथ संगत अन्य कायᲄ के िनवर्हन मᱶ िनदशेक की सहायता करेगा और िनदशेक या बोडर् ᳇ारा समनुदिेशत िजम्मेदािरयᲂ का पालन करेगा ।

18. सहयुᲦ िनदेशकᲂ के िलए ᮧितकर – िनदशेक खोज-सह-चयन सिमित की िसफािरश पर अभ्यथᱮ की संभािवत सािबत क्षमता और ᮰े᳧ता के अनुरूप अकादमी के सहयुᲦ िनदशेक पद के िलए बोडर् ᳇ारा समय-समय पर अिधसूिचत ᮧितकर ᮧदशर्न के आधार पर पिरवतर्नीय संघटकᲂ के अनुसार िनयत करेगा।

19. संकायाध्यक्ष - (1) िनदशेक, सहयुᲦ िनदशेक (शैक्षिणक) के परामशर् स ेऔर अध्यक्ष के अनुमोदन स ेसंकायाध्यक्ष िनयुᲦ कर सकेगा:

परंतु अध्यक्ष, िसनेट की िसफािरश के िबना और उपाध्यक्ष से परामशर् िकए िबना अनुमोदन ᮧदान नहᱭ करेगा।

(2) संकायाध्यक्ष, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनकᲂ मᱶ से जो शैक्षिणक गितिविधयᲂ मᱶ लगे हᲂ और जो अकादमी के संकाय का िहस्सा हᲂ और रा᳦ीय और अंतररा᳦ीय स्तर पर पहचान के साथ ᮧिति᳧त वैज्ञािनक हᲂ, मᱶ से िनयुᲦ िकया जाएगा।

(3) संकायाध्यक्ष अकादमी को उसके शैिक्षक कृत्यᲂ के िनवर्हन मᱶ सहायता करेगा।

(4) जीव िवज्ञान, रसायन िवज्ञान, इंजीिनयरी िवज्ञान, गिणत और सूचना िवज्ञान और भौितक िवज्ञान, ᮧत्येक के िलए, एक संकायाध्यक्ष होगा।

(5) संकायाध्यक्ष की पदाविध िनयुिᲦ की तारीख से तीन वषर् की अविध के िलए होगी, जो एक और वषर् या ऐसी िकसी अन्यून अविध के िलए बढ़ाई जा सकेगी जो िसनेट की िसफािरश पर बोडर् उिचत समझे;

(6) बोडर् ᳇ारा िकसी भी संकायाध्यक्ष को कायार्लय से िनदशेक ᳇ारा उसके िलए संकल्प के दो ितहाई बहुमत ᳇ारा पर हटाया जा सकेगा और वो िसनेट के दो-ितहाई बहुमत से सदस्यᲂ ᳇ारा अनुमोिदत से िकया जाएगा।

20. संकायाध्यक्ष के कतर्᳞ और शिᲦयाँ (1) एक संकायाध्यक्ष संबंिधत क्लस्टर िजसके िलए उसे िनयुᲦ िकया गया ह,ै का भारसाधक होगा और अकादमी के शैक्षिणक कृत्यᲂ के िनवर्हन मᱶ िनदशेक और सहयुᲦ िनदशेक (शैक्षिणक) की सहायता करेगा।

(2) संकायाध्यक्ष को कोई अन्य कायर्, जो िनदशेक या सहयुᲦ िनदशेक (शैक्षिणक) ᳇ारा आवश्यक समझा जाए, समनुदेिशत िकया जा सकेगा।

21. अकादमी के संकायाध्यक्ष के िलए वृिᱫका फीस - बोडर्, सहयुᲦ िनदशेक (शैक्षिणक) की िसफािरश पर िनदशेक ᳇ारा िनयत वृिᱫका फीस का अनुमोदन कर सकेगा ।

22. सहयुᲦ संकायाध्यक्ष- (1) िनदेशक, सहयुᲦ िनदशेक (शैक्षिणक) के परामशर् से और अध्यक्ष के अनुमोदन के साथ सहयुᲦ संकायाध्यक्ष को िनयुᲦ कर सकेगा:

परंतु अध्यक्ष, िसनेट की िसफािरश और उपाध्यक्ष से परामशर् िकए िबना अनुमोदन ᮧदान नहᱭ करेगा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(2) सहयुᲦ संकायाध्यक्ष, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनकᲂ मᱶ से, जो इसके शैक्षिणक कायᲄ के िनवर्हन मᱶ अकादमी की सहायता के िलए शैक्षिणक गितिविधयᲂ मᱶ लगे हुए ह,ᱹ िनयुᲦ िकया जाएगा।

(3) जीव िवज्ञान, रसायन िवज्ञान, इंजीिनयᳳरग िवज्ञान, गिणत, सूचना िवज्ञान और भौितक िवज्ञान ᮧत्येक के िलए एक सहयुᲦ संकायाध्यक्ष िनयुᲦ िकया जाएगा।

(4) एक सहयुᲦ संकायाध्यक्ष की पदाविध उनकी िनयुिᲦ की तारीख से तीन वषर् की अविध के िलए होगी:

परंतु कारण लेखब᳍ करते हुए, िसनेट की िसफािरश पर बोडर् ᳇ारा इसे तीन वषर् की अविध की एक और पदाविध के िलए बढ़ाया जा सकेगा ।

(5) बोडर् एक सहयुᲦ संकायाध्यक्ष को, यिद उसकी सेवाएं संतोषजनक नहᱭ पाई गई या िकसी अन्य कारण से िनदशेक लेखब᳍ करते हुए संबंिधत संकायाध्यक्ष और सहयुᲦ िनदेशक (शैक्षिणक) की िसफािरश पर पद से हटा सकेगा ।

23. सहयुᲦ संकायाध्यक्ष की शिᲦयां और कतर्᳞- (1) एक सहयुᲦ संकायाध्यक्ष संबंिधत क्लस्टर िजसके िलए उसे िनयुᲦ िकया गया ह,ै का भारसाधक होगा और अकादमी की शैक्षिणक गितिविधयᲂ के िनवर्हन मᱶ सहयुᲦ िनदशेक (शैक्षिणक) और इसी क्लस्टर के संकायाध्यक्ष की सहायता करेगा।

(2) सहयुᲦ िनदेशक (शैक्षिणक) और संबंिधत क्लस्टर के संकायाध्यक्ष जैसा उिचत समझᱶ सहयुᲦ संकायाध्यक्ष को अन्य कायर् समनुदिेशत कर सकᱶ गे।

24. अकादमी के सहयुᲦ संकायाध्यक्ष के िलए वृिᱫका फीस - िनदशेक ᳇ारा सहयुᲦ संकायाध्यक्ष के िलए िनयत की गई वृिᱫका फीस को बोडर् अनुमोिदत कर सकेगा:

परंतु िनदशेक, सहयुᲦ िनदेशक (शैक्षिणक) को छोड़कर, की िसफािरश पर वृिᱫका फीस िनयत नहᱭ करेगा।

25. िविभ᳖ ᮧयोगशालाᲐ के िलए समन्वयकᲂ की िनयुिᲦ – िसनेट, अध्यक्ष, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧयोगशालाᲐ के िनदशेकᲂ की िसफािरश पर िविभ᳖ ᮧयोगशालाᲐ के िलए समन्वयकᲂ की िनयुिᲦ कर सकेगा और िनयुिᲦ का िसनेट की अगली बैठक मᱶ अनुसमथर्न िकया जाएगा।

26. अकादमी की ᮧयोगशालाᲐ के समन्वयकᲂ के िलए वृिᱫका फीस - बोडर् सहयुᲦ िनदेशक (शैक्षिणक) की िसफािरश पर ᮧयोगशालाᲐ के समन्वयकᲂ के िलए वृिᱫका फीस िनयत कर सकेगा ।

27. कायर्कारी अिधकारी और सलाहकार- (1) (क) अकादमी के कायर्कारी अिधकािरयᲂ मᱶ ऐस ेअिधकारी सिम्मिलत हᲂगे जो अकादमी के िनिवᲩ संचालन के िलए अत् यंत आवश् यक हᲂ। (ख) अिधकािरयᲂ मᱶ ऐसे अिधकारी समािहत हᲂगे जो अकादमी उिचत समझे परंतु यह केवल इन पदᲂ जैसे सहायक िनदशेक (ᮧशासन एवं िवत् त), ज्ये᳧ ᮧबंधक (ᮧशासन), तकनीकी अिधकारी, पुस् तकालयाध् यक्ष या समतुल् य, िसस् टम ᮧशासक, अिभयंता, मीिडया अिधकारी, जन संपकर् अिधकारी, िविध अिधकारी और अन्य अिधकारी तक सीिमत नहᱭ ह।ᱹ

(2) िनदशेक, अिधिनयम की धारा 33 की उप-धारा (1) के उपबंधᲂ के अनुसार िलिखत सिंवधा के अधीन, कमर्चािरयᲂ और सलाहकारᲂ को संिवधा के आधार पर िनयुᲦ कर सकेगा।

(3) (क) िविनयमᲂ के उपबंधᲂ के अध्यधीन संकाय के स्थायी सदस्यᲂ या अन्य कमर्चािरयᲂ यथा लागू के िलए चयन ᮧिᮓया, िवज्ञापन ᮧकािशत होने या नामिनदᱷशन या आमंᮢण, यथा मामला, की तारीख से पᱹतालीस िदनᲂ के भीतर संपूणर् होगी। (ख) िकसी अभ्यथᱮ का चयन एक बार पूरा होने पर, ऐसे िवस्तार के अध्यधीन जो अभ्यथᱮ ᳇ारा स्वीकृित की दशा मᱶ िसनेट ᳇ारा आवश्यक समझा जाए, तीन मास के िलए िविधमान्य होगा।

(4) अकादमी, रा᳦ीय दिैनक समाचार पᮢᲂ मᱶ और अकादमी तथा वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧयोगशालाᲐ के नोिटस बोडर् पर अिधसूचना ᳇ारा ᳞ापक ᮧचार ᳇ारा िनयुिᲦयां करेगा। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9

(5) (क) अकादमी की चयन सिमित िन᳜िलिखत ᳞िᲦयᲂ से िमलकर बनेगी कायर्कारी सहायकᲂ और कायर्कारी सलाहकारᲂ की िनयुिᲦ सिंवदा के आधार पर कर सकेगी:-

(i) एक सहायक िनदशेक या उसका नामिनदᱷिशत अकादमी का;

(ii) अकादमी का एक अिधकारी जो संयुᲦ आचायर् की पंिᲦ से नीचे का न हᲂ;

(iii) सिमित के अध्यक्ष ᳇ारा नामिन᳸द᳥ वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧयोगशालाᲐ के दो समन्वयक या वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧयोगशाला का एक वैज्ञािनक और एक समन्वयक;

(ख) चयन सिमित अभ्यिथयᲂ, िजन्हᲂने पदᲂ के िलए अपनी अहर्ताᲐ और अनुभव के आधार पर आवेदन िकया ह ैिक एक पैनल मᱶ से चयन कर सकᱶ गे।

(6) (क) अकादमी, समय समय पर आवश्यक अहर्ताᲐ, पदाविध तथा पािर᮰िमक और िविभ᳖ ᮧशासिनक पदᲂ के कृत्यᲂ के ब्योरे अिधसूिचत कर सकेगी। (ख) अकादमी मᱶ लचीली ᮧितकार प᳍ित होगी जो अकादमी मᱶ ᮰े᳧ ᮧितभाशाली ᳞िᲦयᲂ को लाने के िलए कायर् को मान्यता देती ह।ै

(7) (क) अकादमी के कमर्चािरयᲂ की भतᱮ के िलए, सरकार और वैज्ञािनक और औ᳒ोिगक अनुसन्धान पिरषद ्᳇ारा इस संबंध मᱶ समय-समय पर जारी आदशेᲂ और िनदशेᲂ के अनुसार िपछड़े समुदायᲂ एवं िद᳞ांजनᲂ के िलए उपयुᲦ पदᲂ के आरक्षण के िलए समुिचत उपबंध बनाएगी। (ख) भतᱮ की ᮧिᮓया पारदशᱮ होगी और वह िनयिमत रुप से अ᳒तन की जाएगी और अकादमी की वेबसाइट पर उपलब्ध कराई जाएगी। (ग) अकादमी की आवश्यकता और कािमकᲂ को बेहतर शैिक्षक अहर्ताᲐ और तकनीकी सक्षमता को ध्यान मᱶ रखते हुए ᮧत्येक पद की उपबंिधत अहर्ताᲐ को, यथा आवश्यक, पुन: पिरभािषत िकया जाएगा। (घ) िकसी भी ᮧशासिनक कमर्चारीवृद का पािर᮰िमक, िजसका िवᱫ सिमित से सहमित और िनदेशक से अनुसमथर्न अपेिक्षत हो, जो अकादमी ᳇ारा समय-समय पर उपांतिरत पािर᮰िमक होगा। (ड़) शासी बोडर्, उपयुᲦ ᮧितभाशाली ᳞िᲦयᲂ को ऐस ेपदᲂ पर िनयुिᲦ हतेु आकिषत करने के िलए, जो मामले- दर- मामले पर आधािरत होगा, और एक नजीर नहᱭ होगा, यिद आवश्यक हो िव᳒मान वेतनमानᲂ से एक स्तर उᲬतर का वेतनमान पुनः स्थािपत कर सकेगा। (च) अकादमी मᱶ स् थायी, अस् थायी, ᮧितिनयुिᲦ और संिवदात्मक िनयुिᲦयᲂ पर काम करने वाले कमर्चािरयᲂ के अनुपात का िविन᳟य सीिनयर और शासी बोडर् ᳇ारा िकया जा सकेगा। (छ) (i) अकादमी के सभी कमर्चारी पािरवािरक स्वास्थ्य संरक्षण के हकदार हᲂगे।

(ii) अकादमी मᱶ स् थायी, अस् थायी सभी कमर्चारी समय-समय पर अिधसूिचत िनयमᲂ के अनुसार छुᲵी के हकदार हᲂगे।

(7) (क) गैर शैक्षिणक कायर्कारी अिधकािरयᲂ और सलाहकारᲂ की िनयुिᲦ का िवस्तार मामले-दर-मामले के आधार पर सहयुᲦ िनदेशक (ᮧशासन और िवᱫ) की िसफािरश पर िनदशेक ᳇ारा िकया जाएगा। (ख) सहयुᲦ िनदशेक एवं िनदशेक का वािषक कायर्-आंकलन, अकादमी के अध् यक्ष ᳇ारा िकया जाएगा।

(8) (क) अकादमी के सभी कमर्चारी उनकी संिवदा अविध या िवस्तािरत संिवदा अविध पूरी होने के प᳟ात यथा मामला, िसनेट के अध्यक्ष की िसफािरश पर तथा शासी बोडर् की िसफािरश पर सेवांत फायद े जैसे छुᲵी बनाना, उपदान और अन्य फायदे ᮧा᳙ करने के हकदार हᲂगे। (ख) सेवांत फायदᲂ के िलए मानक एक उप सिमित ᳇ारा िनयत िकए जाएंगे िजसमᱶ िसनेट के अध्यक्ष ᳇ारा गिठत सिमित के सदस्य भी सिम्मिलत ह ᱹ। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(9) िनदशेक, गैर शैिक्षक कतर्᳞ और कृत्यᲂ को ऐसी अविध, ऐसे क्षेᮢᲂ मᱶ और कमर्चारीवृंद के ऐसे स्तरᲂ पर जसैा वह उिचत समझे, आउटसोसर् कर सकेगा।

28. अकादमी के कायर्कारी ᮧािधकरण ᳇ारा कारबार का संचालन करना- (1) अकादमी के कायर्कारी ᮧािधकरण और कायर्कारी अिधकारी अपने कतर्᳞ᲂ का िनवर्हन इस रीित से करᱶगे िक अकादमी के कामकाज मᱶ उᲬ कायर्क्षम स्तर ᮧा᳙ िकया जा सके।

(2) खंड (1) के ᮧयोजनᲂ के िलए, अकादमी सभी मामलᲂ मᱶ सामंजस्य से कृत्य करेगी।

(3) कायर्कारी ᮧािधकरणᲂ की कारबार के संचालन करने की पिरयोजनाᲐ के िलए साधारण नीित मागर्दशर्क िस᳍ांत तैयार करने के िलए एक शीषर् सिमित का गठन िकया जाएगा िजसकी अध्यक्षता िनदशेक करेगा, िजसमᱶ सभी सहयुᲦ िनदशेक साधारण िनयुिᲦ मागर्दशर्क िस᳍ातं बनाने के िलए सदस्यᲂ के रुप मᱶ सिम्मिलत हᲂगे।

29. अकादमी का कारबार या कृत्य- (1) ऐसे कृत्य, जो ᮧत्येक सहयुᲦ िनदशेकᲂ की ᮧत्यक्ष पयर्वेक्षण के अधीन अपेिक्षत ह,ै से िनदशेालय का गठन िकया जाएगा जबिक दसूरे कृत्य उपयुᲦ अिधकािरयᲂ को ᮧत्यायोिजत िकए जा सकᱶ गे िजन्हᱶ कायार्लय का गठन िकया जाएगा।

(2) जब तक िक अिभ᳞Ღ रूप से अन्यथा अपेिक्षत न हो, िन᳜िलिखत िनदशेालय अकादमी के कारवार का संचालन करᱶगे, अथार्त: - (क) शैक्षिणक कायर् िनदशेालय;

(ख) छाᮢ कायर् िनदशेालय;

(ग) ससंाधन िवकास और नेटव᳼कग िनदशेालय;

(घ) संस्थान कायर् और सूचना तथा संचार ᮧौ᳒ोिगकी, ई-लिनग और दरूस्थ िशक्षा िनदशेालय; और (ड़) ᮧशासन और िवᱫीय सहायता िनदशेालय (क) शैक्षिणक कायर् िनदशेालय- (i) शैक्षिणक कायर् िनदेशालय सहयुᲦ िनदशेक (शैक्षिणक) की ᮧत्यक्ष ᮧयवेक्षण के अधीन कृत्य करेगा।

(ii) सहयुᲦ िनदशेक (शैक्षिणक) ᳇ारा ᮧत्यक्ष पयर्वेक्षण के अधीन सकंायाध्यक्ष और सहयुᲦ संकायाध्यक्ष, सहयुᲦ िनदशेक (शैक्षिणक) की सहायता करᱶगे।

(iii) शैक्षिणक कायर् िनदशेालय िन᳜िलिखत कृत्य करेगा- (क) बोड़र्, िसनेट और अध्ययन के बोडर् की पाᲹᮓम मॉᲽूल, पाᲹᮓम तैयार करने और इन से जुड़े अन्य मामलᲂ मᱶ सहायता करना;

(ख) उधार प᳍ित और मूल्यांकन से संबंिधत सभी मामलᲂ को जाँचना;

(ग) परीक्षा का िनरीक्षण-उसके आयोजन, पिरणामᲂ की घोषणा, पुन: परीक्षा या पुनमूर्ल्यांकन के संबंध मᱶ परीक्षा का पयर्वेक्षण करना;

(घ) डॉक्टरेट सिमितयᲂ का गठन और िविधमान्य करना;

(ड़) कायर् गुणवᱫा आ᳡ासन का अभ्यास; तथा (च) ऐसे अन्य कृत्य जो अध्ययन बोडर् और िसनेट ᳇ारा िनदᱷिशत िकए गए हᲂ, का िनष्पादन करना, (ख) छाᮢ कायर् िनदशेालय- (i) छाᮢ कायर् िनदशेालय सहयुᲦ िनदशेक (छाᮢ कायर्) के ᮧत्यक्ष पयर्वेक्षण के अधीन कृत्य करेगा।

(ii) सहयुᲦ िनदशेक (छाᮢ कायर्) के ᮧत्यक्ष पयर्वेक्षण मᱶ, संकायाध्यक्ष और सहयुᲦ संकायाध्यक्ष सहयुᲦ िनदशेक (छाᮢ कायर्) की सहायता करᱶगे।

(iii) छाᮢ कायर् िनदशेालय िन᳜िलिखत कृत्य करेगा- ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11 (क) ᮧवेश ᮧिᮓया के सभी पहलुᲐ का िनरीक्षण करना और समय-समय पर ᮧवेश रचना करना;

(ख) अध्ययन के िविभ᳖ पाᲹᮓमᲂ के िलए छाᮢ रिजस्ᮝीकरण ᮧिᮓया का िनरीक्षण और रूपात्मकता बनाना;

(ग) ᮧवेश सिमित का गठन करना;

(घ) सभी छाᮢᲂ की सभी िशकायतᲂ और िववादᲂ का समाधान करना;

(ड़) छाᮢᲂ, कमर्चारीवृद और पणधािरयᲂ से िनयिमत रुप से ᮧितिᮓया ᮧा᳙ करना और उसके संबंध मᱶ अिभवृि᳍ के िलए ऐसे कायर् करना;

(च) िवदशेी छाᮢᲂ से संबंिधत नीित बनाने और िᮓयान्वयन के िलए नेटव᳼कग और संसाधन िनदशेालय को आवश्यक सूचना उपलब्ध कराना;

(छ) ऐसे अन्य कृत्य, जो अधययन बोडर् और िसनेट ᳇ारा िनदᱷिशत िकए जा सकᱶ , का िनवर्हन करना;

(ग) ससंाधन िवकास और नेटव᳼कग िनदशेालय-

(i) ससंाधन िवकास और नेटव᳼कग िनदशेालय, सहयुᲦ िनदशेक (संसाधन िवकास और नेटव᳼कग) की ᮧत्यक्ष पयर्वेक्षण के अधीन कृत्यᲂ का िनवर्हन करेगा;

(ii) सहयुᲦ िनदशेक (संसाधन िवकास और नेटव᳼कग) के ᮧत्यक्ष पयर्वेक्षण के अधीन, संकायाध्यक्ष और सहयुᲦ संकायाध्यक्ष, सहयुᲦ िनदशेक (संसाधन िवकास और नेटव᳼कग) की सहायता करᱶगे;

(iii) संसाधन िवकास और नेटव᳼कग िनदशेालय िन᳜िलिखत कृत्यᲂ का िनवर्हन करेगा- (क) अकादमी के िवकास और वृि᳍ के िलए, रा᳦ीय और अंतररा᳦ीय दोनᲂ स्तरᲂ पर ᳞ापक योजना िᮓयान्वयन के िलए िजम्मेदार होगा;

(ख) उ᳒ोगᲂ के साथ अन्योन्यिᮓया के िलए नीित बनाना और उ᳒ोगᲂ, लोकिहतैषी संगठनᲂ, ᳞ि᳥यᲂ से िनिध जुटाना;

(ग) पीठ आचायर् पदᲂ, अध्येतावृिᱫयᲂ और उसके संबंिधत अन्य मामलᲂ तथा सरकार और अन्य ᳫᲂतᲂ योजना िवᱫ पोषण के िलए िनिध जुटाना;

(घ) िवदशेी छाᮢᲂ के िलए छाᮢ कायर् िनदशेालय के परामशर् से नीित बनाना और िᮓयान्वयन करना तथा उसके संबंध मᱶ मागर्दशर्क िस᳍ांत जारी करना;

(ड़) अकादमी के िलए िशक्षा और अनुसंधान िᮓया-कलापᲂ के िलए अंतररा᳦ीय सहयोग का पोषण करना;

(च) अकादमी के अधीन िवदशेी ᮧिशक्षण अध्येतावृिᱫयᲂ और छाᮢवृिᱫयᲂ संिस्थत करना;

(छ) अकादमी के कायर् के्षᮢᲂ से संबंिधत अंतररा᳦ीय रूप-रेखा से संब᳍ िनयिमत रुप से ᮧभावी दस्तावेज, नीितगत पेपर और ᮧािस्थित िरपोटर् ᮧकािशत करना;

(ज) अकादमी के िᮓया-कलापᲂ मᱶ नवीकृत की नीित ᳇ारा िवकास और िᮓयान्वयन, अवधारणाᲐ ᮧिᮓयाᲐ और प᳍ितयᲂ के माध्यम से नवाचार को बढ़ावा दनेा, पोषण करना और बनाए रखना;

(झ) अकादमी के संकायᲂ, छाᮢᲂ और अन्य सहयुᲦᲂ मᱶ तकनीकी और शैक्षिणक उ᳒मशीलता की ᮧसुिवधा सुकर बनाना;

(ञ) अकादमी मᱶ अन्य पणधािरयᲂ या िशक्षा और अनुसंधान तथा िवकास क्षेᮢ के िखलािड़यᲂ के साथ िमलकर ᮧवितत संस्कृित िवकिसत करना और उिचत पािरिस्थितकी तंᮢ का पोषण करना;

(ट) ᮧवितत सकै्टर के िलए ᮧिᮓयाᲐ और ᮧौ᳒ोिगकी के अनुᮧयोग को उत्ᮧेिरत करना;

(ठ) राजस्व सृजन के नए और अनूठे तंᮢ की पहचान करना;

12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ड) अध्ययन बोडर् और िसनेट के ᳇ारा िनदᱷिशत ऐसे अन्य कृत्यᲂ का िनवर्हन करना। (ढ) सूचना और संचार ᮧौ᳒ोिगकी, अवसंरचना, ई-लिनग और दरू िशक्षा िनदेशालय.- (i) सूचना और संचार ᮧौ᳒ोिगकी, अवसंरचना, ई-लिनग और दरू िशक्षा िनदशेालय संघ मागर्दिशत होगा और सहयुᲦ िनदशेक (संस्थान कायर् और सूचना तथा संचार ᮧौ᳒ोिगकी अवसंरचना) के ᮧत्यक्ष पयर्वेक्षण मᱶ कृत्य करेगा। (द) सूचना और संचार ᮧौ᳒ोिगकी, अवसंरचना, ई-लिनग और दरू िशक्षा िनदशेालय िन᳜िलिखत कृत्य करेगा- (क) अकादमी के िलए ई-लिनग और दरू िशक्षा नीित बनाना;

(ख) िवषय वस्तु िवकास का उᱫरदाियत्व;

(ग) उपयुᲦ िवषय वस्तु िवतरण मंच िवकिसत करने का उᱫरदाियत्व;

(घ) ᮧस्तािवत िकए जाने वाले पाᲹᮓमᲂ की गुणवᱫा का आ᳡ासन देना;

(ड़) दरू िशक्षा कायर्ᮓमᲂ के अधीन ᮧवेश लेने वाले छाᮢᲂ के िलए मागर्दशर्क िस᳍ांत बनाना और छाᮢ कायर् िनदशेालय को भी ऐसे मागर्दशर्क िस᳍ांत जारी करना;

(च) दरू िशक्षा पिरषद से संबंध और समन्वय स्थािपत करना;

(छ) अकादमी की कॉपᲃरेट संचार इकाई के रूप मᱶ कायर् करना;

(ज) अकादमी के िलए सूचना और संचार ᮧो᳒ोिगकी नीित का सृजन करना;

(झ) अकादमी के सूचना और संचार ᮧो᳒ोिगकी अवसंरचना के संरक्षक के रूप मᱶ कायर् करना;

(ञ) अकादमी होम पेज या वेबसाइट, डेटाबेस और उससे जुड़े अन्य मामलᲂ को संपोिषत करना; और (ट) अध्ययन बोडर् और िसनेट के ᳇ारा िनदᱷिशत िकए गए ऐसे अन्य कृत्यᲂ का िनवर्हन करना। (ड़) ᮧशासन और िवᱫीय सहायता िनदशेालय - (i) ᮧशासन और िवᱫीय सहायता िनदशेालय सहयुᲦ िनदेशक (ᮧशासन और िवᱫ) के ᮧत्यक्ष पयर्वेक्षण के अधीन कृत्य करेगा।

(ii) सहयुᲦ िनदशेक (ᮧशासन और िवᱫ) ᳇ारा ᮧत्यक्ष पयर्वेक्षण मᱶ संकायाध्यक्ष, सहयुᲦ संकायाध्यक्ष और िवᱫ सिमित, सहयुᲦ िनदशेक (ᮧशासन और िवᱫ) की सहायता करᱶगे।

(iii) ᮧशासन और िवᱫीय सहायता िनदशेालय िन᳜िलिखत कृत्य करेगा- (क) सभी चारᲂ िनदशेालयᲂ को सभी ᮧशासिनक, िविधक और िवᱫीय सहायता ᮧदान करना;

(ख) िशक्षा और अनुसंधान के िलए रा᳦ीय और अंतररा᳦ीय कᱶ ᮤᲂ के साथ अकादमी के समझौता ज्ञापन से संबंिधत कायर्कलापᲂ का समन्वय करना;

(ग) अकादमी के िलए वािषक बजट तैयार करना;

(घ) राजस्व सृजन- अकादमी के राजस्व उत्पादन और बजट के अनुसार ᳞य को मॉिनटर करना;

(ड़) अध्ययन बोडर् और िसनेट के ᳇ारा िनदᱷिशत िकए गए ऐसे अन्य कृत्यᲂ का िनवर्हन करना।

30. अध्ययन बोडर् - (1) अध्ययन बोडर् अकादमी के शैिक्षक कायर्ᮓमᲂ के संचालन के िलए िसनेट की सहायता करेगा।

(2) िसनेट, बोडर् के अनुमोदन से ऐसे अध्ययन बोडर् का सृजन कर सकेगा या उनको समा᳙ कर सकेगा ।

(3) जब तक िक अिभ᳞Ღ से अन्यथा उपबंिधत न हो, अकादमी मᱶ िन᳜िलिखत तीन अध्ययन बोडर् हᲂगे, अथार्त: - (क) जैव और रासायन िवज्ञान अध्ययन बोडर्;

(ख) इंजीिनयरी और भौितक िवज्ञान अध्ययन बोडर्;

(ग) सूचना िवज्ञान समूह और मानिवकी, सामािजक िवज्ञान, िविध और ᮧबंध अध्ययन बोडर्।

(4) िसनेट, तीनᲂ अध्ययन बोडᲄ के आर-पार अंतर िवषयक और परा-िवषयक कायर्ᮓम अथार्त्, नैनो जैव सूचना ᮧौ᳒ोिगकी कायर्ᮓम आयोिजत कर सकेगी। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13

(5) अकादमी के शैिक्षक कायर्ᮓमᲂ की आवश्यकताᲐ के अध्ययधीन िसनेट, बोडर् के अनुसमथर्न से, अन्य अध्ययन के बोडर् का गठन कर सकेगी।

(6) िसनेट का अध्यक्ष, सहयुᲦ िनदशेक (शैक्षिणक) के परामशर् से िसनेट की अनुज्ञा से अध्ययन बोडर् के सदस्यᲂ का नामिन᳸द᳥ कर सकेगा।

31. अध्ययन बोडर् का गठन- (क) जैव और रासायन िवज्ञान समूह के अध्ययन बोडर् मᱶ िन᳜िलिखत सिम्मिलत हᲂगे:- (I) सहयुᲦ िनदशेक (शैक्षिणक) जो जैव और रासायन िवज्ञान समूह के अध्ययन बोडर् का अध्यक्ष होगा;

(ii) जैव और रासायन िवज्ञान समूह के दो संकायाध्यक्ष, िजनमᱶ से एक को चᮓानुᮓम के आधार पर ᮧत्येक उᱫरोᱫर बैठक के िलए सह-अध्यक्ष िनयुᲦ होगा;

(iii) दो समूहᲂ का ᮧितिनिधत्व िसनेट से दो सदस्य करᱶगे;

(iv) दो वैज्ञािनक, बोडर् या िसनेट मᱶ नामिन᳸द᳥ वैज्ञािनकᲂ से िभ᳖, ᮧत्येक समूह से एक वैज्ञािनक;

(V) दो बा᳭ िवशेषज्ञ, बोडर् या िसनेट मᱶ नामिन᳸द᳥ सदस्यᲂ से िभ᳖, अिधमानत: अनुसंधान पिरषद की तत्स्थानी समूह ᮧयोगशालाᲐ या उ᳒ोगᲂ के सदस्य; और (Vi) तत्स्थानी समूहᲂ का कोई एक सहयुᲦ संकायाध्यक्ष, सदस्य सिचव होगा। (ख) इंजीिनयरी और भौितक िवज्ञान समूह के अध्ययन बोडर् मᱶ िन᳜िलिखत सिम्मिलत हᲂगे:-

(i) सहयुᲦ िनदशेक (शैक्षिणक) जो इंजीिनयरी और भौितक िवज्ञान समूह के अध्ययन बोडर् का अध्यक्ष होगा;

(ii) इंजीिनयरी और भौितक िवज्ञान समूह के दो संकायाध्यक्ष, िजनमᱶ से एक को चᮓानुᮓम के आधार पर ᮧत्येक उᱫरोᱫर बैठक के िलए सह-अध्यक्ष िनयुᲦ होगा;

(iii) इंजीिनयरी और भौितक िवज्ञान ᮧयोगशालाᲐ से िसनेट के दो सदस्य;

(iv) बोडर् या िसनेट मᱶ नामिन᳸द᳥ वैज्ञािनकᲂ से िभ᳖, इंजीिनयरी और भौितक िवज्ञान ᮧयोगशालाᲐ से दो वैज्ञािनक;

(V) दो बा᳭ िवशेषज्ञ, बोडर् या िसनेट मᱶ नामिन᳸द᳥ सदस्यᲂ से िभ᳖, अिधमानत: अनुसंधान पिरषद की तत्स्थानी समूह ᮧयोगशालाᲐ या उ᳒ोगᲂ के सदस्य; और (Vi) तत्स्थानी समूहᲂ का कोई एक सहयुᲦ संकायाध्यक्ष, सदस्य सिचव होगा। (ग) सूचना िवज्ञान समूह और िविध, मानिवकी ᮧबंध िवज्ञान के अंतरिवषयक अध्ययन बोडर् मᱶ िन᳜िलिखत सिम्मिलत हᲂगे:-

(i) सहयुᲦ िनदशेक (शैक्षिणक) सूचना िवज्ञान समूह और िविध, मानिवकी ᮧबंध िवज्ञान के अंतरिवषयक अध्ययन बोडर् का अध्यक्ष होगा;

(ii) सूचना िवज्ञान समूह के संकायाध्यक्ष सह-अध्यक्ष के रूप मᱶ कृत्य करेगा;

(iii) अध्ययन के तत्स्थानी क्षेᮢᲂ से िसनेट के दो सदस्य;

(iv) बोडर् या िसनेट मᱶ नामिन᳸द᳥ वैज्ञािनकᲂ से िभ᳖, ᮧयोगशालाᲐ या ᮧभागᲂ से दो वैज्ञािनक;

32. अध्ययन बोडर् की शिᲦयां और कृत्य - (1) अध्ययन बोडर् की िन᳜िलिखत शिᲦयां और कृत्य हᲂगे, अथार्त्:- (क) िसनेट को अध्ययन के पाᲹᮓम और पाᲹचयार् को आरंभ िकए जाने और अनुगमन िकए जाने की िसफािरश करना;

14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) अध्यादशेᲂ के अध्ययधीन अकादमी मᱶ आचायर् पद और अन्य सहायक संकाय पदᲂ के सृजन हतुे िसनटे को िसफािरश करना;

(ग) अकादमी के अधीन नए िशक्षण कᱶ ᮤ और लिनग आउटरीच केन्ᮤᲂ की स्थापना करना और सिम्मिलत िकए जाने के संबंध मᱶ िसफािरश करना;

(घ) अनुसंधान, िशक्षण, पाᲹᮓम िवकास और इससे जुड़े अन्य मामलᲂ को बढ़ावा दनेे के िलए िवशेष सिमितयां और कायर्दल स्थािपत करना;

(ड़) अकादमी को अंतर-िवषयक और परा-िवषयक क्षेᮢᲂ मᱶ िवशेष अध्ययन कायर्ᮓमᲂ को आरंभ करने के िलए और भारत मᱶ और िवदशे मᱶ उᲬ िशक्षा के अन्य संस्थानᲂ और िव᳡िव᳒ालयᲂ के साथ आपसी संसाधन साझा करने के ᮧोटोकॉल को िवकिसत करने मᱶ सक्षम िकए जाने के िलए उपबंध बनाने के संबंध मᱶ िसनेट के समक्ष ᮧस्ताव ᮧस्तुत करना;

(च) परीक्षाᲐ का पयर्वेक्षण करना और िडᮕी ᮧदान करना;

(छ) अकादमी ᳇ारा ᮧस्तािवत िशक्षण कायर्ᮓमᲂ मᱶ गुणवᱫा आ᳡ासन का पयर्वेक्षण करना;

(ज) अकादमी की िसनेट ᳇ारा अनुमोदन के अध्ययधीन और बोडर् ᳇ारा अनुसमथर्न तथा अध्यादशेᲂ के उपबंधᲂ के अध्ययधीन एक वषर् की अविध से अनिधक के िलए सिंवदात्मक और अन्य असाधारण आज्ञा को अᮕसर करने हतुे अपेिक्षत संिवदात्मक और अन्य असाधारण वचनब᳍ या िरटेनरिशप को कर सकेगा। (झ) सᮢ संबंधी कायर् के मूल्यांकन के िलए साधारण िनयम बनाना;

(ञ) िशक्षण और अनुसंधान के स्तर मᱶ सुधार के िलए योजनाᲐ पर िवचार करना और अनुमोदन के िलए िसनेट के समक्ष ऐसे ᮧस्तावᲂ को ᮧस्तुत करना;

(ट) अकादमी की साधारण समय-सारणी बनाना;

(ठ) अध्यादशेᲂ मᱶ उपबंिधत ऐसे अन्य सभी कृत्यᲂ का िनवर्हन करना और ऐसे सभी मामलᲂ, जो उसे िनदᱷिशत िकए जा सके, पर िवचार करना;

(ड) अध्ययन बोडर् ᳇ारा समय-समय पर िलए गए िनणर्य के अनुसार ऐसी साधारण या िवशेष शिᲦयां, संकायाध्यक्ष या अध्ययन बोडर् िकसी अन्य सदस्य को या एक सिमित को, जैसा वह उिचत समझे, ᮧत्यायोिजत करना;

33. अध्ययन बोडर् की बैठक.- (1) ᮧत्येक अध्ययन बोडर् की बैठक या तो साधारण या िवशेष होगी।

(2) साधारण बैठक सहयुᲦ िनदशेक (शैक्षिणक) और संबंिधत संकायाध्यक्ष ᳇ारा एक वषर् मᱶ दो बार आयोिजत की जाएगी।

(3) सहयुᲦ िनदशेक (शैक्षिणक) या संबंिधत संकायाध्यक्ष स्वᮧेरणा पर िवशेष बैठक बुला सकᱶ गे या यह अकादमी के कुलपित के सुझाव पर बुलाई जाएगी या अध्ययन बोडर् के सदस्यᲂ के कम से कम पांचवᱶ भाग से ᮧा᳙ एक िलिखत अनुरोध पर बुलाई जाएगी।

(4) संबंिधत िवषय का संकायाध्यक्ष थीिसस के पुनिवलोकनकतार् या िवषय, शीषर्क या गाइड पिरवतर्न या ऐसे अन्य कायर्कलापᲂ िजनका अध्ययन बोडर् ᳇ारा अनुसमथर्न कराया जाएगा, का िविन᳟य कर सकेगा।

(5) बैठक वस्तुत: उपिस्थित ᳇ारा या िविभ᳖ सुरिक्षत संचार प᳍ितयᲂ जैसे स्काइप, वीिडयो कॉन् ᱶᮨ िसग, टेलीकांᮨ ᱶ स और अन्य सचंार प᳍ितयᲂ का उपयोग करके आयोिजत की जा सकेगी।

34. अध्ययन बोडर् की पदाविध और उसका िवघटन.- (1) अध्ययन बोडर् की पदाविध तीन वषर् होगी और िजसका उसकी पदाविध पूरा होने के बाद पुनगर्ठन िकया जाएगा।

(2) बोडर्, िसनेट की िसफािरश पर एक या सभी अध्ययन बोडर् को भंग कर सकेगा, परंतु ऐसे िवघटन के िलए एक ᮧस्ताव िसनेट की बैठक मᱶ ᮧस्तुत और साधारण बहुमत से पािरत कर िदया गया हो । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15

35. बैठक की सूचना- (1) अध्यन बोडर् की बैठक की सूचना िवशेष बैठक से िभ᳖, बैठक के िलए िनयत िदन से कम से कम सात िदन पूवर् जारी की जाएगी, परंतु िवशेष बैठक कम से कम पाँच िदन की सूचना से िनयत की जा सकेगी;

(2) शैक्षिणक वषर् के आरंभ मᱶ बैठकᲂ के आयोजन के िलए कैलᱶडर बनाया जाएगा।

36. बैठक संचालन की ᮧिᮓया- (1) संबंिधत अध्ययन बोडर् का अध्यक्ष अध्ययन बोडर् की बैठक का संचालन करने के िलए ᮧिᮓयाᲐ का िविन᳟य कर सकेगा।

(2) गणपूित बनाने के िलए कम से कम एक-ितहाई सदस्यᲂ, िजसके अंतगर्त दो संकायाध्यक्ष या सहयुᲦ संकायाध्यक्ष भी ह,ᱹ की वस्तुत: उपिस्थित ᳇ारा या िविभ᳖ सुरिक्षत संचार प᳍ितयᲂ जैसे स्काइप, वीिडयो कॉन् ᱶᮨ िसग, टेलीकां ᱶᮨ स और अन्य संचार प᳍ितयᲂ ᳇ारा भागीदारी आवश्यक होगी। परंतु सूचना िवज्ञान समूह के अध्ययन बोडर् की बैठक गणपूित बनाने के िलए या तो संकायाध्यक्ष या सूचना िवज्ञान समूह के सहयुᲦ संकायाध्यक्ष सिम्मिलत हᲂगे।

37. िवᱫ सिमित (1) सभी िवᱫीय मामलᲂ के संबंध मᱶ िवचार करने और िसनेट को िसफािरश ᮧस्तुत करने के िलए एक िवᱫ सिमित होगी।

(2) िवᱫ सिमित मᱶ िन᳜िलिखत सदस्य हᲂगे, अथार्त: - (क) अकादमी का िनदशेक, जो सिमित का अध्यक्ष होगा;

(ख) सहयुᲦ िनदशेक (ᮧशासन और िवᱫ) - सदस्य;

(ग) सहयुᲦ िनदशेक (संसाधन िवकास और नेटवकर् ) - सदस्य;

(घ) अध्यक्ष ᳇ारा नामिन᳸द᳥ एक िवᱫीय िवशेषज्ञ - सदस्य;

(ड़) िसनेट के अध्यक्ष ᳇ारा नामिन᳸द᳥ िसनेट का एक सदस्य- सदस्य और (च) सहायक िनदशेक (ᮧशासन और िवᱫ) या उसकी अनुपिस्थित मᱶ ज्ये᳧ ᮧबंधक (ᮧशासन) सिचव होगा।

38. िवᱫ सिमित की शिᲦयां और कृत्य (1) िवᱫ सिमित िन᳜िलिखत कृत्य करेगी- (क) आगामी िवᱫीय वषर् के िलए अकादमी का बजट और िवᱫीय योजना तैयार करना;

(ख) बोडर् के समक्ष अनुदानᲂ और धन के सभी ᮧस्तावᲂ पर िसफािरश दनेा, जो िक बोडर् के समक्ष रखने से पूवर् िवचार-िवमशर् के िलए िवᱫ सिमित को िविन᳸द᳥ िकया जाएगा;

(ग) अकादमी की िकसी िविश᳥ पहल पर िजसमᱶ िवᱫीय िववक्षा हो, पर िसफ़ािरश करना;

(घ) अकादमी के उिचत और पृथक खाते, पूरे ब्योरे सिहत रखना और ᮧत्येक िवᱫीय वषर् की समाि᳙ के छह महीने के भीतर लेखा परीक्षा करवाना;

(ड़) बोडर् और िसनेट ᳇ारा िनदᱷिशत ऐसे अन्य िवᱫीय कृत्यᲂ का िनवर्हन करना।

39. िवᱫ सिमित के नामिन᳸द᳥ सदस्यᲂ की पदाविध - िवᱫ सिमित के नामिन᳸द᳥ सदस्य नामांकन के समय पर िविन᳸द᳥ अविध या जब तक नया नामांकन न कर िदया जाए, जो भी पहले हो, के िलए इस सिमित के सदस्य हᲂगे।

40. िवᱫ सिमित की बैठकᲂ के िलए गणपूित - (1) िवᱫ सिमित की बैठक मᱶ गणपूित पूरा करने के िलए कम से कम तीन सदस्यᲂ की भागीदारी आवश्यक होगी, िजनमᱶ से कम से कम एक िवᱫीय िवशेषज्ञ होगा।

(2) बैठक मᱶ भागीदारी, या तो वस्तुत: उपिस्थित से या िविभ᳖ सुरिक्षत संचार प᳍ितयᲂ जैसे स्काइप, वीिडयो कॉन् ᱶᮨ िसग, टेलीकां ᱶᮨ स और अन्य संचार प᳍ितयᲂ के उपयोग ᳇ारा, बैठक की गणपूित के िलए की जा सकेगी।

43. अकादमी के संकाय पद- इस ᮧयोजन के िलए वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧयोगशालाᲐ और उसकी घटक इकाइयᲂ से चुने गए वैज्ञािनकᲂ पर अकादमी के संकाय और वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनकᲂ के रूप मᱶ कृत्य करने की दोहरी भूिमका होगी ।

(2) वैज्ञािनक, संकाय के ऐसे पदनाम धारण करᱶगे जो वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद अपने िविभ᳖ स्तर के वैज्ञािनकᲂ के िलए उिचत समझे।

(3) वैज्ञािनकᲂ का चयन िसनेट ᳇ारा अनुमोिदत संकाय के मागर्-दशर्क िस᳍ांतᲂ के आधार पर िकया जाएगा।

(4) वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद का महािनदशेक, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनकᲂ मᱶ से तैयार की गई संकाय सदस्यᲂ की सूची, ᮧख्यात वैज्ञािनकᲂ और अवकाश ᮧा᳙ वैज्ञािनकᲂ सिहत को िसनेट के अनुमोदन के िलए उसके पास सूची को अᮕेिषत करेगा।

(5) वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद का महािनदशेक अकादमी के संकाय वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद से तैयार की गई सूची मᱶ तत्प᳟ात कोई भी पिरवतर्न कर सकᱶ गे। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19

(6) वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद से चयन िकए गए संकाय के सभी पद अवैतिनक हᲂगे और उनकी सेवािनवृिᱫ या वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद से सेवािनवृिᱫ के प᳟ात एक साथ समा᳙ हᲂगे। परंतु, ᮧिति᳧त सेवामुᲦ आचायर् या िविश᳥ आचायर् के रूप मᱶ या एक ᮧायोिजत आचायर् पद के रूप मᱶ, उनके ᳇ारा धािरत िकए गए पदᲂ के अनुरूप पािर᮰िमक के साथ, बोडर् के अनुमोदन से सेवािनवृिᱫ के प᳟ात संकाय सदस्यᲂ की सेवाᲐ का लाभ उठाया जा सकेगा।

(7) िसनेट आकलन और वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनकᲂ की िनयुिᲦ के प᳟ात समय-समय पर संकाय की सूची को अ᳒तन करेगा।

(8) अकादमी, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के वैज्ञािनकᲂ, जो सेवािनवृᱫ ह,ᱹ को िनदशेक की िसफािरश पर, पदनाम से अकादमी के संकाय सदस्यᲂ के रूप मᱶ िनयᲦु कर सकेगा।

(9) बोडर्, ᮧख्यात वैज्ञािनकᲂ, हिस्तयᲂ, िशक्षािवदᲂ और अन्य हिस्तयᲂ, िजनके िलए भारत का नागिरक होना आवश्यक नहᱭ होगा, का सम्मान कर सकेगा और "अकादमी का आचायर्" का उᲬ शीषर्क ᮧदान कर सकेगा।

(10) अकादमी आचायर् पद सबसे असाधारण शैिक्षक योगदान और असाधारण िव᳇ᱫापूणर् के कृत्य के साथ ᮧख्यात ᳞ि᳥यᲂ को ही भᱶट िकए जा सकᱶ गे।

(11) िसनेट की िसफ़ािरश पर और शासी बोडर् के अनुमोदन से सीएसआईआर के महािनदशेक और अन् य िवख् यात वैज्ञािनक, जो ᮧिति᳧त ह,ᱹ को अकादमी के ᮧिति᳧त आचायर् के रूप मᱶ सम् मान िकया जाएगा।

(12) बोडर्, अकादमी के कुशल संचालन के िलए, जीतने आवश्यक समझे, उतने कमर्चािरयᲂ की िनयुᲦी कर सकेगा।

44. िनदशेक, सहयुᲦ िनदशेक, संकायाध्यक्ष और सहयुᲦ संकायाध्यक्ष से िभ᳖ शैक्षिणक कमर्चारीवृंद की भतᱮ -

(1) अकादमी मᱶ शैक्षिणक पद के िलए सीधी भतᱮ समुिचत िवज्ञापन के प᳟ात, सीधी भतᱮ ᳇ारा भरे जाएंगे।

(2) अकादमी भारत या िवदेश से अन्य ᮧिति᳧त शैक्षिणक संस्थानᲂ से सहायक और अितिथ संकाय के पदᲂ पर भरने पर िवचार कर सकेगी।

(3) संकाय के रूप मᱶ भतᱮ िकए जाने के िलए अहर्ताएँ और पाᮢता मानदडं और िनयुᲦ ᳞िᲦयᲂ को िदए जाने वाले पदनाम, समय-समय पर, बोडर् ᳇ारा अवधािरत िकए जाएंगे।

45. वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद मᱶ वैज्ञािनकᲂ के अवैतिनक शैक्षिणक पद, जो िन᳜ सारणी के स्तंभ

2. मानद आचायर् (तीन वषर् की पदाविध, नवीकरणीय) सेवािनवृᱫ मानद िशक्षािवद / िनयिमत पदᲂ से अवकाशᮧा᳙ हुए समय-समय पर अिधसूचना ᳇ारा पािर᮰िमक िनयत िकया जा सकेगा

3. ᮧख्यात मानद आचायर् (तीन वषर् की पदाविध, नवीकरणीय) सेवािनवृिᱫ पार वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के िनदेशक / िविश᳥ / ᮧख्यात वैज्ञािनक समय-समय पर अिधसूचना ᳇ारा पािर᮰िमक िनयत िकया जा सकेगा

4. ᮰े᳧ आचायर् वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के महािनदशेक के समतुल्य ᮰े᳧ता वाले िशक्षािवद / वैज्ञािनक अवैतिनक

5. अकादमी आचायर् (आजीवन पद) सवᲃᲬ रा᳦ीय और अंतररा᳦ीय ᮰े᳧ता ᮧा᳙ िशक्षािवद / वैज्ञािनक अवैतिनक

47. िनयुिᲦ की शिᲦयᲂ का ᮧत्यायोजन.- (क) बोडर्, अवैतिनक आचायर् िनयुᲦ करने और वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के ऐसे वैज्ञािनकᲂ जो सेवािनवृᱫ या अवकाश ᮧा᳙ हो चुके ह,ᱹ को मानद आचायर् उपािध ᮧदान करने की शिᲦ, िसनेट को ᮧत्यायोजन कर सकेगा। (ख) अवैतिनक या मानद आचायर् िसनेट या बोडर् का पदने सदस्य नहᱭ होगा।

48. िडᮕी और िडप्लोमा ᮧदान करना - (1) अकादमी ᳇ारा ᮧदᱫ िडᮕी िजसके अंतगर्त िन᳜िलिखत भी ह,ᱹ परंतु इन तक सीिमत नहᱭ ह,ै अथार्त्: -

(i) एम.टेक;

(ii) िवज्ञान, इंजीिनयरी और सामािजक िवज्ञान और मानिवकी मᱶ पीएचडी;

(iii) एकीकृत एम.टेक - इंजीिनयरी मᱶ पीएचडी;

(iv) िवज्ञान या इंजीिनयरी मᱶ एकीकृत पीएचडी;

(v) एकीकृत एम.एससी - िवज्ञान मᱶ पीएचडी;

(vi) िवज्ञान और इंजीिनयरी मᱶ िरसचर् ᳇ारा एम.एस;

(vii) ऑनसर् ᳇यात्मक िडᮕी;

(viii) पिरष्कृित स्कूल ᳩातकोᱫर िडप्लोमा (एक / दो वषर् का ᳩातकोᱫर िडप्लोमा); और (IX) नए ज्ञान वाले ᮧस्तािवत क्षेᮢᲂ मᱶ िडप्लोमा (अल्पकािलक िडप्लोमा)

(2) िडᮕी और िडप्लोमा ᮧदᱫ करने का िविन᳟य िसनेट ᳇ारा िकया जाएगा।

49. कायर्ᮓम के िलए फीस - (1) िसनेट समय-समय पर अकादमी ᳇ारा ᮧस्तािवत िविभ᳖ कायर्ᮓमᲂ के िलए फीस िवशेष रूप से िनधार्िरत करेगा।

(2) अकादमी के कायर्ᮓमᲂ के िलए फीस ऐसी होगी िक वह समाज के कमजोर वगर् को नए ज्ञान की पहुचँ से िनवािरत न करे।

(3) अकादमी समाज के आिथक रूप से कमजोर वगर् के ᮧेिरत ᮧितभाशाली छाᮢᲂ को आकिषत करने और सहायता ᮧदान के िलए अध्येतावृिᱫ उपलब्ध कराने के िलए उपबंध करेगी।

(4) फीस सरकार समिथत तकनीकी और वृितका संस्थानᲂ के साथ तुलनीय होनी चािहय।

(5) िसनेट, समय-समय पर, फीस संᮕह की प᳍ितयᲂ का िविन᳟य करेगी।

50. िवलम्ब फीस.- िसनेट, दरेी से भुगतान करने के मामलᲂ मᱶ िवलंब फीस ᮧभािरत करेगी और िवलंब शुल्क या जुमार्ना और अन्य संबंिधत मु᳎ᲂ के ब्योरे, पिरिनयमᲂ के उपबंधᲂ के अनुसार हᲂगे।

51. पुरस्कार, अध्येतावृिᱫ, छाᮢवृिᱫ आिद संिस्थत करना- (1) िसनेट, अकादमी से संबंिधत सभी दान ᮧसुिवधाᲐ और पुरस्कारᲂ का ᮧशासन एक ‘दान और पुरस्कार सिमित’ के माध्यम से करेगी।

(2) दान और पुरस्कार सिमित मᱶ िन᳜िलिखत सिम्मिलत हᲂगे- (क) अकादमी िनदशेक - अध्यक्ष;

(ख) सहयुᲦ िनदशेक (संसाधन िवकास और नेटव᳼कग) और सहयुᲦ िनदशेक (शैक्षिणक) - सदस्य;

(ग) सभी संकायाध्यक्ष- सदस्य;

(घ) वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के महािनदशेक ᳇ारा एक नामिनदᱷिशती - सदस्य; और (ड़) एक बा᳭ सदस्य, िजसने िकसी िव᳡िव᳒ालय मᱶ आचायर् के पद से नीचे की पंिᲦ का न हो सेवा की हो या कर रहा हो या रा᳦ीय ᮧयोगशालाᲐ मᱶ समतुल्य अिधकारी हो ।

(3) सिमित दान या उपकृित के ᮧबंध की ᮧिᮓया अिधकिथत करेगी:

परंतु जहां िकसी दान, िवन्यास या उपकृित के िलए संलᲨ शतᱸ और िनबंधन मᱶ उसके ᮧबंधन के िलए कोई िविश᳥ ᮧिᮓया उपबंिधत है, तो ऐसी ᮧिᮓया अभीभावी होगी।

(4) दान और पुरस्कार सिमित िविभ᳖ पुरस्कारᲂ और अध्येतावृिᱫयᲂ के ᮧस्ताव ᮧस्तुत करेगी।

(5) बोडर्, िसनेट की िसफािरश पर पुरस्कारᲂ और अध्येतावृिᱫयᲂ को िविभ᳖ रूपᲂ मᱶ संिस्थत कर सकेगा और ऐसे पुरस्कारᲂ और अध्येतावृिᱫयᲂ मᱶ िन᳜िलिखत सिम्मिलत हᲂगे, परंतु िनबर्िधत नहᱭ हᲂगे, अथार्त्,

(i) िवशेष पदक और ᮧशिस्त;

(ii) पूवर् डॉक्टरेट, पोस्ट डॉक्टरेट और अध्ययन के िविश᳥ पाᲹᮓमᲂ के िलए िवन्यास अध्येतावृिᱫ;

(iii) सवर्᮰े᳧ अनुसंधान पुरस्कार;

(iv) नवीकृत ᮧौ᳒ोिगकी पुरस्कार;

(v) याᮢा अध्येतावृिᱫ;

(vi) मेधा छाᮢवृिᱫ;

(vii) अनुसंधान पयर्वेक्षकᲂ के िलए वजीफा।

(6) दान और पुरस्कार सिमित, समय समय पर, पुरस्कार और अध्येतावृिᱫ संिस्थत करने के िलए ᮧिᮓयाᲐ के ब्यौरे बनाएगी जो िसनेट के समक्ष अनुमोदन के िलए ᮧस्तुत िकए जाएंगे। 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(7) अकादमी बा᳭ अिभकरणᲂ से अनुदान स्वीकार कर सकेगी या बोड़र् के अनुमोदन से ऋण एकᮢ सकेगी:

परंतु िवᱫ सिमित की सहमित के िबना- (क) कोई अनुदान स्वीकार नहᱭ िकया जाएगा, या (ख) कोई ऋण एकᮢ नहᱭ िकया जाएगा।

(8) कोई भी छाᮢ अकादमी की ओर से िकसी भी अध्येतावृिᱫ या सहायकवृिᱫ या िवᱫीय सहायता ᮧा᳙ करने का हकदार नहᱭ होगा, परंतु अकादमी के छाᮢ वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद ᳇ारा संचािलत रा᳦ीय पाᮢता परीक्षा उᱫीणर् करने पर पिरषद की अध्येतावृिᱫ और िव᳡िव᳒ालय अनुदान आयोग की किन᳧ अनुसंधान अध्येतावृिᱫ, ज्ये᳧ अनुसंधान अध्येतावृिᱫ या अन्य ᮲ोतᲂ से अन्य अध्येतावृिᱫया ंᮧा᳙ कर सकᱶ गᱶ:

परंतु, और यह िक, अकादमी समाज के कमजोर वगर् के मेधावी, ᮧितभाशाली, ᮧिेरत छाᮢᲂ के िलए अध्येतावृिᱫ दे सकेगी या उ᳒ोगᲂ या लोकिहतैषी इकाइयᲂ ᳇ारा ᮧायोिजत अध्येतावृिᱫ ᮧदान कर सकेगी।

(9) अकादमी के छाᮢᲂ के िलए खंड (8) के उपबंधᲂ पर ᮧितकूल ᮧभाव डाले िबना, अध्यादशे कोई भी अन्य िवᱫीय सहायता उपलब्ध करा सकेगᱶ।

(10) अकादमी, उᲦ समय अविध मᱶ िदए गए सभी दान, उपकृितयᲂ और िवन्यासᲂ के साथ सभी पुरस्कारᲂ पदकᲂ अध्येतावृिᱫयᲂ को अंतिव᳥ करके वािषक िरपोटर् मᱶ एक सूची होगी ।

(11) (क) इन पिरिनयमᲂ मᱶ इस बात के होते हुए भी, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧयोगशालाᲐ के पुरस्कार, उपकृितयां और िवन्यासᲂ को, अकादमी के अपने संबंध को िवचार मᱶ लाए िबना, हो सकᱶ गᱶ। (ख) अध्येतावृिᱫयᲂ, पुरस्कारᲂ, दान और िवन्यासᲂ, उनके ᮧबंध और उससे जुड़े अन्य मामलᲂ का िविन᳟य ᮓमश:

संबंिधत ᮧयोगशालाᲐ ᳇ारा िनरंतर िकया जाता रहगेा और वह इन पर िनयमᲂ के अधीन नहᱭ हᲂगे।

52. संपदा, िवन्यास, दान और उपकृितयां आिद का ᮧबंध- (1) अकादमी की यथा आवश्यक अपनी स्व संपदा होगी।

(2) अकादमी के स्वािमत्व वाली संपदा या तो पूणर् स्वािमत्व वाली होगी या िनन्यानवᱶ वषर् स ेअन्यनू वषर् के िलए पᲵे पर ली हुई होगी। परंतु अकादमी िकसी भी आवास को लघुतर अविध, संचालन के िलए इसके नवीकरण के एक उपबंध के साथ िकराए पर या पᲵे पर दे सकेगी।

(3) अकादमी के िलए स्वािमत्व िवलेखᲂ और पᲵा िवलेखᲂ पर अकादमी के िनदेशक ᳇ारा हस्ताक्षर िकए जाएंगे।

(4) अकादमी ᳇ारा स्वािमत्व या पᲵे पर या िकराए पर ली गई सम्पदा को अकादमी उन ᮧयोजनᲂ के िलए उपयोग कर सकेगी जो आज्ञा के अनुरूप ह।ᱹ

(5) अकादमी स्व सम्पदा को खंड (4) के ᮧयोजनᲂ के िलए िन᳜िलिखत ᮧयोजनᲂ के िलए उपयोग मᱶ ले सकेगी, अथार्त्: - (क) िशक्षण और अनुसंधान की अवसंरचना का िनमार्ण हतुे;

(ख) अकादमी की आज्ञा को अᮕसर करने हतेु बगीचे और ऊष्मािमᮢ का िनमार्ण करने हतुे;

(ग) अनुषंगी सुिवधाᲐ जैसे अितिथगृह, सम्मेलन कᱶ ᮤ, ᮧदशर्नी मंडप और अन्य सुिवधाएं िनमार्ण करने हतुे;

(घ) ᮧायोिगक खेतᲂ, कायर्शालाᲐ और परीक्षण सुिवधाᲐ का िनमार्ण करने हतुे;

(6) अकादमी का सम्पदा कायार्लय होगा जो अकादमी की सम्पदा कायर् का ᮧशासन करने के िलए सशᲦ होगा।

(7) अकादमी का एक कायार्लय होगा जो दान, िवन्यासᲂ और उपकृितयᲂ का ᮧशासन करने के िलए सशᲦ होगा।

(8) अकादमी दान, िवन्यास और उपकृित की स्वीकृित से पहले दाताᲐ के पूवर्वृᱫ का उिचत सत्यापन पूरा करेगी।

(9) अकादमी ᳇ारा ᮧा᳙ िवन्यास, िजसके अंतगर्त िविभ᳖ ᮲ोतᲂ से ᮧा᳙ सभी धन और अन्य जंगम आिस्तयां ह ᱹपरंतु दान और संदान तक ही िनबᲈिधत नहᱭ ह।ᱹ ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23

(10) इन पिरिनयमᲂ अध्यधीन अकादमी स्व संसाधनᲂ के संवधर्न और िशक्षण, अिधगम और अनुसंधान के के्षᮢ मᱶ उत्कृ᳥ता ᮧा᳙ करने की अपनी ᮧितब᳍ता अᮕसर करने हतुे दान की याचना और स्वीकृित को बढ़ावा दगेी।

(11) (क) अकादमी ऐसा कोई भी दान स्वीकार नहᱭ करेगी जो िक उसे अन्य दाताᲐ से दान स्वीकार करने से रोकता हो;

(ख) अकादमी ऐसा कोई भी दान स्वीकार नहᱭ करेगी जो िक उस समय ᮧवृᱫ िकसी भी िविध या िविनमय का उल्लंघन करता हो और िकसी भी दान को अस्वीकार करने का अिधकार सुरिक्षत रखता है;

(ग) अकादमी को दान दनेे का कृत्य अᮧितसहरणीय होगा और दान तथा उपहार का ᮧयोजन, एक बार स्वीकार कर लेने के बाद, िव᳒मान नीितयᲂ और अकादमी की ᮧिᮓयाᲐ के अध्यधीन होगा।

(12) (क) दानकतार् ᳇ारा िकए गए दान की मान्यता मᱶ, अकादमी बोडर् के अनुमोदन से दाता को नामकरण जैसे िक अकादमी के भीतर पीठ आचायर् या अध्येतावृिᱫ आिद का अवसर ᮧदान करेगी । (ख) बोडर्, समय-समय पर नामकरण अवसर के िलए अहर्ता ᮧा᳙ करने के िलए दान का न्यूनतम स्तर का िविन᳟य कर सकेगा और मामले-दर-मामले के आधार पर होगा।

(13) (क) अकादमी ᳇ारा ᮧा᳙ सभी दान का उपयोग दान ᮧयोजन के अनुसार िकया जाएगा;

(ख) दाता और दान से संबंिधत सभी जानकारी को गोपनीय रूप मᱶ रखा जाएगा, जब तक िक ऐसी जानकारी का ᮧकटीकरण न्यायालय के आदशे के अनुसरण मᱶ न हो या तत्समय ᮧवृᱫ िकसी िविध के उपबंधᲂ के अनुपालन मᱶ अपेिक्षत न हो। (ग) अकादमी दान दाताᲐ और उनके दान को इस संबंध मᱶ बनाए गए अध्यादशे के अंतगर्त समुिचत रूप से अिभस्वीकृत और मान्य करेगी।

(14) खंड (13) मᱶ इस बात के होते हुए भी, िक यिद नामकरण अवसर ᮧस्तािवत दानकतार् की बदनामी हो जाती है या प᳟ातवतᱮ िकसी तारीख पर दाता ᳇ारा ᮧस्तािवत नाम बदनाम पाया जाता ह ैतो अकादमी ᮧासंिगक नाम या दान, दान या उपकृित का उपयोग बोडर् ᳇ारा िविन᳟य िकया जाए, बंद कर सकेगी।

(15) अकादमी दान को उसी पिरयोज्य के िलए उपयोग करने का ᮧयास करेगी िजसके िलए उस ेᮧा᳙ िकया गया था। परंतु बोडर्, असाधारण पिरिस्थितयᲂ मᱶ अकादमी की अपेक्षाᲐ के अनुरूप दान के ᮧयोजन का एक सीमा तक पिरवतर्न कर सकेगी।

(16) बोडर् के अनुमोदन पर, िवन्यास कायार्लय दान ᮧयोजन के पिरवतर्न हतुे दानदाता से सहमित अिभᮧा᳙ करेगा।

(17) अकादमी दान का उपयोग और दान ᮧयोजन के अनुसार दान का ᮧबंधन कर सकेगी और दान तथा िनिध का िनवेश कर सकेगी।

(18) अकादमी को दान दी गई िनिध को वैज्ञािनक और नवीकृत अनुसंधान अकादमी िवन्यास नाम के कोष मᱶ रखा जाएगा।

(19) यह कोष पूंजी का गठन करेगा और ऐसे सभी िवन्यासᲂ के संबंध मᱶ िकए जाने वाले सभी भुगतान, उᲦ िवन्यास कोष से ᮧो᳍भूत आय से भुगतान िकया जाएगा।

(20) (क) अकादमी, इस पिरिनयम के उपबंधᲂ के अनुसार कोष का ᮧबंधन कर सकेगी। (ख) अकादमी, सहयुᲦ िनदशेक (ᮧशासन और िवᱫ) की अध्यक्षता मᱶ, िजसमᱶ पांच सदस्यᲂ से अन्यून सदस्य सिम्मिलत हᲂगे, एक िवन्यास कोष सिमित का गठन करेगी, िजसे तत्समय ᮧवृᱫ िकसी िविध के अधीन कोई भी िनवेश करने की शिᲦ होगी। (ग) अकादमी, कोष ᮧबंधन के िलए सभी ᳞यᲂ का कोष की आय मᱶ से भुगतान करेगी। 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (घ) बोडर्, समय-समय पर, कोष की आय के ऐसे भाग को, कोष की पूंजी के िहस्से के रूप मᱶ ᮧभािजत कर सकेगा, जो मुᮤास्फीित और ऐसे अन्य कारकᲂ के कारण कोष की पूंजी के मूल्य मᱶ िकसी भी मूल्य᮳ास को मुजरा करने के रूप मᱶ कोष की पूंजी के मूल्य को संरिक्षत करने के िलए आवश्यक हो। (ड़) ᮧत्येक िवᱫीय वषर् के आरंभ मᱶ, ᮧत्येक िवन्यास एक पूवर् िनयत दर पर उपभोिजत आय का एक वािषक िवतरण ᮧा᳙ करेगा जो िवᱫ सिमित की िसफािरश पर बोडर् ᳇ारा िनयत िकया जाएगा।

(21) अकादमी का िवन्यास कोष बोडर् ᳇ारा समय-समय पर िविन᳸द᳥ ᮧयोजनᲂ के िलए उपयोग िकया जाएगा।

53. अन्य संगठनᲂ और संस्थानᲂ के साथ सबंंध- (1) अकादमी अपने उ᳎ेश्यᲂ और कायर्कलापᲂ की ᮧाि᳙ के िलए अन्य रा᳦ीय संस्थाᲐ और संगठनᲂ के साथ शैिक्षक संबंध स्थािपत करने का ᮧयास करेगी।

(2) अनुसंधान और िवकास के ᮧयोजनᲂ के िलए अकादमी, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद नेटवकर् से िभ᳖ सरकार से संबंिधत िकसी भी िवभाग या कᱶ ᮤीय सरकार के मंᮢालय के िकसी भी संस्थान या कᱶ ᮤ या ᮧयोगशाला के साथ सहज संबंधᲂ को बढ़ावा दे सकेगी ।

(3) संबंधᲂ के अंतगर्त िन᳜िलिखत हᲂगे, परंतु िनबᲈिधत नहᱭ हᲂगे, अथार्त:- (क) अनुसंधान कामकाज के िलए छाᮢᲂ का आवागमन;

(ख) अनुसंधान और िशक्षण कामकाज के िलए संकाय का आवागमन;

(ग) छाᮢᲂ के ᮧवेश के ᮧयोजनᲂ के िलए संस्थानᲂ की न्यूनतम पाᮢता मानदडं की स्वीकृित;

(घ) संयुᲦ स्कूलᲂ, अंतर-संस्थागत उपकरणᲂ और कम्प्यूटेशनल सिुवधाᲐ को बढ़ावा दनेा;

(ड़) अंतर संस्थागत पुस्तकालय संसाधन साझा करना; और (च) अंतर-संस्थागत पाᲹᮓम ᮧत्यय साझा करना

(4) दशे के सभी कᱶ ᮤीय िव᳡िव᳒ालयᲂ और रा᳦ीय महत्व के अन्य संस्थानᲂ जैसे भारतीय ᮧौ᳒ोिगकी संस्थान, भारतीय िवज्ञान िशक्षा और अनुसंधान संस्थान और रा᳦ीय महत्व के अन्य संस्थानᲂ को अकादमी के िलए छाᮢᲂ के ᮧितयोगी चयन, अकादमी के िलए ऐसे िव᳡िव᳒ालयᲂ या संस्थानᲂ से छाᮢᲂ का ᮧᮯजन और इसके िवपरीत और पाᲹᮓम की समतुल्यता के संबंध मᱶ अकादमी को समतुल्य माना जाएगा।

(5) (क) अकादमी, दशे के राज्य िव᳡िव᳒ालयᲂ और राज्य सहायता ᮧा᳙ संस्थानᲂ के साथ शैक्षिणक िवचार िवमशर् को बढ़ावा देने के िलए सिᮓय कदम उठाएगी। (ख) एक राज्य िव᳡िव᳒ालय अकादमी के समतुल्य माना जाएगा, यिद-

(i) ऐसे िव᳡िव᳒ालय मᱶ अध्ययन के ᮧस्तािवत पाᲹᮓम मᱶ ᮧवेश के िलए िव᳡िव᳒ालय अनुदान आयोग ᳇ारा िविन᳸द᳥ एक ही रा᳦ीय स्तर पाᮢता मानदडं का पालन करता ह ैऔर परीक्षा, मूल्यांकन और िव᳡िव᳒ालय ᳇ारा ᮧदान की जाने वाली ᮧत्यय प᳍ित रा᳦ीय स्तर के मानकᲂ ᳇ारा िविन᳸द᳥ प᳍ित के अनुरूप ह;ᱹ और

(ii) रा᳦ीय मूल्यांकन और ᮧत्यायन पिरषद ᳇ारा न्यूनतम तीन स्टार रᱹक के साथ मान्यता ᮧा᳙ राज्य िव᳡िव᳒ालयᲂ या वे िजनकी एक िविन᳸द᳥ िवषय मᱶ उत्कृ᳥ता के कᱶ ᮤ के रूप मᱶ पहचान की गई ह।ै (ग) खंड (5) के ᮧयोजनᲂ के िलए, अकादमी कᱶ ᮤीय िव᳡िव᳒ालयᲂ या संस्थानᲂ की तरह के अध्ययन के सभी ᮧासंिगक क्षेᮢᲂ वाले इस तरह के िव᳡िव᳒ालयᲂ और संस्थानᲂ के साथ िनबार्ध संबंध स्थािपत करने का ᮧयास करेगी। (घ) िवज्ञान और ᮧौ᳒ोिगकी के क्षेᮢ मᱶ राज्य से सहायता ᮧा᳙ संस्थानᲂ के साथ संबंधᲂ को बढ़ावा िदया जाएगा और मामले दर मामले के आधार पर िवचार िकया जाएगा। (ड़) िसनेट, सहयुᲦ िनदशेक (शैक्षिणक) की अध्यक्षता मᱶ एक सिमित का गठन कर सकेगी, जो िसनेट के अनुमोदन से संबंधᲂ की रूपात्मकता का िविन᳟य और उस िविन᳟य का कायार्न्वयन कर सकेगी।

(6) (क) अकादमी उ᳒ोगᲂ, सावर्जिनक क्षेᮢ के उपᮓमᲂ, स्वायᱫ िनकायᲂ और गैर सरकारी संगठनᲂ के साथ शैिक्षक और अनुसंधान संबंधᲂ की स्थापना और बढ़ावा दनेे का ᮧयास करेगी। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25 (ख) िसनेट, मामले दर मामले के आधार पर, संबंधᲂ का मूल्यांकन करने के िलए िनदशेक की अध्यक्षता मᱶ एक सिमित का गठन कर सकेगी । (ग) उप खंड (ख) के ᮧयोजनᲂ के िलए, सिमित मᱶ सहयुᲦ िनदशेक (शैक्षिणक), सहयुᲦ िनदशेक (ससंाधन िवकास और नेटवकर् ), संबंिधत समूह के संकायाध्यक्ष िजनके अंतगर्त संगठन या ᮧयोगशाला आती हो और िसनेट ᳇ारा नामिनदᱷिशती एक सदस्य जो उस क्षेᮢ मᱶ िवशेषज्ञ हो, सिम्मिलत हᲂगे।

(7) (क) अकादमी अंतररा᳦ीय संस्थानᲂ और स्थापनᲂ से िनबार्ध संबंध स्थािपत करने का ᮧयास करेगी;

(ख) ससंाधन िवकास और नेटवकर् िनदशेालय ᳇ारा अंतररा᳦ीय स्थापनᲂ के साथ संबंध, योजनाब᳍, ᮧबंिधत और िनष्पािदत िकए जाएंगे। (ग) बोडर्, संबंधᲂ को शािसत करने के िलए, िसनेट ᳇ारा बनाई गई अकादमी की ᳞ापक अंतररा᳦ीय सहयोग की नीित का अनुमोदन कर सकेगा; और (घ) अकादमी के िलए नीित बनाते हुए, िसनेट यह सिुनि᳟त करेगा िक सुरक्षा की दिृ᳥ से मुख्य रूप से रा᳦ीय नीितयᲂ के अनुरूप, नीित होगी।

(8) वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद के साथ सहयोगकारी अनुसंधान मᱶ भाग लेने वाली, वैज्ञािनक और औ᳒ोिगक अनुसंधान पिरषद की ᮧणाली से िभ᳖, अंतररा᳦ीय या रा᳦ीय ᮧयोगशालाᲐ या िशक्षा या उ᳒ोग से ली गई ᮰े᳧ ᮧितभाᲐ को, अकादमी के सहायक संकाय के रूप मᱶ मान्यता ᮧदान की जा सकेगी, जो अकादमी मᱶ अध्ययन कर रह ेछाᮢᲂ के सह-गाइड बन सकᱶ गᱶ।

54. वािषक िरपोटर् – िनदेशक, िरपोटर् के वषर् के दौरान ᳞ापक िनष्पादन, शैक्षिणक और अनुसंधान की िवशेषताएँ, भौितक और िवᱫीय मूल्यांकन या ᮧगित और अन्य महत्वपूणर् उपलिब्धयᲂ को सिम्मिलत करते हुए, शासी बोडर् को अकादमी की वािषक िरपोटर् ᮧस्तुत करेगा। [फा. सं- 6/1 / सीएसआईआर-एसीएसआईआर / 2012-13 / पीपीडी/एस ] के.आर. वैधीस्वरन, संयुᲦ सिचव MINISTRY OF SCIENCE AND TECHNOLOGY (Department of Scientific and Industrial Research) NOTIFICATION New Delhi, the 6th April, 2017 S.O. 1153(E).— In exercise of the powers conferred by sub-section (1) of section 28 of the Academy of Scientific and Innovative Research Act, 2011 (13 of 2012) and in supersession of the Academy of Scientific and Innovative Research Statutes, 2012, except as respects things done or omitted to be done before such supersession, the Board of Governors hereby makes the following Statutes for the Academy of Scientific and Innovative Research, namely:-

1. Short title and commencement.- (1) These Statutes may be called the Academy of Scientific and Innovative Research Statutes, 2017.

(2) They shall come in to force on the date of their publication in the Official Gazette.

2. Definitions.- In these Statutes, unless the context otherwise requires,-

(a) “Academy” means the Academy of Scientific and Innovative Research established under sub-section (1) of section 3 of the Act;

(b) “Act” means the Academy of Scientific and Innovative Research Act, 2011 (13 of 2012);

(d) “Associate Director” means Associate Director of the Academy appointed under section 23 of the Act;

(e) “Board” means the Board of Governors of the Academy of Scientific and Innovative Research constituted under sub-section (1) of section 11 of the Act;

(f) “Chairperson” means the Chairperson of the Board appointed under section 12 of the Act;

(g) “Council of Scientific and Industrial Research” means the society registered by the name of the ‘Council of Scientific and Industrial Research’ under the Societies Registration Act, 1860 (21 of 1860);

(h) “Dean” means the Dean of the Academy;

(i) “Director” means the Director of the Academy appointed under section 22 of the Act;

(j) “estates” means any or all of landed property which is owned or acquired by the Academy either through payment or received as gift and benefaction and which belongs solely to itself but does not include a part of the campus of Council of Scientific and Industrial Research Laboratories; houses or buildings or any premises of Council of Scientific and Industrial Research used by the Academy;

(k) “faculty of the Academy” means Academy Professors, Professors of Eminence, distinguished professors, outstanding professors, emeritus professors, distinguished emeritus professors, senior professors, professors, associate professors, assistant professors, visiting faculty, adjunct faculty and such other persons as may be appointed for imparting instructions or conducting research in the Academy or institution maintained by the Academy and includes such other scientists of the Council of Scientific and Industrial Research assigned for imparting instructions or conducting research in the Academy;

(l) ”gift” means a contribution, grant, testamentary disposition or otherwise, of movable and immovable properties and monies from a donor that the Academy receives, without making any commitment of resources or services with a commercial value in return, other than naming opportunities and using the gift as the donor may designate in consonance with the objectives of the Academy;

(m) “Senate” means the Senate of the Academy constituted under section 18 of the Act;

(n) “Statutes” means the Statutes of the Academy for the time being in force;

(o) “student” means a person who has-

(i) enrolled for a degree or diploma programme of the Academy, and has not graduated or withdrawn from candidature or failed to satisfy any continuation requirement for the relevant degree or diploma, or has been expelled as a result of disciplinary proceedings; or

(ii) registered to study at the Academy but not for a degree or diploma programme such as Finishing School, and has not completed the period of study or withdrawn, or been expelled as a result of disciplinary proceedings;

(p) “Vice Chairperson” means the Vice Chairperson of the Board of Governors.

(2) Words and expressions used herein and not defined but defined in in the Act shall have the meanings respectively assigned to them in the Act.

3. Board of Governors.- (1) The Board shall form the apex authority of the Academy.

(2) The composition, method of appointment of Chairperson and nomination of members, term of office of members and powers of the Board shall be in accordance with the provisions of sections 11, 12, 13, 14, 16 and 17 of the Act.

4. Meetings of the Board.– (1) The Chairperson shall preside over the meetings of the Board.

(2) The Board may evolve its own procedures for the purpose of conducting its meetings and transacting business therein.

(3) Decision shall be taken in the meeting by consensus, but in the event of a lack of consensus, may resort to voting.

(4) The Board shall meet at least once a year and the Chairperson may convene extraordinary meeting of the Board as many times as he deems fit .

(5) The Secretary to the Board shall serve the notice of the meeting at least seven working days prior to the meeting, along with relevant agenda papers slated for consideration:

Provided that in the case of extraordinary meeting the Chairperson may convene it giving forty eight hours’ notice after recording reasons therefor.

(6) The Secretary shall record the discussion of the meeting in the form of minutes and circulate to the members of the Board after the minutes are duly approved by the Chairperson and the minutes shall be finally adopted in the next meeting of the Board.

(7) One-third of the total number of members of the Board shall constitute the quorum for the meetings of the Board.

(8) The participation for the meeting may be either by physical presence or by electronic communication modes such as skype, video conferencing, teleconferencing or by any other mode.

(9) In case the quorum is not formed when the meeting is called to order, the Chairperson shall adjourn the meeting for thirty minutes and thereafter the meeting may be reconvened with the members present forming the quorum.

(10) A proposal shall be deemed to have been passed if more than fifty per cent of the participating members, excluding the Chairperson, voted in favour of the proposal and in the event of equality of votes, the Chairperson shall have the casting vote.

(11) Any business which may be necessary for the Board to perform except, matters relating to the annual report and accounts of the Academy, be carried out by circulation amongst all its members and any resolution so circulated and approved by a majority of the members signing shall be as effectual and binding as if such resolution had been passed at a meeting of the Board provided that at least one-third of the total strength of the Board have recorded their views on the resolution.

5. Senate.- (1) In addition to the members of the Senate as provided in section 18 of the Act, all the Associate Deans of the Academy shall be ex officio members of the Senate.

(2) The Assistant Director (Administration and Finance) or in his absence the Senior Manager (Administration) shall function as the non-member Secretary of the Senate.

6. Powers and Functions of Senate.- The Senate may, in addition to the powers and functions specified in the Act-

(a) frame, review and revise curricula and courses offered by the Academy;

(b) frame guidelines for admission of students, subject to the procedures laid down in the Ordinances;

(c) maintain standards of instruction, education and examination, evaluate the students and declare results of such examinations subject to the procedures laid down in the Ordinances;

(d) appoint different committees, as it deems fit, to seek recommendations on academic and administrative affairs of the Academy;

(e) consider recommendations of the committees and place them before the Board for ratification;

(f) make periodical review of performance of the Academy;

(g) prepare annual report of the Academy and any other publications that may be considered relevant for disseminating information on the activities of the Academy;

(h) utilise the estates of the Academy, residences for staff, hostels for students and provide for inspection of staff, in accordance with the Ordinances;

(i) organise the faculty into such faculties, departments of teaching, institutes, schools, centres and units and other sub-divisions of studies and learning;

(j) make recommendations to the Board for expansion, diversification and repositioning of activities and programmes of the Academy;

(k) make recommendation to the Board for creation of posts and re-designation of existing posts along with suggestions for fixing emoluments for such posts;

(l) institute and give stipends, scholarships, medals, prizes and confer awards in accordance with the provisions of the Ordinances;

(m) frame guidelines on various issues such as admission of overseas students; Intellctual property rights of the Academy and other guidelines in accordance with the Statutes and Ordinances;

(n) resolve any other academic issues; and

(o) perform such other functions as may be directed by the Board.

7. Meetings of Senate.- (a) The Senate shall meet at least three times in a year;

(b) The Chairperson of the Senate may convene the meeting either at his own initiative or on signed requisition of at least twenty-five percent of the members of the Senate;

(c) The Secretary to the Senate shall issue notice of the meeting of the Senate at least five working days in advance for ordinary meeting and three working days in advance for requisitioned meeting;

(d) The Chairperson of the Senate shall chair the meeting of the Senate;

(e) When the Chairperson of the Senate is absent, the Associate Director (Academic) shall preside over the meeting;

(f) One-third of the total members shall constitute the quorum for meeting of the Senate;

(g) Participation either by physical presence or by electronic communication modes such as skype, video conferencing, teleconferencing or any other mode of communication may be taken into account for determining the quorum;

(h) In case the quorum is not formed when the meeting is called to order, the Chairperson for the meeting shall adjourn the meeting for thirty minutes and thereafter the meeting may be reconvened with the members present forming the quorum;

(i) The Secretary to the Senate shall prepare the minutes of the meeting of the Senate and circulate the minutes after the minutes are duly approved by the Chairperson of the Senate;

(j) Decision taken in the meeting pertaining to faculty of the Academy shall be subsequently placed before the Board for ratification;

(k) The decision in the meeting shall be taken by consensus and if there is a lack of consensus on any agenda, the Chairperson, Senate may resort to voting to decide the issue by a majority of more than fifty percent of members, excluding himself;

(l) In the event of equality of votes when voting is resorted to on any agenda, the Chairperson of the meeting shall have the casting vote;

(m) Any business which may be necessary for the Senate to perform may be carried out by circulation amongst all its members a resolution and any resolution so circulated and approved by a majority of the members agreeing shall be as effectual and binding as if such resolution had been passed at a meeting of the Senate:

Provided that one third of the members of the Senate have recorded their support on the resolution;

(n) The decision of the Senate and recommendation of the Board shall be in conformity with the Memorundum of Understanding between the Council of Scientific and Industrial Research and the Academy.

8. Chancellor.- (1) The Chairperson shall be the Chancellor of the Academy.

(2) The Chancellor shall preside over the convocation of the Academy and in his absence the Vice- Chairperson shall act as the Chancellor.

9. The Director- (1) The President of the Council of Scientific and Industrial Research shall appoint the Director in accordance with the provisions of section 22 of the Act.

(2) The Director shall be an Indian citizen and the chief academic and executive officer of the Academy who shall be responsible for the administration of the Academy and imparting of instruction, research and maintenance of discipline.

10. Term of office and removal of Director.– (1) The term of office of the Director shall be for a period of five years from the date of appointment:

Provided that the President of the Council of Scientific and Industrial Research may extend the tenure of the Director till seventy years on the recommendation by an evaluation committee having at least three members of the search-cum-selection committee for appointment of Director, including the Chairperson and Vice Chairperson.

(2) The Director may be removed from his office in accordance with the provisions of sub-section (2) of section 35 of the Act.

(3) In the absence of the Director on account of deputation, transfer, medical or other leave, resignation or any other reason, the senior-most Associate Director shall discharge the duties of the Director till the return of the Director to the office or till the position of Director is filled up by regular appointment.

11. Powers and duties of Director.- (1) The Director shall-

(a) implement the decisions taken by the Board and the Senate other than the ones delegated by Statutes or Ordinances to other functionaries of the Academy;

(b) subject to the availability of funds in the approved budget, incur expenditure in accordance with the procedures as laid down in the Ordinances and in terms of decisions taken by the Board, Senate and the Finance Committee from time to time;

(d) have the power, subject to concurrence of the Finance Committee and ratification of the Senate and Board, to waive off loans, recoveries and irrevocable losses, to the extent that be fixed by the Board;

(e) make all appointments to the Academy, constitute selection committees for such appointments, recommend initial pay for the incumbents and decide on the level of appointment to be offered with the approval of the authority as appropriate;

(f) have the power to fix the eligibility criteria and standards for assessment or evaluation for admissions to the Academy and approve all such admissions;

(g) fix the rents and fees for buildings, hostels, guest houses and other infrastructure of the Academy, subject to the recommendation of the Finance Committee and approval by the Senate;

(h) submit the annual report and the annual accounts of the Academy to the Board;

(i) create temporary posts in the Academy and induct suitable individuals in the said posts on contractual basis on the recommendation of the Senate and ratification by the Board;

(j) have the power to outsource any academic duties and functions with the approval of the Senate and ratification of the Board;

(k) sign all agreements, contracts and Memorundum of Understandings on behalf of the Academy;

(l) have the power to grant sabbaticals to members of the academic staff of the Academy and send the staff of the Academy for training and personal development, if required;

(m) have the power for constituting committees, task force and working group for advising and advancing the mandate of the Academy in specific areas;

(n) perform such other duties as may be specified in the Statutes, or provided by the Ordinances or by notifications from time to time by the Board.

(2) The Director may delegate his powers to other suitable officers of the Academy with the approval of the Chairperson.

12. Compensation for Director.- The selection committee may recommend compensation for the position of a Director commensurate with the eminence of the person and shall have both fixed and performance based variable component which shall be ratified by the Board.

13. The Associate Directors.– (1) There shall be five Associate Directors, namely, Associate Director (Academic), Associate Director (Administration and Finance), Associate Director (Student Affairs), Associate Director (Resource Development and Network) and Associate Director (Institute Affairs and Information and Communications Technology Infrastructure).

(2) The Board may assign any other designation for the Associate Directors, for the purpose of administrative convenience or academic efficiency of the Academy.

14. Appointment of Associate Directors.– (1) The Director may appoint Associate Directors with the approval of the Chairperson, from among the Professors of the Academy or scientists from Council of Scientific and Industrial Research engaged in academic activity of the Academy.

(2) There shall be a selection committee for selection of Associate Directors which shall consist of-

(i) Vice Chairperson of the Board – Chairman;

(ii) Director – Member;

(iii) One member of the Board, nominated by the Vice Chairperson from among the members of the Board – Member;

(iv) Three experts, out of whom at least two shall be not related to the Council of Scientific and Industrial Research nominated by the Vice Chairperson on the recommendation of the Director;

(3) The selection committee shall seek the candidates for the post of Associate Directors from the members of the Board, Directors of laboratories of Council of Scientific and Industrial Research and distinguished scientists of Council of Scientific and Industrial Research.

(4) For the purpose of clause (1), the selection committee shall follow such procedures as it deems fit.

(5) The Director shall submit to the Chairperson for his approval the recommendation of the selection committee for appointment of Associate Directors.

15. Term of office of Associate Directors.– (1) The term of the office of the Associate Director shall be initially for a period of three years, or five years, from the date of appointment or till the age of sixty five years, as decided by the Board on the recommendation of the selection committee:

Provided that the Board may for the reasons to be recorded in writing, extend the tenure of the Associate Director on the basis of his performance.

16. Removal of Associate Directors.- The Board may remove an Associate Director from office by giving three months notice or salary in lieu of three months notice:

Provided that no Associate Director shall be removed from office by the Board unless a resolution, moved by the Director in that behalf is approved by two-thirds majority of the Senate and the Board.

17. Duties and powers of Associate Directors.- The Associate Director shall assist the Director in discharging academic, administrative, financial, operational and other functions consistent with the designation and carry out responsibilities as may be assigned to him by the Director or the Board.

18. Compensation for Associate Directors.- The Director shall fix the compensation for the position of Associate Director of the Academy on the recommendation of the search-cum-selection committee commensurate with the eminence and proven potential competence of the candidate and shall have both fixed and a performance based variable component as notified by the Board from time to time.

19. The Deans.– (1) The Director may appoint the Deans in consultation with the Associate Director (Academic), with the approval of the Chairperson:

Provided that the Chairperson shall not grant approval without recommendation of the Senate and consultation with the Vice Chairperson.

(2) The Deans shall be appointed from among the scientists of Council of Scientific and Industrial Research engaged in academic activities who are part of faculty of the Academy and have eminent scientific standing with national and international recognition.

(3) The Deans shall assist the Academy in discharging its academic functions.

(4) There shall be one Dean each for Biological Science, Chemical Science, Engineering Science, Mathematical and Information Science and Physical Science.

(5) The term of office of a Dean shall be for a period of three years from the date of appointment, extendable by another term of three years or such lesser period as the Board may deem fit on the recommendation of the Senate.

(6) The Board may remove a Dean from office by two-thirds majority on a resolution moved by the Director which shall be approved by two-thirds majority of the members of the Senate.

20. Powers and functions of Deans.– (1) A Dean shall be in charge of the respective cluster for which he has been appointed and shall assist the Director and the Associate Director (Academic) in discharging the academic functions of the Academy.

(2) A Dean may be assigned any other function as may be considered necessary by the Director or Associate Director (Academic).

21. Professional Fee for Deans of the Academy.- The Board may approve the professional fee fixed by the Director on the recommendation of the Associate Director (Academic) .

22. Associate Deans.– (1) The Director may appoint the Associate Deans in consultation with the Associate Director (Academic) and with the approval of the Chairperson:

Provided that the Chairperson shall not grant approval without recommendation of the Senate and consultation with the Vice Chairperson.

(2) The Associate Deans shall be appointed from among scientists of Council of Scientific and Industrial Research engaged in academic activities to assist the Academy in discharging its academic functions.

(3) There shall be one Associate Dean each for Biological Science, Chemical Science, Engineering Science, Mathematical and Information Science and Physical Science.

(4) The term of office of an Associate Dean shall be for a period of three years from the date of his appointment:

Provided that the Board may, on the recommendation of the Senate, extend the term for another three years for the reasons to be recorded in writing.

(5) The Board may remove an Associate Dean from his office if his services are not found satisfactory or for any other reason to be recorded in writing by the Director on the recommendation of the concerned Dean and Associate Director (Academic).

23. Powers and functions of the Associate Deans.– (1) An Associate Dean shall be in-charge of the respective cluster for which he has been appointed and shall assist the Associate Director (Academic) and the Dean of the corresponding cluster in discharging academic activities of the Academy.

(2) The Assoicate Director (Academic) and the Dean of the concerned cluster may assign, as they may deem fit, other functions to the Associate Deans.

24. Professional Fee for Associate Deans of the Academy.- The Board may approve the professional fee for Associate Deans fixed by the Director:

Provided that the Director shall not fix the professional fee except on the recommendation of the Associate Director (Academic).

25. Appointment of Coordinators for different Laboratories.- The Chairperson, Senate may appoint coordinators for different laboratories on the recommendation of the Directors of the laboratories of the Council of Scientific and Industrial Research and the appointment shall be ratified in the next Senate meeting.

26. Professional Fee for Coordinators of Laboratory of the Academy.- The Board may fix professional fee for coordinator on the recommendation of the Associate Director (Academic).

27. Executive Officers and Advisors.– (1) (a) The executive officers of the Academy shall include such officers who are considered to be essential for smooth running of the Academy.

(b) The officers comprise, but are not restricted to, posts such as those of Assistant Director (Administrative and Finance), Senior Manager (Administration), Manager and Technical officers, librarian or equivalent, system administrator, engineer, media officer, public relations officer, law officer and other officers as the Academy may deem fit.

(2) The Director may appoint employees and advisors, on contractual basis under a written contract in accordance with the provisions of sub-section (1) of section 33 of the Act.

(3) (a) Subject to the provisions of the Statutes, selection process for permanent members of the faculty and other employees, as applicable, shall be completed within forty-five days of publication of advertisement or nomination or invitation, as the case may be.

(b) The selection of a candidate, once completed, shall be valid for three months, subject to such extension as may be deemed necessary by the Senate, in the case of acceptance by the candidate.

(4) The Academy shall make appointments by giving wide publicity in national dailies and by notification on the notice board of the Academy and laboratories of the Council of Scientific and Industrial Research.

(5) (a) A selection committee of the Academy consisting of the following persons-

(i) an Associate Director or his nominee of the rank of Professor of the Academy as Chairperson;

(ii) one officer of the Academy not below the rank of Associate Professor;

(iii) two coordinators of laboratories of the Council of Scientific and Industrial Research, or one coordinator and one scientist of the laboratory of the Council of Scientific and Industrial Research as nominated by the Chairman of the Committee, may select the Executive Assistants and Executive Consultants for appointment on contract basis.

(b) The selection committee may make selection from a panel of candidates who have applied for the posts on the basis of their qualifications and experience.

(6) (a) The Academy may notify from time to time details of the essential qualification, tenure, remuneration and function of the different administrative positions.

(b) The Academy shall have flexible compensation system which recognises performance to bring the best talent to the Academy.

(2) (a) For recruitment of the employees of the Academy, adequate provision shall be made for reservation of posts for backward communities and physically handicapped candidates, in accordance with the orders or instructions issued by the Government and Council of Scientific and Industrial Research from time to time.

(b) The recruitment process shall be transparent and the same shall be updated regularly and be made available on the website of the Academy.

(c) The qualifications for each post provided shall be redefined wherever necessary, keeping in view the requirements of the Academy and availability of personnel with better academic qualification and technical competence.

(d) The remuneration for any administrative staff which requires concurrence by the Finance Committee and ratification by the Director shall be as modified by the Academy from time to time.

(e) The Board, if necessary, may introduce scales of pay at a level higher than those existing, to attract suitable talents to be appointed to such positions, which shall, be on a case to case basis and shall not be a precedent.

(f) The Senate and the Board may decide upon the proportion of employees to occupy permanent, temporary, deputation and contractual appointments in the Academy.

(g) (i) All the employees of the Academy shall be entitled for family health coverage;

(ii) All the employees, permanent or temporary, of the Academy shall be entitled for leave in accordance with rules notified from time to time.

(7) (a) The extension of appointment of non-academic executive officers and advisors shall be made on a case to case basis by the Director on the recommendation of the Associate Director (Administration and Finance);

(b) The Chairperson shall do the annual performance appraisal of the Associate Director and the Director.

(8) (a) All employees of the Academy, on completion of their period of contract or an extended period of contract, as the case may be, shall be eligible for terminal benefits such as leave encashment, gratuity and other benefits, as recommended by the Chairperson, Senate to the Board.

(b) The criteria for the terminal benefits shall be fixed by a sub-committee which shall include the members from the Finance Committee as constituted by the Chairperson, Senate.

(9) The Director may outsource the non-academic duties and functions for such period, in such areas and at such levels of staff as he deems fit.

28. Conduct of Business of Executive Authorities of the Academy.– (1) The executive authorities and executive officers of the Academy shall perform the duties in a manner so as to achieve a highly efficient level of functioning of the Academy.

(2) For the purposes of clause (1), the Academy shall function in unison in all matters.

(3) For the purposes of carrying out the business of the executive authorities, an apex committee shall be formed and chaired by the Director having all Associate Directors as members for formulating general policy guidelines.

29. Functions or business of the Academy.– (1) The functions that require to be undertaken under the direct supervision of each of the Associate Directors shall be constituted into Directorates, while the others may be delegated to suitable officers which shall be formed as offices.

(2) Unless otherwise expressely provided, there shall be the following Directorates to discharge the business of the Academy, namely:-

(a) Directorate of Academic Affairs;

(b) Directorate of Student Affairs;

(d) Directorate of Institute Affairs and Information and Communications Technology, e-Learning and Distance Education; and

(e) Directorate of Administration and Financial Support

(a) Directorate of Academic Affairs.– (i) The Directorate of Academic Affairs shall function under the direct supervision of the Associate Director (Academic).

(ii) In the direct supervision by the Associate Director (Academic), the Deans and Associate Deans shall assit the Associate Director (Academic).

(iii) The Directorate of Academic Affairs shall-

(a) assist the Board, Senate and Boards of Studies in framing course modules, syllabi and other matters connected thereto;

(b) look into all the matters related to credit system and evaluation;

(d) constitute and legitimise Doctoral Committees;

(e) undertake quality assurance exercises; and

(f) perform such other functions as may be directed by the Boards of Studies and Senate.

(b) Directorate of Student Affairs.– (i) The Directorate of Student Affairs shall function under the direct supervision of the Associate Director (Student Affairs).

(ii) In the direct supervision by the Associate Director (Student Affairs), the Deans and Associate Deans shall assit the Associate Director (Student Affairs).

(iii) The Directorate of Student Affairs shall -

(a) oversee all aspects of admission processes and frame admission modalities from time to time;

(b) frame modalities and oversee student registration process for various courses of study;

(d) deal with all disputes and grievances of students;

(e) obtain regular feedback from students, staff and stake holders and to take such action for improvements in respect thereof;

(f) provide necessary inputs to Directorate of Networking and Resource in matters related to framing and implementation of overseas students policy; and

(g) perform such other functions as may be directed by the Boards of Studies and Senate.

(c) Directorate of Resource Development and Networking.– (i) The Directorate of Resource Development and Network shall function under the direct supervision of the Associate Director (Resource Development and Networking).

(ii) In the direct supervision by the Associate Director (Resource Development and Networking), the Deans and Associate Deans shall assit the Associate Director (Resource Development and Networking).

(iii) The Directorate of Resource Development and Networking shall-

(a) undertake comprehensive planning activity for growth and development of the Academy, both nationally and internationally;

(b) prepare strategy for interaction with industry and raising funds from industries, philanthropic organisation and individuals;

(c) raise funds for sponsored chairs, fellowships and other matters and project funding from Government and other sources;

(d) frame and implement overseas students policy in consultation with the Directorate of Student Affairs and issue guidelines in this regard;

(e) foster international collaboration in education and research activities for the Academy;

(f) institute overseas training fellowships and scholarships under the Academy;

(g) publish regular impact documents, strategy papers and status reports for international scenarios relevant to the areas of work of the Academy;

(h) promote, nurture and sustain innovation in the activities of the Academy through development and implementation of innovation strategy, concepts, processes and methods;

(i) facilitate technological and academic entrepreneurship amongst faculty, students and other associates of the Academy;

(j) inculcate culture of inverted innovation and nurture appropriate ecosystem in the Academy in association with other stakeholders or players of academia and Research and Development sector;

(k) catalyse application of innovative processes and technologies to the social sector;

(l) identify new and unique revenue generation mechanisms;

(m) perform such other functions as may be directed by the Boards of Studies and Senate.

(d) Directorate of Information and Communications Technology Infrastructure, e-Learning and Distance Education.– (i) The Directorate of Information and Communications Technology Infrastructure, e-Learning and Distance Education shall be consortium-led and shall function under the direct supervision of the Associate Director (Institute Affairs and Information and Communications Technology Infrastructure).

(ii) The Directorate of Information and Communication Technology, Infrastructure e-Learning and Distance Education shall-

(a) frame E-learning and distance education policy for the Academy;

(b) undertake content development;

(d) assure the quality of courses being offered;

(e) frame guidelines for students to be enrolled under distance programmes and issue such guidelines to the Directorate of Student Affairs;

(f) liaise and coordinate with the Distance Education Council;

(g) serve as the Corporate Communications Unit of the Academy;

(h) frame the information and communication technolgoy policy for the Academy;

(i) be the custodian of the Information and Communication Technolgoy infrastructure;

(j) maintain the Academy home page or website, databases and other matters connected thereto; and

(k) perform such other functions as may be directed by the Board of Studies and the Senate.

(e) Directorate of Administration and Financial Support.– (i) The Directorate of Administration and Financial Support shall function under the direct supervision of the Associate Director (Administration and Finance).

(ii) In the direct supervision by the Associate Director (Administration and Finance), the Deans, Associate Deans and the Finance Committee shall assit the Associate Director (Administration and Finance).

(iii) The Directorate of Administration and Financial Support shall-

(a) provide all the administrative, legal and financial support to all the four Directorates;

(b) coordinate the activities related to the Memorundum of Understandings of the Academy with national and international centres of learning and research;

(d) monitor the expenditure as per the revenue generation and budget of the Academy;

(e) perform such other functions as may be directed by the Boards of Studies and Senate.

30. Board of Studies.– (1) The Board of Studies shall assist the Senate for operating the academic programmes of the Academy.

(2) The Senate may create or do away with such Boards of Studies, with the approval of the Board.

(3) Unless otherwise expressely provided there shall be the following three Boards of Studies, namely:-

(a) Board of Studies for Biological and Chemical Sciences;

(b) Board of Studies for Engineering and Physical Sciences;

(4) The Senate may conduct interdisciplinary and trans-disciplinary programmes across the three Board of Studies, namely, Nano-Bio-Information Technology programmes.

(5) Subject to the requirements of academic programmes of the Academy, the Senate, with due ratification of the Board, may constitute other Boards of Studies.

(6) The Chairperson of the Senate may nominate the members of the Board of Studies in consultation with the Associate Director (Academic) with the approval of the Senate.

31. Constitution of Boards of Studies.- (a) There shall be a Board of Studies for Biological and Chemical Sciences Cluster which shall consist of-

(i) Associate Director (Academic) who shall be the Chairperson of the Board of Studies for Biological and Chemical Sciences Cluster;

(ii) two Deans of the Biological and Chemical Sciences Cluster, one of whom shall be the Co-chairperson on rotation basis, for each successive meetings;

(iii) two members from the Senate, representing two clusters;

(iv) two scientists, one from each cluster other than those nominated in the Board or the Senate;

(v) two external experts, preferably members of the Research Council of the corresponding cluster laboratories or Industries, other than those nominated in the Board or the Senate; and

(vi) one of the Associate Deans of the corresponding clusters shall be the Member Secretary.

(b) There shall be a Board of Studies in Engineering and Physical Sciences Cluster which shall consist of-

(i) Associate Director (Academic) who shall be the Chairperson of the Board of Studies in Engineering and Physical Sciences Cluster;

(ii) two Deans of Engineering and Physical Sciences, one of whom shall be the Co-chairperson on rotation basis, for each successive meetings;

(iii) two members from the Senate from Engineering and Physical Sciences laboratories;

(iv) two scientists from Engineering and Physical Sciences laboratories, other than those nominated in the Board or the Senate;

(v) two external experts, preferably members of the Research Council of the corresponding cluster laboratories or industries, other than those nominated in the Board or the Senate; and

(vi) one of the Associate Deans of the corresponding clusters shall be the Member Secretary.

(c) There shall be a Board of Studies for Information Science Cluster and Interdisciplinary Studies for Law, Humanities and Management Sciences which shall consist of-

(i) Associate Director (Academic) who shall be the Chairperson of the Board of Studies for Information Science Cluster and Interdisciplinary Studies for Law, Humanities and Management Sciences;

(ii) the Dean of information Sciences Cluster to act as the Co-chairperson;

(iii) two members from the Senate from corresponding areas of study;

(iv) two scientists from the cluster laboratories or divisions other than those nominated in the Board or the Senate;

(v) two external experts, preferably members of the Research Council of the corresponding cluster laboratories or Industries, other than those nominated in the Board or the Senate; and

(vi) Associate Dean of the corresponding cluster shall be the Member Secretary.

32. Powers and Functions of the Board of Studies.– (1) The Boards of Studies shall have the following powers and functions, namely:-

(a) to recommend the Senate the courses of studies and curriculum to be introduced and followed;

(b) to recommend the Senate on the creation and institution of professorships and other adjunct faculty positions in the Academy; subject to provisions in this regard in the Ordinances;

(c) to make recommendations on inclusion and establishment of new learning centres and learning outreach centres under the Academy;

(d) to set up special committees and task forces for promotion of research, teaching, curriculum development, and other matters connected thereto;

(e) to make proposals to the Senate regarding provisions to be made for enabling the Academy to undertake specialised study programmes in inter-disciplinary and trans-disciplinary areas and to evolve mutual resourcesharing protocols with other institutions of higher learning and universities in India and abroad;

(f) to supervise the examinations and award of degrees;

(g) to supervise quality assurance in the teaching programmes being offered by the Academy;

(h) to make contractual and other extraordinary engagement or retainership as may be required for furtherance of the mandate of the Academy subject to the approval of the Senate and ratification by the Board for a period not exceeding one year and subject to the provisions of the Ordinances;

(i) to frame general rules for the evaluation of sessional work;

(j) to consider schemes for the improvement of the standards of teaching and research, and to submit such proposals to the Senate for approval;

(k) to frame the general time-table of the Academy;

(l) to perform all other functions which may be provided in the Ordinances, and to consider all such matters as may be referred to it; and

(m) to delegate to the Dean or any other member of the Board of Studies or to a committee as he deems fit such general or specific powers as may be decided upon by the Board of Studies from time to time.

33. Meetings of the Boards of Studies.– (1) The meeting of each of the Board of Studies shall either be ordinary or special.

(2) The Associate Director (Academic) and the concerned Dean shall hold ordinary meeting twice a year.

(3) The Associate Director (Academic) or the concerned Dean at his own initiative may call special meeting or shall be called at the suggestion of the Chancellor of the Academy or on a written request from at least onefifth of the members of the Board of Studies.

(4) The Dean of the respective subject may take decision on the matter of approval of reviewers of thesis or change of subject, title or guide or other such activities which shall be ratified by the Board of Studies.

(5) The meeting may be held in physical presence or by using various secure communication modes such as skype, video conferencing, teleconference and other modes of communication.

34. Term of Boards of Studies and its dissolution.– (1) A Board of Study shall have a term of three years and shall be reconstituted after completion of its term.

(2) The Board may dissolve one or all of the Boards of Studies on recommendation of the Senate, provided a motion for such dissolution is moved before a Senate meeting and is passed by simple majority in the meeting.

35. Notice of Meeting.– (1) The notice for a meeting of the Board of Studies, other than a special meeting, shall be issued at least seven days before the day fixed for the meeting:

Provided that a special meeting may be fixed with at least five days’ notice.

(2) A calendar of events shall be prepared at the beginning of the academic year for holding the meetings.

36. Procedures for conducting meeting.– (1) The Chairperson of the relevant Board of Studies may decide the procedures for conducting the meeting of the Board of Studies.

(2) The participation of at least one-third of the members including two Deans or Associate Deans either by physical presence or by using various secure communication modes such as skype, video conferencing, teleconference and other modes of communication to form the quorum:

Provided that the quorum for the meeting of the Board of Studies for Information Science Cluster shall consist of either the Dean or the Associate Dean of the Information Science Cluster.

37. The Finance Committee.– (1) There shall be a Finance Committee to consider and make recommendation to the Senate in respect of all financial matters.

(2) The Finance Committee shall consist of the following members, namely:-

(a) the Director of the Academy, who shall be the Chairperson of the Committee;

(b) the Associate Director (Administration and Finance)- Member;

(d) one Financial expert nominated by the Chairperson- Member;

(e) one member of the Senate nominated by Chairperson of the Senate- Member; and

(f) the Assistant Director (Administration and Finance) or in his absence Senior Manager (Administration) shall be the Secretary.

38. Powers and Functions of the Finance Committee.– (1) The Finance Committee shall-

(a) formulate the financial plans and prepare the budget of the Academy for the forthcoming financial year;

(b) make recommendation to the Board on all proposals of demands for grants and monies, which shall stand referred to the Finance Committee for deliberation prior to placing the same before the Board;

(d) maintain proper and separate accounts of the Academy in full detail and audit within six months of the end of each financial year;

(e) perform such other financial functions as may be directed by the Board and the Senate.

39. Terms of nominated members of the Finance Committee.- The nominated members of the Finance Committee shall be its members for the period specified at the time of nomination or till a fresh nomination is made, whichever is earlier.

40. Quorum for meetings of the Finance Committee.– (1) There shall be participation of at least three members to form the quorum for the meeting of the Finance Committee, of whom one shall be a financial expert.

(2) The participation for the meeting may either by physical presence or by using various secure communication modes such as skype, video conferencing, teleconference and other modes of communication to form the quorum.

41. Entitlement for members of the Board, Senate, Board of Studies and other sub-committees.- The members attending the meeting, in person or by electronic communication modes such as skype, video conferencing, teleconferencing or by any other mode, of the Board, Senate, Board of Studies and other subcommittees constituted from time to time shall be entitled for the following, namely:-

(i) honorarium or sitting fee in accordance with the notification issued by the Academy from time to time;

(ii) reimbursement of expenditure incurred on travel for attending the meeting; and

(iii) arrangement for stay or in lieu thereof, reimbursement of reasonable expenditure incurred towards lodging in connection with attending the meeting.

42. Research Institutes, Laboratories, Centres and Units.– (1) The institutes or laboratories or centres or constituent units of the Council of Scientific and Industrial Research specified in column (2) of the Table below, shall be the research institutes or laboratories or centres or constituent units of the Academy and the website addresses of the institutes or laboratories or centres or constituent units of the Council of Scientific and Industrial Research shall be as specified in column (3) of the said Table.

(2) The resource and infrastructure of the institutes or laboratories or centres or constituent units of the Council of Scientific and Industrial Research shall be available to the Academy as per the Memorandum of Understanding between Academy of Scientific and Industrial Research and the Council of Scientific and Industrial Research.

Note.- If a laboratory or unit of the Council of Scientific and Industrial Research is created in future, it shall be deemed to be a research institute and in case any laboratory is merged or closed by the Governing Body of the Council of Scientific and Industrial Research, then the corresponding laboratory or centre or unit shall cease to be research institute or centres or unit of the Academy.

43. Faculty positions of the Academy.– (1) The Scientists of the Council of Scientific and Industrial Research Laboratories and its constituent units selected for the purpose shall have the dual role of being faculty of the Academy and Scientists of Council of Scientific and Industrial Research.

(2) The Scientists shall bear the designations of the faculty based on such criteria as the Council of Scientific and Industrial Research deems fit for its scientists of different grades.

(3) The selection of the scientists shall be based on the guidelines of the faculty as approved by the Senate.

(4) The Director General of the Council of Scientific and Industrial Research shall forward, the list of faculty members drawn from among the Scientists of Council of Scientific and Industrial Research, including eminent scientists and emeritus scientists, to the Senate for its approval.

(5) The Director General of the Council of Scientific and Industrial Research may make any subsequent change in the list of faculty of the Academy drawn from Council of Scientific and Industrial Research.

(6) All the positions of the faculty drawn from among the Council of Scientific and Industrial Research shall be honorary and are co-terminous with their superannuation or discontinuation of service from the Council of Scientific and Industrial Research:

Provided that the services of the faculty members may be availed beyond superannuation as distinguished emeritus professor or professor of eminence or as a sponsored chair professorship with remuneration commensurate with the positions which they hold with the approval of the Board.

(7) The Senate shall update the list of faculty from time to time following the assessment and appointment of Scientists of Council of Scientific and Industrial Research.

(8) The Academy may induct the superannuated scientists of Council of Scientific and Industrial Research as faculty members of the Academy with appropriate designation on the recommendation of the Director.

(9) The Board may honour and confer on eminent scientists, personalities, academicians and other personalities who may not necessarily be citizens of India, with the higher title of “Academy Professor”.

(10) The Academy Professorships may be offered to only eminent individuals with most exceptional academic contributions and extraordinary scholarly work.

(11) The Director General of Council of Scientific and Industrial Research and other renowned scientists of equivalent eminence shall be honoured, on the recommendation of the Senate and the Board, as a professor of eminence of the Academy;

(12) The Board may appoint such number of employees as it considers necessary for the efficient functioning of the Academy.

44. Recruitment of academic staff other than Director, Associate Directors, Deans and Associate Deans.– (1) The direct recruitment for the academic posts in the Academy, shall be filled up by direct recruitment, after due advertisement.

(2) The Academy may consider positions of adjunct and visiting faculty from other reputed academic institutions from India or abroad.

(3) The qualification and eligibility criteria for being recruited as faculty and the designation to be given to the appointees shall be determined by the Board from time to time.

45. Honorary academic positions for Council of Scientific and Industrial Research scientists in the Academy.- The honorary academic positions for the Council of Scientific and Industiral Research Scientists specified in column (2) of the Table below shall be designated in the Academy as specified in column (3) of the said Table.

47. Delegation of powers of appointment.- (a) The Board may delegate to the Senate the power to appoint Honorary Professors and confer the title of Emeritus Professor upon any professor who has retired or superannuated from the service of Council of Scientific and Industrial Research.

(b) An Honorary or Emeritus Professor shall not, ex officio, be a member of the Senate or the Board.

48. Conferment of Degrees and Diplomas.– (1) The degrees conferred by the Academy include, but not limited to, the following, namely:-

(i) M.Tech;

(ii) Ph.D in Science, Engineering and Social Science and Humanities;

(iii) Integrated M.Tech - Ph.D in Engineering;

(iv) Integrated Ph.D in Science or Engineering;

(v) Integrated M.Sc - Ph.D in Science;

(vi) M.S by Research in Science and Engineering;

(vii) Honors Dual Degree;

(viii) Post Graduate Diploma in Finishing School (One/Two year Post Graduate diploma); and

(ix) Diploma in areas offering new knowledge (Short term diploma)

(2) The conferment of degrees and diplomas shall be decided by the Senate.

49. Fees for the programme.– (1) The Senate shall specify the fees for the different programmes offered by the Academy from time to time.

(2) The fees for the programmes of the Academy shall be such that it shall not deter the weaker section of the society to have an access to new knowledge.

(3) The Academy shall make provisions for the institution of fellowships to provide support to attract motivated brilliant students from the economically weaker section of the society.

(4) The fees shall be comparable with Government supported technical and professional institutes.

(5) The Senate shall decide the methodology of collection of fees from time to time.

50. Late Fee.- The Senate shall charge late fees for cases of delayed payment of fees and the details of late fee or fine and other related issues shall be in accordance with the provisions of these Statutes.

51. Institution of Awards, Fellowships, Scholarships, etc.– (1) The Senate shall administer all gifts, benefactions and awards related to the Academy through a Gifts and Awards Committee.

(2) The Gifts and Awards Committee shall consist of-

(a) The Director of the Academy - Chairperson;

(b) Associate Director (Resource Development and Networking) and Associate Director (Academic)- Member;

(d) One nominee of Director General, Council of Scientific and Industrial Research- Member; and

(e) one external member who has served or serving not below the rank of Professor of a university or equivalent officer of the national laboratories.

(3) The committee shall lay down the procedure for administration of the gift or benefaction:

Provided that where the terms and conditions attached to any gift, endowment or benefaction provides for any particular procedure for administration thereof, such procedure shall prevail.

(4) The Gifts and Awards Committee shall place before the Senate the proposal for different Awards and fellowships.

(5) The Board may on the recommendation of the Senate institute different forms of awards and fellowships and such awards and fellowships, shall comprise, but not be restricted to, the following, namely:

(i) Special Medals and Citations;

(ii) Endowment Fellowships for pre-doctoral, post-doctoral and specialised courses of studies;

(iii) Best Research Awards;

(iv) Innovative Technology Awards;

(v) Travel Fellowships;

(vi) Merit Scholarships;

(vii) Bursaries for research supervisors.

(6) The Gifts and Awards Committee shall formulate the details of the procedures for institution of the awards and fellowships from time to time which shall be placed before the Senate for approval.

(7) The Academy may accept grants from external agencies or raise loans with the approval of the Board:

Provided that-

(a) no grants shall be accepted; or

(b) no loan shall be raised;

except with the concurrence of the Finance Committee.

(8) No student shall be entitled to receive any fellowship or assistantship or financial support from the Academy:

Provided that the students of the Academy may receive the fellowship after clearing National Eligibility Test conducted by the Council of Scientific and Industiral Research fellowship and the University Grants Commission for Junior Research Fellowship, Senior Research Fellowship or other fellowships from other sources:

Provided further that the Academy may provide fellowship or sponsored fellowship by industries or philanthropic entities for meritorious, talented, motivated students from the weaker section of the society.

(9) Without prejudice to the provision of clause (8), the ordinances may provide for any other financial support to the students of the Academy.

(10) The annual report of the Academy shall contain a list of all gifts, benefactions and endowments along with mention of all awards, fellowships and medals given over the said period of time.

(11) (a) Notwithstanding anything contained in these Statutes, the laboratories of Council of Scientific and Industrial Research may continue to have their own awards, benefactions and endowments, irrespective of their relationship with the Academy.

(b) The procedure for grant of fellowships, awards, gifts and endowments, their administration and other matters connected thereto shall continue to be decided by the respective laboratories and not under the provisions of these Statutes.

52. Administration of Estates, Endowments, Gifts and Benefactions, etc.– (1) The Academy may, where necessary, have its own estates.

(2) The estates owned by the Academy shall be either on a free-hold title or on a lease for not less than ninety nine years:

Provided that the Academy may lease or rent any accommodation for shorter duration with a provision for renewal for its functioning.

(3) The ownership deeds and lease deeds for the Academy shall be signed by the Director of the Academy.

(4) The Academy may use the estates owned or leased or taken on rent for the purposes that are in line with the mandate of the Academy.

(5) For the purposes of clause (4), the Academy may put into usage its estates for the following purposes, namely:-

(a) to build teaching and research infrastructure;

(b) to build knowledge parks and incubators in furtherance of the mandate of the Academy;

(d) to build experimental farms, workshops and test facilities.

(6) The Academy shall have an office of estates that shall be empowered to administer all affairs of estates of the Academy.

(7) The Academy shall have an office that shall be empowered to administer all affairs of gifts, endowment and benefactions.

(8) The Academy shall carry out appropriate verification of the antecedents of the donors before accepting the gifts, endowments and benefactions.

(9) The endowments shall consist of all those monies and other movable assets received by the Academy from various sources including but not restricted to gifts and donations.

(10) Subject to the provisions of these Statutes, the Academy shall promote solicitation and acceptance of gifts in order to augment its own resources and to further the commitment it has for achieving excellence in teaching, learning and research.

(11) (a) The Academy shall not accept any gift that may preclude it from accepting gifts from other donors;

(b) The Academy shall not accept any gifts that may violate any law for the time being in force or regulation and reserves the right to reject any gift;

(c) The act of giving a gift to the Academy shall be irrevocable and the gift and the gift-purpose, once acceded to, shall be subject to the prevailing policies and procedures of the Academy.

(12) (a) In recognition of a gift made by a donor, the Academy shall provide the donor with a naming opportunity like named chairs or fellowships within the Academy with approval of the Board.

(b) The Board may set the minimum level of the gift to qualify for a naming opportunity from time to time, and shall be decided on a case to case basis.

(13) (a) All gifts received by the Academy shall be used in accordance with the gift purpose;

(b) All information relating to the donor and the gift shall be treated as confidential unless disclosure of such information is in pursuance of an order of a court of law or is required in compliance with provisions of any law for the time being in force.

(c) The Academy shall appropriately acknowledge and recognise the donors and their gifts as may be provided by Ordinances framed in this regard.

(14) Notwithstanding anything contained in clause (13), if a donor offered with a naming opportunity falls into disrepute or the name proposed by the donor is found at a later date to be of disrepute, the Academy may discontinue the use of the relevant name or gift, donation or benefaction as may be decided by the Board.

(15) The Academy shall endeavour to use the gift for the purposes for which it was received:

Provided that the Board may alter the gift purpose to an extent required under exceptional circumstances, in order to keep in tune with the requirements of the Academy.

(16) On the approval of the Board, the endowment office shall obtain the concurrence of the donor to alter the gift purpose.

(17) The Academy may use the gift and administer the gift in accordance with the gift purpose and invest gifts and endowments.

(18) The endowments donated to the Academy shall be placed in a fund called the Academy of Scientific and Innovative Research Endowment Fund.

(19) The Fund shall constitute the capital and all payments required to be made in respect of all such endowments, shall be paid out of the income accruing to the said endowment fund.

(20) (a) The Academy may administer the fund in accordance with the provisions of this Statute.

(b) The Academy shall constitute an endowment fund committee, consisting of not less than five members, under the chairpersonship of the Associate Director (Administration and Finance) which shall have the power to make any investment under any law for the time being in force.

(d) Board may apportion such part of the fund income, from time to time, to form part of the capital of the fund, as may be necessary, to preserve the value of the capital of the fund to offset any depreciation in the value of the capital of the fund due to inflation and such other factors.

(e) At the beginning of every financial year, each endowment shall receive an annual distribution of expendable income at a predetermined fixed rate that shall be fixed by the Board, on the recommendation of the Finance Committee.

(21) The endowment fund of the Academy shall be used for the purposes specified by the Board from time to time.

53. Relationship with other organisations and institutes.– (1) The Academy shall endeavour to establish academic relationship with other national institutions and organisations for realisation of its objects and activities.

(2) For the purposes of research and development, the Academy may promote a seamless relationship with any institute or centre or laboratory, belonging to any Department or Ministry of the Central Government other than Council of Scientific and Industrial Research network.

(3) The relationship shall include, but not be restricted to, the following:

(a) movement of students for the pursuit of research;

(b) movement of faculty for the pursuit of research and teaching;

(d) promotion of joint schools, inter-institutional instruments and computational facilities;

(e) inter- institutional library resource sharing; and

(f) inter-institutional course credit sharing

(4) All central universities of the country and other Institutions of national importance such as Indian Institutes of Technology, Indian Institutes of Science Education and Research and other institutes of national importance shall be treated at par with the Academy in regard to competitive selection of students to the Academy, migration of students from such universities or institutes to the Academy and vice versa and equivalence of courses.

(5) (a) The Academy shall take proactive steps to promote academic interactions with the state universities and State-aided institutes of the country.

(b) A state university shall be considered at par with the Academy if-

(i) the admission to a given course of study in such a university follows the same national level eligibility criteria specified by the University Grants Commission and that the examination, evaluation and credits offered by the university are in conformity with the specified national level standards; and

(ii) the state universities accredited by the National Assessment and Accreditation Council with a minimum of three star rank or those which have been identified as centres of excellence for specified discipline.

(c) For the purposes of clause (5), the Academy shall endeavour to establish a seamless relationship with such universities or institutes in all relevant areas of study similar to those with central universities and institutes.

(d) relationship with State-aided institutes in science and technology shall be promoted and considered on a case to case basis.

(e) The Senate may constitute a committee under the chairpersonship of Associate Director (Academic) to decide the modalities of relationship and implement the decision with approval of the Senate.

(6) (a) The Academy shall endeavour to establish and promote academic and research relationship with industries, public sector undertakings, autonomous bodies and non-governmental organisations.

(b) The Senate may constitute a committee under the chairmanship of the Director to evaluate the relationship on a case to case basis.

(c) For the purposes of sub-clause (b), the committee shall consist of the Associate Director (Academic), Associate Director (Resource Development and Network), Deans of the respective cluster to which the organisation or laboratory belongs, and one nominee of the Senate who is an expert in the field.

(7) (a) The Academy shall endeavour to establish seamless relationship with international institutes and establishments;

(b) The relationship with international institutes shall be planned, managed and executed by the Directorate of Resource Development and Network;

(c) The Board may approve, the comprehensive International Cooperation Policy of the Academy, formed by the Senate, to govern the relationship; and

(d) In framing the policy for the Academy, the Senate shall ensure that the policy is in consonance with the national policies mainly from security angle.

(8) The best minds drawn from international or national laboratories or academia or industry, other than the Council of Scientific and Industiral Research system participating in collaborative research with the Council 46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] of Scientific and Industiral Research, may be recognised as adjunct faculty of the Academy which may be coguides to students pursuing studies at the Academy.

54. Annual Report.- The Director shall submit the annual report of the Academy to the Board covering the overall performance, academic and research highlights, physical and financial assessment or progress and other significant achievements during the year of the report.
