S.O. 891(E).— Whereas Tirap and Changlang districts of Arunachal Pradesh were declared as disturbed areas under the Armed Forces (Special Powers) Act, 1958 w.e.f. I 7 .9.1991 vide this Ministry's Notification referred to above, as, in the opinion of the Central Government, the said districts were in such a disturbed and dangerous condition that the use of armed forces in aid of civn power was neressary, and [1.17111—"gtut3(ii.))

2. Whereas in a statement filed before the Hon'ble Supreme Court, the Government of India had stated that all current notifications regarding declaration of "disturbed areas" under the aforesaid. Act, would be reviewed within a period of three months from 20.8.1997.

3. A review of the law & order situation in Tirap & Changlang districts has accordingly been conducted.

The State Government reports on law & order bring cut the following facts:

(i) On 9th May 1999, Shri Wangjo Bosai was brutally killed by smashing his head with iron rod at Lothung village by the NSCN(K)

(ii) On 20th May 2000, NSCN(K) ultras armed with sophisticated weapons and hand grenades raided Borduria village and kidnapped six persons including the younger brother of Shri Wanglat, Ex-Finance Minister and present MLA.

(iii) The activities of NSCN(K) prevented a BJP candidate, Mrs. Lomrian Mophuk from filing nomination from Khonsa (East) Parliamentary constituency.

(iv) On 15th July 2000 the Deputy Commissioner, Tirap District with other officers were intercepted by ultras at Borduria village and an AK-47 rifle was snatched away from his Personal Security Officer.

(v) On 31st July 2000, two persons of Paniduria village were shqt dead by the NSCN(K) at Khonsa-Longding road near Tissa on the ground that these persons were responsible for bringing in NSCN(I/M) cadre to Tirap District.

S.O. 2.59(E).— Whereas Tirap and Chanlang districts of Arunachal Pradesh were declared as disturbed. areas under the Armed Forces (Special Riawars) Act, 1.968 17.9.3.991 vide this Minisilry's iliertifiGatien.iri?ferred to above, as, in the opinion of the Central Government, the said districts were in such a disturbed and dangerous condition that the use of armed forces in aid of civil power was necessary, and 4 ME GAZETTE OF INDIA : EXTRAORDINARY [PART Ti-SEC. 3(ii)]

2. Whereas in a statement filed before the Hon'ble Supreme Court, the Government of India had stated that all current notifications regarding declaration of "disturbed areas" under the aforesaid Act, would be reviewed within a period of three months from 20.8,1997.

3. The situation was last reviewed in September 2000 and vide Notification bearing SO 891(E) dated 27.9.2000, it was decided to extend the tenure of the declaration of Tirap and Changlang as 'disturbed areas' upto

31.3.2001. A further review of the law & order situation in Tirap & Changlang districts has since been conducted. The State Government reports on law & order bring out the following facts:

(i) NSCN(K) activists continued to collect house-tax at the rate of Rs.150/- per house from villages under Kanubari area of Tirap district. Meanwhile, a group of NSCN(K) activists led by one, Nowlai Arangham, visited village Banfera and harassed the villagers.

(ii) One Kimong Nyamtey of NSCN(IM), who was kidnapped by NSCN(K) a activist from Lazu village (Tirap district) in May, 2000, escaped from the NSCN(K) hideout from Longbo village and joined the NSCN(IM).

(iii) A contingent of 60 armed NSCN(K) activists were reportedly camping in the villhge of Nongtham under Kharsang Circle of Changlang district since 15.1.2001. The purpose of their camping in Changlang was to fight with NSCN(IM) faction, who were collecting taxes from the public in that area.

(iv) On December 29, 2000, four suspected armed NSCN(IM) cadres came to the office of Higher Secondary School, Miao (Changlang district) and collected Rs.23,000 as tax. They also demanded [ 1mTII--gruw3(ii)] FMT aivrtimir 5 money from the SDO, Miao and insisted that the SDO should assist in collection money from all the Departments.

(v) NSCN(IM) activists summoned 3 non-tribal persons in the jungle of Wangsu Pahar near Miao and directed them to collect money from the shopkeepers of Miao.

(vi) The businessmen of Kharsang area (Changlang district) paid money, as demanded by the NSCN(IM) outfit. The demandletters issued to SDO, Miao and Project Director, Namdapha Tiger Project were signed by one self-styled Captain Victor alias Rokunawang of Nagaland and Thingwang alias Kenwang (of Myanmar origin).

4. 2. Whereas in a statement filed before the Hon`ble Supreme Court, the Government of India had stated that all current notifications regarding declaration of "disturbed areas" under the aforesaid Act, would be reviewed within a period of three months from 20.8.1997.

3. The situation was last reviewed in March 2001 and vide Notification bearing SO 259(E) dated 23rd March.2001, it was decided to extend the tenure of the declaration of Tirap and Changlang as 'disturbed areas' upto 30.9.2001, A further review of the law & order s,ituatjon in Tirap & Changlang districts has since been conducted. The State Government reports on law & order bringing out the following facts:

(i) On 10.4.2001', an encounter took place between NSCN(K) and NSCN(IM) at village Longbo of Tirap District in which four NSCN(K) cadres were Injured of which one is reported to have died later.

During their encounter eight houses were gutted in fire caused by firing between the two factions. In an another encounter between NSCN(IM) and Army near Kaimai village in Tirap district one army person was reportedly injured.

(ii) NSCN(K) activists reportedly demanded Rs.5000/- from Shri T.

Tlkhak, GB of Namchik village under Jairampur circle of Changlang district. They also demanded Rs.100/- from each family in Changlang district as tax. In Alma, Namgoi, Longkey and Nampong areas of Changlang district, the NSCN(K) activists led by Shri Arun Jugli collected Rs.300/- per house.

(iii) On 13.6.2001, at about 1115 hours, ten Assam Rifles personnel (including on e JCO) while escorting a serious patient oon a 2 ton vehicle from Changlang to Jairampur were attacked by militants with small fire arms and grenades at about 1 km away from Namdang check-gate towards Margherita (Assam). In the ambush nine Assam Rifles personnel died on the spot and the JCO was grievously injured.

(iv) On 12.7.2001 at about 0010 hours, the Under Grounds ambushed CRPF personnel near Gas Agency, Khonsa in Tirap District killing Head Constable Amir Hussain and Constable Lakhir Singh on the spot and leaving Constable Din Mohammed seriously injured.

(v) On 20.7.2001, the Undergrounds ambushed CRPF personnel in between Ponkong and Sanliam village under Lazu circle of Tirap district in which 6 CRPF personnel were killed and six other seriously injured.

(vi) The NSCN(IM) has demanded money from the local leaders and petty contractors of Longding-Pumao area at the rate of Rs.5000/- each. The tea garden owners of Kanubari were also asked to pay 3% of their sales.

(vii) On 18.7.2001, the NSCN(K) activists abducted Shri Wanglong Wangien, Tujen Bihani and Wangjeih Wangjen from Luaksirn village under Kanubari circle of Tirap district and demanded Rs.1 lakh as ransom. Later the Luaksim villagers reportedly paid Rs.15,000/- and got the abducted person released from Nokyang village of Nagaland.

(viii) It is reported that NSCN(IM) activists served demand notices t PWD, RWD and PHED authorities of Miao and Kharsang area of Changlang district to pay Rs.3 lakhs each. They also demanded 24% of yearly service tax at rate of 2% per month from the employees of Agriculture department.

(ix) On 25.7.2001, about six NSCN(IM) activists visited Indian Oil Company at Manabhum under Diyum circle of Changlang district and demanded Rs.10,000/- from each employee with the warning not to report the matter to security forces.

4. The State Government have also reported, that with the limited availability of State police force, it is not possible to fully control the law and order situation in these two districts and have sought the help of Army/pare military forces, to control the situation. 5. In the light of the above, the Central Government is of the opinion that the situation in Tirap and Changlang districts is disturbed and that conditions exist for the use of armed forces in aid. of 'civil power. It is, therefore, decided that the notification dated 17th September 1991 of .this Ministry mentioned above, will remain in force upto 31' March 2002 unless vvithdravvn earlier.

The situation was last reviewed in September. 2001 and vide Notification bearing SO 932(E), dated 18-9-2001, it was decided to extend the tenure of the declaration of Tirap and Changlang as 'disturbed areas' upto 31-3-2002. A further review of the law and order situation in Tirap and Changlang districts has since been undertaken. The State Government has intimated about reports on law and order detailing a number of encounters between Security Forces and NSCN(IM), NSCN(K), distribution of subversive literature by undergrounds attempts at extortion and seizure of Arms and Ammunition from the undergrounds during the period under review.

4. The State Government have reported, that in Tirap and Changlang the Army and Para Military Forces are engaged in counter insurgency operations to flush out the militants. The State Government have also recommended that these two districts be continued to be declared as disturbed.

5. In the light of the above, the Central Government is of the opinion that the situation in Tirap and Changlang districts is disturbed and that conditions exist for the use of anned forces in aid of civil power. It is, therefore, decided that the notificaion dated 17th September, 1991 of this Ministry mentioned above, will remain in force upto 30th September. 2002 unless withdrawn earlier.

These two districts of Aninachal Pradesh continue to be in the grip of insurgency. The insurgent outfits have been indulging in large-scale extortion besides resorting to acts of violence directed against the security forces. The sustained counter-insurgency operation by the Security Forces and steps taken by the State Government has shown improvement. The Central Goverment feels that these efforts not only need to be sustained but intensified;

The situation was last reviewed in September, 2002 and vide Notification bearing S.O. 1050(E) dated 30-9-2002, it was decided to extend the tenure of the declaration of Tirap and Changlang as 'disturbed areas' upto 31-3-2003. A further review of the law and order situation Tirap and Changlang districts has since been undertaken. The State Government has in their report detailed a number of encotuners between Security Forces and NSCN(IM), NSCN(K), large-scale extortion, acts of violence by these insurgent outfits and seizure &farms and ammunition during the.period under review. The State Government has reported that the Army, CPMF and Civil forces are jointly carrying counter insurgency operations to flush out militants from Ti rap and Changlang. The State Government have, therefore, also recommended that these two districts be continued to be declared as disturbed.

4 In the light of the above, the Central Government is of the opinion that the situation in Tirap and Changlang districts is disturbed and that conditions exist for the use of armed forces in aid of civil power. It has, therefore, been decided that the notification dated 17th September, 1991 of this Ministry mentioned above, will remain in force upto 30th September, . 2003 unless withdrawn earlier.

These two districts of Arunachal Pradesh continue to be in the grip of insurgency. The insurgent outfits have been indulging in large-scale extortion besides resorting to acts of violence directed against the security forces. The sustained counter-insurgency operation by the Security Forces and steps taken by the State Government has shown improvement. The Central Government feels that these efforts not only need to be sustained but intensified;

Though the security situation in these two achal Pradesh is under control due to sustained counter-insurgency operations by the Security taken by the State Government, the Central Government feels that these efforts not only need to be tensified.

The two factions ofNational Socialist Council f Nags land (NSCN) and United Liberation Front of Assam (TJLFA) continue to extort and indulge in acts of violence eluding those directed against the security forces. Intergroup rivalry between the factions of NSCN has also vitiated the aw and order situation in these two districts. Therefore, effective counterinsurgency operation against the insurgent utfits iin these two districts of Arunachal Pradesh is necessary.

4. The Central Government is, therefore, of the opinion that the situation in Tirap and Changlang districts is isturb and that conditions exists for the use of the Armed Forces in aid of civil power. It has, therefore, been decided that e noti cation dated 17th September, 1991 of this Ministry mentioned above, will remain in force up to 30th September, 2006 nless 4ithdrawn earlier.

These Under Ground outfits also use these two districts as transit mate for transshipment of arms and ammunitions procured from other Countries to neighbouring States of Assam and Nagaland.

The cadres of United Liberation Front of Assam (ULFA) have been using the Changlang district as corridor for to and fro movement from India to Myanmar.

The Central Government is. therefore, of the opinion that the situation in Tirap and Changlang districts is disturbed and the conditions exist for the use of the Armed Forces in aid of civil power. Jt has, therefore, been decided that the notification dated 17th September, 1991 of this Ministry mentioned above, will remain in force upto 30th September, 2007, unless withdrawn earlier.

2. Supreme Court of India vide their judgment dated 27th November, 1997 in Writ Petition ( Criminal) No. 550 of 1982 directed, inter alia, that declaration of 'disturbed areas' under the aforesaid Act should be reviewed periodically.

Accordingly, the declaration of Tirap and Changlang districts of Arunachal Pradesh as distrubed areas' was last reviewed in March, 2007 and tenure of declaration of these two districts of Arunachal Pradesh as 'disturbed areas' was extended up to 30th September, 2007.

3. A further review of the law and order situation in these two districts has since been undertaken. National Socialist Council of Nagaland (Issac/Moviah) and National Socialist Council of Nagaland (Khaplang) and United Liberation Front of Assam (ULFA) continue to indulge in extortion and acts of violence including those directed against Security Forces in these two districts of Arunachal Pradesh. These outfits have also been using these two districts for transhipment of arms and ammunition from neighbouring countries. Intense inter-group rivalry between the two factions of National Socialist Council of Nagaland (NSCN) has also vitiated the law and order situation in these two districts.

4. The Central Government is, therefore, of the opinion that the situation in Tirap and Changlang districts of Arunachal Pradesh is disturbed and the conditions exist for the use of the Armed Forces in aid of civil power. It has, therefore, been decided that the notification dated 17th September, 1991 of this Ministry mentioned above, will remain in force up to 31st March, 2008, unless withdrawn earlier.

During 2009 (Upto 15th August, 2009) there have been 34 incidents of violence relating to abduction, assault, intergroup clash, killing etc. in these two districts. The National Socialist Council of Nagaland (Issac!Moviah) and National Socialist Council of Nagaland (Khaplang) continue to engage themselves in extortions and acts of violence as a result of which fear psychosis prevails in these two districts. Intense inter-group rivalry between the two factions of National Socialist Council of Nagaland has further vitiated the law and order situation in these two districts. These two districts are also being used by cadres of National Socialist Council of Nagaland (Khaplang) and United Liberation Front of Asom as transit routes to their camps in Myanmar.

1431. 74Z-1,74."T 741.1":1 MINISTRY OF HOME A WA IftS NOTIFICATION New Delhi, the 31st March, 2010 S.O. 725(E).-Tirap and Changlang districts of Arunachal Pradesh were declared as disturbed areas under the Armed Forces (Special Powers) Act, 1958 w.e,f.

17th September, 1991 vide this Ministry's Notification No. 603(E) dated 17th September, 1991. as, in the opinion of the Central Government, the said districts were in such a disturbed and dangerous condition that the use of armed forces in aid of civil power was necessary.

2. The declaration of Tirap and Chan lung districts of Arunachal Pradesh as 'disturbed areas' was last reviewed in September. 2009 and the tenure of declaration of these two districts of Arunachal Pradesh as 'disturbed areas' was extended up to 31st March. 2010, 1186 G1/20 i0

3. l'he law and order situation in these two district has been reviewed frther. Various Underground outfit continue to engal.)e in extortion, kidnapping and abduct lot in these two districts. The intense rivalry between militan outfits also continues to vitiate the law and order situation in these two districts. Cadres of United Liberation Front o Asom (f..11.FA) reportedly use these districts for transit to their camps in Myanmar. Occasional movement of militants outfits operating in other areas have also been noticed in Changlang District of Arunachal Pradesh.
