1. Short title and commencement.— (1) These rules may be called the Ministry of Defence, Armed Forces Tribunal, Group‘C’ posts( Recruitment and Conditions of Service) Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. — These rules shall apply to the posts specified in the column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale .— The number of the said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to said posts shall be as specified in columns (5) to (13) of the said Schedule.

5. Absorption of employees appointed on deputation. —(1) Notwithstanding anything contained in the provisions of these rules, the persons holding the posts of Upper Division Clerk, Stenographer Grade II, Lower Division Clerk cum Hindi Typist, Data Entry Operator, Staff Car Driver, Despatch Rider, Library Attendant and Multi Tasking Staff (Peon-cum-helper) on the date of commencement of these rules on deputation basis and who fulfill the qualifications and experience laid down in these rules and who are considered suitable by the Departmental Promotion Committee, shall be eligible for absorption in the respective grade subject to the condition that such persons exercise their option for the absorption, and that their parent Departments do not have any objection to their being absorbed in the Tribunal.

(2) The seniority of the officers mentioned in sub-rule (1) shall be determined with reference to the dates of their regular appointment to the posts held by them in the parent Department.

(3) The suitability of persons for absorption may be considered by a Departmental Promotion Committee.

6. Conditions of service.—The conditions of service of the said posts of the Tribunal in matter of allowances, leave, provident fund, age of superannuation, pension and retirement benefits, medical facilities and other conditions of service, shall be regulated in accordance with such rules as are for the time being applicable to officers belonging to Group C posts of the Central Government of the corresponding pay band and grade pay or pay scale.

7. Procedure for direct recruitment .— The following procedure shall be followed for making direct recruitment to the posts specified in the said Schedule namely:-

(a) the Tribunal shall invite applications for the said posts through an advertisement on all India basis;

(b) the applications received shall be screened for eligibility by a Screening Committee constituted by the Chairperson of the Tribunal;

(c) if the number of applications received is large, then the Selection Committee may recommend a preliminary writtern examination;

(d) the recruitment shall be done in interview by a Selection Committee comprising of:-

(i) Chairperson or Judicial Member nominated by the Chairperson of the Tribunal -Chairman;

(ii) Administrative Member to be nominated by the Chairperson of the Tribunal - Member;

(iii) Principal Registrar of the Tribunal - Member.

8. Procedure for appointment on deputation . — The following procedure shall be followed for making appointment on deputation to the said posts, namely:—

(a) the Tribunal shall invite applications for the said posts through an advertisement on all India basis;

(b) the applications received thereof shall be screened for eligibility by a Screening Committee constituted by the Chairperson;

9. Disqualifications .—No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living or

(b) who, having a spouse living, has entered into or contracted marriage with any other person, shall be eligible for appointment to any of the said posts.

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

10. Power to relax.— Where the Chairperson, Armed Forces Tribunal is of the opinion that it is necessary or expedient so to do, he may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

11. Saving.— Nothing in these rules shall affect reservation, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes , Exservicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

For Ex-servicemen: Deputation/reemployment – The Armed Forces personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered, who shall, if selected, be given deputation terms up to the date on which they are due for release from the Armed Forces, and thereafter they may be continued on re-employment.

Note:1. Period of deputation including period of deputation in another ex-cadre post, held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not to exceed three years.

Note: 2. The maximum age limit for appointment by deputation or absorption shall be not exceeding 56 years as on the closing date of the receipt of applications.

Note: 3. For the purpose of appointment on deputation or absorption, the service rendered on a regular basis by an officer prior to 1st January,2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission, except where there has been merger of more than one prerevised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the posts for which that grade pay or pay scale is the normal replacement grade without any upgradation.
