These regulations shall cover and apply to:
l ' Foreign universit ies / institutions interested in imparting technical education in India leading to award of diplomas and degrees incruding post graduate and \ doctoralprogrammes.
2' Indian university / institution andl or private educational service interested ih imparting technicar education leading to the award of diplomas of a foreign university through coilaborative arrangements.
3. The existing collaborative agreements / arrangements with Universitievlnstitutions offering technicar education in India.
4' Any other educational activity carried out in tndia, in any manner, by the foreign universit ies/ insti tut ions, as may be decided by the council to bring such activit ies under these Regulations.
on commencement of these Regulations no foreign university/ insti tut ions shall establish /operate i ts educational activity in India leading to award of diplomas/ degrees including post graduate and doctoral without the expressed permission /approval of the Council.
Delinit ions :
Unless the context othentise requires a' AICTE means the All India council for Technical Education established under section 3 of the AICTE Act (52 of 1987) by the parlianrent for co-ordinated development of technical education in the country b' NBA nteans the National Board of Accreditation, authorized body under AICTE Act to accredit programmes of technical education imparted by universities / institutions in India and recommend recognition/de-recognition of institution or the programme.
c' All other words and expressions used herein and not defined above but defined in the AICTE Act shall have the meaning as assigned to it in AICTE Act (52 of I e87) .

l: Any application to AICTE by a Foreign university / Institution seeking to operate in India either directly or tkough collaborative alrangement with an Indian University / Institution or a private educational service provider must be accompaniedbyaNo-object ioncert i f icateiszuedbytheconcernedEmbassyin .lndia. The Missions of the concerned countries shall be required to certify ' genuineness of the educational institutions of their respective countries willing to offer studY Programmes in India' The concerned Foreign university / Institution shall submit a Detailed Project Report (DPR) to AICTE alongwith application in a prescribed fornr' giving details regarding infrastructure facilities, facilities available for instruction' faailty' prescribed fee, courses, curricula, requisite funds for operation for a minimum period of three years and other terms and conditions of collaboration' if any' alongwith relevant details' ^att i6utt uft., receiving the application alongwith DPR"'acknowledge the receipt of the application. The proposal shall then be processed internally and any deficiency shall be cornmunicated a.nd aclclitional documents. if anv required' shall be asked for.
once the AICTE.is convinced that the propbsal is complete in all respects, a standing committee nominated by the Council shall consider the proposal and invite presentation, if warranted'
5. On the recommendations of the Standing Committee, the Chairman' AICTE shall nominateanExpertCommit teetovis i t theinst i tut ionandassessthecompl iance of minimum Norms and Standards in respect of infrastructural and instructional facilities to start programmes of technical education and training'
6. The council shall consider the recomtnendations of the standing cornmittee and the Expert committee in regard to the quality of education, overall merit of the proposal, credibility of the programme provider of the foreign country vis-ir-vis the institution intending to start the programmes in India and decide conclusively on the application regarding grant of approval or otherwise for registration'

a. Refusal / withdrawal for grant of visa to employees/teachers of the said foreign university / insti tut ion.
b. Stop repatriat ion of funds from India to honte country' c. Forbid the advert isement of said university / insti tut ion in print or visual media.
Withdrarvnl :Once the regil trat ion of a Foreign University/ lnsti tut ion is rvithdrawn, the f t Council shali make attemptS in co-ordination rVith concernbd State Govt ' to rdlal locate the studehts etrrol led into such prolrammes to other approved insti tut ions of tne eouncil .
The foreign university/ insti tut ion in such cases, shall have to return the entire fee collected from such students to the al lottee insti tut ions in rvhich sugh stUdents are accomnrodated. Such foreign institutions shctll not be allotve'd to open any other centre/institution of enter into a collaborative arrangenlent in India.
Alnual Rellorts : The Foreign univers{ty / insti tut ion shall 'submit an annual report giving detai ls of the number of students admitted, programmes conducted, total fee lollected; alrouht ransferred to parent country, investment made, number of students awarded degree, diploma and any such information that AICTE may ask for' I . terpretnt io l : I f any quest io ; ar ises ns to the in terpret r t ion of these regulat ions t l re sante s l r : r l l be decided by the AICTE.
The AICTE shall have power to issue any clarif ications to remove any doubt, which may arise in regard to implernentation of these regulations.
