GOVERNMENT OF ODISHA FISHERIES & ARD DEPARTMENT NOTIFICATION Bhubaneswar, Dated thefijfi day of March, 2019 No.13V—01l2019-2 gfi IFARD: In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Odisha hereby makes the following rules further to amend the Odisha non—Gazetted Veterinary Technical Service (Recruitment and Conditions of Service) Rules, 1983, namely:—

1. Short Title and Commencement:— (1) These rules may be called the Odisha Veterinary Technical Service Group “C” (Recruitment and Conditions of Service) Amendment Rules, 2019.

(2) They shall come into force on the date of their publication in the Odisha Gazette.

2. In the Odisha non—Gazetted Veterinary Technical Service, (Recruitment and Conditions of Service) Rules, 1983 (hereinafter referred to as the said rules), in the preamble,—

(i) the words and expression “non—Gazetted” shall be omitted and (Ii) after the words and comma, “Technical Service,” and before the word “namely”, the word, letter and comma “Group ",’C shall be inserted.

3. In the said rules, in rule 1, in sub rule (1) in short titIe,—

(i) the words and expression “non—Gazetted,” shall be omitted and (Ii) after the words and comma, “Technical Service,” and before the bracket and words “(Recruitment and Condition of Service)”, the comma, word and letter, “Group “C , shall be inserted.

4. In the said rules, for rule 2, the following rule shall be substituted, namely:— . “2. Definitions,~ (1) In these rules unless the context othenNis‘e requires,—

(a)“Board” means the Selection Board constituted under rule 8 (1)

(b)“Commission” means the Odisha Sub—ordinate Staff Selection Commission;

(c)“Committee” means Departmental Promotion Committee constituted under rule 13.

(d)“Director” means Director of Animal Husbandry and Veterinary Services, Odisha;

(e)“Government” means the Government of Odisha;

(f)“Ex—Servicemen” means the person as defined in the Odisha Ex—Servicemen (Recruitment to State Civil Services and Posts) Rules, 1985;

(g)“Persons with disabilities” means persons who have been granted with disability certificates by competent authority as per the provisions of the Rights of Persons with Disability Act, 2016;—

(h)“Scheduled Castes and Scheduled Tribes” shall have reference to the Scheduled Castes and Scheduled Tribes specified in the Constitution (Scheduled Castes) Order, 1950 and the Constitution (Scheduled Tribe) Order, 1950, as the case may be, made under Article 341 and 342 of the Constitution of India, respectively;

(i)“SEBC” means the Socially and Educationally Backward Classes of citizens defined as Backward Classes and referred to in clause (a) of Section 2 of the Odisha State Commission for Backward Classes Act, 1993;

(j)“Service” means the Odisha Veterinary Technical Service, Group—‘C’;

(k)“Sportsmen” means persons who have been issued with identity card as sportsmen by the Director, Sports; as decided by the Government from time to time;

(I)“Veterinary Technicians” means Veterinary Technician including Enumerator, Poultry Extension Overseer, Milk Analyst, Stockman Supervisor, Livestock Census Supervisor and such other posts to be created in the cadre of Veterinary Technician; and

(m)“SeIeot List” means the list of the candidates approved by the appointing authority containing the names of persons considered suitable in the order of merit for appointment as recommended by the Commission; and

(n)”Year” means the calendar year.

(2) All other words and expressions used in these rules but not specifically defined shall, unless the context othenNise requires, have the same meaning as respectively assigned to them in the Odisha Service Code.

. In the said rules, in rule 4, for clause (a), excluding the proviso thereto the following clause shall be substituted, namely:— “(a) in respect of posts of Livestock Inspector, 90 (ninety) percent of the vacancies shall be filled up by way of direct recruitment by the Commission to be held once in

(3) a year and the remaining 10 (ten) percent of the vacancies shall be filled up by way of promotion from among Group—D field employees, who have passed H.S.C Examination from a recognised Educational Institution / Board and have worked at Ieast for a period of two years in the treatment of animals and must have possessed eligibility criteria and the physical standards as prescribed in clause (f) of rule 6.”

6. In the said rules, in rule 6,——

(a) for the provisos to clause (d) the following provisos shall be substituted, namely:— “Provided that out of total vacancies meant for selection as Livestock Inspectors through direct recruitment in a district, 60% of the vacancies shall be filled up from among the candidates who have passed +2 Vocational Courses. in the field of Animal Husbandry or Dairy or PouItry or Meat or Animal Production or +2 Science from a recognised Educational Institution or Board or Council or University and remaining 40% of the vacancies shall be filled up from among Gomitra Candidates who have passed +2 Science or +2 Vocational Courses in the allied Animal Husbandry activities with satisfactory performance in Artificial Insemination (A. I.) activities for three years under National Project for Cattle and Buffalo Breeding (NPCBB) in the manner provided in clause (0) as applicable to them following the reservation principle and other norms of recruitment rule. There shall be no career assessment for the above candidates for the said selection.

Provided further that after exhaustion of othenNise eIigibIe Gomitra candidates by way of selection against the district wise vacancies in accordance with the prevalent Recruitment Rules and Reservation principle, the vacant posts of Livestock Inspector shall be filled up only through direct recruitment from among eIigibIe candidates who have passed +2 Vocational Courses in the above allied AnimaI Husbandry activities or +2 Science from a recognised Educational Institution or Board or Council or University.

(b) for clause (h), the following clause and proviso shall be substituted, namely:— “(h) she/he, if married, must not have more than one spouse living:

Provided that the Government may, if satisfied that such marriage is permissible under the personaI law applicable to such pefson or there are other grounds for doing so, exempt any person from the operation of this rule”.

7. In the said rules, for rule 7, the following rule shall be substituted, namely:— “7. Determination of vacancy and submission of requisition.—— (1) The Director shaII determine the number of vacancies preferably in the month of January every year and

(4) submit the requisition to the Commission for direct recruitment after obtaining approval of the Government.

(2) On receipt of the requisitions under sub rule (1), the Commission shall invite applications from the eIigibIe candidates through open advertisement made in two widely circulated Odia daily and in their website for filling up of the vacant posts by direct recruitment. ‘

(3) The date on which and the places at which the written examination to be held shall be as decided by the Commission.

(4) The standard, syllabus and subjects of the examination shall be as decided by the Commission”.

8. In the said rules, for rule 8, the foIIowing rules shall be substituted, namely:— “(8) (1) There shall be a Selection Board comprising the following members for selection of candidates of Group—D employees to undergo Livestock Inspector Training by way of promotion:—

(a) Collector of the concerned District Chairman

(b) A nominee of the Director, Animal Husbandry & Veterinary Services, Odisha, Belonging to Member Odisha Veterinary Service, Group—A (C) District Welfare Officer Member

(d) Chief District Veterinary Officer Member of Concerned District Convenor

(2) The Board shall consider the applications received from Group—D employees and conduct interview and prepare the select list of Group—D employees selected to undergo Livestock Inspector’s Training and furnish the same to the Director for intimating the candidates to join the Training Institute subject to verification of antecedents and submission of certificate of health and fitness from a Medical Officer not below the rank of Assistant Surgeon. The names of such candidates as are adversely reported upon shaII be struck off the list”.

(3) The Director of Animal Husbandry and Veterinary Services, Odisha shall take steps to submit a report to Government in the matter of selection of candidates under Sub—ruIe (2) above within a month from the date of interview.

9. In the said rules, in ruIe11,—

(a) for sub—rule (2), the following sub—ruIes shall be substituted, namely:—

(5) “(2) The duration of the Training Course shall be of two completed years, out of which, theoretical training shall be for 18 (Eighteen) months and practical training in Farms and Veterinary Institutions shall be for 6 (Six) months.

(b) for sub~ruIe (5), the following sub—rules shall be substituted, namely:— “(5) After completion of training (both theoretical and practical), all the trainees shall have to appear the examination which shall be conducted by Orissa University of Agriculture and Technology”. Upon successful completion of training, certificate to the Livestock Inspector trainees shall be issued by Orissa University of Agriculture and Technology.

(c) for sub—rule (6), the following sub—ruIes shall be substituted, namely:—— “(6) A Departmental candidate, who fails to complete the training successfully in one chance shall be given two more chances to complete the training successfully.

(6a) No enhanced remuneration or increment shall be allowed untill he/she comes out successful in that examination. In case, a departmental candidate fails to complete the training successfully within three chances, he/she shaII be reverted to his parent post of Group—D cadre.

(6b) A direct candidate undergoing Livestock Inspector training, who fails to complete the training successfully in one chance, shall be given two more chances to complete the training successfully.

(6c) No stipend shall be allowed for the said next two chances of training. In case he/she fails to complete the training successfully within three chances, he/she shaII not claim for appointment to the post of Livestock Inspector”.

10. In the said rules, after rule 19, the following rules, shall be inserted, namely:— “20. Other Conditions of Service— The conditions of service in regard to matters not covered in these rules shall be the same as are or as may from time to time be prescribed by the State Government.

21. Relaxation— When it is considered by the Government that it is necessary or expedient so to do in the public interest, it may, by order, for reasons to be recorded in writing, relax any provision of these rules in respect of any class or category of the employees”. i By Oader of the Governor mud,” (VISHAL GAGAN) Commissioner—cum—Secretary to Government
