(xiv), उपधारा (1) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड
(ii) में प्रकाजित, का.आ.सं. 668 (अ), तारीख 21 फरवरी, 2017 के द्वारा प्रकाजित पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर्, भारत सरकार की अजधसूचना द्वारा जनम्नजलजखत संिोधन करती ह,ै अथाात:्- उि अजधसूचना में-
(i) पैरा 2 में, उप-पैरा (1) के स्ट्थान पर, जनम्नजलजखत उप-पैरा को रखा िाएगा: अथाात:्- “(i) राज्र् सरकार, पाररजस्ट्थजतक संवेिी िोन के प्रर्ोिनों के जलए, इस संिोजधत अजधसूचना के प्रकािन से िो वर्ा की अवजध के भीतर, स्ट्थानीर् लोगों के परामिा से और इस अजधसूचना में िी गई ितों का पालन करते हुए एक आंचजलक महार्ोिना तैर्ार करेगी’.
(ii) पैरा 4 में,- स.ं 2024] नई दिल्ली, बुधवार, मई 3, 2023/विैाख 13, 1945 No. 2024] NEW DELHI, WEDNESDAY, MAY 3, 2023/ VAISAKHA 13, 1945 सी.जी.-डी.एल.-अ.-04052023-245692 CG-DL-E-04052023-245692 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) 'जनगरानी सजमजत' िीर्ाक और उससे संबंजधत प्रजवजिर्ों के स्ट्थान पर जनम्नजलजखत को रखा िाएगा, अथाात:्- “5. जनगरानी सजमजत.- केन्द्रीर् सरकार एक जनगरानी सजमजत का गिन करेंगी जिसमें नीचे िी गई सारणी में जनर्िाि जनम्नजलजखत व्यजि सजममजलत होंगे, अथाात्: - क्र. स. व्यजिर्ों के नाम पि
(i) कलेक्टर, बुलिाना पिेन, अध्र्क्ष
(ii) पर्ाावरण जवभाग के एक प्रजतजनजध, महाराष्ट्र सरकार। पिेन, सिस्ट्र्
(iii) रािस्ट्व जवभाग का एक प्रजतजनजध, महाराष्ट्र सरकार। पिेन, सिस्ट्र्
(iv) क्षेत्रीर् अजधकारी, महाराष्ट्र प्रिरू्ण जनर्ंत्रण मडंल। पिेन, सिस्ट्र्
(v) प्रत्र्ेक तीन वर्ा में समर्-समर् पर राज्र् सरकार द्वारा नाजमत पाररजस्ट्थजतकी एवं पर्ाावरण के के्षत्र में एक जविेर्ज्ञ। सिस्ट्र्
(vi) पर्ाावरण (जवरासत संरक्षण सजहत) के के्षत्र में कार्ारत गैर-सरकारी संगिन का एक प्रजतजनजध राज्र् सरकार द्वारा समर्-समर् पर प्रत्र्ेक तीन वर्ा में नाजमत दकर्ा िाएगा। सिस्ट्र्
(vii) वररष्ठ नगर जनर्ोिक अजधकारी, बुलिाना पिेन, सिस्ट्र्
(viii) उप वन संरक्षक, बुलिाना (प्रािजेिक) पिेन, सिस्ट्र् सजचव (ख) िीर्ाक, 'जनिेि और िता' और उससे संबंजधत प्रजवजिर्ों के स्ट्थान पर जनम्नजलजखत को रखा िाएगा, अथाात:्- 5ए. जनगरानी सजमजत के कार्ा. –
(1) जनगरानी सजमजत, वास्ट्तजवक स्ट्थल-जवजिि जस्ट्थजतर्ों के आधार पर उन दक्रर्ाकलापों की छानबीन करेगी िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006, और पर्ाावरण, वन मंत्रालर् में केन्द्रीर् सरकार को जनर्िाि उसके पैरा 4 के अधीन सारणी में जनर्िाि जनजर्द्ध दक्रर्ाकलापों को छोड़कर, पाररजस्ट्थजतक संवेिी िोन में आत ेहैं और र्थाजस्ट्थजत, िलवार् ुपररवतान र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण, उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरणीर् मंिूरी के जलए होंगे।
(2) भारत सरकार के तत्कालीन पर्ाावरण एवं वन मंत्रालर् की अजधसूचना क्रमांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 और पाररजस्ट्थजतकी संवेिी िोन में आन े वाल,े उसके पैरा 4 के अधीन सारणी में जनर्िाि जनजर्द्ध दक्रर्ाकलापों को छोड़कर, जनगरानी सजमजत द्वारा वास्ट्तजवक साइट-जवजिि की जस्ट्थजतर्ों के आधार पर िांच की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को जनर्िाि की िाएगी।
(3) जनगरानी सजमजत के सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लंघन करने वाले दकसी भी व्यजि के जवरुद्ध जिकार्त ििा करन ेके जलए सक्षम होंगे।
(4) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेर्ज्ञों, उद्योग संघों के प्रजतजनजधर्ों र्ा संबंजधत जहतधारकों को अपने जवचार-जवमिा में सहार्ता के जलए िारी करने के आधार पर अपेक्षा के आधार पर आमंजत्रत कर सकती ह।ै
(5) जनगरानी सजमजत प्रत्र्ेक वर्ा 31 माचा को अपन ेदक्रर्ाकलापों की वार्र्ाक कारावाई ररपोटा उस वर्ा के 30 िून तक इस अजधसूचना को राज्र् के मखु्र् वन्द्र् िीव संरक्षक को उपाबंध-IV में जवजनर्िाि प्रोफामाा के अनुसार प्रस्ट्तुत करेगी।
(6) केन्द्रीर् सरकार अपन ेकार्ों के प्रभावी जनवाहन के जलए जनगरानी सजमजत को जलजखत रूप में ऐसे जनिेि िे सकती ह,ै िैसा वह उजचत समझे। [फा. सं. 25/43/2015-ईएसिेड-आरई] डॉ. एस. करकेट्टा, वैज्ञाजनक ‘िी’ रटप्पण: मूल अजधसूचना भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में अजधसूचना संख्र्ा का.आ.
668(अ), तारीख 21 फरवरी, 2017 के द्वारा प्रकाजित की गई थी;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 3rd May, 2023 S.O. 2112(E).—In exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsections (2) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide notification number S.O. 668(E), dated the 21 st February, 2017, namely:- In the said notification, -
(i) in paragraph 2, for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:- “(i) The State Government shall, for the purposes of the Eco-sensitive Zone, prepare a Zonal Master Plan, in consultation with local people and adhering to the stipulations given in this notification for consideration, within a period of two years from the publication of this amendment notification”.
(ii) in paragraph 4,-
(a) for the heading ‘Monitoring Committee’, and entries relating thereto, the following shall be substituted, namely:- “5. Monitoring Committee.- There shall be a committee to be known as Monitoring Committee constituted by the Central Government which shall comprise of the following persons specified in the Table below, namely:- Serial number Name of persons Designation

(ii) A representative of the Department of Environment, Government of Maharashtra.

(v) One expert in the area of ecology and environment to be nominated by the State Government from time to time every three years.

(vi) A representative of a Non-Governmental Organisation working in the field of environment (including heritage conservation) to be nominated by the State Government from time to time every three years.

(vii) Senior Town Planner Officer, Buldana exofficio, Member;
(viii) Deputy Conservator of Forests, Buldana (Territorial) exofficio, Member Secretary.”
(b) For the heading, ‘Terms and Condition’, and entries relating thereto, the following shall be substituted, namely:- “5A. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual sitespecific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1553 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.
(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14 th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis.
(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-IV, appended to this notification.
(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
