In exercise of the powers conferred by Section 15 of the Mines and Minerals (Development and Regulation) Act, 1957 (No. 67 of 1957), the State Government, hereby, makes the following further amendment in the Chhattisgarh Minor Mineral Rules, 2015, namely :- AMENDMENT In the said rules,-

For clause (b) of sub-rule (7) of rule 10, the following shall be substituted, namely:- "(b) completes the prospecting operations in accordance with these rules and establishes the existence of the minerals, such holder shall make an application in Form IX to the Competent Authority for grant of quarry lease within ninety days from expiry of licence period or the such extended period by Director which shall not be more than six months."

(i) in sub-rule (1), for the words "Schedule V and VI respectively, the words "Schedule V" shall be substituted.
(ii) in sub-rule (2), for the words "seven days'', the words "fifteen days" shall be substituted.

(a) fails to complete the prospecting operations in accordance with these rules and terms and conditions of the licence, such holder shall not be eligible for grant of the quarry lease and the Composite license shall expire and the security deposited by the licensee shall be confiscated whole or its part by a written order of the sanctioning authority;

(b) completes prospecting operations in accordance with these rules and terms and conditions of the licence, and establishes the existence of the minerals, such holder shall make an application in Form IX to the Competent Authority for grant of quarry lease within ninety days from expiry of licence period or such period as extended by the Director, which shall not be more than six months:
Provided quarry lease shall be granted for the such area where existence of mineral has been established and necessary for quarry operations and shall not be more than the maximum area for which quarry lease shall be granted under these rules:
Provided further that any additional area, shall be deemed to be surrendered after it is corrected by any holder of the prospecting licence."
4. Rule 19 shall be omitted.
5. Rule 33 shall be omitted.
6. Rule 37 shall be omitted.
7. After sub-rule (5) of rule 38-A, the following shall be added, namely :- "(6) The State Government, upon an application made to it in this behalf at district office by the Central and State government company or corporations or their undertaking for extension of their quarry lease or mining lease, one year prior to their expiry of lease period as per rule 43, for the reason to be recorded in writing, extend the period of lease for further period of twenty years for one time only.
(7) Non refundable fees of rupees fifty thousand in respect of each application under sub-rule (6) shall be paid. The amount of the fee shall be deposited in government treasury in the revenue receipt head as prescribed in sub-rule (3) of rule 31.''
8. In rule 46,-
(i) in sub-rule (1), for the words "Schedule V and VI", the words "Schedule V" shall be substituted.
(ii) in the sub-rule (2) for the words "seven days", the words "fifteen days" shall be substituted.
9. After rule 46, the following shall be added, namely :- "46A. Security Deposit.- (1) Before the execution of quarry lease deed as specified in rule 47 for minerals specified in Schedule I and Part-A of Schedule II, the applicant shall deposit an amount equivalent to five times of the rate prescribed in column (5) of Schedule IV in following revenue receipt head as security deposit and original treasury chalan shall be attached with the lease deed:- 8443 - Civil deposits 101 - Revenue Receipts (Refundable)
(2) Deposits deposited under sub-rule (1), if not forfeited under these rules and there is no other dues against the lessee, then on the expiry or determination of the lease, whichever is earlier, shall be refunded by the Collector."
10. In the rule 51,-
(i) in sub-rule (6), for the words "cumulative period of one year", the words "continuous period of twelve months" shall be substituted.
(ii) in sub-rule (14), for the words "Form-XIV", the words "Form-II of Chhattisgarh Mineral (Mining, Transportation and Storage) Rules, 2009" shall be substituted.
(iii) after sub-rule (14), the following shall be added, namely : - ''(14A) weighing machine shall be established within quarry/mining lease area of those minerals for which royalty has been fixed on per ton basis in Schedule-III, and shall weigh all the said minerals which were excavated in lease area and dispatched from lease area and shall at the close of each day maintain the account of mineral/product raised or sold within 24 hours:

Provided that in special circumstances, the State Government, may with special conditions relax the condition of establishing weighing machine within lease area."
(iv) in sub-rule (26), for the words, figures and punctuations "sub-rule (1), (3), (4), (11), (12) or
(13)", the words, figures and punctuations "sub-rule (1), (3), (4), (11), (12), (13) or rule 24'' shall be substituted.
11. In rule 58,-
(i) in clause (cc) of sub-rule (4), the words and punctuation "for minerals specified in Part A of Schedule II, except mineral specified in serial number (2);" shall be omitted.
(ii) in clause (cc) of sub-rule (4), for the words "Form III B", the words "Form XXII A" shall be substituted.
(iii) in clause (ccc) of sub-rule (4), the words, "for minerals contained in Part A of schedule II except mineral specified in serial number (2);" shall be omitted.
12. After sub-rule (2) of rule 59, the following shall be added, namely : - "(3) In addition to the royalty as specified in sub-rule (2), thirty percent equivalent amount of royalty shall be paid in the contribution fund of the District Mineral Foundation Trust."
13. For rule 60, the following shall be substituted, namely :- "60. Permission for disposal of Minor Minerals obtained during excavation work within Mining Lease area granted under the Mines and Mineral (Development and Regulation) Act, 1957.- The State Government shall grant permission for any minor minerals, obtained during mining operation within mining lease area or as an overburden/ rejects during processing/ beneficiation/crushing and such minor mineral is not going to be utilised for rehabilitation of the land of mining area as per mining plan, for the purpose of utilisation in construction activities or utilisation in other works/sale in view of conservation of mineral on advance payment of royalty and contribution to District Mineral Foundation Trust:
Provided after required testing of samples collected by the departmental officer from the stack of minor mineral from lease area permission shall be given for use/sell as minor mineral for fixed quantity and for fixed period in view of conservation of mineral as per the mining plan/scheme."
14. After rule 75, the following shall be inserted, namely :- "75A. Star rating of Quarry Lease.- The Government shall award the 5 star, 4 star and 3 star rating to the quarry leases after assessing them based on the criteria specified for star rating."
15. In Schedule-V, for the words "Part-A and Part-C of Schedule-I.", the words "Schedule-I" shall be substituted.
16. Schedule-VI shall be omitted.
17. For the proviso of clause (1) of Part (IV) of Form-IV, the following shall be substituted, namely: - "Provided that sanctioning authority is satisfied that licensee/ licensees has submitted an application in Form-IX to the Competent Authority for grant of quarry lease within ninety days of the expiry of licence, or abandonment of operations or termination of the license, which is earlier or such period as extended by the Director, which shall not be more than six months and carried out the operations for establishing the mineral deposit in the area, has not violated any terms and conditions of composite license, and is illegible person for grant of quarry lease."
18. After clause (7) of Part-II of Form-IV A, the following shall be added, namely :- "(7A). Forfeiture and adjustment of performance securities. –
(i) As per the provision of rule 13, demand draft of Rupees................ or a bank guarantee valid for three years presented as performance security, the bank guarantee shall be extended from time to time during the entire lease period. There will be no interest on the performance securities.

(ii) In case of grant of the mining/quarry lease after the prospecting work, the performance security may be adjusted for mining/quarry lease, otherwise it will be refunded.
(iii) After giving opportunity to remedy the breach in the case of breach of rules and terms and conditions of the agreement, forfeit the whole or part of the performance security, as the Competent Authority may deem fit."
19. For the proviso of clause (1) of part (iv) of Form-IV-A, the following shall be substituted, namely : - "Provided that sanctioning authority is satisfied that licensee/ licensees has submitted an application in Form -IX to the Competent Authority for grant of quarry lease within ninety days of the expiry of licence, or abandonment of operations or termination of the license, which is earlier or such period as extended by the Director, which shall not be more than six months and carried out the operations for establishing the mineral deposit in the area, has not violated any terms and conditions of composite license, and is illegible person for grant of quarry lease."
20. In Important note of Form-VIII, the words ''after expiration of one year from the date of execution of the prospecting license or '' shall be omitted.
21. In Form XIII,-
(i) after clause 15 of Part-VII, the following shall be added, namely : - "15A Forfeiture of performance securities.- (i) As per the provision of Rule 13/46, demand draft of Rupees................ or a bank guarantee valid for three years presented as performance security, the bank guarantee shall be extended from time to time during the entire lease period. There will be no interest on the performance securities.
(ii) In case of grant of the mining/quarry lease after the prospecting work, the performance security may be adjusted for mining/quarry lease, otherwise it will be refunded."
(ii) after sub-clause (i) of clause 19 of Part VII, the following sub-clause shall be added, namely: - "(j) weighing machine shall be established within quarry/mining lease area of those minerals for which royalty has been fixed on per ton basis in Schedule-III, and shall weigh the all said minerals which were excavated in lease area and dispatched from lease area and shall at the close of each day maintain the account of mineral/product raised or sold within 24 hours:
Provided in special conditions, with the consent and recommendation of Director on application with justification of lessee, the State Government, may with special conditions relax the condition of establishing weighing machine within lease area. Mineral cannot be transported from lease area until issuance of relaxation."
(iii) Clause 3 of Part VIII shall be omitted.
(iv) After clause 5 of Part VIII, the following shall be added, namely : - "6 Refund of Performance securities deposits.- On such date as the Collector may elect after the determination of this lease, the amount of the performance security paid or Bank Guarantee, as the case may be, in respect of this lease and not required to be applied to any purpose mentioned in this lease, shall be refunded to the lessee/lessees. No interest shall run on the performance security."
22. Form XIV shall be omitted.
