Naya Raipur, the 8th Apri l 2015 NOTIFICATION No. F 13-73/2011/20-3.- In exercise of the powers conferred by Section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (No. 35 of 2009), the State Government, hereby, makes the following amendment in the Ch hattisgarh Right of Children to Free and Compulsory Education Rules, 20 10, namely:- AMENDMENT In the said rules,- l. After clause (d) of sub-rule (1) of rule 2, the following shall be inserted, namely: - "(d-1) "Entry Point" means a class of school as specified in sub-clause (iv) of clause

(n) of Section 2 of the Act, by whatever name called but which does not include classes after Class-I, and in which a school may give admission."

2. In sub-rule (1) of rule 3, for the words, punctuation and parenthesis "A Sch ool Management Committee (hereinafter in this rule referred to as the said committee) shall be constituted in every school, other than an unaided school, within six months of the appointed date, a n d reconstituted every year", the words, punctuation and parenthesis "A School Management Committee (hereinafter referred to as committee) shall be constituted in every school within a period of six months from the date appointed for every school, other than a n unaided school and school defined in sub­ clause (ii) and (iv) of clause (n) of Section 2 of the Act, and shall be reconstituted in every two and half year" shall be substituted.

After sub-rule (4) of rule 7, the following shall be added, namely :- "(S) (a) School specified in sub-clause (ii) and (iv) of clause (n) of Section 2 of the Act shall give admission to children belonging · to weaker section and disadvantaged group in the neighborhood at each entry point to a m inimum 448 (2) of twenty-five per cent of the total strength of that class and shall provide free and compulsory primary education, till its completion:

Provided that the calculation of the above reservation shall be made on the basis of total number of seats offered by the institution at each entry point and where any school imparts pre-school education then the provisions of this clause shall also apply for admission to such pre-school education:

Provided further that a child belonging to local area shall be admitted to the schools. All available seats of Government aided and unaided schools shall be combined together in a pool. The process of selection shall be made in a fair and transparent manner, as specified by the Government.

(b) If selection of a child is made against a reserved seat and he refuses or does not get admission for whatever reasons it may be, then he shall not be considered for selection in the said category.

(c) Any school as specified in sub-clause (ii) and (iv) of clause (n) of Section 2 of the Act cannot give admission directly on its own:

Provided further that if seats are vacant against the reserved seat in private school, after the last date for admission i.e. 15th June, then it shall be deemed to be de-reserved after seven day s as declared under the Right of Children to Free and Compulsory Education Act, 2009 (No. 35 of 2009) by the Appropriate Authority.

(d) Any school failing to furnish information regarding seats available at entry point and at higher classes, in which open admission is granted, shall be liable to be punished.

(e) After the admission of children in schools on reserved seats on the basis of figure recorded at entry point, it is found that strength of the class is less than the seats provided by the school, in that case school shall be entitled for reimbursement of the students fees on the basis of the actua l enrollment and it shall be the responsibility of school to provide free and compulsory education to the children admitted the above reserved percentage till the completion of their primary education.

(f) For the matter related to admission, the District Education Officer shall be the nodal officer and the entire process shall be completed from 1st June to the 15th June of every year."

4. After sub-rule (5) of rule 10, the following shall be added, namely:- "(6) Minimum number of working days/teaching hours in an academic year shall be 200 days and 800 teaching hours for class one to class fifth and 220 days and 1000 teaching hours for class sixth to class eighth.

(7) Any violation of minimum working day s and teaching hours by school shall be liable to be punished."

5. After sub-rule (2) of rule 12, the following shall be added, namely: - "(3) (a) There shall be a State level committee, as specified by the State Government which shall determine the extent of reimbursement of expenditure of every child under the said Act.

(b) Such assessment shall be done at the interval of every three years."

6. After rule 30, the following shall be added, namely:- "31. Power to remove difficulties.- If a ny difficulty arises in giving effect to the provisions of this rule, the State Government may, by order, published in the Official Gazette, make such provisions not inconsistent with the provisions of this rule, as may appear to be necessary for removing such difficulty."
