और कें रीय सरकार की यह राय ह ैदक ईि ऄजधसूचना का संिोधन करना लोकजहत में अवश्यक और समीचीन है;
और पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 का ईप-जनयम (4) यह ईपबंध करता ह ै दक िब भी कें रीय सरकार को यह प्रतीत होता ह ै दक ऐसा करना लोकजहत में है, तो आसके जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईप-जनयम (3) के खंड (क) के ऄधीन नोरिस की ऄपेक्षा से ऄजभमुजि दी िा सकती है;
और केन्द्रीय सरकार की यह राय ह ै दक ऄजधसूचना संखयांक का.अ. 891(ऄ), तारीख 20 माचा, 2017 द्वारा संिोधन करन ेके जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के खंड (क) के ऄधीन नोरिस की ऄपेक्षा से ऄजभमुजि दनेा लोकजहत में ह;ै ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (4) के साथ परित पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की भारत के रािपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) में संखयांक का.अ. 891 (ऄ), तारीख 20 माचा, 2017 द्वारा प्रकाजित ऄजधसूचना, में जनम्नजलजखत संिोधन करती ह,ै ऄथाात:्- स.ं 2044] नइ ददल्ली, बुधवार, मइ 29, 2024/ज् यषे् ि 8, 1946 No. 2044] NEW DELHI, WEDNESDAY, MAY 29, 2024/JYAISHTHA 8, 1946 सी.जी.-डी.एल.-अ.-30052024-254434 CG-DL-E-30052024-254434 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ईि ऄजधसूचना में, पैरा 5 और 6 के स्ट्थान पर, जनम्नजलजखत परैा रखे िाएंगे, ऄथाात:् - “5. जनगरानी सजमजत. – कें रीय सरकार जनम्नजलजखत व्यजियों से जमलकर एक जनगरानी सजमजत का गिन करती है, ऄथाात:् -
(i) अयुि, जमिाापुर ऄध्यक्ष, पदेन;
(ii) जिलाजधकारी, सोनभर का एक प्रजतजनजध सदस्ट् य, पदेन;
(iii) जिला मजिस्ट्रेि, जमिाापुर का एक प्रजतजनजध सदस्ट् य, पदेन;
(iv) क्षेत्रीय ऄजधकारी, ईत्तर प्रदेि प्रदषूण जनयंत्रण बोडा, सोनभर या जमिाापुर सदस्ट् य, पदेन;
(v) क्षेत्र का ज्येष्ठ नगर जनयोिक सदस्ट् य, पदेन;
(vi) ईत्तर प्रदेि सरकार द्वारा प्रत्यके तीन वषों में समय-समय पर नामजनर्ददष्ट दकए िाने वाला पाररजस्ट्थजतक और पयाावरण के क्षेत्र का एक जविेषज्ञ सदस्ट् य;
(vii) ईत्तर प्रदेि सरकार द्वारा प्रत्यके तीन वषों में समय-समय पर नामजनर्ददष्ट दकए िाने वाला गैर-सरकारी संगिन का एक प्रजतजनजध [िो पयाावरण और जवरासत के क्षेत्र में काया कर रहा हो] सदस्ट् य;
(viii) रािकीय िैव जवजवधता बोडा का सदस्ट्य सदस्ट् य, पदेन;
(ix) ईप वन संरक्षक, कैमूर वन्द्यिीव प्रभाग सदस्ट् य सजचव, पदेन।”
6. जनगरानी सजमजत के काया.- (1) जनगरानी सजमजत, स्ट्थल जवजिष् ि वास्ट्तजवक पररजस्ट्थजतयों के अधार पर ईन दियाकलापों की िााँच करेगी िब दक भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की तारीख 14 जसतम्बर, 2006 की ऄजध सूचना सं. का.अ. 1553 (ऄ) की ऄनुसूची में िाजमल हैं और पाररजस्ट्थजतकी संवेदी िोन के ऄधीन अती हों, ईसके पैरा 4 के ऄधीन दी गयी सारणी में यथा जवजनर्ददष् ि जनजष्ध दियाकलापों को ोो़ककर और ई् त ऄजधसूचना के ईपबंधों के ऄधीन पयाावरणीय ज्लयरेंस के जलए भारत सरकार के पयाावरण, वन एवं िलवायु पररवतान मंत्रालय या रािकीय पयाावरण प्रभाव अकलन प्राजधकरण के पास भेिे गय ेहैं।
(2) ऐसे दियाकलापों, िो दक भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ईपपैरा (1) में जनर्ददष्ट ऄजधसूचना की ऄनुसूची में िाजमल नहीं ह ैऔर पाररजस्ट्थजतकी संवेदी िोन के भीतर अते हैं, आसके पैरा 4 की सारणी में जनजष्ध दियाकलापों को ोो़ककर, की िााँच जनगरानी सजमजत द्वारा स्ट् थल जवजिष् ि वास्ट् तजवक पररजस्ट्थजतयों के अधार पर की िायेगी और आन्द् हें संबंजधत जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया िाएगा।
(3) जनगरानी सजमजत के सदस्ट् य सजचव या संबंजधत कले् िर या संबंजधत ईप वन संरक्षक आस ऄजधसूचना के ईपबंधों का ईल् लघंन करन ेवाले दकसी भी यजि के जखला पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन जिकायत ाआल करन ेके जलए सक्षम होंगे।
(4) जनगरानी सजमजत मामल-ेदर-मामले के अधार पर अवश् यकतां के ऄनुसार ऄपने जवचार-जवमिा में सहायता के जलए संबंजधत जवभाग के प्रजतजनजध या जविेषज्ञ, ईद्योग संघों के प्रजतजनजध या संबंजधत जहतधारकों को अमंजत्रत कर सकती ह।ै
(5) जनगरानी सजमजत प्रत् येक वषा के 31 माचा तक की ऄवजध की ऄपनी गजतजवजधयों की वाषिकषक कारावाइ ररपोिा ईस वषा के 30 िून तक राज् य के मखु य वन्द् यिीव वाडान को आस ऄजधसूचना के ईपाबधं-IV में जवजनर्ददष् ि प्रो- ामाा में प्रस्ट् तुत करेगी।
(6) कें रीय सरकार ऄपने कायों के प्रभावी जनवाहन के जलए जनगरानी सजमजत को जलजखत रूप में ऐसे जनदेि दे सकती ह,ै िैसा वह ईजचत समझे।” [ ा. सं. 25/112/2015-इएसिेड-अरइ] डॉ. सु. केरकेट्टा, वैज्ञाजनक ‘’िी’’ [भाग II—खण् ड 3(ii)] भारत का रािपत्र : ऄसाधारण 3 रिप् पण.- मूल ऄजधसूचना भारत के रािपत्र, ऄसाधारण, भाग II, खंड 3, ईप खंड (ii) में ऄजध सूचना संख या का.अ. 891(ऄ), तारीख 20 माचा, 2017 द्वारा प्रकाजित की गइ थी। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 29th May, 2024 S.O. 2143(E).—Whereas the Central Government, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) of section (3) section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 891 (E), dated the 20 th March, 2017;
And whereas the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification;
And whereas sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986;
And whereas the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 891 (E), dated the 20 th March, 2017;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) and sub-section(3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule
(4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Environment and Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 891 (E), dated the 20 th March, 2017, namely:- In the said notification, for paragraphs 5 and 6, the following paragraphs shall be substituted, namely : - ―5. Monitoring Committee. - The Central Government hereby constitutes a Monitoring Committee consisting of the following persons, namely: -
(i) Commissioner, Mirzapur Chairman, ex officio;
(ii) A representative of District Magistrate, Sonbhadra Member, ex officio;
(iii) A representative of District Magistrate, Mirzapur Member, ex officio;
(iv) Regional Officer, Uttar Pradesh Pollution Control Board, Sonbhadra or Mirzapur Member, ex officio;
(v) Senior Town Planner of the area Member, ex officio;
(vi) An expert in the area of Ecology and Environment to be nominated by the Government of Uttar Pradesh from time to time every three years.
Member;
(vii) A representative of Non-Governmental Organisation [working in the field of environment and heritage] to be nominated by the Government of Uttar Pradesh from time to time every three years.
Member;
(viii) Member of State Biodiversity Board Member, ex officio;
(ix) Deputy Conservator of Forests, Kaimur Wildlife Division Member Secretary, ex officio.‖ 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
6. Functions of Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual sitespecific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.
(2) The activities not covered in the Schedule to the notification referred to in sub-paragraph (1) and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests may file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis.
(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-IV, appended to this notification.
(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.‖ [F. No. 25/112/2015-ESZ/RE] Dr. S.
