और केन्द्रीर् सरकार की रार् ह ैदक उि अजधसूचना में संिोधन करना लोकजहत में आवश्र्क और उजचत ह;ै और िबदक पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 का उप-जनर्म (4) उपबंध करता ह ैदक िब भी केन्द्रीर् सरकार को र्ह प्रतीत होता ह ैदक ऐसा करना लोकजहत में ह,ै इसके जलए पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के खंड (क) के अधीन सूचना की अपके्षा से अजभमुजि िी िा सकती ह;ै और केन्द्रीर् सरकार की रार् ह ैदक र्ह अजधसूचना संख्र्ा का.आ. 680 (अ), तारीख 29 माचा, 2012 में संिोधन करने के जलए पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के खंड (क) के अधीन सूचना की अपेक्षा से अजभमुजि िेना लोकजहत में ह।ै स.ं 3012] नई दिल्ली, िुक्रवार, िुलाई 14, 2023/आषाढ़ 23, 1945 No. 3012] NEW DELHI, FRIDAY, JULY 14, 2023/ASHADHA 23, 1945 सी.जी.-डी.एल.-अ.-14072023-247345 CG-DL-E-14072023-247345 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (4) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv), उपधारा
(1) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में प्रकाजित, का.आ. सं. 680 (अ), तारीख 29 माचा, 2012 के द्वारा प्रकाजित पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर्, भारत सरकार की अजधसूचना द्वारा जनम्नजलजखत संिोधन करती ह,ै अथाात:्- उि अजधसूचना में,-
(i) पैरा 2 में, - (क) उप-पैरा (1) के स्ट्थान पर, जनम्नजलजखत उप-पैरा को रखा िाएगा, अथाात:् - “(1) राज्र् सरकार, पाररजस्ट्थजतक संवेिी िोन के प्रर्ोिनों के जलए, इस संिोजधत अजधसूचना के प्रकािन से िो वषा की अवजध के भीतर, स्ट्थानीर् लोगों के परामिा से और इस अजधसूचना में िी गई ितों का पालन करत ेहुए एक आंचजलक महार्ोिना तैर्ार करेगी’.
(ख) उप-पैरा (6) में, "और केन्द्रीर् सरकार द्वारा उसका अनुमोिन", िब्िों को लोप दकर्ा िाएगा;
(ii) पैरा 4 में, उप-पैरा (2) में खंड (क) से (ि) के स्ट्थान पर, जनम्नजलजखत खंड रखे िाएंग,े अथाात्: - क्रम संख्र्ा व्यवस्ट्थापक पि
(i) आर्ुि, कोल्हान रािस्ट्व प्रभाग अध्र्क्ष;
(ii) िल (प्रिषूण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 16) की धारा 3 की उपधारा 1 के अधीन गरित कें रीर् प्रिषूण जनर्ंत्रण बोडा का एक प्रजतजनजध सिस्ट्र्;
(iii) वन एवं पर्ाावरण जवभाग, झारखण्ड सरकार का एक प्रजतजनजध सिस्ट्र्;
(iv) खनन जवभाग का एक प्रजतजनजध, झारखण्ड सरकार सिस्ट्र्;
(v) उद्योग जवभाग, झारखण्ड सरकार का एक प्रजतजनजध सिस्ट्र्;
(vi) रािस्ट्व जवभाग, झारखण्ड सरकार का एक प्रजतजनजध सिस्ट्र्;
(vii) ससंचाई जवभाग, झारखण्ड सरकार का एक प्रजतजनजध सिस्ट्र्;
(viii) लोक जनमााण जवभाग, झारखण्ड सरकार का एक प्रजतजनजध सिस्ट्र्;
(ix) पर्ाावरण के के्षत्र में कार्ारत गैर-सरकारी संगिनों का एक प्रजतजनजध (जवरासत संरक्षण सजहत) प्रत्र्ेक मामल ेमें 3 वषा से अजधक की अवजध के जलए राज्र् सरकार द्वारा नाजमत दकर्ा िाएगा सिस्ट्र्;
(x) क्षेत्रीर् अजधकारी, झारखण्ड राज्र् प्रिषूण जनर्ंत्रण बोडा, रांची सिस्ट्र्;

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 14th July, 2023 S.O. 3141(E).— Whereas the Central Government, in exercise of the power conferred by sub section (1) and clauses (v) and (xiv) of sub-section (2) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 issued in the Gazette of India, Extraordinary, Part- II, Section 3, sub-section (ii), vide number S.O. 680 (E), dated the 29 th March, 2012;
And whereas the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification;
And whereas sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986;
And whereas the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 680 (E), dated the 29 th March, 2012;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsections (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide notification number S.O. 680 (E), dated the 29 th March, 2012, namely:- In the said notification,-
(i) in paragraph 2, –
(a) for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:- “(1) The State Government shall, prepare a Zonal Master Plan, for the purposes of the Eco-sensitive Zone, in consultation with local people and in accordance with this notification, within a period of two years from the date of publication of this amendment notification.”;
(b) in sub-paragraph (6), the words, “and approval thereof by the Central Government”, shall be omitted;

(ii) in paragraph 4, in sub-paragraph (2) for clause (a) to (h), the following clauses shall be substituted, namely:- “ Serial number Constituents Designation
(i) The Commissioner of Kolhan Revenue Division Chairman;
(ii) A representative of the Central Pollution Control Board, constituted under subsection 1 of section 3 of the Water (Prevention and Control of Pollution) Act, 1974 ( 1 6 of 1974) Member;
(iii) A representative of the Department of Forests and Environment, Government of Jharkhand Member;
(iv) A representative of the Department of Mines, Government of Jharkhand Member;
(v) A representative of the Department of Industries, Government of Jharkhand Member;
(vi) A representative of the Department of Revenue, Government of Jharkhand Member;
(vii) A representative of the Department of Irrigation, Government of Jharkhand Member;
(viii) A representative of the Department of Public Works, Government of Jharkhand Member;
(ix) A representative of Non-governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the State Government for a period not exceeding 3 years in each case Member;
(x) The Regional Officer, Jharkhand State Pollution Control Board, Ranchi Member;
(xi) The Senior Town Planner, Government of Jharkhand Member;
(xii) One expert in the area of ecology and environment to be nominated by the State Government for a period not exceeding 3 years in each case Member;
(xiii) The Divisional Forest Officer, In-charge of the Dalma Wildlife Sanctuary Convener”.
