और केन्द्रीर् सरकार की र्ह रार् ह ैदक उि अजधसूचना में संिोधन करना लोकजहत में आवश्र्क और समीचीन ह;ै और पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप जनर्म (4) में उपबंध ह ैदक िब भी केन्द्रीर् सरकार को र्ह प्रतीत होता ह ै दक ऐसा करना लोकजहत में ह,ै तो इसके जलए पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप जनर्म (3) के खंड (क) के अधीन सूचना की अपेक्षा से अजभमुजि िी िा सकती ह;ै और केन्द्रीर् सरकार की रार् से र्ह अजधसूचना संखर्ांक का.आ. 221 (अ), तारीख 23 िनवरी, 2015 में संिोधन करन ेके जलए पर्ाावरण (संरक्षण) जनर्म, 1985 के जनर्म 5 के उप जनर्म (3) के खंड (क) के अधीन सूचना की अपेक्षा से अजभमुजि िनेा लोकजहत में ह।ै स.ं 3362] नई दिल्ली, सोमवार, अगस्ट् त 7, 2023/श्रावण 16, 1945 No. 3362] NEW DELHI, MONDAY, AUGUST 7, 2023/SHRAVANA 16, 1945 सी.जी.-डी.एल.-अ.-07082023-247900 CG-DL-E-07082023-247900 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (4) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड
(xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड
(ii) संखर्ांक का.आ. 221 (अ), तारीख 23 िनवरी, 2015 द्वारा प्रकाजित भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर्, की अजधसूचना में जनम्नजलजखत संिोधन करती ह,ै अथाात्:- उि अजधसूचना में-
(i) पैरा 2 में, उप-पैरा (1) के स्ट्थान पर, जनम्नजलजखत उपपरैा रखा िाएगा: अथाात:्- “(1) राज्र् सरकार, पाररजस्ट्थजतक संवेिी िोन के प्रर्ोिनों के जलए, इस संिोजधत अजधसूचना के प्रकािन की तारीख से िो वर्ा की अवजध के भीतर, स्ट्थानीर् लोगों के परामिा से और इस अजधसूचना के अनुसार एक आंचजलक महार्ोिना तैर्ार करेगी’.
(ii) पैरा 3 के उप-पैरा (11) में, "िोनल मास्ट्टर प्लान के तैर्ार होने और पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् द्वारा अनुमोदित के िौरान" िब्िों के स्ट्थान पर "िोनल मास्ट्टर प्लान के तैर्ार होने के िौरान" िब्ि रखे िाएंग े;
(iii) पैरा 5 में, उप-पैरा (2) में, पि ख में " केन्द्रीर् सरकार के पर्ाावरण और वन मंत्रालर्" िब्िों के स्ट्थान पर " र्थाजस्ट्थजत, केन्द्रीर् सरकार के पर्ाावरण वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण प्रभाव आकलन प्राजधकरण, गोवा " िब्ि रखे िाएंगे। [फा. सं. 25/34/2013-ईएसिेड-आरई] डॉ. एस. करकेट्टा, वैज्ञाजनक ‘िी’ रटप्पण: मलू अजधसूचना भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में अजधसूचना संखर्ांक का.आ. 221 (अ), तारीख 23 िनवरी, 2015 द्वारा प्रकाजित की गई थी। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th August, 2023 S.O. 3513(E).—Whereas the Central Government, in exercise of the power conferred by sub section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification in the Gazette of India, Extraordinary, Part-II, Section 3, sub-section (ii), vide number S.O. 221(E), dated the 23 rd January, 2015;
And whereas the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification;
And whereas sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986;
And whereas the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 221(E), dated the 23 rd January, 2015;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 Now, therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule
(4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide notification number S.O.
221(E), dated the 23 rd January, 2015, namely:- In the said notification,-
(i) in paragraph 2, for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:- “(1) The State Government shall, prepare a Zonal Master Plan, for the purposes of the Eco-sensitive Zone, in consultation with local people and in accordance with this notification, within a period of two years from the date of publication of this amendment notification”.
(ii) in paragraph 3, in sub-paragraph (11), the words, “approved by the Ministry of Environment, Forests and Climate Change”, shall be deleted;
(iii) in paragraph 5, in sub-paragraph (2), after the words, “Ministry of Environment, Forest and Climate Change”, the words “or the State Environment Impact Assessment Authority, Goa, as the case may be,” shall be inserted.
