और उ4त राजप� तार1ख 30 जलुाई, 2012 को जनता को उपलUध करा 0दया गया था;
और कL W1य सरकार ने उ4त �ाEप �नयमD पर जनता से �ाQत आJेपD और सझुावD पर +वचार कर %लया है;
अत: अब, कL W1य सरकार औ Sष�ध और �साधन साम?ी अ�ध�नयम, 1940 (1940 का 23) कF धारा 33ढ Hवारा �द त शि4तयD का �योग करत ेहुए, आयुव�द %स& और यूनानी औ Sष�ध तकनीकF सलाहकार बोडR से परामशR के पZ चात ्औ Sष�ध और �साधन साम?ी �नयम, 1945 का और संशोधन करने के %लए �न(न%ल\खत �नयम बनाती है, अथाRr ~:— 4521 GI/2013 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
1. (1) इन �नयमD को औSष�ध और �साधन साम?ी (पांचवा ंसंशोधन) �नयम, 2013 कहा जाएगा।
(2) ये राजप� मL �काशन होने कF तार1ख से �व ृत हDगे और अ�ध�नयम कF धारा 3 के खंड (क) और (ज) मL यथाप रभा+षत सभी अनु_Q त आयुव�द, %स& या यूनानी औष�धयD पर लागू हDगे।
2. औSष�ध और �साधन साम?ी �नयम, 1945 मL, �नयम 157 के उप�नयम (1अ) के पZ चात ् �न( न%ल\खत उप�नयम अंत:� था+पत �कए जाएंगे, अथाRत:- “(1आ) कोई भी +व�नमाRता अ�ध�नयम कF �थम अनुसूची मL सचूीब& प�ु तकD मL +व�न0दRb ट के %सवाए, अ�ध�नयम कF धारा 3 के खd ड (क) के Jे� के भीतर आने वाले आयुव�द, %स& और यूनानी औषध के नाम के साथ �कसी उपसगR या � यय का उपयोग नह1ं करेगा:
परंतु �नयम 156 मL उपबं�धत अनु_िQत नवीकरण कF साधारण समयाव�ध के होत े हुए भी, ऐसी आयुव�द, %स& अथवा यूनानी औषध, जो �नयमD के अनुEप नह1ं है, का अनु_िQतधार1, औSष�ध और �साधन साम?ी (पांचवां सशंोधन) �नयम 2013 के �काशन कF तार1ख से एक वषR के भीतर उस औषध के सम�ुचत नाम से अनु_िQत के नवीकरण कF मांग करेगा:
परंतु यह और �क �ामा\णक आयुव�द, %स& और यूनानी प�ु तकD मL उि�ल\खत और अ�ध�नयम कF धारा 3 के खंड (क) मL समा+वb ट अनाम +व�न%मR�तयD को उ4 त �ामा\णक प�ु तकD मL उि�ल\खत उपसगR या � यय के उपयोग के साथ या उसके Tबना ऐसी +व�न%मR�तयD के �थम संघटक के आधार पर नाम 0दया गया है। परंतु यह भी �क इससे औSष�ध और �साधन साम?ी (पांचवां संशोधन) �नयम, 2013 के �काशन कF तार1ख से पवूR +व�न%मRत आयुव�द, %स& और यूनानी औषध पर कोई �भाव नह1ं पड़गेा। (1ई) अ�ध�नयम कF धारा 3 के खd ड (ज) के Jे� के भीतर आने वाले वाल1 पेटLट या सापंि तक आयुव�द, %स& और यूनानी औष�धयD के नाम, ऐसी +व�न%मR�तयD के खुराक EपD के नाम का उपयोग करने के %सवाए, उ4 त धारा के खंड (क) के अधीन +व�न0दRb ट +व�न%मR�तयD और अ�ध�नयम कF �थम अनुसूची मL सचूीब& प�ु तकD मL उि�ल\खत +व�न%मR�तयD के नामD से %मलत ेजलुत ेया उसकF नकल नह1ं हDगे।” [स.ं के.11024/01/2011-डीसीसी (आयुष)] अ�नल कुमार गनेर1वाला, संयु4 त स�चव 0टQ पण : मलू �नयम राजप� मL अ�धसचूना स.ं एफ-28-10/45-एच(I),तार1ख 21.12.1945 Hवारा �का%शत �कए गए थे और अं�तम संशोधन सा.का.�न. स.ं 588 (अ) तार1ख 30.8.2013 Hवारा �कया गया। MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Ayurveda, Yoga, Naturopathy, Unani, Siddha and Homeopathy) NOTIFICATION New Delhi, the 25th October, 2013 G.S.R. 704(E).—Whereas the draft of certain rules further to amend the Drugs and Cosmetics Rules, 1945 was published as required by section 33-N of the Drugs and Cosmetics Act, 1940 (23 of 1940) vide notification number G.S.R. 579(E), dated the 30th July 2012, of the Government of India in the Ministry of Health and Family Welfare, in the Gazette of India, Extraordinary, inviting objections and suggestions from persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;

And whereas, objections and suggestions received from the public on the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Section 33-N of the Drugs and Cosmetics Act, 1940 (23 of 1940) the Central Government, after consultation with the Ayurvedic, Siddha and Unani Drugs Technical Advisory Board, hereby makes the following rules further to amend the Drugs and Cosmetics Rules, 1945, namely:-
1. (1) These rules may be called the Drugs and Cosmetics (5th Amendment) Rules, 2013.
(2) They shall come into force on the date of their publication in the Official Gazetteand shall apply for all licensed Ayurveda, Siddha or Unani medicines as defined in clauses (a) and (h) of Section 3 of the Act.
2. In the Drugs and Cosmetics Rules, 1945, in rule 157, after sub-rule (1A), the following sub-rules shall be inserted, namely:- “(1B) No manufacturer shall use any prefix or suffix with the name of Ayurveda, Siddha or Unani medicine falling within the purview of clause (a) of Section 3 of the Act, except as specified in books listed in the First Schedule to the Act:
Provided that notwithstanding the normal license renewal time period provided in rule 156, the licensee of such Ayurveda, Siddha or Unani medicine, which is not in conformity with the rules, shall seek renewal of the license with appropriate name of the medicine within one year from the date of publication of the Drugs and Cosmetics (5th Amendment) Rules, 2013:
Provided further that the anonymous formulations mentioned in the authoritative Ayurveda, Siddha or Unani books and covered under clause (a) of Section 3 of the Act are named on the basis of first ingredient of such formulations with or without the use of prefix or suffix mentioned in the said authoritative books:
Provided also that no Ayurveda, Siddha or Unani medicine with the date of manufacture prior to the publication of the Drugs and Cosmetics (5th Amendment) Rules, 2013 shall be affected.
(1C) The names of patent or proprietary Ayurveda, Siddha or Unani medicines falling under the purview of clause (h) of Section 3 of the Act, except to the extent of using the names of dosage forms of such formulations, shall not resemble or mimic the names of formulations specified under clause (a) of that section and mentioned in the books listed in the First Schedule of the Act.”.
