PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 461] ubZ fnYyh] eaxyokj] tqykbZ 5] 2016@vk"kk<+ 14] 1938 No. 461] NEW DELHI, TUESDAY, JULY 5, 2016/ ASADHA 14 , 1938 वािण� यवािण� यवािण� यवािण� य एवं उ�ोग म�ंालय एवं उ�ोग म�ंालय एवं उ�ोग म�ंालय एवं उ�ोग म�ंालय ((((वािण� यवािण� यवािण� यवािण� य िवभाग िवभाग िवभाग िवभाग)))) अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द� ली, 5 जुलाई, 2016 सासासासा....काकाकाका....िनिनिनिन. 666. 666. 666. 666((((अअअअ))))....————के ीय सरकार,त� बाकू बोड� अिधिनयम, 1975 (1975 का 4) क� धारा 8 के साथ प�ठत धारा 32 क� उप धारा (2) �ारा �द� त शि तय" का �योग करते $ए, तंबाकू बोड� िनयम, 1976 म( आगे और संशोधन करने के िलए एत,ारा िन� निलिखत िनयम बनाती ह,ै अथा�त:्- 1. संि/0 त नाम एवं आरंभ : (1) इन िनयम" को तंबाकू बोड� (संशोधन) िनयम, 2016 कहा जाएगा। (2) वे शासक�य राजप4 म( �काशन क� तारीख से �वृ� त ह"गे । 2. तंबाकू बोड� िनयम, 1976 (िजसे एत9प: चात् मूल िनयम कहा गया ह)ै, के िनयम 2 म(, ख< ड (च) के बाद, िन� निलिखत ख< ड अंत:= थािपत �कया जाएगा, अथा�त् :- (चक) “सरकार” से ‘क( ीय सरकार’ अिभ�ेत ह;ै 3. मूल िनयम म(, िनयम 28 के िलए िन� निलिखत िनयम �ित= थािपत �कया जाएगा, अथा�त् “28. अ@ य/ क� शि तयA एवं कत�B य – (1)अ@ य/ बोड� क� बैठक" क� अ@ य/ता कर(गे। (2) अ@ य/ को, के ीय सरकार के सम/ इस संबंध म( िनण�य लंिबत रहने तक बोड� अथवा सिमित �ारा, जैसा मामला हो, िलए गए िनण�य के अनुसरण म( बोड� अथवा उसक� �कसी सिमित �ारा क� जा रही कार�वाई को आ= थिगत रखने का अिधकार होगा। (3) जहां �कसी मामले का बोड� अथवा सिमित �ारा िनपटान �कया जाना ह ैऔर उस मामले पर िनण�य के िलए बोड� अथवा सिमित, जैसा मामला हो, क� बैठक के आयोजन तक इंतजार नहH �कया जा सकता ह ैअथवा उस मामले से संबंिधत संक� प का बोड� या सिमित, जैसा मामला हो, के सद= य" के बीच प�रचालन तक, अ@ य/ = वयं िनण�य ले सक( गे । 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(4) जहA अ@ य/ उप-िनयम (3) के तहत िनण�य लेते हI वहA वह उसे बोड� अथवा सिमित, जैसा मामला हो, क� अगली बैठक म( इस मामले का अनुसमथ�न कराने के िलए �= तुत कर(गे। परंतु शत� यह है �क जहA बोड� अथवा सिमित, अ@ य/ �ारा क� गई कार�वाई का संशोधन करती ह ैअथवा उसे िनर= त करती ह,ै तो यह संशोधन अथवा िनरसन इस संशोधन अथवा िनरसन से पूव� क� गई �कसी कार�वाई क� वैधता के पूवा�Jह के िबना होगा।” 4. मूल िनयम म( िनयम 29 के िलए िन� निलिखत िनयम �ित= थािपत �कया जाएगा, अथा�त् :- ““““29292929 काय पालक िनदशेक क� शि� तकाय पालक िनदशेक क� शि� तकाय पालक िनदशेक क� शि� तकाय पालक िनदशेक क� शि� तय� एव ं कत � यय� एव ं कत � यय� एव ं कत � यय� एव ं कत � य::::---- (1) काय�पालक िनदशेक बोड� के �मुख काय�पालक ह"गे और वह इस अिधिनयम के तथा इसके अ तग�त बनाए गए िनयम" के अधीन बोड� के उिचत काय� संचलन तथा अपने कत�B य" का िनव�हन करने के िलए उ� तरदायी ह"गे। (2) काय�पालक िनदशेक को िन� निलिखत शि तयA �ा0 त ह"गी, अथा�त्:- (i) बोड� के सभी अिधका�रय" और कम�चा�रय" को अवकाश �दान करना; (ii) बोड� के सभी िवभाग" एवं काया�लय" पर �शासिनक िनयं4ण रखना ; (iii) बोड� के कायK का समुिचत िनव�हन करने के िलए आव: यक समझे गए या इस अिधिनयम अथवा इन िनयम" के अंतग�त यथापेि/त द= तावेज" और �रकाडK को मंगा सकेगा और B यवसाय" अथवा सॉNटग, यूOरग, �सं= करण, JेPडग, िविनमा�ण, पैQकग, भंडारण अथवा नीलामी = थान" सिहत �कसी भूिम अथवा प�रसर का िनरी/ण करना अथवा िनरी/ण करवाना; (iv) बोड� के काया�लय के काय� संचालन हतेु अपेि/त आकि= मक B यय, आपूRतय" अथवा सेवाS तथा व= तुS क� खरीद क� सं= वीकृित �दान करना; तथा (v) तंबाकू बोड� अिधिनयम, 1975 क� धारा 8 म( उि� लिखत उपाय करना । (3) काय�पालक िनदशेक वजTिनया तंबाकू के उ� पादन तथा आंत�रक िवपणन का िविनयमन करने, उपजकता�S को उिचत एवं लाभकारी क�मत सुिनि: चत कराने, बोड� �ारा आव: यक समझे जाने पर उपजकता�S से वजTिनया तंबाकू क� खरीद करने, इस �कार Uय क� गई तंबाकू क� िबU� करने, उपजकता�S के = तर पर वजTिनया तंबाकू के JेPडग का संवध�न करने, तथा तंबाकू उVोग के संवध�न हतेु �ायोजन करने, सहायता �दान करने, सम वयन करने या वैWािनक, तकनीक� एवं आRथक अनुसंधान करने हतेु बोड� क� नीितय" का �Uया वयन करने के िलए उ� तरदायी ह"गे । काय�पालक िनदशेक का यह भी उ� तरदािय� व होगा �क वह यह सुिनि: चत कर( �क इन कायK का िनX पादन करने म( बोड� यिूनयन, एज(िसय", सं= थान" और �ािधका�रय", जैसे िवपणन एवं िनरी/ण िनदशेालय आ�द, जैसे �ािधकरण", िजनका तंबाकू उVोग के इन पहलुS से संबंध ह,ै के िनकट सम वय से काय� करते हI और काय� के दोहरेकरण से बचा जाता ह।ै (4) काय�पालक िनदशेक अपने �भार के अंतग�त कायK तथा उप िनयम (3) म( प�रगिणत कायK के बारे म( बोड� को ऐसी आविधक �रपोट� �= तुत कर(गे िज ह( बोड� या सरकार �ारा समय-समय पर िविनधा��रत �कया जाए।’’ 5. मूल िनयम" के िनयम 30 के िलए िन� निलिखत िनयम �ित= थािपत �कये जाएगे अथा�त :- “ 30303030 सिचव के अिधकार एव ंकत � यसिचव के अिधकार एव ंकत � यसिचव के अिधकार एव ंकत � यसिचव के अिधकार एव ंकत � य ::::---- (1) सिचव, बोड� अथवा उसक� सिमितय" �ारा िलए गए िनण�य" के काया� वयन के िलए तथा अिधिनयम एवं उसके अधीन बनाए गए िनयम" �ारा अिधरोिपत कत�B य" के िनव�हन हतेु उ� तरदायी ह"गे।’ (2) काय�पालक िनदशेक �ारा यथा �� यायोिजत शि तय" एवं कत�B य" के अ@ यधीन सिचव- (क) बोड� म( �= तुत �कए गए सभी मह� वपूव� द= तावेज" एवं मामल" को यथाB यहाय� अित शीZ मंगवाएगं( ; (ख) बोड� के िनण�य" का अनुपालन कराने के तरीक" के संबंध म( िनदशे जारी कर(गे ;
¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 (ग) बोड� के B यय एवं �ाि0 तय" का एक खाता रख(गे अथवा अनुरि/त रखवाएगंे और इस अिधिनयम अथवा इन िनयम" के अंतग�त बोड� �ारा यथा िनधा��रत िविभ न रिज= टर रखवाएगं(। (ड.) अिधिनयम क� धारा 10 से 13 के अंतग�त बोड� म( पंजीकरण हतेु उपजकता�S, यरस� िनया�तक", पैकस�, नीलामीकता�S, डीलर", नीलामी मंच" के = वािमय" अथवा लीज �दाताS से आवेदन �ा0 त कर(गे, बोड� क� नीित, अिधिनयम और उसके अधीन बनाए गए िनयम" के उपबंध" के अनुसार उनक� जांच कर(गे और आवेदक" के आवेदन" पर आव: यक पंजीकरण �माणप4 जारी कर(गे अथवा अ यथा िनण�य क� सूचना द(ग।े (च) अिधिनयम म( और उसके अधीन बनाए गए िनयम" म( उि� लिखत उपबंध" तथा तंबाकू बोड� �ारा यथा िनद[िशत �दशािनद[श" के अनुसार बोड� के िनण�य" के िव\] िलिखत या मौिखक अपील �ा0 त कर(गे और उन पर समुिचत कार�वाई कर(गे । (छ) बोड� के काय�करण संबंधी वाRषक मसौदा �रपोट� अनुमोदन हतेु बोड� के सम/ �= तुत कर(गे और वह �रपोट� बोड� �ारा अनुमो�दत �\प म( क( ीय सरकार को संसद के �� येक सदन के सम/ पुर= थािपत करने के िलए के ीय सरकार �ारा इस संबंध म( समय-समय पर जारी िनधा��रत तारीख" के भीतर �= तुत कर(गे । (ज) काय�पालक िनदशेक के सभी �शासिनक मामल" म( तथा काय�पालक िनदशेक �ारा यथािनधा��रत अ य सभी मामल" के िनव�हन म( सहायता कर(गे । [फा.सं 2/3/2016-ईपी(एJी-VI)] अनीता �वीण, संयु त सिचव MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) NOTIFICATION New Delhi, the 5th July, 2016 G.S.R. 666(E).—In exercise of the powers conferred by sub-section (2) of section 32 read with section 8 of the Tobacco Board Act, 1975 (4 of 1975) the Central Government hereby makes the following Rules further to amend the Tobacco Board Rules, 1976 namely:- 1 Short title and commencement.- (1) These rules may be called the Tobacco Board (Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2 In the Tobacco Board Rules, 1976 (hereinafter referred to an the principal rules), in rule 2, after clause (f), the following clause shall be inserted, namely:- ‘(fa) “Government” means the Central Government;’.
3 In the principal rules, for rule 28, the following rule shall be substituted, namely:- “28. Powers and Duties of Chairman.-
(1) The Chairman shall preside over the meetings of the Board.
(2) The Chairman shall have power to require the Board or any committee thereof to defer taking action in pursuance of any decision taken by the Board or the Committee, as the case may be, pending a reference to the Central Government on such decision.
(3) Where a matter has to be disposed of by the Board or a Committee and a decision in respect of that matter cannot wait till a meeting of the Board or the Committee, as the case may be, is held or till the circulation of the resolution relating to that matter among the members of the Board or Committee, as the case may be, the Chairman may take the decision himself.

(4) Where the Chairman takes a decision under sub-rule (3), he shall submit the same for ratification to the Board or the Committee, as the case may be, at its next meeting.
Provided that where the Board or the Committee modifies or cancels the action taken by the Chairman, such modification or cancellation shall be without prejudice to the validity of any action taken before such modification or cancellation.” 4 In the principal rules, for rule 29, the following rule shall be substituted, namely:- “29. Powers and Duties of Executive Director.- (1) The Executive Director shall be the Chief Executive of the Board and shall be responsible for the proper functioning of the Board and for the discharge of its functions under the Act and the rules made there under.
(2) The Executive Director shall have the following powers, namely:-
(i) to grant leave to all officers and employees of the Board;
(ii) to exercise administrative control over all departments and offices of the Board;
(iii) to call for documents and records and to inspect or cause to be inspected any land or premises including places of business or sorting, curing, processing, grading, manufacture, packing, storage or auction as required under the Act or these rules or as may be considered necessary for discharging properly any of the functions of the Board;
(iv) to sanction expenditure for contingencies, supplies and services and purchase of articles required for the working of the office of the Board; and
(v) to carry out measures referred to in section 8 of the Tobacco Board Act, 1975.
(3) The Executive Director shall be responsible for implementing the Boards policies in regard to regulation of production and internal marketing of Virginia tobacco, ensuring a fair and remunerative price to growers, purchasing of Virginia tobacco from the growers when considered necessary by the Board, the disposal of the tobacco so purchased, promoting the grading of Virginia tobacco at the level of growers, sponsoring, assisting, coordinating or encouraging scientific, technological and economic research for the promotion of the tobacco industry. It shall also be the responsibility of the Executive Director to ensure that in carrying out these functions, the Board works in close liaison with union agencies, institutions and authorities such as the Directorate of Marketing and Inspection, the Indian Council of Agricultural Research etc., which may be concerned with these aspects of the tobacco industry and avoids duplication of effort.
(4) The Executive Director shall present to the Board such periodical reports in respect of the work under his charge and the functions enumerated in sub-rule(3), as may be specified from time to time by the Board or the Government.” 5 In the principal rules, for rule 30, the following rule shall be substituted, namely:- “30. Powers and Duties of Secretary.-
(1) The Secretary shall be responsible for the implementation of the decisions arrived at by the Board or by its Committees and the discharge of the duties imposed on him under the Act or by the rules made there under.
(2) Subject to such powers and duties as may be delegated by the Executive Director, the Secretary shall –
(a) cause all important papers and matters presented to the Board as early as practicable;
(b) issue directions as to the method of carrying out the decisions of the Board;

(c) grant receipts on behalf of the Board for all moneys received under the Act;
(d) maintain or cause to be maintained an account of the receipts and expenditure of the Board and also the various registers that may be prescribed for the Board under the Act or these rules;
(e) receive applications from growers, curers, exporters, packers, auctioneers, dealers, owners or lessors of auction platforms, for registration with the Board under section 10 to 13 of the Act, examine them in accordance with the policy of Board, the provisions of the Act and the rules made there under and issuing necessary certificates of registration or otherwise communicating the decision on such applications to the applicants;
(f) receive appeals, written or oral, against the decisions of the Board and taking appropriate action thereon in accordance with the provisions contained in the Act, and the rules made there under and the guidelines that may be laid down by the Tobacco Board;
(g) present an annual draft report on the working of the Board to the Board for approval and submit the report in the form approved by the Board to the Central Government not later than the dates specified from time to time in this behalf by the Central Government for being laid before each House of Parliament; and
(h) assist the Executive Director in all administrative matters and in the discharge of such other functions as may be decided the Executive Director.
