(xiv), उपधारा (1) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड
(ii) में प्रकाजित, का.आ.सं. 3029 (अ), तारीख 13 जसतंबर, 2017 के द्वारा प्रकाजित पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर्, भारत सरकार की अजधसूचना द्वारा जनम्नजलजखत संिोधन करती ह,ै अथाात्:— उि अजधसूचना में-
(i) पैरा 5 के स्ट्थान पर जनम्नजलजखत परैा को रखा िाएगा: अथाात:्— “5. जनगरानी सजमजत.- कें रीर् सरकार इस अजधसूचना के कार्ाान्द्वर्न के जलए नीचे िी गई सारणी में जनर्िाष्ट जनम्नजलजखत व्यजिर्ों की एक सजमजत का गिन करती ह,ै अथाात्:— क्रम सख्र्ा व्यजिर्ों के नाम पि (क) जिला कलेक्टर, नागपुर अध्र्क्ष, पिेन ;
(ख) पर्ाावरण (जवरासत संरक्षण सजहत) के क्षेत्र में काम करने वाले एक गैर- सरकारी संगिन का एक प्रजतजनजध, जिसे महाराष्ट्र सरकार द्वारा तीन वर्ा की अवजध के जलए नाजमत दकर्ा िाएगा। सिस्ट्र्;

(ड.) रािस्ट्व जवभाग, महाराष्ट्र सरकार का एक प्रजतजनजध सिस्ट्र्, पिेन;
(च) ससंचाई जवभाग, महाराष्ट्र सरकार का एक प्रजतजनजध सिस्ट्र्, पिेन;
(छ) लोक जनमााण जवभाग, महाराष्ट्र सरकार का एक प्रजतजनजध सिस्ट्र्, पिेन;
(ि) मुख्र् वन संरक्षक और क्षेत्र जनिेिक, पेंच बाघ पररर्ोिना, नागपुर का एक प्रजतजनजध सिस्ट्र्, पिेन;
(झ) पाररजस्ट्थजतकी और पर्ाावरण के क्षेत्र से एक जविेर्ज्ञ को तीन वर्ा की अवजध के जलए महाराष्ट्र सरकार द्वारा नाजमत दकर्ा िाएगा। सिस्ट्र्;
(ञ) उप वन संरक्षक, नागपुर प्रभाग पिेन, सिस्ट्र् सजचव
(i) पैरा 6 के स्ट्थान पर जनम्नजलजखत को रखा िाएगा, अथाात्:— “6. जनगरानी सजमजत के कार्ा. – (1) जनगरानी सजमजत, वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर उन दक्रर्ाकलापों की छानबीन करेगी िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006, और पर्ाावरण, वन मंत्रालर् में केन्द्रीर् सरकार को जनर्िाष्ट उसके परैा 4 के अधीन सारणी में जनर्िाष्ट जनजर्द्ध दक्रर्ाकलापों को छोड़कर, पाररजस्ट्थजतक संवेिी िोन में आत ेहैं और र्थाजस्ट्थजत, िलवार् ुपररवतान र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण, उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरणीर् मंिूरी के जलए होंगे।
(2) उप-पैरा (1) में जनर्िाष्ट अजधसूचना की अनुसूची में िाजमल नहीं की गई पररर्ोिनाएं और दक्रर्ाकलापों और उसके पैरा 4 के अधीन सारणी में जनर्िाष्ट जनजर्द्ध दक्रर्ाकलापों को छोड़कर, जनगरानी सजमजत द्वारा वास्ट्तजवक साइट-जवजिष्ट की जस्ट्थजतर्ों के आधार पर िांच की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को जनर्िाष्ट की िाएगी।
(3) जनगरानी सजमजत के सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लंघन करने वाले दकसी भी व्यजि के जवरुद्ध जिकार्त ििा करने के जलए सक्षम होंगे।
(4) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेर्ज्ञों, उद्योग संघों के प्रजतजनजधर्ों र्ा संबंजधत जहतधारकों को अपने जवचार-जवमिा में सहार्ता के जलए िारी करने के आधार पर अपेक्षा के आधार पर आमंजत्रत कर सकती ह।ै
(5) जनगरानी सजमजत प्रत्र्ेक वर्ा 31 माचा को अपन ेदक्रर्ाकलापों की वार्र्ाक कारावाई ररपोटा उस वर्ा के 30 िून तक इस अजधसूचना को राज्र् के मुख्र् वन्द्र् िीव संरक्षक को उपाबंध-V में जवजनर्िाष्ट प्रोफामाा के अनुसार प्रस्ट्तुत करेगी।
(6) केन्द्रीर् सरकार अपने कार्ों के प्रभावी जनवाहन के जलए जनगरानी सजमजत को जलजखत रूप में ऐसे जनिेि िे सकती ह,ै िैसा वह उजचत समझे। [फा.सं. 25/205/2015-ईएसिेड-आरई] डॉ. स.ु केरकेट्टा, वजै्ञाजनक ‘िी’ रटप्पण: मूल अजधसूचना भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में अजधसूचना संख्र्ा का.आ. 3029(अ), तारीख 13 जसतम्बर, 2017 के द्वारा प्रकाजित की गई थी;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 3rd June, 2024 S.O. 2169(E).—In exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsections (2) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide notification number S.O. 3029(E), dated the 13th September, 2017, namely:— In the said notification,—
(i) for paragraph 5, the following paragraph shall be substituted, namely:— “5. Monitoring Committee.—The Central Government constitutions a committee for the implementation of this notifications of the following persons specified in the Table below, namely:— Serial number Name of persons Designation 1 2 3

(b) A representative of a Non-Governmental Organisation working in the field of environment (including heritage conservation) nominated by the Government of Maharashtra for a period of three years.

(d) Senior Town Planning Officer Member, exofficio;
(e) A representative of Department of Revenue, Government of Maharashtra Member, exofficio;
(f) A representative of Department of Irrigation, Government of Maharashtra Member, exofficio;
(g) A representative of Public Works Department, Government of Maharashtra Member, exofficio;
(h) A representative of Chief Conservator of Forests and Field Director, Pench Tiger Project, Nagpur Member, exofficio;
(i) One expert from the area of ecology and environment nominated by the Government of Maharashtra for a period of three years.

(j) Deputy Conservator of Forests, Nagpur Division Member Secretary, exofficio;
(ii) for paragraph 6, the following shall be substituted, namely:— “6. Functions of the Monitoring Committee.—(1) The Monitoring Committee shall, based on the actual sitespecific conditions scrutinise, the projects and activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 4 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.
(2) The projects and activities not covered in the Schedule to the notification referred to in sub-paragraph
(1), and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Regulatory Authorities concerned.
(3) The Member-Secretary of the Monitoring Committee or the District Collector or the Deputy Conservator of Forests concerned shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis.
(5) The Monitoring Committee shall submit an annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-V appended to this notification.
(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
