PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अधिसचूना नई दिल्ली, 12 अगस्ट् त, 2024 का.आ. 3249(अ).— केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में अजधसूचना संखर्ांक का.आ. 838 (अ), तारीख 16 माचा, 2017 द्वारा प्रकाजित भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की िरांगघाटी वन्द्र्िीव अभर्ारण्र्, जिमाचल प्रिेि की अजधसूचना में जनम्नजलजखत संिोधन करती ि,ै अथाात;
उि अजधसूचना में- (क) मानीटरी सजमजत से संबंजधत परैा 5 के स्ट्थान पर, जनम्नजलजखत पैरा रखा िाएगा: अथाात:्- “5. मानीटरी सजमजत.- कें रीर् सरकार मानीटरी सजमजत के नाम से ज्ञात एक सजमजत का गठन करती ि,ै जिसमें जनम्नजलजखत व्यजि सजममजलत िोंगे, अथाात:् -
(1) उपार्ुि, जिमला अध्र्क्ष, पिेन ;
(2) पर्ाावरण र्ा वन्द्र् िीवन (जवरासत संरक्षण सजित) के के्षत्र में सिस्ट्र्;

(3) पाररजस्ट्थजतकी और पर्ाावरण के के्षत्र में एक जविेर्ज्ञ को जिमाचल प्रिेि राज्र् सरकार द्वारा तीन वर्ा की अवजध के जलए नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्;
(4) जिमाचल प्रिेि राज्र् िैव जवजवधता बोडा का सिस्ट्र् सिस्ट्र्, पिेन;
(5) कार्ाकारी अजभर्ंता, जिमाचल प्रिेि राज्र् प्रिरू्ण जनर्ंत्रण बोडा सिस्ट्र्, पिेन;
(6) उप-जवभागीर् मजिस्ट्रेट, रामपरु र्ा उसका प्रजतजनजध सिस्ट्र्, पिेन;
(7) प्रभागीर् वन अजधकारी, प्रािेजिक सिस्ट्र्, पिेन;
(8) प्रभागीर् वन अजधकारी (वन्द्र्िीव) पिेन, सिस्ट्र् सजचव;” (ख) पैरा 6 के स्ट्थान पर, जनम्नजलजखत पैरा रखा िाएगा, अथाात:्- “6. मानीटरी सजमजत के कार्ा. – (1) उन दिर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ा का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजममजलत िैं और िो पाररजस्ट्थजतक संवेिी िोन में आते िैं, जसवार् इसके पैरा 4 के अधीन सारणी में जवजनर्िाष्ट प्रजतजर्द्ध दिर्ाकलापों के, मानीटरी सजमजत वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा करेगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केन्द्रीर् सरकार के र्थाजस्ट्थजत, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् समाघात जनधाारण प्राजधकरण को जनर्िाष्ट दकर्ा िाएगा।
(2) उन दिर्ाकलापों की, िो उप-पैरा (1) में जनर्िाष्ट अजधसूचना की अनुसूची में सजममजलत निीं ि ै और िो पाररजस्ट्थजतक संवेिी िोन में आते ि,ै जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजर्द्ध दिर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंजधत जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।
(3) मानीटरी सजमजत के सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लंघन करने वाले दकसी भी व्यजि के जवरुद्ध जिकार्त फाइल करने के जलए सक्षम िोगा।
(4) मानीटरी सजमजत मामला िर मामला के आधार पर जनभार रिते हुए जवभाग के प्रजतजनजध र्ा जविेर्ज्ञ, औद्योजगक संगमों र्ा संबंध पणधाररर्ों के प्रजतजनजध को अपन ेजवचार-जवमिा में सिार्ता के जलए आमंजत्रत कर सकेगी ।
(5) मानीटरी सजमजत प्रत्र्ेक वर्ा के 31 माचा तक की अवजध की अपने दिर्ाकलापों की वार्र्ाक कारावाई ररपोटा उस वर्ा के 30 िून तक राज्र् के मुखर् वन्द्र् िीव संरक्षक को उपाबंध-IV में जवजनर्िाष्ट जनििान पत्र के अनुसार प्रस्ट्ततु करेगी।

838(अ), तारीख 16 माचा, 2017 द्वारा प्रकाजित की गई थी। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 12th August, 2024 S.O. 3249(E).—In exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following amendments in the notification of Daranghati Wildlife Sanctuary, Himachal Pradesh of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide notification number S.O. 838(E), dated the 16th March, 2017, namely:- In the said notification, —
(a) for paragraph 5, relating to ‘Monitoring Committee’, the following paragraph shall be substituted, namely: - “5. Monitoring Committee. — The Central Government constitutes a Committee to be known as Monitoring Committee, which shall comprise of the following persons namely:—
(1) Deputy Commissioner, Shimla Chairman, ex officio;
(2) One representative of a Non-Governmental Organisation working in the field of Environment or Wildlife (including heritage conservation) nominated by the State Government of Himachal Pradesh for a period of three years Member;
(3) One expert in the area of ecology and environment to be nominated by the State Government of Himachal Pradesh for a period of three years.
Member;
(4) Member of the Himachal Pradesh State Biodiversity Board Member, ex officio;
(5) Executive Engineer, Himachal Pradesh State Pollution Control Board Member, ex officio;
(6) Sub-Divisional Magistrate, Rampur or his representative Member, ex officio;
(7) Divisional Forest Officer, Territorial Member, ex officio;
(8) Divisional Forest Officer (Wildlife) Member Secretary, ex officio;
(b) for paragraph 6, the following paragraph shall be substituted, namely: — “6. Functions of the Monitoring Committee. — (1) The Monitoring Committee shall, based on the actual sitespecific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.
(2) The activities not covered in the Schedule to the notification referred to in sub-paragraph (1) and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) The Member-Secretary of the Monitoring Committee or the Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite a representative or expert from the Department, a representative from the industry associations or stakeholders to assist the committee in its deliberations depending on the requirements on a case to case basis.
(5) The Monitoring Committee shall submit the action taken report of its activities annually for the period up to the 31st March of every year to the Chief Wildlife Warden of the State by the 30th June of that year in proforma specified in Annexure-IV.
(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.”.
