1. (1). These regulations may be called the Spices Board Service (Classification, Control and Appeal) Amendment Regulations, 2018.
(2). They shall come into force on the date of their publication in the Official Gazette.
2. In the Spices Board Service (Classification, Control and Appeal) Regulations, 1992 (hereinafter referred to as the said regulations), in regulation 6, in sub-regulation (1), for the word “Chairman”, the word “Secretary” shall be substituted.
3. In regulation 8, in sub-regulation (1), for the word “Chairman”, the word “Secretary” shall be substituted.
4. In regulation 9, in sub-regulation (1), for the word “Chairman”, the word “Secretary” shall be substituted.

1. (i) These rules may be called the Spices Board (Amendment) Rules 2018.
(ii) They shall come into force on the date of their publication in the Official Gazette.
2. In the Spices Board Rules, 1987 (hereinafter referred to as the said rules), in rule 4,-
(i) in sub-rule (1), for clause (a), the following clause shall be substituted, namely:- “(a) a Chairman shall be appointed by the Central Government ;”.
(ii) in sub-rule (1), for clause (d), the following clause shall be substituted, namely:- “(d) six members to represent growers of spices;”.
(iii) in sub-rule (1) A, for the word “Chairman”, the word “Secretary” shall be substituted.
3. In rules 6 and 7 of the said rules, for the word “Secretary”, the words “Director or Deputy Secretary level officer of Spices Board” shall be substituted in both the places.
4. In rule 11 of the said rules, in sub-rule (i), in sub-clause (e), for the word “Secretary”, the words “Director or Deputy Secretary level officer of Spices Board” shall be substituted;
5. In rule 11 of the said rules, in sub-rule (2);
(a) in clause (i), for sub-clause (a), the following sub-clause shall be substituted, namely:- “The Secretary of the Board who shall be the ex-officio Chairman of the Committee;”;
(b) in clause (ii), for sub-clause (a), the following sub-clause shall be substituted, namely:- “The Secretary of the Board who shall be the ex-officio Chairman of the Committee;”;
(c) in clause (iii), for sub-clause (a), the following sub-clause shall be substituted, namely:- “The Secretary of the Board who shall be the ex-officio Chairman of the Committee;”;
6. In Chapter III, in the heading, for the words “POWERS AND DUTIES OF CHAIRMAN”, the words “POWERS AND DUTIES OF CHAIRMAN AND SECRETARY” shall be substituted.
7. For rule 14, the following rules shall be substituted, namely:- “14A Powers and duties of the Chairman:
(i) the Chairman shall be the head of the Board;
(ii) the Chairman shall have power to grant leave to Secretary of the Board;
(iii) the Chairman shall preside over the meetings of the Board; accept resignations, if any, of the Board members and he shall also exercise such other powers as may be specified by the Government of India.
14B Powers and duties of the Secretary:
The Secretary shall have the following powers and duties :-
(i) to grant leave to officers and employees of the Board;
(ii) to prescribe duties of all officers and staff of the Board and exercise such supervision and disciplinary control as may be necessary;

(iii) to sanction expenditure for contingencies, supplies and services and purchase of articles required for the working of the office of the Board;
(iv) to require the Board or any Committee thereof to defer taking action in pursuance of any decision taken by the Board or the committee as the case may be pending a reference to the Central Government on such decision;
(v) to take decision in respect of matters that cannot wait disposal by the Board or a Committee, as the case may be. The action taken by the Secretary shall be put up to the Board for post facto approval at its next meeting;
(vi) to perform such duties as may be delegated to him by the Central Government or the Board or Chairman in accordance with provisions of the Act:
Provided that where the Board modifies or reverses the decision taken by the Secretary, such modification or reversion shall be without prejudice to the validity of any action taken before such modification or reversion.”.

2. In the Spices Board (Quality Marking) Regulations, 1992 (hereinafter referred to as the said regulations), in subregulation (12) of regulation 3, for the word “Chairman”, the word “Secretary” shall be substituted.
3. In sub-regulation (5) of regulation 5, for the word “Chairman”, the word “Secretary” shall be substituted.
4. In regulations 6 of the said regulation,-

9. 3rr7 R^T % R^T 16 if ' tfRR" 3TS? % T̂ TR RT " R^MI f f # % RR?TRT TT ^T ^f%T T̂TT RR' 3Tf&RRf>" ?T^ T?RT [W. t. 5/10/2016-^TR-#T] WfW J*TTT ̂ TTift, T^TP Hf% "̂ NOTIFICATION New Delhi, the 2nd February, 2018 G.S.R. 160 (E).—In exercise of the powers conferred by section 38 of the Spices Board Act, 1986 (10 of 1986), the Central Government hereby makes the following rules further to amend the Spices Board (Meeting) Rules, 1992, namely:-
1. (1) These rules may be called the Spices Board (Meeting) Amendment Rules 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Spices Board (Meeting) Rule, 1992 (hereinafter referred to as the said rules), in rule 2, for clause (iii), the following clause shall be substituted, namely:- "Chairman" means the Chairman of the Board”.
3. In rule 5 of the said rule, for the word “Secretary”, the word “Director or Deputy Secretary level officer of Spices Board” shall be substituted.
4. In sub-rule (1) and sub-rule (2) of rule 8, for the “Chairman” wherever they occur, the word “Secretary” shall be substituted.
5. In sub-rule (1) of rule 11, for the word “Secretary”, the words “Director or Deputy Secretary level officer of Spices Board” shall be substituted.
6. In sub-rule (3) of rule 12, for the word “Secretary”, the word “Director or Deputy Secretary level officer of Spices Board” shall be substituted.
7. In sub-rule (2) of rule 13, for the word “Chairman”, the word “Secretary” shall be substituted.
8. In rule 15, for sub-rule (1) , the following sub-rule shall be substituted, namely:- “The Secretary shall preside over the meetings of the ‘Executive Committee’.

In the absence of the Secretary, the Vice-Chairman, shall preside over the meetings of these committees and in the absence of Secretary and Vice-Chairman, the Director or Deputy Secretary level officer of the Spices Board shall preside over the meetings.”
9. In rule 16 of the said rules, for the word “Secretary” the word “Director or Deputy Secretary level officer of Spices Board” shall be substituted.
