No. 10.12/PCC/Gen-Consent/2010/PF/216 ANDAMAN AND NICOBAR ADMINISTRATION DEPARTMENT OF SCIENCE AND TECHNOLOGY NOTIFICATION Port Blair, dated the 3 August, 2017 No. 146/2017.— The Administration had laid down detailed guidelines for siting of the Stone Crushing Units (SCUs) to prevent air pollution and improve the Ambient Air Quality (AAQ) in and around such units vide Notification No. 257 dated 23.11.2012 published in the Andaman & Nicobar Gazette (Extraordinary) and the Order No. 136 dated 12.03.2013 in Andaman & Nicobar Islands.
However, after careful consideration of the complaints and suggestions received from various quarters, the above guidelines have been revisited to ensure that the Ambient Air Quality (AAQ) and the environment surrounding the units those are likely to come up in future do not adversely affect the environment and the Ambient Air Quality (AAQ) to the disadvantage of the habitations.
In view of above and in supersession of Notification No. 257 dated 23.11.2012 and Order No. 136 dated 12.03.2013, the Administrator (hereinafter called the Lieutenant Governor), in exercise of the powers conferred under Section 5 of the Environment (Protection) Act, 1986 (29 of 1986) read with Notification No. S.O. 667 (E) dated 10'" September, 1992, is pleased to lay down the following revised siting criteria / guidelines for setting up of SCUs in A & N Islands :
Criteria / Guidelines for siting of Stone Crushing Units in Andaman & Nicobar Islands :
1) Location criteria for siting of SCUs :
a) Distance of SCUs from Road : Irrespective of the nature of the road, SCUs shall not be allowed to be established at a distance less than 100 meters from mid-point of such road.
b) Distance of SCUs from residential area :
(i) SCUs shall not be allowed to be established at a distance less than 200 meters from any residential area.
Explanation :.The “Residential Area” for the above purpose is defined as an area having minimum 15 households residing in ciose vicinity covering an area of 5000 Sq. Meter.
(ii) No SCUs shall be established in any area other than the commercial area either owned or leased out for such purpose.
(iii) No SCUs shall be established at a distance less than 500 meters from school or health institution.
Explanation : The distance of SCU from school / health institution should be measured from the outer-most boundary of the premises of the school / health institution.
2 THE ANDAMAN AND NICOBAR EXTRAORDINARY GAZETTE, AUGUST 3, 2017 c) Distance of SCUs from water body : No SCUs shall be established at a distance less than 200 meters from a source of potable water.
Explanation : The distance from water body shall ne calculated / measured from the nearest:
edge of the water body from SCUs.
2) Minimum area required for siting of SCUs :
No SCUs, with or without conveyer belt, shall be established in a commercial plot having an area less than 500 Sq. Meter.
3) Other Conditions :
a) SCUs shall raise a compound wall or barrier of a G.I. Sheet or similar other material of a height of atleast 3 meters along the periphery of the plot.
b) SCUs shall raise a green shelter belt along the periphery of the plot and maintain it to arrest the dust released from the units.
4) Repeal and Saving: oo i) The Notification No. 257 dated 23.11.2012 and Order No. 136 dated 12.03.2013 for siting of the Stone Crushing Units (SCUs) in Andaman & Nicobar Islands are hereby repealed.
ii) The repeal of the said Notification No. 257 dated 23.11.2012 and Order No. 136 dated
12.03.2013 shall, however, not affect :
a) the operation of the SCUs set up in accordance with the guidelines laid down in the Notification No. 257 dated 23.11.2012 and Order No.136 dated 12.03.2013:
b) any right, privilege, obligation or liability acquired, accrued or incurred or incurred lawfully under the Notification and Order aforesaid.
However, in greater public interest for protection of environment and maintenance of Ambient Air Quality, the Lieutenant Governor, A & N Islands, reserves the right to revoke all or any of the ‘provisions made in the Notification and the Order aforesaid or any right, privilege, obligation or liability so acquired / accrued or incurred lawfully due to the operation of the abovesaid Notification and Order.
These guidelines shall come into effect from the date of its Notification in the Andaman and Nicobar Gazette. ' By order and in the name of the Lt. Governor, Andaman & Nicobar Islands.
