The Andaman and Nicobar Islands (Municipal) Regulation, 1994.Regulations · 1994

(1) Every Municipality, unless sooner dissolved, under any law for the time being in force, shall continue for five vears, from the date appointed for its first meeting, and no longer.

(2) Notwithstanding anything contained in sub-section (7), the elected and nominated members of the Board functioning immedi-uclv before the coming into force of this Regulation .shall continue to be memberq till the expiration of (he term prescribed under spetion 9 of Ihe Andnmnn and Nicobar Islands (Municipal Boards) Regulation, 1957 as it stood before its repeal.

(3) An election to constitute a Municipality shall be completed,—

(a) before the expiry of its duration specified in sub-section (1);

(b) before the expiration of a period of six months from ihe date of its dissolution.

Provided that where the reminder of (he period for which (he dissolved Municipality would have continued, is less than six months, it shall not be necessary io hold any election under th1^ sub-section for constituting the Municipality for such period.

(4) A Municipality constituted upon the dissolution of a Municipality bofore the expiration of its duration shall continue only for the remainder oP the period for wbVh the dissolved Municipality would have continued under sub-section (!) had it not been so dissolved.

tc 1] THE GAZETTE OF INDIA EXTRAORDINARY 9 IX- (2) A member may resign his membership, in writing, under his hand addressed to the Chairperson and his seat shall become vacant on its acceptance by him.

Resignation of Members.

(2) A person nominated by the Administrator under clause (a) of sub-section (2) of section 9 may resign in writing under hia hand addressed to the Administrator, through the Chairperson, and he shall cease to represent in the Municipality on the acceptance of his resignation by the Administrator.

(3) If for a period of sixty days a member or a person nominated by the Administrator under clause (a) of sub-section (2) of section 9, is without permission of the Municipality absent from all meetings thereof the Municipality may declare his seat vacant.

Provided that in. computing the said period of sixty days no account shall be taken of any period during which the Municipality is adjourned for more than four consecutive days:

Provided further that he shall be eligible for re-election, if otherwise qualified.

(4) If a member becomes subject to any of the disqualifications mentioned in sub-section (1) or aub-section (2) of section 12, his seat shall thereupon become vacant.
