Section 48

The Andaman and Nicobar Islands (Municipal) Regulation, 1994.Regulations · 1994

(1) It shall be the duty of ihe Vice Chairperson present—

(a) to perform, during the continuous absence ot the Chairperson from the city for more than pight days, or in incapacitated for more than eight days or dining a vacancy in the office of Chairperson, the duties of the Chairperson described in section 45; and

(b) to perform such other duties as are required of or may be imposed upon him by or under this Regulation.

(2) A Vice Chairperson performing the duties of the Chairperson in the circumstances stated in Clause («) ol sub-section (2) shall have all the powers conferred on the Chairperson by or under this Regulation.

4G. (7) In case of emergency, the Chairperson of a Municipality may direct the execution of any work or the doing of any act which the municipality is empowered to execute or do; and the immediate execution or doing of which is, in his opinion, necessary for the preservation of the valuable property or foi the safety o'f the public, and may also direct that the expense or executing such work nr doing such act shall be paid from the Municipal Fund.

(2) The Chairperson shall not act under this section in c-ontr-tven.

(3) The Chairperson may, prohibit, unlil ihe matter \ui> bmi comi-- dered by the Municipality, the doing of any act which is, in his opinion, undersirable in the public Interest, provided that the act is one which ihc m'^aicipality !ns power to prohibit.

(4) No direction given under this w-'ction shall be questioned in any court on the ground that the case was not one of emergency.
