In terms of the recommendations containeil in the 124rh Report of the Committee on Subordinate Legislation, Rajya Sabha communicated by the Ministry of Home Affairs, Govt. of India vide Office Memorandum No. U-16016/5/99ANL dated 10'n September, 1999 and in exercise of the powers confened by section 202 of tne Andaman and Nicobar tslands (Panchayats) Regulation' igga, f, Snri lshwari Prasid Gupta, Lieutenant Govemor (Administrator), Andaman and Nicobar lslands hereby make the following amendments to be Andaman and Nicobar lslands (Panchayats Administration) Rules, 1997, namely i
1. (D These rules may be called the Andaman and Nimbar lslands (Panchayats Administration) (Amendment) Rules, 2000. 1il1 ihey snatt come Into force on the date of their publication in the Official Gazette.
(xv) ln the Andaman and Nicobar lslands (Panchayats Administration) Rules, 1997 -
(i) The.e)(isting entries against Rule 9(2) (a) and (b) shall be substituted as under :" .qZ) Orani panchayat : (a) Two-thirds of the total membership of Gram Panchayat shall be srifrcient quorum foia mebting including a special meeting called under sub-section(2) of section 21 of the Regulation. For an adjoumed meeting of an odinary meeting, no quorum shall be necessary. (xvD fo decide the motion of no confidence under subsec{ion (3) of section 21, a majority of the total membership ofthe Gram Panchayat voting in favour ofthe motion is necessary"
(xvii) In rule 12, afterthe existing proviso, the following shall be inserted, namely:- " The minutes ofthe meetings ofthe Panchayats shall be circulated amongst the members also."
(xviii) Existing proviso of Rule 25 shall be substituted as under :- "2s-Rules to be observed while speaking -
(xix) A member whiie speaking shall not -(a) Coniment on any matter which is subjudice; iOj Meke personal charges or accusition against a member or official of a Local Self Govemment,theUTAdministration,anyStateGovernmentorCentralGovemment'
(c) Use offensive language about the conduct or proceedinqs df the Parliament, of the Legislature of any State, UT Administration or any Local Self Govemment;
(d) Ufter defamatory words; i"l Use unfairly nis rignt'of speech for the purpose of obstructing the business of the Panchayat; (D Reflect on the conduct ofa person in high authority. 141 F

(2) (a) A member who has once addressed the meeting on a motion shall not subsequently move or second an amendment.thereto,
(xx) A member shall sit down and refrain from speaking if called to order by the Chairperson.
(iv) Existing proviso of Rule 32(1);hall be substituted.to read as: "32(1). No application under rule 31 shall be considered by a Gram Panchayat unless such application is accompanied by a receipt granted by the Gram Panchayat against fee paid by the applicant at such rate as may be applicable under rule 36 M. The Secretary or any other employee of the Gram Panchayat,authorizedbythePradhanihthisbehallsha||receiVethefeetenderedincash,bycheque, demand draft, pay order, postal order as is convenient to the applicant and shall immediately grant a formal receipt therefore."
(xxi) In sub-rule (1) (a) of rule 36J, the word 'predominantl/ shall be deleted.
(xxii) In rule 36L, after-existing sub-rule (3) and the provision thereunder, the following subrule shall be inserted to read as sub-rule (4) i '(4). Any construction, erection, addition, alteration to which permission of the Panchayat has not been obtained shall be deemed to be unlawful and the owner of the land on which such construction, erection, addition, alteration ardwere made or being undertaken shall be responsible for such unlalvful construction. Decision of the Panchayat to stop or demolish such unlatrvful construction shall be final."
(xxiii) In rule 36M, the following words shall be inserted afterthe words in cash, namely; "by cheque, demand draft, pay order, postal order etc."
(xxiv) Rule 46 shall be substituted as under, namely:- : "46. The Central Civil Services (Conduct) Rules, 1964 and Central Civil Services (CCA) Rules, 'f 965 as applicable to the Central Govt. servants shall mutatis mutandis be applicable 10 the officers and employees of the Panchayat Administration." v Sd/- It (ISHWARI PRASAD GUPTA} Lieutenant Governo(Adm inistrator) Andaman and Nicobar lslands.
