No.106/2016/F.No.2-1/PCC/Plastic/2004.— In supersession of A & N Gazette Notification No. 300, dated 17.08.2000, the Andaman and Nicobar Administration is pleased to frame a Scheme for transportation of Plastic, Glass and E-waste to mainland. Under this scheme freight charges shall be exempted for transportation of all sorts of Plastic, Glass and E-waste from various Islands io Port Blair and Port Blair to Mainland Port (Chennai, Vishakhapainam & Kolkata).
4. Name & Title of the Scheme:
This scheme may be called the “Andaman and Nicobar Islands Scheme for Exemption of Freight Charges for Transportation of Plastic, Glass & E-wastes”.
2. Commencement & Duration :
The scheme shall come into force with effect from ihe date of its Notification in the A & N Gazette and remain in operation initially for a period of three years, to be extended further with the approval of the Administrator.
3. Definitions:

“Competent Authority” means Principal Secretary or the Secretary in-charge of Department of Science & Technology, A & N Administration.
“Freight Charges” means the expenditure incurred for transportation of Plastic, Glass and E-wastes by Ships run by Andaman and Nicobar Administration from origination port to destination port but shall not include the wharfage éharges, barge charges, handling charges, loading and unloading charges etc. which are connected with transportation by ship/surface transport.
“Plastic Waste” means the waste defined under rule 3(q) of the Plastic Waste Management Rules, 2016.
_ “Glass Waste” means all kinds of glass waste meant for recycling/safe disposal! in mainland.
“E.waste” means the waste defined under rule 3(r), 3(y), 3(aa) and 3(bb) of E-Waste (Management and Handling) Rules, 2016.
"Registration" means the registration obtained by an Enterprise/Individual’ from District Industries Centre for transportation of Plastic, Glass and E-waste from various Islands to Port Blair and shredded/compacted/pelletised Piastic, Glass and E-waste from Port Blair to Mainiand Port (Chennai, Vishakhapatnam & Kolkata).
“DSS Ships" means Ships run by Directorate of Shipping Services, Andaman and Nicobar Administration.
THE ANDAMAN AND NICOBAR EXTRAORDINARY GAZETTE, JUNE 28, 2016 5 Applicability/Eligibility :
The Enterprises/Individuals involved in the transportation of all kinds of Plastic, Glass and E-wastes which are meant for recycling/safe disposal in mainland shall be eligible for freight exemption under this scheme provided they have obtained registration from District Industries Centre and authorization from Competent Authority, A & N Administration.

Exemption for freight charges for transportation of Plastic, Glass and E-wastes by DSS Ships shall be available subject to availability of empty containers/cargo space in the ships.
The exemption of freight charges shall be restricted between various Islands to Port Blair/Mainiand Port and from Port Blair. to Mainland Port (Chennai, Vishakhapatnam & Kolkata). Plastic, Glass and E-wastes shall be transported in shredded/pelletised or compacted forms from Port Blair to Mainland.
Other than exemption of freight charges in a DSS Ship, no other charges including surface transport charges for collection and transportation of Plastic, Glass and E-wastes upto the ship/recycling units shall be payable under this scheme.
The Enterprises/Individuai interested in Plastic, Glass and E-wastes transportation under this scheme shall maintain register/documents for making entries of quantity of Plastic, Glass and E-wastes transported to the mainland and shall permit officials of District Industries Centre/Pollution Control Committee for inspection of the unit/records. The enterprise/ individual shall also submit quarterly report to Competent Authority.
The Port dues and other incidental charges such as clearing and forwarding in Island Ports and Mainland Ports shall be borne by the enterprise/individual & the documentation, obtaining clearance from various authorities in dispatch port and arrival port shall be responsibility of the enterprise/individual.
in case of any demurrage towards non-clearance of cargo from the port/vessel, expenditure shall be borne by the enterprise/individual.
In case the permitted quantity of cargo is not logded for transportation due to technical reasons or in forced circumstances the enterprise/individual shall bear the wharfage charges, barge charges, handling charges, loading and unloading charges etc. as applicable.
The Plastic, Glass and E-wastes may be carried as break bulk cargo and the charges for stuffing / de-stuffing and container handling shall be borne by the enterprise/individual.
The DSS shall not be responsible in case of loss, damage etc. suffered by the enterprise/ individual towards transportation of Plastic, Glass and E-wastes.
Procedure for Sending Plastic, Glass and E-Wastes :
Enterprise/individual intending to avail freight exemption under this scheme shall obtain registration from District Industries Centre/Udyog Adhar, Port Blair.
After obtaining registration, the enterprise/individual shall make an application to the competent authority for allotment of container & to authorize for transportation of Plastic, Glass and E-wastes by DSS Ships.
After obtaining authorization, the enterprise/individual shall apply to the Director, Shipping Services for transportation of Plastic, Glass and E-wastes.
The Director, Shipping Services shall permit only those enterprise/individual to transport the Plastic, Glass and E- wastes who are authorized by the competent authority.
6 THE ANDAMAN AND NICOBAR EXTRAORDINARY GAZETTE, JUNE 28, 2016 V. The Director, Shipping Services shall ensure that the enterprise/individual transports only the Plastic, Glass and E-wastes under this scheme and also obtain an undertaking to that effect from the enterprise/individual concerned.
7. Revocation of exemption of Freight/Charges :
The Competent Authority may revoke the exemption granted from payment of freight charges under the scheme in case of non fulfillment of any of clauses mentioned at Para 5 by the enterprise/individual.
8. Power of Interpretation :
The power of interpretation of any clause under the scheme shall vest with the Competent Authority of A & N Administration.
