Section 38

The Andaman and Nicobar Islands Weights and Measures (Enforcement) Regulation, 1959.Regulations · 1959

(1) No court shall take cognizance of an offence punishable under this Regulation except upon complaint in writing made by the Controller or any officer authorised in this behalf by the Controller by general or special order.

(2) No court inferior to that of a magistrate of the first class shall try any offence punishable under this Regulation.

A weight or measure or weighing or measuring instrument duly •i stamped under the provisions of this Regulation and the rules made ( thereunder shall be presumed to be correct until its inaccuracy is proved, if this is produced in any court by any Inspector having charge thereof or by any person acting under the general or special authority of the Controller.
