, I THE ARUNACHAL PRADESH CIVIL COURTS ACT. 2021 (ACT NO. 4 OF 2021) (Received the assent of the Governor on SthApril, 2021 and sent to the Govt. Press vide No. LaWLegn-6/2021 and published in theArunachal Pradesh Extraordtnary Gazette No. 108 Vol. )qvlll dated 12th April, 2021).

An Act to consolidate the law reiattng to Civil Courts and for establishment of various Crvil Courts for speedy disposal of Civil cases in the State of Arunachal Pradesh and matters connected therewith and tncidental thereto i BE it enacted by the Leglstative Assembly of the State ofArunachal Pradesh in the Seventy-second Year of the Republic of lndia as follows,-

CHAPTER _ I PRELIMINARY 1 . Short title, extent and commencement :

(1) This Act may be called the Arunachal Pradesh Civil Courts Act, 2021

(2) lt extends to the whole of the State ofArunachal pradesh.

(3) lt shall come jnto force on the date of ats pubtication in the Olficial Gazette.

2. Definitions : ln this Act unless the context otherwise requires.

(a) "Assistant Commissioner" means and includes Assistant Commissioner, Extra Assistant Commissioner, Sub-Divisional Officer and Circle Officer ;

(b) "Civil court" means a court of a District Judge, a Court of and Additional District Judge, a Court of CivilJudge (Senior Division), a Court of Civil Judge (Junior Division) or a Customary Court including Village Authorities by whatever name called under the Assam Frontier (Administration of Justlce) Regulation, 1945 ,

(c) "Code" means the Code of Civit Procedure, 1908 (Act No. 5 of 1908) ,

(d) "Customary Court" means Court of traditional council or authority of a village(s) indigenous to the State bywhatever name c€lled, and includes a court of village authority under section S of the Assam Frontier (Administration of Justice) Regulation, 194S.

(e) "Deputy Commissioner,, means Deputy Commissioner of adistrict and inctudes an Additionat ,i"*,V i"_r,"J,."".

21. Vacation and Holidays :

(8) On the reopening of any CIvil Courl after any vacatton, all suits, appeals and other proceedlngs pendtng before the vacation judge shall stand transferreo to the Civil Court concerned tn whrch it would have been lnstituted or pending but for the appointment of the Vacatton Judge Any decree ordei or proceedrngs passed bythe vacation .ludge shall be deemed to be a dec[e, order orproceedjngs passed by the Court concerned.

22 Subordination of Civil Courts :

(1 ) -Sublect to the other provisrons of this Act and the rules madethereunder and any other law for the time Oeing in ioice, att CivitCourts except the Customary Courts in a Oistici, injuOing thestaff thereof, shalt, sublect to the control ot tne irtn Court, oesubordtnate to the Coun of Dlstflct Judge.

(3) The Government may for discharging their functions andresponsibilitres require through the High courr, tne crvit courts tofurnrsh to rhe Government suCh particuLrs uno ,loiriuiioi retatrngto the workrng of the courts and other matters a1 iti/ may cattfrom ttme to time 23 Power to invest Civil Judges (Senior Divlsion) with jurisdiction under certain Acts :

Fees for process : The High Court shall from time to time, in consultation with the Government, prescribe and regulate by rules, the fees to be taken for any process issued by any Civil Court;ther than Customary Court. Such rule may provjde for payment of process fee in a lump sum rn advance along with the plaint.

25 Mode of conferring powers I Except as otherwise provided, anypower that may be conferred by the High Court on any person underthisAct may be conferred on such perjon ejther oy n#e oity virtue of offrce 26 Power to make rules :

(1) The Government may, in consultation with the High court, by nottfication make rules to carry out the purposes of-thrs Rct

(2) ln padtcular and wjthout prejudice to the generality of the foregotng power such rules may provide for allor any of the following matters, namely:-

(a) the manner in which the proceedings of each Civil Courtshall be kept and recorded ;

(b) regutating the grant of certjfied copies of papers in Cjvil Courts,

(c) regulating the dutjes and functions of the min jsterialstaff and officers of the Civil Courts.

(d) regutating the jssue of licenses by the Drstrict Judge of thedistlct to persons to act as petition wrjters in Civit 6ourts rn that dtstnct and the conduct of busrness by them and the scale of fees to be charged by them.

(e) provtdtng penally of such amount not exceedtng one thousand rupees for breach of the rules made under cliuse (d) and the authoflty who coLtld jnvestjgate the breach of rules and rmpose the penalty , (, Forms, books, regjsters records and account to be majntalned by the Civil Courts ;

(g) Any other matter which in the opinion of the State covernment has to be or may be prescribed for the efective eniolement of the Act and the administratlon of the Courts.

(l) ln section 15, the words "tlre Deputy Colnmissiorrer, the Assistant Commtssloner and" shall be deleted.

(ii) Sections 16, 1 7 shall be deleted.

(iii) ln section 24, for the words, "Assistant Commissioner", the words 'District Sessions Court' sh3ll be substituted.

(v) Sections, 25.26,27 and 28 shall be deleted.
