(1) If a fresh poll is held under section 63 oftheAct, the Municipal Returning Officer Commencement shall, after completion of that poll, recommence the counting of votes on the of counting after date and at the time and place which has been fixed by him in that behalf and of fresh poll.

64. When the counting of vote has been completed for all the polling station in a ward, Declaration of the Municipal Returning Officer shall forthwith declare the result in Form 35 in the results and following manner:- procedure in case of tie.

(a) the candidate who is found to have obtained the largest number of valid votes shall be declared to have been elected.

(b) if after the counting of votes tie is found to exist between any two candidates, and the addition of one vote entitles any of those candidates to be declared elected that shall forthwith be decided between those candidates by lot, and the candidate on whom the lot falls shall be considered to have received an additional vote and shall be declared to be duly elected.

65. When the result has been declared under rule 64, the Returning Officer shall forthwith Preparation of prepare a return showing the names of the candidates, the number of votes recorded return of for each and the names of the candidates declared to have been elected in Form 36 election.

66. The Municipal Returning Officer shall retain the packets of the counter foils of used Custody of ballot papers, the packets of unused ballot papers, the packets of used ballot papers papers relating whether valid, tendered or rejected and all other papers relating to the elections in to elections.
