BE it enacted by the Legislative Assembly of Arunachal Pradesh in the Thirty-fourth Year of the Republic of India as follows:- Short title and commencement
1.( 1) This Act may be called the Arunachal Pradesh Speaker and Deputy Speaker Salaries and Allowances Act, 1983.
(2) It shall be deemed to have come into force from the 1st day of January, 1982.
Definitions
2. In this Act, unless the context otherwise requires,- *[(a)] [Omitted by 1987 Amendment Act, S.2 (i) w.e.f03/07/1987]
(b) "Assembly" means the Legislative Assembly of the * [State] of Arunachal Pradesh;

(c) "Deputy Speaker" means the Deputy Speaker of the Assembly;
(d) "Family" in relation to the Speaker or the Deputy Speaker means his wife residing with him and legitimate children and step children residing with and wholly dependent on him. (Not more than one wife shall be included in his family for the purpose of this Act.) If the Speaker or the Deputy Speaker is a married woman family shall include her husband residing with her;
(e) "Government" means the Government of the "[State] of Arunachal Pradesh;

(f) "Prescribed" means prescribed by rules made under this Act;
(g) "Schedule" means the Schedule appended to this Act;
(h) "Speaker" means the Speaker of the Assembly; ------------------
(i) "Travelling Allowance" means the allowance granted to Speaker/Deputy Speaker under this Act to cover the expenses which he incurs in travelling in the interest of the public service as against travelling in personal interest or private purpose, such as journeys for rest, recoupment of health, attending party meetings or election campaign;
U) "usual place of residence" means a place declared by the Speaker /Deputy Speaker to be his residence in his home district or any other place declared by him as such, Salaries of Speaker and Deputy Speaker * [3. On and from the date the Arunachal Pradesh Speaker and Deputy Speaker Salaries and Allowances (Amendment) Act, 2017 comes into force, there shall be paid to the Speaker a composite salary of Rupees One Lac Twenty Eight Thousand per mensem and to the Deputy Speaker a composite salary of Rupees One Lac Twenty Four Thousand per mensem.
Provided, further that other perk facilities, incentives and non quantifiable allowances which are not specified in this Act shall be regulated by an executive order as per actual or at such rate with ceiling limit as the state Government may determine from time to time as may be deemed appropriate.
3A.Notwithstanding, anything contained in section 3, the salary payable to the Speaker and Deputy Speaker, under Section 3 shall be reduced by thirty percent, for a period of one year commencingfrom l srApril, 2020, to meet the exigencies arising out of Corona Virus (Covid-I9) pandemic.

5. The Speaker and Deputy Speaker shall not practice any profession or engage in any trade or receive any money for employment other than duties a the speaker or the deputy speaker as the case may be Residence of Speaker and Deputy Speaker *[6 ] [Deleted by 2017 Amendment Act, S.3. w.e.f05/04/2017] Conveyance allowance and use of motor cars *[7 ] [Deleted by 2017 Amendment Act, S.3.wefOS/04/2017] Motor car advance.
8. There may be paid to the Speaker and the Deputy Speaker by way of re-payable advance such sum of money and subject to such conditions as the Administrator may prescribe in this behalf, for the purchase of motor car, in order that he may be able to discharge conveniently and efficiently the duties of his office.
Provided that, if the Speaker and the Deputy Speaker cease to be in office by way of resignation or otherwise, the balance amount due against such advance shall be recoverable in one installment.

1 1. The Speaker and the Deputy Speaker shall not be entitled to receive any sum out of the funds provided by the Assembly by way of salary or allowances in respect of their membership of the Assembly.
Notification respecting.
12.The date on which any person became or ceased to be a Speaker or Deputy Speaker shall be published in the Official Gazette of the Union Territory of Arunachal Pradesh and any such notification shall be conclusive evidence of the fact that he became or ceased to be, the Speaker or the Deputy Speaker, as the case may be, on that date for the purposes of this Act.
Repeal and Saving.
13 (1). The Salaries and Allowances of Speaker and Deputy Speaker of the Legislative Assembly (Arunachal Pradesh) Order No. Admn. S/7S, dated 15th August, 1975, is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the order so repealed shall, in so far as it is not inconsistent with the provisions of this Act, be deemed to have been done or taken under this Act.
Power to Make Rules.
**[14. (1) The Government may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act.
(2) Every rule made under this Act shall be laid, as soon as may be after it is made before the Assembly while it is in session for a total period of not less than fourteen days which may be comprised in one session or in two more successive sessions and if before the expiry of the session in which it is so laid or the sessions aforesaid, the Assembly makes any modifications in the rule or the Assembly agrees that the rule should not be made, the rule shall thereafter have effect, only in such modified form or be of no effect, as the case may be, so however, that any such notification or annulment shall be without prejudice to the validity of anything previously done under that rule."
**[Inserted by 1985 amendment Act (Act no 3 of 1985) S.2.wef25.06.1985] THE SCHEDULE (See Section 9) Travelling on duty
1. When travelling on duty by railway or by. road or by steamer or by air the Speaker and the Deputy Speaker shall be entitled to draw travelling allowances and daily allowances at the maximum rates applicable to Group "A" Officers of the Central Government serving in connection with the administration of the Union Territory of Arunachal Pradesh.
Provided that the Speaker and the Deputy Speaker shall be entitled to draw only half of such travelling allowance, if he travels on duty by road in a motor car provided to him under sub clause (i) of clause (a) of section 7.
Travelling allowance on journeys - for assuming and demitting of office
2. In respect of the journey to headquarters from his usual place of residence for assuming office or between headquarters and his usual place of residence on demitting office the Speaker and the Deputy Speaker shall be entitled to travelling allowance on the scale, for the time being, admissible to Group "A" Officers of the Central Government serving in connection with the administration of the Union Territory of Arunachal Pradesh on transfer, subject to the modification that for journeys by rail, the Speaker and the Deputy Speaker and the members of their family may travel by air conditioned class of accommodation.
3. (1) The Speaker and the Deputy Speaker may, in public interest, perform journeys on tour by air transport services.
(2) On the cancellation of a journey due to official reasons the Speaker and the Deputy Speaker shall be entitled to be reimbursed by the Government any deduction made by the air-transport service when refunding the fare on account of cancellation ofthe air passage.
(3) The Speaker and the Deputy Speaker if they do not utilize free transport provided by the air transport services between the air booking centre and the airport may also recover in respect of journey to and from the airport actual travelling expenses or road mileage as for journey on duty by road. whichever is less.
Travel by railway.
4. The Speaker and the Deputy Speaker shall have the right to reserve by requisition an ordinary first class compartment when travelling by railway on duty.
Explanation- For the purposes of this paragri.ph, a first class compartment means a two berth compartment or an air conditioned coupe, where it is available, or a four berth compartment if a two berth compartment or air conditioned coupe is not available in the train by which the Speaker or the Deputy Speaker travel.
Advance
5. The Speaker and the Deputy Speaker shall be entitled to-
(a) an advance of travelling allowance to- wards the cost of transporting himself and the members of his family's effects,-
(i) in respect of the journey to headquarters from his usual place of residence outside the headquarters for assuming Office;
(ii) in respect of the journey from head- quarters to his usual place of residence outside the headquarters on relinquishing office; and
(b) an advance of travelling and daily allowances in respect of the tours undertaken by him in discharge of his official duties whether by land, sea or air.
