GOVERNMENT OF ASSAM GI!:NERAL ADMINISTRATION (A) DEPARTMENT DlSl'UR, GUWAHATl-G ORDERS BY THE GOVERNOR NOTIFICATION Dated Friday, Apri127, 2007 No. GCN 78/200 ll 21 In exercise of power conferred by Section 10 of Assam Cinema ( Regulation) Act 1953 ( Assam Act XIV of 1953). the Governor of Assam is hereby pleased to make the following rules further to amend the Assam Cinema ( Regulation) Rules, 1960, hereinafter referred to as the principal Rules, namely ·:- Short title and commencement: \. These rules may be called the Assam Cinemas ( Regulation) ( Amendment) Rules, 2007 They shall come into force on the date of their publicatlon in the Official Gazette. ·· In the principal Rules, in rule 2, after the existing clauses (viii), the following clauses shall be inserted, namely:- Permanent Mini Cinema Hall means a Cinema Hall having not less than 200 seats and not exceeding 500 seats. -- ··Perm<ment Multiplex" means, the Permanent Cinema Halls existing along vv'\,th other activities like shopping mall, Cafeteria, I\estaurant etc. in one campus with not less than 2 sep1arate cinema screens in _t ~o different halls under th,¢' same Con~p:ex having mmum1m 500 (five hundreg{ seats compnsmg all theatres and not less than·foo seats in each theatres". In the principal Rues. in rule 3 :" in the first l inc , for the word "four", the word "six" shall be substituted, af1er clauses (v), the following new clauses shall be inserted. namely .:- "(vi) Permanent Multiplex", Tn the principal Rules. in rule 4. in sub rule (2), after the existing second proviso. the fo\lowing·vroviso shall be inse11ed , mi1nely:- · "Provided also that all uddition and alteration whenever necessary shall be intimated to the Applicant by the Licensing Authority within thirty days and the applicant shall recast the plan and estimate accordingly and resubmit within - ·, thirty days. The Licensing Authority may then issue the No Objection Certificate as per the recast estimate at the earliest." 1n the principal Rules, in ruleS, in sub rule (2) , in the tirst line , after the wo!ids "Permanent -_Cinema" , the following words and sign shall be inserted namely:­ "Permanent Mini.Cinema I Permarient Mutipkx" ..:.;.___...:-.-.--'---- ·----------:------- - - --- !· .. ,· v ., t,l ~~ :.~ l~ c~: , 2 6 (i) ln the principal Rules, in rule 6,- (i) in sub rule(l) , I after the word "permanent cinema", the following shall be inserted, namely :- "/Permanent Mini Cinema/ Permanent Multiplex";

(ii) in sub rule (2),

(a)in the first line, after the words "Cinema house" the following shall be inserted, I · namely:- "permanent mini cinema" ;

(b) in the first line, for the words "one furlong", the word and figure , "200 meters and no permanent Multiplex shall be allowed within a radius of 50 meters" shall be inserted;

(iii) in sub rule (4), for the letter and figure" Rs. 50" , the following word and figure shall be inserted, namely :- ''Rupees 1000.00"; Amendment of rule 7

7. ln the principal Rules, in rule 7,- ( i) for the existing provision, the following, shall be substituted namely:- "7. fee for permanent cinema , Permanent Mini Cinema and Permanent Multiplex :- A fee of Rs. 2000.00 shall be levied for grant of license for permanent cinema and RslOOO:OO for li permanent mini cinema and RsJOOO.OO for ' Permanent Multiplex for the flrst year and for each subsequent year, the year be'ing calculated from the date of license. A fee ofRs. 500.00 shall be payable for a duplicate copy of license." : ( i i) after existing provisions of sub rule (2) the following shall be inserted , namely :- "Permanent Mini Cinema! Permanent Multiplex". Amendment of rule 9

8. ln the principal Rules, in rule 9, in sub-rule (3), for the word '·one furlong" the word and f1gure "200 meters" shall be substituted. Amendment of rule 10

9. ln the principal Rules, in rule 10, in second para, for the existing \etters and figure "Rs. 1 0" the following word and figure shall be substituted, namely "Rupees

10. ln the principal Rules, in rule 12:-

(i) ·existing provision shall be re-numbered as sub rule \ l) and thereafter in the proviso, for the words "one furlong" , the following shall be inserted, namely :- "100 meters" ; (i i) after sub- rule ( 1) so renumbered, the following shall be inserted as sub-rule (2), namely "(2) License may be renewed from year to year on receipt of any application in writing from the I Licensee for such renewal accomp<>.nied by a fee as I provided in Rule I 3 and certificates mentioned in ;I Rule I I (2). Application for renewal shall be submitted to the Licensing Authority at \east one month before the elate of expiry of the existing license." : .... · • -- - -· ••••• • •• w•·-··•• ••••

(d) 3 In the principal Rules, in rule 15, in the first para, for '';'' semicolon, occun·ing at the end, "full stop" shall be substituted and thereafter the folrowing·shall be inserted, namely :- " It may be renewed from year to year on receipt of any application in writing from the Licensee for such renewal accompanied by a fee as provided in rule 16 and certificates mentioned in rule 14 (2). Application for renewal shall be submitted to the Licensing Authority at least one month before the date of expiry of the existing license." In the principal Rules, in Rule 16 in the last line, for the existing letters and figure "Rs. 5/-" the following letters and figures shall be substituted , namely :- "Rs. 50/-'" In the principal Rules, in rule 19, in sub rule (3), for the existing letters and figures " Rs . 50.00" , "Rs.

25.00",and "Rs. 20/-",and "Rs. 2/-",the following letters and figures respectively shall be substituted , namely :­ "Rs . 500'', "Rs. 250", "Rs. 1 00" and "Rs. 50" In the principal Rules, in Patt II, in the heading, after the words "Permanent Cinema", the following shall be inserted , namely :- "/Permanent Mini Cinema/Permanent Multiplex". In the principal Rules , in rule 27, in clauses (c), for the existing letters and figure "5 np and" 10 np", the following letter, fi gure and sign respectively shall be · subtitled . namel y: -" 1 %"and "Re 1.00" In the principal Rules, in rule 74 , after the words "permanent cinema house" , the following words · and sign shall be inserted , namely:- "Permanent Mini Cinema I Permanent Multiplex". In the principal Rules, after existing rule 74. the following new rules, shall be inserted, namely:- Permanent Multiplex shall satisfy the following requirements to qualify as Permanent Multiplex, namely:- Screens·- A minimum of 2 Screens . Seats- A minimum of 500 ( five hundred) seats in total for all the theatres. In each hall the number of seats will not be less than 200. All seats should be comfortable and preferably push- back type and the seat should not be less than 22 inches in width and the row to row spacing should not be less than llOOrnm. Air - Conditioning- The Cinema halls and the Lobby shall be fully Air conditioned. Shopping mall- There shall be general shopping area in the same compound/ complex which may include readymade garrnl!nt shops, chemist. novelty gift items hops etc. No shops on hardware, explosive. cement, etc. which may create pollution ' to the environment and observation to cine goers ~1.~11 h ~ .. 11~ ... 0 .~ !· "' · · 4

(e) Entertainment Area- The Multiplex should have a minimum of 250 sq .ft. area marked for entertainment I creche/ kids' play area facilities.

(f)

(g) Food Couii- The Permanent Multiplex should have a minimum of 500 Sq. Ft. area for Food Court. Power Back up- 100% sound and pollution free Power back up facility must be available for 24 hours.

(h) Projector- The Projectors should be equipped with Xenon lamps.

(i) Sound System- Dolby Sound system should be installed in every theatre.

(j) Car parking- A minimum of one car parking for 10 Cinema hall seats should be provided. Ample space should also be kept fo r two wheelers.

(k) Gangway/ Passage- The central gangway I passage should be 4 ft. wide and the side gangway/ passage should be 3 ft. wide in minimum. Power Tariff and fixation of rate of ticket 76 ln respect of power tarif( and rates of tickets, it may be fixed in the following manner :-

(a) ASEB power tariff to be decided by ASEB,

(b) Permanent Multiplex can fix the rate of tickets at an amount subject to approval by the Licensing Authority. Amendment of Form I3 18 .
