1. (1) Th is Act may be called the Assam Tea Planta tion s Prov iden t Fund and Pens ion Fund Scheme (Amendm ent) Act, 1970,

(2) It shall have the like extent as the princi ­ pa l Act.

(3) It shall come into force at once.

Preamble. Whereas it is e xpedien t to amend the Rules for t he Adminis trat ion of Justice in the Nor th Ca char Hills Subd ivision of the State o f Assam, hereinafte r called the said Rules , in the m anner her einafter appeari ng ;

It is h ereby ena cted in the Twenty- first Year of the Republic of Ind ia as follows :— Sh or t titl e, ex ten t an d comm ence­ m en t.

1.(1) This Act m ay be called the Assam Criminal Law (Am endm ent) Act , I97O.

(2) It shall have the like extent as the said Rules .

(3) It shall come into force at once.

An endm ent 2. In rule 1 of the said Rules ef rule 1.

(1) the words “ Un ited Distri ct of Mikir and No rth Ca ch ar Hills , Subd ivis iona l Office r” shall be dele ted.

(2) after rule 1, the following shall be inser ted as rule 1 A, n amely :— “ Th e Governor may w hen he thinks fit, appoint an Addit ional Deputy Commissioner, either gene rally , or for the tri al of a pa rti cu lar case, or pa rtic ula r cases, civil or crim ina l, and may direct that such Add i­ tional Deputy Commissioner shall for the gene ral or specia l purp ose aforesaid, exercise all or any of the powers of the Deputy Commissioner. ’’ Amendment 2. In rul e 4,6,8 an d 9 c f the said Rules, for O t t l̂ e w o r d s » “ Subdivisional Off icer” , the words “ Deputy Com miss ioner” shall be substituted.

Amendment 3. In rul e 10 of the sa id Rules , for the words of r ule 10. “ Subd ivis iona l Of ficer, or an Assistant to the Deputy Com missioner as m ay be specifically auth orised by the Sub divisional Officer in this behal f or Deputy Com mission er” occurring at the end, the words, “ De pu ty Commissioner or an Assistant to the Deputy Com missioner as m ay be specifically autho­ rised’.’ sha ll be sub stit ute d.

Amendm ent 4. The rul e 11 of the said Rule s, for the of rule 11. words, “ Th e Subdivisional Officer, or to an Assistant to the Deputy Com miss ioner and from him to the De cu ty Comm issioner, whose order s are final but the Governo r may at any time call for th e procee­ dings of any officer subordinate to him an d modify or reverse any ord er passed” the words, “an Assis­ tant to the Deputy Commissioner and from him to the Deputy Commissioner whose orders are final bu t the Governor may at any time call for the pro ­ ceedings of any officer subordinate to him and modify or reverse any order passed” shall be substi ­ tuted .

Amendment 5. . I n rule 12 of t he said Rules, ihe words of rule 12. “S ubdivis iona l Officer or” shall be dele ted.

Amendm ent 6. In r ule 13 of the said Rules, for the word of rule 13. “ an ” the wor d, “An” shall be substitu ted and the words, “ the Subd ivisional Officer or ” sha ll be dele ted.

Am end - 10. In rul e 25 o f the said Rules ,— men t of rule 2 5‘ (a) Th e words “ the Subdivisiona l Officer ’ shall be dele ted.

(b) in clause (b),—

(i) the words, “ and the Subdivi­ sional Officer” occu rring in between the words “ Deputy Com miss ioner” and “ be” shall be dele ted.

(ii) the words , “ Subd ivisional Officer or an ” occurring in between the words “t he ” and “Assistant” shall be deleted .

(c) in clause (d), the words, “ or Subdivi­ sional Officer” shall be dele ted.

Am end - 12. In rule 26 of the said Rules, the words, men t of rul e “ S u b d iv is io n a l Officer” sha ll be deleted.

Amendm ent ]7 . I n rul e 39 of the said Rules , in pa ragrap h 2,— of rule 39.

(i) the words “ Subd ivisional Officer or an ” occurring in the second line shall' be deleted ;

(ii) for the words, “ Subdivisional Officer” occur­ ring in the ten th line, the words , “ Assis­ ta nt to the Dep uty Commissioner” sha ll be substitu ted.

Amen dm en t 18. In rule 40 o f the said Rules, the punctua tion of ru le 40. and w ord s, ", ” and “ Subdiv isional Officer” shall be dele ted.
