II OF 2013 (Received the assent of the Governor on 3rd January, 2013) THE ASSAM FIRE SERVICE (AMENDMENT) ACT, 2012 26 1 H E A S S A M l iA Z .E l 1 1,, E A 1 K A O K D 1 A A K Y, J A N U A R Y / , Z V 1J Preamble Short title,. extent andcommencement Substitution of the words “Fire Service”Substitution of the words “Fire Station”Substitution of the words “fire fighting”Amendment of section 2 Amendment of 6. section 4 AN ACTto amend the Assam Fire Service Act,1985.Whereas it is expedient to amend the Assam Assam Act No.Fire Service Act, 1985, hereinafter referred to as the X III o f 1985principal Act, in the manner hereinafter appearing;It is hereby enacted in the Sixty- third Year of the Republic of India as follows:-1. f l) This Act may be called the Assam Fire Service(Amendment) Act, 2012.(2) It shall have the like extent as the principal Act.(3) It shall come into force at once.2. In the principal Act, for the words "Fire Service", wherever they occur, the words "Fire and Emergency Services" shall be substituted.3. In the principal Act, for the words "Fire Station", wherever they occur, the words "Fire and Emergency Services Station" shall be substituted.4. In the principal Act, for the words "fire fighting", wherever they occur, the words "fire and emergency services" shall be substituted.5. In the principal Act, in Section 2,-(i) in clause (a), for the words, punctuation mark, bracket and figures "under section 4 of the Police Act, 1861 (Act V of 1861)", the words, punctuation mark, bracket and figures "under sub-section (3) of section 5 of the Assam Police Act, 2007 (Assam Act No. XX of 2007)" shall be substituted;(ii) after clause (a), the following new clause (aa) shall be inserted, namely:-" (aa)" Fire and Emergency Services" means the Services essential for hazard response in all types of disasters and emergency situations, both natural and man-made, caused by fire, earthquake, landslides, flood and erosion, drought emergency, chemical and biological mishaps, bomb explosions, major accidents in road, air and water, hostage situation etc;".In the principal Act, in section 4, for the words and punctuation mark "of the rank of Deputy Inspector General of Police, Assam”, the words and punctuation mark "not below the rank of Inspector General of Police, Assam" shall be substituted.

w In the principal Act, in section 9, -in clause (d), for the word "fires", wherever it occurs, the words "fire or emergency" shall be substituted;
09 in clause (g), for the word "fire", the words "fire and emergency" shall be substituted.Amendment of section 10 8.
0) In the principal Act, in section 10,-in clause (a), in between the words "fire" and "or", the words "or providing emergency services" shall be inserted;
00 in clause (b), after the words "burning” occurring at the end, the words "or emergency has arisen" shall be inserted;(iiij in clause (c), in between the words "fire" and punctuation mark the words "or providing emergency services" shall be inserted;(iv) in clause (f), in between the words “fire" and "or", the words" or providing emergency services" shall be inserted.
Amendment of section 32 9. In the principal Act, in section 32, in between the words "fire" and "to", the words "or occurrence of an emergency" shall be inserted.
Amendment o f section 49 10. In the principal Act, in section 49, in sub- section (1), in clause (c), in between the words "fire" and "when", the words "and providing emergency service" shall be inserted.
