1. (1) These Rules may be called the “Assam Fish Seed Rules, 2010.”

(2) They shall come into force on the date of their publication in the Official Gazette.

Definitions

2. In these rules, unless there is any thing repugnant in the subject or context,-

(a) “Act” means the Assam Fish Seed Act, 2005 (Assam Act No. XIV of 2005);

(b) “Annexure” means the Annexure appeared to these Rules;

(c) “Committee” means the State Level Seed Committee constituted under the Act;

(d) “Member Secretary” means the Member Secretary of the Committee;

(e) “Receiving Officer” means an officer not below the rank of the Fishery Extension Officer to be designated by the District Fishery Development Officer to receive applications under section 6, 8 and 14 of the Act;

(f) Words and expressions used in these rules and not defind but defined in the Act shall have the same meaning respectively assigned to them in the Act.

Procedure for transaction of business for the Committee 3 (1) At least 10 days notice shall be required to convene the meeting of the Committee.

(2) At least half of the total strength of members of the Committee at the time of meeting shall have to be present, to form the quorum.

(3) The decision of the Committee shall be taken by the majority of the members present.

(4) The Members Secretary of the Committee shall convene the meeting of the Committee.

(5) The Member Secretary of the Committee shall be responsible for maintaining records and proceeding of the meetings.

(6) In case the Chairman of the Committee remains absent the members present shall elect one member as Chairman for that meeting.

Honorarium and Allowances of the nominated members of the Committee.

4 The Honorarium and Allowances of the nominated members of the Committee shall be Rs. 500/- (Rupees Five Hundred) only per sitting.

In addition they shall be entitled to get Travelling allowances as per Government rules.

Format for submission of Annual Report to the State Government by the Committee.

5 The Format for submission of Annual Report of the Committee as required under Section 5 (e) of the Act to the State Government shall be as per Annexure “A”.

Form for application of Registration and Licence.

6 1. The form of application for Registration and Licence as required under section 6(2) shall be as provided in the Annexure B-1 in respect of Fish Seed Producer and Grower, B-2 in respect of Seller, Importer and Exporter respectively.

2. The District Fishery Development Officer shall ensure availability of photo copy of form for application of Registration and Licence at his office at free of cost.

Fee for Registration and issue of Licence.

7 (1) The fee for application for Registration and issue of Licence as Fish Seed Grower, Producer, Seller, Stockiest, Exporter or Importer under section 7 of the Act, 2005 shall be as follows :

Sl. Classification Amount 1 Fish Seed Producer with production capacity up to 5 million spawn / yr.

Rs. 1,000/- 2 Fish Seed Producer with production capacity above 5 million spawn up to 50 million spawn / yr.

Rs. 3,000/- 3 Fish Seed Producer with production capacity above 50 million spawn / yr.

Rs. 5,000/- 4 Fish Seed Grower/ Stockiest with nursery water area up to 1 ha Rs. 500/- 3 5 Fish Seed Grower/ Stockiest with nursery water area above 1 ha Rs. 1,000/- 6 Fish Seed seller (Handi trader) Rs. 50/- 7 Fish Seed seller (Whole seller/owner of seed market) Rs. 5,000/- 8 Fish Seed Importer Rs. 5,000/- 9 Fish Seed Exporter Rs. 2,500/-

(2) The fee for Registration and issue of Licence shall be collected by the receiving officer by issuing government Money Receipt against cash payment and shall be deposited at treasury through challan under Government receipt, Head of A/c -0405 Fisheries Revenue Receipt General Areas – 800-other receipt.

(3) The Certificate of Registration and Licence shall be issued in the format as per Annexure-B-3, B-4 and B-5 respectively.

Form for application for renewal of Registration and Licence.

8 (1) The form for application for renewal of Registration and Licence as required under section 8 shall be as provided in the Annexure-E-1 in respect of Fish Seed Producer and Grower and Annexure E2 in respect of Seller, Importer and Exporter respectively.

(2) The District Fishery Development Officer shall ensure availability of photo copy of form for application for renewal of Registration and Licence at his office at free of cost.

Fee for renewal of Registration and issue of Licence.

9 (1) The Annual fee for renewal of Registration and issue of Licence as required under sub-section (2) of section 8 shall be 10% of the fee for registration and issue of Licence as mentioned in the rule 7.

(2) The fee for renewal of Registration and issue of Licence shall be colleted by the receiving officer by issuing government Money Receipt against cash payment and shall be deposited at treasury through challan under Government receipt Head of A/c -0405 Fisheries Revenue Receipt General Areas – 800-other receipt.

(3) The Certificate of renewal of Registration and Licence shall be issued in the Format as per Annexure E3, E4 and E5 respectively.

Form of application for Fish seed Certificate and form for issue of Fish Seed Certificate.

10 (1) The form for application for Fish Seed Certificate as required under section 14 (1) and form for issue of certificate as required under section 14 (3) of the Act shall be as per Annexure C-1 and C-2 respectively.

(2) Only the Registered Fish Seed producer, Fish Seed grower, Fish Seed importer and Fish Seed exporter shall apply for Fish Seed Certificate mentioned at rule 10 (1) Matter on which monthly report to be submitted under section 15 (iv) 11 (1) The District Fishery Development Officer or any other officers authorized by the State Government to act as Fish Seed Regulator under section 15 of the Act shall furnish monthly 4 report to the respective Zonal Deputy Director under section 15

(iv) of the Act on or before 10 th of every subsequent month as per Annexure “D” in respect of following matters, namely:

(i) particulars of inspected person, farm, Associations;

(ii) particulars of fish seed sample collected ;

(iii) item seized, if any;

(iv) persons arrested, if any.

Appointment of Receiving Officer 12 The District Fishery Development Officer shall designate one officer not below the rank of Fishery Extension Officer as Receiving Officer to receive applications for Registration and Licence, Renewal of Registration and Licence and application for Fish Seed Certificate in the Format “F” as incorporated with the application form for Registration and Licence, Renewal of Registration and Licence and application for Fish Seed Certificate, as the case may be.
